More calypso controversy ahead of Saturday’s finals

Dominica’s ambassador to Venezuela, Dr Philbert Aaron, has through his lawyer Noelize Knight Didier, written to calypsonian Checko threatening to file an “injunction” to “prevent” him from singing the song “Bug Her” on the night of the calypso finals, February 18.

Dr Aaron had written to Checko earlier, demanding that he either stop singing the controversial song  or remove or alter the lyrics which the ambassador alleges defames him.

However, Checko has told the media that on the advice of his lawyer he won’t be altering his lyrics since they are not defamatory to Dr Aaron in any way.

In the latest letter obtained by DNO, Dr Aaron’s legal representative proposes a “meeting between both parties to try to reach an amicable solution” to the matter.

The letter also warns that should Checko refuse to alter his lyrics Dr Aaron will “file an injunction to prevent him from performing the Bug-Her song”  which has grown in popularity since the news broke that it could be the subject of a possible libel case.

The Dominica Calypso Association has meanwhile had to deal with its own legal matter.

One of the calypsonians who failed to make the finals, Comforter, had his lawyers threaten to file an injunction against the finals if he was not made a finalist.

He alleged that he should have been among the nine selected at the semi-finals because he was reliably informed that he tied with one of the contenders who went through.

DCA president Kelly “De Ghost” Williams has rubbished that claim and said that the show will go ahead as planned.

    Dr. Aaron cutting off his own legs here. the more he try and stop that song the bigger it gets. people would have not known it was about him and those who did would have forgotten by march for the latest. dominica have so much drama that would have died down by ash wednesday. if this song gets road march and wins the crown, which it might now, thanks to Aaron, then he will be hearing it all next year.

    The song clearly implies the Ambassador A is Dr. Aaron. Come on people, have some compassion. If the song was written about you, how would you feel? How would you react? I agree with the Ambassaor- file an injunction!

      Yesterday and yesteryear are gone. We are now in today, the year 2012, the 21st century. Times have changed and people must change. Do you not want changes?
      In bygone years, people indiscriminately made and sung calypsoes against people and to boot, against their personal lives. Today, people are not taking it sitting and lying down and doing nothing about it. If you are not aware of that, you must be still asleep. Wake up! A man’s name is included in that calypso. This is wrong! It is defamation of character and slander. He reserves the right to insist that this calypsonian should re-word his song by eliminating his name otherwise face legal proceedings. Can you not comprehend that?
      Dominica does not belong to you alone. All of us are of the opinion that DA is a beautiful country. We have a right to stand up for the truth and not water-it-down and not encourage others to demean others. It is not a Christian-like act to damage people’s character and good name.
      You love your country. What are you doing for your country? In my opinion, due to your comments, it appears that you are doing nothing good except loving carnival. People like you could put DA and its nationals to shame for you are also not a fair and just person. Carnival will soon be over and where will you direct your love?

      They did not like what you stated because they support him. In their ignorance, they do not know that they are causing him to sin further and encouraging sin against a fellow person: “Thou shalt not bear false witness against thy neighbor” by slandering his name. God will deal with all of them in time.
      As for the pastor who gave him the OK, so much for that pastor. Our Lord Jesus Christ said, “Many will come in My Name…So as to deceive the elect.” Those who allow themselves to be deceived, they and their false prophets will end up in the place that God has reserved for liars, cheaters, criminals, sorcerers, flse prophets, those who slander the good name of others, etc. In other words, the unloving ones.
      This is a serious offense, a grave/mortal one against our God.

    My humble opinion is that Checko should just alter the line, after all, he is the one with the legal expenses. None of us on here will be contributing financially for the legal combat over the calypso which a week or two after the show will be long forgotten and off the airwaves.

      You need to ask yourself what precedence will this set. Checko alters the line and from next year every person who thinks a calypso is about them will want go to court to have the calypsonians alter their lines.

      Your concern shouldn’t be whether Checko should alter his line but whether he has reason to. Do you agree that the lines in his song have identified Dr. Philbert Aaron specifically? If not, then why should he be forced to change it?

      Now that will be very unfair to the other people who are implicated in the song. Many of the other people may be saying “well that is Carnival. No problem”.

      But Philbet makes a fuss and his line is changed but the others remain in. This does not make sense.

      When those old time ‘chantuelle’ used to sing their ‘chante mas’ all over Roseau and Portsmouth exposing scandal and ro-ro, no one, from British Governor down used to say anything about lawyer and court.

      In fact many of them used to jump in the band too, like when Charlo was jumping in the Convent Prep band with his children singing “Marry the girl Charlie”. Calypso is calypso, just let the thing pass!

      The motive may simply be to set a a precedent for censorship. Allusion has already been made to calypsos that, allegedly may be less then flattering to our country’s leadership. If the latter would voice criticism publicly it would likely to be at some cost to the popular vote. Such potential damage is avoided by using Dr. Aaron to express these misgivings instead.

    Last year Prosper sang about the speaker, She was at Finals with a big smile on her face enjoying the song. This year Checko is singing about the PM When it hard…, I heard that’s the PMs favorite calypso for the season, so tell me why “others” have to act so childish.     One of the comments that have been made about Calypso in general is that it is form of social commentary. If that is the case is Checko song “Bug Her” a story, gossip or an experience?? Keep in mind that there are differences between them. Stories are about what transpires with others and experiences are about what occur to us while gossip we know …….- a folk version of literature.
    This is where I think the debate should commence as in this clarification that we can get into the heart of this so called controversy and keep people like A from Bug us with the law from our Cultural Heritage.

    This calypso is actually mild compared to the one by the black ghost in 1995 re the bugging saga between Gonzales and Mamo.

    The lyrics had lines such as :

    Serious allegations; libelous allegations

    Neighbor, is it true or just propaganda that Mamo is a bohga, (and listed the names of many a former minister still alive today)

    the song went on further to say :

    investigate their behavior we doh want no minister Bohga!!!

    There was also another line: But the truth Lord we will never know

    Up to this day no ordinary Dominican has ever believed that these former ministers Dominica Freedom Party whose Christian names were exposed in that song are Bohgas or Bohgarahs

    Now Ghost is a straight shooter in Calypso; Checo on the other hand is hit and run.

    The following line from another Calypso of ghost again shows his metal: Let us Pray for d Minister of Kabooway, tibwaila est tou malkcasay.

    Sir that too shall pass just like over ten years ago an AG who is still in the news these days got serious blows in Calypso advocating equal privileges for gays. Today super power governments are placing conditionalities for financial aid if the rights of gays and lesz are not respected.

    The song will not be a distraction to your carrier nor to that of your superiors. The song will never result in any supermarket owner pulling out any investment anywhere in the world, nor will it stop the work of history detectives that persons voraciously absorb.

    The worse that can happen on carnival day is for a man to have heads of you and your friends on a poster with a bold caption titled Bugs fraid the spray – the physical evidence being a can spray tin labeled UWP with small print reading: for a cleaner Dominica use every 5 years!!!!

    Any attorney, or so called Lawyer who would seek a court injunction to prevent the singing the song by the author would be a waste of time, and should be considered a bush Lawyer!

    You know when I was growing up in Wesley, we had plenty of them in the village perhaps even I was one of them.

    This Didier woman, and this Aaron, does not have two feet to stand on in a court of law, they have no case!

    Not once was his name Aaron mentioned in that song, his behavior here is simply drawing attention to himself.

    Who cares if you are disoriented, an aunty-man or not?

    Any law suit filed by the petitioner, and his lawyer should be considered frivolous, and not be allowed a hearing.

    On the contrary the calypso boy should file a counter suit against both that so called lawyer, and her client, because what they are doing constitute harassment, which can cause the calypso singer some mental and psychological distress.

    On such grounds he can file for damages caused to his person due to Aaron, and his lawyer’s harassment.

    It is time that the victims in Dominica fight fire with fire, in this case the calypso boy does indeed have a case against this man Aaron who for no other reason than wanting to victimize him, to prove to Dominica that ” I is ambassador, I is big man, so I doh like his calypso, because I think he talking bout me, so I go shut him up.”

    Aaron, you cannot kill Calypso, you are to small for that, your mouth, and your bark are not lowed enough, if you screw up I will write a calypso with your name in it, and there is nothing you or missy Didier will be able to do about it.

    And I might give it to the same guy to sing too!

    If you can successfully file a law suite against this guy and win, every homosexual on earth would have the opportunity to go to Dominica, and file a law suit against this guy, only on the suspicions that the man song is about then.

    Be informed that what you read is my expressed opinion, if there is something in it that is offensive to you such as calling you and your lawyer by name, if you have a problem with that feel free to deal with me since DNO is not responsible for anything I conveyed here.

    I have always thought that my people, Dominicans, have a warped sense of justice. Justice is served only when it serevs them, otherwise “there is no justice.”

    Let’s face it, that “bug-her” song has gone too far. It makes little effort to mask persons’ identity. Worse again, in a society that is as smal and as homophobic as ours, to link someone in such a permanent manner to homosexuality does untold damage.

    This song epitomises part of what is wrong with our society today. Hiding behind the cloak of “free speech,” persons resort to openly sullying person’s name. Well, the fact is, calypsonians can sing on whatever topic they wish to. This is their right. It is NOT their right, however, to trample upon another person’s right while they are singing their songs. And all of you claiming that the song in question does not identify anyone, well, you know that not even you believe that statemnet. So, no need to repeat it!

    Calypsonians must sing freely. The persons who are identified in the song deserve justice. We have to learn to live civilly.

    People must be careful about slandering the names of others. They must also look to themselves and their relatives. Is he perfect? Are they perfect?
    Why not make a song about the lions/foo dogs that were placed on the new Roseau bridge and other occurrences in DA? How about those government employees who are involved/arrested in DA’s passports scam? Those murderers, those who are on drugs and imprisoned as well; those who transported drugs by a vessel to DA? These sound feasible to me; to sing a calypso about them.
    Personally, I do think he should withdraw the song or choose other words for the song. Otherwise, he will surely end up in Court. There is no Law than can protect him and exonerate name.
    It appears to me that harm has already been done to the Dr’s good name. The calypsonian is given another chance or three chances to withdraw the song or change its format. He should comply.
    Generally people should not rejoice about the words of the song and encourage him to sing it. The Golden Rule: “Always put yourself in a person’s shoes.” If it were you how would you feel?     Why is the ambassador so sensitive? For years calypso has always been based on the calypsonian interpretation of societal happenings, ZYe in years gone bye spoke about Patrick John, Austin and others, others sang songs about money being taken from the treasury. Even more pointedly, The Mighty Sparrow sang about the WICB in the days of Stolmeyer and Kerry Parker Cricket, there was no attempt then to sanction Sparrow’s lyrics. So why now Mr Ambassador? You have just given checko the Road March with ‘Bug her’ and you have succeeded in drawing attention to yourself. Even if he withdraws the song, it will still be the road march and you can rest assured Mr Ambassador that on the road Jam, the lyrics will actually have some names incoorporated, thanks to you.

    I do not believe that checko should withdraw the song because ‘bug her’ may have several interpretations, could it also mean that the ambassador placed a listening device on her? Just asking.

It tarnishes peoples’ reputations. It jeopardizes persons well-being. It publicly accsues certain persons of illegal acts. It proclaims to be God. Now, contrast this to the tunes that you mentioned.

        Since you seem to request an intelligent analysis and you were not nasty in your comments, I will try to respond to your concerns.

        In order to meet your conditions, I have read the lyrics of the song in its entity and I am baffled by the interpretation by Dr Aaron, a gentleman whom I know and worked alongside with at PSS.

        A review of the lyrics in no way suggest that Ambassador Aaron is gay and does not clearly speak or address any issue of the ambassador’s sexual preference. The only logical interpretation of the expression bug-her in the song is the use of (a) a listening device or spying tool to surreptitiously obtain information about a person. Clearly in his song Checko talks about the use of technology, he talks about the use of wires. He talks about phone and computer being bugged etc. How can this be interpreted to be anything sexual? (b) No one can argue that bugging devices are used in telephones, computers and for surviellence of different types. (c) the only mention of ambassador, states A ambassador, It does not say Ambassador A. So unless Dr Aaron is seeing something in the lyrics that I am unable to see or he is willing to tell Dominicans what they did not know, he sadly, does not have a case and Checko should keep his lyrics. Peeping Tom since you asked for three interpretations, I will give you an additional interpretation: (2) to bug may also mean to irritate, could checko mean that he irritated her when he said he bug her? The lyrics do not seem to support this interpretation, just like the sexual preference interpretation from The ambassador is not supported by the lyrics. The third interpretation, Peeping Tom, To bug could mean to spoil or ruin, could checko’s song be so interpreted, it may well be. so there you are peeping Tom, I am sure I passed your test with flying colours.

It is about time also that those who speak so eloquently and forcefully about democracy and “rights” of others should speak out against clear attempts at disrespecting others’ rights.         Peeping Tom I was begining to enjoy the exchanges between you and RAS B; You asked for his rebuttal and for three alternatives he gave you 4 and you mean you do not have a come back for Ras B.

        You mentioned about Sparrow the most slanderous of songs by Sparrow and there were many is ‘ Phillip my Dear” straight to the point – and there was no sanction placed on Sparrow or Trinidad by the mighty empire- because if that was down “London Bridge would have fell down completely.” I can list many many more artist not only in the likes of Sparrow and calypso but also in all forms of music including reggae, hiphop, rap, jazz, the blues etc. that have one way or another bring mesaages using satirre and mask; you see music and song has always been a form of expression – the likes of Booguoy Banton, Peter Tosh “if you live in glass house doh throw stone” brother if you cay take blows brother doh give blows” , Jimmy Cliff; and even the greats like Bob Marley, Jimmy Cliff , Burning Spear ” Christopher Columbus is damn blasted liar” You see the Honorable brother “Bob Marley ” put nicely in song – ” me throw mi corm mi eh cal no foul sorry Fowl”,so who the cap fits let them wear it”. So the A ambassador figured the cap fit therefore he has the right to wear it – but Checko never call no fowl.

        Finally they tried that very same thing in Trinidad many many years ago and the backlash from the calypsoians ( with the likes of Chalkie, Croco, Aloes, Pink Panther and Puppet Master among many others Mr. Aron would be living a honest nest), were so furious that all that stupidness was shelved.
        I wish you and the others luck in your support for injunction but the people will continue to find a way to express themselves in song!!

        DNO if you allow me people say Checko will be left allow to face the music in court if ever it gets to there; Well Iam making the world know that he will never be alone in this matter; I have already alerted my Trinidadian counterparts on the issue and we are ready to rally for the protection of the calypsonian rights not only in Dominica but in the region – so the moral of the story here is when u touch one you touch all of us so better come good!!

        Tactical, i wanted to enagge Ras B some more but i could not find the “reply to this comment” button. Ditto for your response below. So, i am appending this extended response to an earlier one.

        Now, as to the examples that you cited, there is no doubt that history is replete with examples of slanderous songs. My argument is that the fact that Jack or Jill opts not too seek legal redress if he/she feels injured by the lyrics of a song does not in any way indicate that the song’s lyrics are proper. Most persons offended by lyrics this year will not seek redress, for many reasons. I fully support the ambassador’s right to defend his name. I also support his decision because i am very offended by the trend in our society today where it seems that, with a warped understanding of demoacrcy and “free spech,” many D/cans just run amock with their tongues. I am disgusted by this incivility.

        Remmeber, tactical, today it is the ambassador crying for justice; tomorrow could be you, or me, God forbid.

        As for Ras B’s comments, i found it hilarious as he tried to stretch the song to fit his interpretations. I suggest that he also listens to the song. Second, the reference to technology is metaphorical. It is a standard trick by writers to express themselves. No difference in thsi song. It is left to the person reading the lyrics or listening to the song to understand the message. Thrid, the meaning of bug-her is even clearer when you consider that it is only men who are doing the bugging. Fourth, you would notice that Ras B often said what the term “bug-her” COULD mean. I do not doubt that the expression taken in isolation has multiple meanings. I challenge him, however, to show how in the context of the song bug-her could have multiple meanings.

        Ras B’s effort is interesting but taken in context, which is what an adjudicator/magistrate/judge woudl have to do, that song is one of the most vile songs for this year. I do not believe that the singer (or writer) himself would like to be a victim in that song.

        We must learn to speak our minds without injurying others.

    What’s up with all this censoring of free speech in Dominica? Dr. Aaron filing an injunction against Checko only gives him the legal right to counter file against you for silencing his constitutional rights. In a free democracy, Checko is entitled to his opinion and you are entitled to yours. You are entitled to speak on ALBA and he is entitled to voice his opinion in song. What is your problem?

      Are you really a lady? Ladies behave accordingly. Ladies do not scandalize the good name of others and encourage others to do evil and against their fellowmen/people, etc…
      Some of you do not see the point of why he is angry and upset and sought legal counsel. Whether he is gay or not, it is his personal affair. Is he bothering anyone? If per chance it is true what he did, using as much as his initials and business title, this gives no one, no calypso the right to make a song about him and scandalize his name. IT IS WRONG! His intention is to scandalize his name. It is wicked of him. Utilize your common sense and good judgment if you have any. If it happened to you or a family member what would your reaction be?
      Speak your mind; sing your songs but do not bring the include the name of others in it if it involves scandalizing their name. Contemplate on that. This is what ladies and gentlemen will do and how they would act.
