I am constrained to the view that there is a conspiracy to pervert the course of justice – GON Emanuel writes to President Liverpool

Your Excellency

I would refer to the Police Investigation into the attempted murder of my wife and I by the firebombing of my home on December 25, 2010.

Regarding this investigation, I am constrained to the view that there is a conspiracy to pervert the course of justice within the Police Force,  the Commissioner of police and the Executive Branch of the Commonwealth of Dominica.

This view I have formed based on the following (summary) of primary reasons:-

•    The credible confession of the arsonist;
•    The corroborating evidence of the Arsonist’s Uncle;
•    The corroborating available evidence to the police as an out growth of the arsonist’s confession;
•    The absconding of a person of interest on April 18, 2011 from the jurisdiction following credible information of a break in the case;
•    The documentary evidence of motive;
•    The convoluted and contradictory statements on the investigation from the Commissioner of Police;
•    The briefings of the investigating officer on the Police investigation to date;
•    The interview of the person of interest by Mr. Anthony Astaphan S.C., he being the lead counsel for my former partner;
•    The referral of the matter to Cabinet and the failure of the Government to condemn the atrocity and his alleged briefings to Cabinet and his public statements on this matter ;
•    The briefings of the Deputy Commissioner of Police on the Police investigation to date; and
•    The failure of the Police to investigate the related, theft of almost $6.9 million of the firm’s fees, the sabotage of my Associate’s car and the theft of my firm’s computer.

In these grave circumstances for all concerned I hereby call upon you, Your Excellency to use your good offices to prevail upon the Government to establish a Commission of Inquiry into these matters with the utmost urgency.

Failing which, the Commissioner of Police should resign forthwith so that the investigation can be brought to a proper closure and justice thereby served.

    Let us examine the chronology of events as far as we have heard without refute.

    1 Emmanuel and Isidore falls out over alleged business wrongdoings some of which involved services for government initiated projects
    2 Emmanuel files civil suit. Warrant put out for arrest of other party. Police fail to execute warrant. Three days later lawyers for the other party attempted and succeeded to halt proceedings in the magistrate court while magistrate awaits for party to show up in court. Matter subsequently went for initial court work and other party afforded SSU security.
    3 A rat with a slit throat is placed in front of Emmanuels’ house, his associates car sabotaged, computer is stolen from his office, then his house gets firebombed.
    4 Police ruled it as arson, not an accident, nor attempted murder
    5 Speculations are flung over the place
    6 Lawyers for the other party calls a press conference, denying that their client is responsible. They voluntarily went to the police to assist with investigations though they were not mentioned as persons of interest nor did the police request anything of them
    7 Lawyers for the other party in what should be a private matter took it to cabinet. None of the lawyers are ministers nor members of cabinet so why did they take such actions
    8 An individual comes forward and confesses. Lawyers for the other party seek to discredit the confessed criminal and you wonder why? If someone claims responsibility shouldn’t that exonerate the client you were hired to defend? Ministers of government took to discrediting the criminal in what is a private NOT STATE matter week after week on radio programs and you wonder why too
    9 Confessed criminal admits he was paid by an identified individual
    10 Police tags identified individual as a person of interest
    11 Lawyer for the other party conducts live radio interview with identified individual who by then was out of state. Individual in question claimed he was out of state renewing his passport and would be back soon. Its’ been three months since and he has not returned
    12 Police claims they have no further interest in individual.

    These are just 12 of many reasons why an inquiry is needed in this which is supposed to be a private matter yet ministers of government have become publicly involved and you have to ask why. The people need to know why the ministers their servants, not masters, seem to have so much vested interest in this matter and why the police seem to be going nowhere in their investigations.

    All I will say is that GOD is not a Dominican Police Commissioner or DPP. One day he will bring the guilty ones to justice. Only he knows what punishment he will impose on the guilty people involved in such a malicious crime. We all know that the evil that men do live with them and my GOD will definitely have the last laugh.

    I await the day when my fellowmen and women will call a spade a spade. You cannot build a boat and tell everyone it is an airplane. Wrong is wrong is very wrong regardless of ones political affiliation. Mr. Emmanuel is a victim of crime and as such deserves justice like everyone else. But, time will tell!

    In response to your rediculous statement I will say that if Lennox and cco were to accuse me wrongly on a radio station I would have that radio station and Lennox and co sued for defamation of character, libel,etc I would not go on another radio station to defend myself – you may do that but not me!! and thats the difference here I am even more convinced now by your flimsy response that there are powers at play including persons like you who are trying as much possible and at best for this matter not to reach the courts or now an inquiry as suggested my Mr Emanuel for fear that many in high places may be implicated. I am planning to write a story or a book or better yet a script so that it can be submitted for a consideration to be made a best selling movie one day because it sure smell of conspiracy after conspiracy and the more you and others try to defend it it is the bigger and deeper the conspiracy unfolds and gets..

    Is there any doubt that this case has been mishandled by the police?

    Lennox, Matt, Josh Shaw and GON Emmanuel aside, do we need anybody to tell us that this case has been bungled by the police AND that it is clear as day that there is a determined effort to protect ‘the former partner.’

    Are we not right thinking enough in this country to come to this conclusion on our own? Why do people continue to put up defences in this matter as if it were not true there was arson at the man’s home and that the investigation since then has been lacking to say the least.

    People! Take the blinders off! See wrong where and when it occurs and condemn it!

      I have no idea what carette knows or what evidence he has. And honestly I really don’t care its just that we dominicans always know everything yet still if we are asked to come to the courts to testify or the police come to ask us questions we refuse. But when it comes to blogging we have all the evidence. Christmas morning I was home with my family so I have no idea who burnt the house. Did you listen to the comments made by the police chief this week about not being able to used the confession to go after the person of interest.     Dear editor,
    After reading your published letter to the president. May I

    Welcome to the club of defenseless victims.
    Some people are simply above the law in Dominica.
    The following is a list of just some of the crimes my wife and I (both professionals and local investors)have had ignored by the police and DPP.
    1. Repeated Auto theft and vandalism admitted to the CID—no action taken.
    2. Armed robbery in broad daylight by someone without a license for the firearm —case adjourned for the 12th time to march 2012
    3. Threatening to shoot our children to police officers with the same fire arm as above…fire arm not confiscated.
    4. My wife and children discovered the firearm owner
    at 6:00am armed with a cutlas and revolver waiting to ambush me. He was laying in bushes next to the drivers door of my vehicle…reported to the police yet no action. Firearm not confiscated despite the perpetrator admitting to doing so.
    5. Our water tanks poisoned and boldly stating that he would do it again if he gets mosquitoes at his home…note we live 1/4 mile from the perpetrator…no action taken by the police.
    The perpetrator has been under a high court restraining order since 2008 to keep 100 feet from my family and I yet happens to be placed on bail twice since this order both cases for attempting to murder me with a cutlass and his dog (in the presence of a witness). The only reason that he was arrested (2days later) was because he sent his dog to attack the police officer who came to question him and the officer had to fire a bullet at the dog to avoid being bitten.
    5. I have been repeatedly Threatened and have to abandon my own property to avoid being harmed yet the police have never done a thing.
    Inspector Abraham has witnessed and warned the perpetrator trespassing and attempting to move my boundary mark…nothing done .
    6. My pregnant wife and children were threatened at (in the presence of her staff member) her then business place on cork street just after 1 pm on a school day…she lost the baby that night…
    These are but some of the lawless acts we have had to

      I would like to join with Mouth of the South in calling for a speedy resolution of Mr Emanuel’s case. This case seemed enmeshed in political shenanigans and blackmail. This case stinks and it embarrasses our country and its justice system. Law and order must prevail, irrespective of who takes the fall. Can’t Mr Emanuel file a civil suit with regards to the loss of his law firm’s asset? Since he has so much evidence that should be a slam dunk!!

        Most professionals in civilized nations do not resort to violence and do not carry/own firearms.(It is international knowledge that owning a firearm only makes you a target in countries with corrupt police services…the criminals are informed where they can get available guns.)
        We have always taught our children to rely on God.
        For he who lives by the sword dies by the sword.
        Fortunate for our family but unfortunate for Dominica we have realized that investing synergistic sustainable development in countries like Dominica who on the fast track to lawlessness is a dead end street.
        Despite having over 2 million in investments in Dominica (we Now consider mistakes). We have concluded it is Much better to spend our efforts at investing in personal development intellectually that will make our children marketable internationally.
        To answer your question, on seeing the person laying in the bushes my wife and two of our children(then 10 and 8) naturally called out asking if the person was needing help. They only saw the cutlass and firearm after he stood up. Thank God they were able to run away and shout to alert my two other boys and I.

    doubting Thomas what about the travesty of justice on Kairi FM with the Minister of Legal Affairs and the Minister of National Security among others on the matter that is suppose to be between two private individuals – that to my mind is dispicable and shameful then again who am I; I do not know what is it for them guys and what they are protecting or have to lose and that seem to be the knox out punch ! why are Gov’t Ministers publicly siding the allegged suspect(s) and trying to crucify the victim remember Lennox and co are not public officials – but here you have Ministers that are suppose to be nuetral openly boardcasting their bias and you complaint about the other side- we must ask them why.but then again you must have been somewhere in Europe for sometime and have since lost 28 pounds in other words you have lost two stones, and therefore you do not have what it takes to ask the questions that Lennox and others are asking..

      If Lennox and Co. went out publicly and attacked u, make it appear that u are the perpetrator if the crime, that while this is supposed to be a matter between two private individuals they paint a picture that your Prime Minister and your entire government had a vested interest in the matter, that the motive for the fire was not hinged on personal problems between two private individuals but politics with your entire government and even your security apparatus playing a part, WOULD U NOT BE FORCED TO DEFEND YOURSELF??

      I am not saying that the ministers’ response/reaction on Kairi was the most ethical but given the circumstances, it was warranted.

    Gwen Fig he is asking for a Commission of inquiry and only the President can institute that; the question you should ask yourself why do Government Ministers of all types get involve and doing so publicly by engaging themselves on a private radio station in what is a private criminal matter between two former law partners – what is in it for the Cabinet&for Gov’t; to have the likes of the Minister of Legal Affairs and the former Minister of National Security openly siding the alleged suspects and at the same time trying to discredit the victim – don’t you find something fundamentally and dangerously wrong with that;if you don’t then something is wrong with and not Mr. Emmanuel- I agree lets have an open inquiry but then again we may hear that we may not want to self – incriminate.

    What happened to the Commission of Inquiry on Q95 that was set up by the opposition to bring justice and swift closure to the case? Is it that they have lost all interest in the case as it’s popularity and consequent political impact has expired? Have you been abandoned by the political parasites to whom u prostituted your case in order to bring government agencies and the office and associates of the Prime Minister in disrepute?

    Chastise Lennox and Angelo and the rest of the UWP executive, seems that u had entrusted to them the procurement of your justice, they are the ones who failed or abandoned u.

      Now that Lennox et al has failed those who truly seek justice then those who are truly trained to execute justice must do what we pay them to do. Do you agree? I would like to hear you as a resposible citizen demand that the police solve the case if not those who are responsible for executing such duty should step aside and allow others to solve the case.
      One day we will all regret our failure to do and say what was right or wrong.

        I would like to see justice done, but I would also like to see the authorities in whom we place our trust be treated with respect and given the appropriate space within which to work. I would like to see the victims of crime cooperate with the police and give their full support to the chief of police etc… regardless of political differences; solving crime is not a matter of political biases. I would like to see matters of law tried in the court of law rather than be turned into a media circus. I would like to see certain media personalities keep their politics out of police investigations; if u seek justice you must do so honestly and not just for political convenience.

        This case from the very beginning, from the morning of December 25th was turned into a media circus for very political reasons. It was used in an attempt to tie the PM, his cabinet and associates to organized crime including attempted murder and corruption, Mr. Emmanuel made clear his lack of confidence in the police commissioner from the very beginning, based on what he assumed was Mr. Carrette’s political allegiance to Mr.Skerrit. The police were discredited on Q95 for poor investigations into the matter before they had even begun the investigation. Lennox and Matt’s haste to have Denny confess publicly may well have alerted other persons who might have been involved and possibly incriminated by Denny’s confession, and allowed for their timely evasion of the long arm of the law.

        The investigation was doomed to fail because that was all part of the plot by those who wanted to punish more than just the arsonist for the fire, apparently the investigation of Mr. Emmanuel’s case or the lack thereof was supposed to be a catalyst for a vote of no confidence in the government, popular uprisings and regime change. Those of us who frequently listened to Lennox and Angelo on Q95 would have heard these sentiments being echoed, the fire was never their focus.

        I would like to see justice done but it must be pursued for an HONEST and RIGHTEOUS cause.

    My conscience cannot allow me to sit back and pretend that there is nothing or that too much is being made out of this case. The circumstances surrounding this case is just really bizarre; it is obvious that he did try to derail an investigation. Why the police refuse to carry out the arrest warrant? The excuse given by Mr Carrette we all know is just utter rubbish.

    When “they” can no longer hold back the pressure head of truth and that red wall of corruption comes tumbling down I doubt that there will be any jaw dropping and surprises but I am sure that there will be destruction of families, friendships, religious leaders who have not yet humiliated. The high riders, senior lawyers , ambassadors, mayors shall be humiliated. I can see some of them wearing that blue shirt and dungaree shorts.

      The issue of “justice” is not one for mr. emanuel, and shouldn’t depend on whether you are a fin of his or not.

      It is a pertinent concern for all persons who have rights in Dominica, or own land, or have children, property, money or a spouse.

      To date, a crime has been committed against Mr. emanuel, and the investigaations to date are highly unsatisfactory.

      Tomorrow, a family murder could take place, and a similar situation could haunt you

      today, the evidence suggests that the police force of the Commonwealth of Dominica is refusing or rather neglecting (if you will) to actively investigate a crime committed against a man and his wife.

      The evidence, by all reports, is significantly greater than the evidence that was made available to the public in other cases, for example an alleged murder of 2 young men from Newtown, almost 2 years ago, far at sea.

      In that case, a suspect was arrested and held in polic custidy for a significant period of time. though he was later released, the circumstances suggested that the police arrest was made in response to great public interest.

      the police neglect in Emanuel’s case suggests that the department feels the level of public outrage is not so high, as to even warrant an arrest of the accused, or conduct a reasonably high standard or investigation.

      And that is very frightening.
      Selective Justice is often a forerunner and supporter of political persecution, religious persecution, and of course, astronomically high levels of crime.

      it would be interesting to see the police department reaction if one of the suspect’s properties were to be damaged tomorrow.

      I wonder why other persons more educated than myself are so afraid to speak out against ignorance and evil.

      Hon. Mr Liverpool is a distinguished lawyer. If he has any amount of credibility, he will attempt to investigate these allegations.

      I dont think Mr Emanuel is asking the President to solve the case, he appears to be asking for some sort of intervention. He surely feels that if the president is made aware of the facts, then IF its in his power, he’ll ask questions and hopefully get answers.

      I dont feel that the trial by media (mainly Q95) has helped this case. So many claimed to know what happened, who did it, why it was done (hope they all gave statements to the police, and not Q95). Getting the main suspect to publicly confess, thus alerting any accomplice(s) was a bad move.

      Hope Mr Emanuel gets justice soon. Justice for justice sake, and not for political mileage.

      PS: Drop the hahahaha, its getting boring.

    but what is really happening… let’s put our political support aside… this is bigger than politics… as a dominican every citizen need justice served… what’s going on is very wrong… how can the arsonist give details and such details is being swept aside… by the very same people who should be holding justice… what’s going on with mr isidore and that case… the commissioner wants to scold officers for dealing with ‘questionable’ characters but forgot that it starts from the top… when the police force provides security for someone of questionable character then how can mr top cop come and give advice… when mr top cop has refused to apprehend the one who allegedly planned the fire and did the recruitment… what example is this… remember it happened to mr emanuel.. 2morrow may be u….. it may not come through politics… but u may just have a piece of land a big man may want… u decide u not selling out… and mr big man together with his partners within the inner judiciary…police and gov’t circles may decide to intimidate u and make ur life a living hell… turn as u may… those who supposed to serve and protect u.. turn a blind eye to your plight…. this is an embarrassment to our system…. but even if i wish we see the big picture…. i know many ‘blind’ supporters like buwo and wikileaks…. will come and spin it around and say oh mr emanuel not interacting with or withholding info from police… which is a lie….. i really hope we open up our eyes…. haven’t it dawned on us that even if mr skerrit is asked to vacate the post of p.m… he will instruct the top cop to protect him and all who try to get him out will meet stiff resistance..hhhmmmmppphhhhh

    Wonder why Mr.Emanuel as a former Chief Magistrate chose to write to the President instead of writing to the Director of Public Prosecution, DPP.

    The DPP is the only one given the authority under the Constitution to decide which matter he proceeds with criminally, so why on earth would he decide to write to the President?

    What should have been clear to the former Chief Magistrate is that the President CANNOT force the DPP to investigate or proceed either way in this matter.

    Mr. Emanuel’s letter begs the question, ” Has he lost it_?” Bet he will only get a courtesy response from the President acknowledging receipt of his letter.

    One more point, is Mr. Emanuel the investigator or what, how did he arrive at the fact that the alleged arsonist version/confession of the incident is credible?

    Some bright bulp from from Q95 Law School please help me understand that. Just my take.

      Gwen fig – when will we allow sanity to prevail in lieu of obvious and blatant biasness. It would have been prudent to remain silent and not be confirmed bias and totally ignorant. If you read the letter with an open mind you will notice that the letter says “ In these grave circumstances for all concerned I hereby call upon you, Your Excellency to use your good offices to prevail upon the Government to establish a Commission of Inquiry into these matters with the utmost urgency.” Mr Emmanuel is asking for a commission of inquiry.
      Why write to th DPP when a warrant to arrest Isidore was issued and the police refuse to follow the order – doesn’t that ring a bell or is that you are so dense and ignorant and or arrogant to put things into simple perspective. Come on – take that wool of your eye and be honest with yourself and if any your kids.
      With regards to the confession I ask that you ponder upon the following questions; Look yourself in the mirror and answer the following questions . Let us see how intelligent you are.
      Why would Denny implicate himself/ why would he lie about his involvement is something so serious.
      Is it because Denny wants to be famous? What fame can one get by being in Stock farm prison for 25 years. In my opinion Denny is an intelligent young man.
      Why Denny was not prosecuted for breaking into SECO’s house and selling SECO’s stuff?
      Gwen fig if you are being named in such a serious crime and that you are truly innocent would you make the best effort to come clear your name ?
