Pinard-Byrne demands £307.61 from Linton in Privy Council matter

Attorneys representing Chartered Accountant Kieron Pinard-Byrne, have demanded that Opposition Leader, Lennox Linton, pay £307.61, which is the remainder of a Privy Council order of £20, 000 in court costs stemming from a defamation case.

A letter from the chambers of DeFreitas, DeFreitas and Johnson to Linton noted that the remainder is outstanding and should be paid immediately.

“The time limited by the order of the Judicial Council of the Privy Council for the payment of the sum of £20, 000 has now expired and the sum of £307.61 remains outstanding,” the letter, dated February 29, reads. “We, therefore, demand that you make immediate payment of the outstanding sum of £307.61 to our Chambers.”

Linton was ordered to pay the £20, 000 by February 22.

Between February 22 and 23, a total of £19,000 and EC$2,708(£692.39) was paid.

The EC$2,708 payment was made in bags of “pennies, nickels, dimes and quarters” according to the letter.

The letter insisted that the £307.61 be paid in banker’s draft or certified check and that Linton “desist from further contemptuous form of payment.”

“If you fail to comply, an appropriate order will be sought from the court,” the letter said.

The letter also made reference to the “unorthodox and contemptuous manner” in which the initial payment was made. It said this “resulted in hostile and disruptive behavior, on the part of those who presented themselves to make payment, which was not conducive to, nor consistent with, the professional standing of our Chambers.”

“We refer, in particular, to the loud and aggressive conduct of your brother, Brian Linton, who threatened, assaulted and insulted our staff, using some of the most vile and unsavory language. His despicable behavior was completely unwarranted, in circumstances where he and the other persons entering our Chambers were received and accommodated with civility,” it stated, referring to a video which surfaced on the internet recently of Brian Linton as the office of DeFreitas, DeFreitas and Johnson.

The entire matter centers around the Layou River Economic Citizenship Program and the Layou River Hotel project and goes back to 2002 when Pinard-Byrne sued then journalist Linton because of an article published on the program on a website and statements made about the same program on a radio show, on which Linton was a guest.

It eventually ended up in the Privy Council which ruled in favor of Pinard-Byrne.

  2. One more question to those who are supporting the manner of payment which Lennox is using to pay his dues of the court.

    If you gave a cashier a $20.00 note for the payment of your $5.00 purchase would you so easily accept your change of $15.00 in quarters, dimes, and nickels? I am sure that most of you wouldn’t; but we are only speaking about $15.00! Neither would the cashier do that!

    A normal change of $15.00 would have to be $10.00; 2 loonies; and 4 quarters, from the majority of cashiers–I know what I am talking about.

    I read where that idiot from Los Angeles is comparing £307.61, which is at least EC $1400.00, with $1.00, to base his stupid contention –there can be no comparison between the two!

    People come on now! We need to be fair through our sentiment!

    I am Labor Supporter but that’s too much on Linton. The Government should step in right now. Pinard looking like he wants to suck Dominica dry because the supporters are really helping to pay that for their Leader.

    Lennox deserves pardon so that he can start thinking as a normal human being.

      What crime has he committed to deserve this crap? All Lennox has done thus far, as an investigative reporter, and former anchor at Observer Radio in Antigua, prior to that he anchored a program “What About” on Marpin Television in Dominica.

      As an investigative reporter he researched issues such as thievery and corruption in the country, and inform the nations of the evil which takes place in high places in the country, he exposed corruption and thievery. Most of them who claims to be innocent are thieves!

      They use their position to fleece and robe people in the country, some of them will even snatch the breast of a mother from the mouth of an infant baby simply to thief the milk from her breast, so that the baby can remain hungry. Lennox ability to track and investigate the garbage bin scandal involving Dominicans in New Jersey, caused the treasury to recover more than five hundred thousand dollars.

    Elizabeth, I live with a woman who worked in a Bank for more than thirty years as a banker, prior to changing he profession and becoming a Nurse, she is the same one whom I paid to travel with me as my nurse, and was in Canada with me the day when I slipped away from her and came to you house. But anyway she is reading DNO too, and saw all of this rubbish talk; she informed in a bank if one refuse to accept legal tender money; they automatically told the person their debt is paid in full.

    Your situation is that you did not owe her anything, and she was not compelled to sell you anything. Remember in some business place in North America there are sings saying we have the right to refuels service to anyone!

I have always been aware of that fact, because I know you cannot read and understand anything on your own.       This has nothing to do with me owing the lady and she not being compelled to sell to me. She maintained a business and I am was her customer–that is not the subject here.

    Yes, mr. Byrne won his case and has to be paid. But is he the victor? The U.K. has a famous, some say notorious, but certainly satirical magazine, the Private Eye. Defamation cases being a public sport in England, it has been sued for defamation/slander & libel more often than it can remember. Yet it survives. It is irreverent, and lampoons and takes down a peg, those it deems harbouring low morals, guilty of social wrongs or simply have too high an opinion of themselves, avoiding prosecution often through the use of clever euphemisms. A marijuna reefer for instance becomes an “exotic cheroot” and Richard Branso is famously known as “Beardie”. Maybe our journalist should try that next time they write a risque piece. It certainly makes for hilarious reading!
    Yes, Mr. Byrne won his case but it may have made him also the butt of public ridicule and
    left him with little sympathy. Who did really win?

    The millions gathered in the infamous Escrow Account simple vanished between the years 1995 to 20000. Every one of us know who was in power and who used the money to build the same infamous Layou ruins Linton led his people to.. Even after work on the ‘ruins’ was stopped by the Marigot man in charge money was still being withdrawn for working on the same project that had stopped. A scapegoat had to be found to carry the blame of reckless spending, and no more suitable person could be found than the chartered accountant. The best accuser to condemn the chartered accountant was found in Lennox Linton. Byrne took the accusation like a man and won over Lennox lies in court. It is Lennox turn now to take it like a man and pay Byrne. To save ‘Ma Dominique Children’ PM Skerrit must now call for an investigation in the Layou River Hotel Project and let the vultures who spent the money between 1explain to the public exactly how it was spent. That infamous Layou ruins cannot be $30 million…

    Linton cannot want to talk about law and integrity and then ignore the stipulated date by the courts as to when the monies owed should be paid. What goes for the goose must also go for the gander. It is interesting that Dcans seems so bias to the upholding and enforcement of law. Linton, Pay up!!!!!     Surely ! All the comments proved the people we are dealing with. At the end of each month you receive bills and if you don’t pay they tender your services, credit union,banks,all are almost identical. The Court Order ,if you don’t pay they send out a warrant for your arrest. Mr. PINNARD go back to the court let them pay more interest on the balance they owe to you

      The Privy Council demanded he pay by February 22nd 2016. Go read the order. Tell your leader to pay and do not waste time. The faster he pay the better. Had he settled ” the on account” in case you forget, when he should have the matter would not arise again. Tell him to pay the man and eat his pride. It won’t take him anywhere but more legal costs.     The thought crossed my mind. You could say it is a strange one. :lol: If Lennox had made amends with Pinard-Byrne and did not fight him and hate him, probably Pinard-Byrne could have waived that small amount.
    It is easy to write a short letter and to be humble and say, “I am sorry.” This goes a long way.
    Did anyone of you ever thought about that? People are not all that bad as some of you think based on your mentality. There are two sides to each and every one of us. We are happy, smiling, peaceful at one time but if someone annoyed us, to a certain degree we could get angry. Just an example to the other side of us which God knows too well.
    When you keep fighting and hating and note his brother Brian’s attitude and giving all that money in change, do you expect Pinard-Byrne and his Attorney to be pleased?

    Pay by cheque/draft which is legally dignified and professional to do.
    Let your brother Brian stay out of it. He is not the one whose name is mentioned in the libel suit and who was ordered to pay the money. He had no right involving himself in this. In fact, the attorney’s staff should not have accepted that manner of payment and from Brian with all his insults and scandalized behavior.
    In future be careful. The mouth/words can put people in trouble. The manner you did was wrong which is why you found yourself in this hot water and ordered to pay this exorbitant sum of money.

    Pinard Byrne is not the law nor is he in control of the law, in every court hearing the judge usually ask the convict of his ability to pay before fines are imposed, but in this scenario it appears that byrne is calling the shots.

      He was given a certain amount of time to pay. You know that was the last case the Privy Council heard for Dominica. Therefore, Pinard-Byrne’s attorney cannot return to them.
      I think it is fitting for a place as Dominica, that his attorney should demand payment.

        If the are suggesting a bank draft, or a certified cheque from a bank, that can always bounce for lack of enough funds to cover the amount!

    In terms of the smallest coin of the realm being considered “contemptuous payment”; perhaps the Privy Council should have followed the celebrated court case of 1877 in which the artist Whistler sued the critic Ruskin. The jury brought in a verdict for the plaintive and awarded him damages of….one farthing!

    But alas, the artist had to pay court costs and was thus brought to the brink of bankruptcy.

      If Mr. Pinard-Byrne attorneys prefer a cheque in payment, Mr. Linton could follow the example of A. P. Herbert’s ingenious litigant in his “Misleading Cases”. In the case, known as “The Negotiable Cow”, a cheque in payment for an exorbitant tax demand was written in red ink on the side of a white cow and the cow tied up outside the office of The Collector of Taxes.

      No one should pay such large sums of money with coins –it is rude, it is insulting, and is most certainly anger arousing–no person will simply accept that kind of behavior; not even once, far more for two or three times .

      And yes! The person whom you are paying has the right to demand a manner of payment that will be satisfactory to his or her reception–when the banks says to you, pay monthly, you are liable to face the consequences for not going along with that order

      You cannot owe a person a large sum of money and you decide how and when you will make that payment; without compromise –that cannot be!

        There is a difference in honoring a bank debt, and paying someone in coins. If I owe the damn bank, and I submit my payments in all pennies, they cannot refuse it, all they can do is count it, if they find one cent short they are suppose to inform me I am short.

        Now if I am short one cent they can refuse to accept that particular payment. In Canada, and America. If your agreed on monthly payments, on your house, rent, or mortgage, car payment is ten dollars, and you submit five or nine dollars at the end of the month the recipient has the right to refuse the payment, based on insufficient funds to complete the payment.

        In America, they have money counting machines, in the banks, supermarkets, and casino, if you have a million one cent and you throw then in one of those machines within seconds it tells you exactly how much you have in dollars and cents.

      @ Youthfull Eyes, coins are only legal tender for payments of limited amounts. If you owe $20.00 and you offer to pay in coins, the person you owe can legally refuse such payment and demand payment in banknotes or check. That is the law.

      At the end of the day the monies will be paid. I do believe that KPB should have drawn a line when the judgement from the local court was paid. It was his right to insist on a payment method convenient to him, he did not. Now according to this recent demand letter if Lennox insist in paying in coins an order will be sought from the courts to have him comply with the requested payment method. Just stop the antagonism and give the man a check. If it goes back to court the court will rule in favor of KPB as coins are only legal tender for payments of up to $10.00, so do the maths.

    This pinard is acting like a little ” ……….. the coins are legal, Just a few days ago, the Eastern caribbean central bank, deputy director of currency stated the public and business have to accept coins, when someone is making a payment. The court order did not state how or what type of currency is to be used for payment. Tell your lawyer take the coins to the bank and change it into what ever currency you want.     Dominicans are generally and very often, law-abiding people. We respect the rule of law, and we also respect the opinion of Lisa Defreitas in ensuring her client gets what the Court granted to him. This is what we would like her to do had we been in Pinard-Byrne’s position. But I think Pinard-Byrne needs to take a broader look as things unfold, because it would seem to me that many people do not like him. I say this because it is not only UWP supporters who are siding with Lennox on this particular matter. Even folks who do not like Lennox, seem to dislike Pinard-Byrne more. Probably he is not a social guy, or probably his commissions or omissions do not go down well with locals. So while many will obey the decision of the Court, even more may attempt to frustrate justice simply because they do not like the victor. Food for thoughts.

      Aquaint yourself with the law and what is legal tender. Coins are legal tender only for a very small amount whereas bank notes are legal tender for the payment of any amount. So it is Contemptuos when you pay or attempt to pay any debt with a method that is not legal tender especially pursuant to a court order.

        Mr. Telemaque let me refer to the legal tender act of Dominica Chapter 75:01. Section 3.(1) Bank notes shall be legal tender in Dominica for the payment of any amount of money. 3(2). coins shall be legal tender for the payment of the following amounts:
        a. gold coins for the payment of any amount
        b. silver coins for the payment of an amount not exceeding $10.00.
        c. bronze coins for the payment of an amount not exceeding $2.00.
        You can check it out yourself. So you see sir I don’t bray before I educate myself on the relevant facts.

      Where do you reside and what experience do you have? I am surprised you do not know that and would be critical.
      Generally, everyone should know this is the legal manner of paying. Furthermore, since it is a bank draft or a cheque, Linton will have a copy or make a copy of it prior to giving/sending it to the attorneys. The copy is proof as being paid.
      When you pay in this manner, it cannot be said that they did not get the money or he did not pay enough. This is the best manner of payment and legally so.

      It is a disgrace that some people choose to act in such unbecoming manner, worst than children. They blame the government for their woes. What they do not know, with their type of attitude, they do not contribute to love, peace and harmony in Dominica. Their indifferent mannerisms cause evil to flourish. They are at fault.

      The point here is principle. Linton was told to pay acertain amount, he must pay the full amount. Some of you people are so ridiculous it is unbelievable. Where in the world have you heard of people were told to pay certain judgement and only partial payment was made? Linton needs to grow up and face the consequences of his behavior like a man.

      So what if the money is blown in a twinkling of an eye. This is not the point. It is his money, awarded by the Privy Council. He is entitled to it and has a right to demand it.
