State attorney supports death penalty

State attorney in the office of the Director of Public Prosecutions (DPP) Clement Joseph is supporting the death penalty as a form of punishment for murder in Dominica.

Increasingly in the last few years the island has seen what officials describe as an alarming acceleration in the murder rate.

The escalating violence in Dominica has led to many calls for hanging to be carried out.

While capital punishment remains on the statute books, the last person to be executed here was in 1983.

Prime Minister Roosevelt Skerrit is on record stating categorically that under no circumstances would the death penalty be removed from the laws of Dominica.

Joseph told DNO on Tuesday “I find it to be an appropriate sentence for the crime of murder”.

He said while he was not advocating arbitrary use of the death penalty, “it is an appropriate form of punishment.”

“I see nothing wrong with it in fact it is on our law books so while we have issues as it relates to persons being on death row for over five years, you can still be sentenced to hang if the crime is of a capital nature,” he stated.

Meanwhile the state attorney told DNO that he was satisfied with the work being done by the office of the DPP.

“We have just concluded the January criminal assizes and we are now preparing for the Court of Appeal, which will after send us straight into the May criminal assizes, I am satisfied with the work that the team in the office of the DPP led by Mr. (Gene) Pestaina is doing,” he stated.

In the January Assizes there were over five murder cases with the state completing two with convictions and rest being traversed to the May assizes.

      I beg to concur wih you on this one. The root. How can people walk around with so much hatred in their heart which actually is murder as well.

      WE do not put ourselves in other people’s position and feel what persons feel. It is about me, I and myself. Wht I think is only what matters. Then if so is the case, then I should be alone on this wide world. People think if the boots was on your feet and it was your loved ones or family member. Would you not ask for God’s mercy.

    Who gives you the right to decide who lives or dies? Yes, we have a problem with crime, but God will pass the final judgement – not you or anyone else. You are not God, and it is well out of your jurisdiction to decide to take another person’s life. An eye for an eye and we’ll all be blind.The death penalty will not help, and I do not want anyone killing people on my behalf. I will never support the death penalty.

      I would give them the Holy Bible to read and study. Even write an exam on what they read. This should be their exercise as long as they are in prison so that they will know what God has commanded and expects of everyone lest they condemn themselves for all eternity. Hopefully this would rehabilitate them.

    What is wrong with a simple “life-time” sentence in solitude? That is immoral. Fire for Fire is not the answer. The persons who hang another for killing will absorb all the sins of that person.     The death penalty law is there, apply without exception. Stop making the poor malaway pay for everything, whilst the criminals with high connection are free to roam about. No one should support the no law no constitution outcry.
    Find the muderers, spare no one. Among others we need justice for Wayne Dalrymple, Yannick Lander and GUN Emmanuel. The persons responsible for the attempted murder of the latter should face the death penalty as well. There is a serious link there. Amen.

    here we go again.we all have family and non of us would like to know that a certain date is our last day on earth.while i agree with the death penalty, i think there are negative and positives. the law men of this country have a serious problem in giving evidence at the court and this is very frustrating.I for sure can testify to that, i had my own experience with the Dominica court system. Hope if this thing is implemented the innocent don’t pay.

    Yes, keep the Death Penalty.

    But while Dominica’s last court of appeal remains the Privy Council, any such sentance will never be carried out.

    I’m not supporting a murderer but u hanging someone doesn’t make the person himself no different than the murderer. Life sentencing is much more better as this person may have family to take care of.the court on the order hand is so court up with politics an not forgetting racist. For example, a woman kill her two children and she someplace no one knows. Siblings killed their family member has sentence to 15 yrs each but a woman stab her boyfriend without it knowing it would have killed him an was of self defense has got a $100,000 bail n another Kalinago man done the same as the siblings did but not a family got life sentence which he deserves. Why didn’t all these murderers get the same thing excluding the Kalinago woman since it was self defense? As can see,the court of justice is not doing the right thing.every murderer should be sentence for life except if it was of self defense. That’s how I see it as a black person.

      Did you read elswhere as well. Did you read that Vengeance is mine saith the Lord. I pray that you do not find yourself in a difficult situation or a loved one. Read the other parts of the Bible as well not only the Old Testament part which highlights the law before Christ came and died on the cross for all of us. Yes all of us as long as we repent.

    If we are going to start dishing out the right punishment for crime, then let’s do it across the board and do away with the whole prison thing. In that case, the punishment for murder would be death; the punishment for stealing would be to cut off the hand, the punishment for rape would be to cut off the penis, and so on. If we do that, there should be no punishment for dealing drugs. Let’s go back to barbaric days and see what that gets us. Just remember, the murder rate when the world had four people was 25% (Cain and Abel – if you believe that), and it has been going down ever since. Like most countries, DA will go through this period and it will probably get worse before it gets better. But I don’t think killing people helps to reduce the murder rate. We should think of the social ills of our society and try to address them constructively as opposed to going back to barbaric times.

    I would like to support the call of the state attorney, but my concern is who is actually doing the execution, is the executioner not taking a life also, thing is the one who passes the sentence is not the executioner!!! but since the death penalty is resting stats shows that murder is on the increase, your call is justified.

    Hanging is barbaric and there is no place for it in civilised society. Properly address the root causes of crime, and introduce hard community labour into penal sentences – make criminals pay back society and re-educate them. Killing people is wrong, whoever does it.

    I can’t see why people thinks hanging is only to prevent others from killing, one would have to go to court to hear and see for themself in the court room. I believe it should be more so to get the real sick ones off the streets because they may end up doing it again like they out their heads. People must stop acting as if all who kills or alegged to kill should be hanged, a case must be heard with evidence presented. At the end of the day weather someone gets hanged the public will still have what to say mostly because they don’t understand or care how the legal system works, besides you can’t please people. It’s common for emotion to guide we humans unlike the courts system that goes mainly by the evidence presented, which by now i think should be clear to us.

      Generally, if they deprive people of their lives, they should pay the price. They should not be allowed to be in prison for a few years and then to be released while their victims are dead. Consider too their families who will continue mourning their loss until they die. I do endorse the death penalty. Think of yourself too and your family members.

    There are much more important issues with regards to the system and it being clean..

    The Courts left alot to be desired and definetly not above Board…so many state matters swept under the carpet…these same folks just collect massive salaries but refuse to uphold standards where the public and be atleast 75% proud of..

    But by picking on these issues doesnt me the ills of the sickening justic system is covered up.

    Our legal minds need to show some form up upward movements and not be subject to the lesser..

    in the end Dominica will continue to suffer…

    We can say what we want but to reduce the murder rate in Dominica we need to hang some of these murders. Why do most criminals hide to commit crime? Come on people, it is a very simple answer. They don`t want to be caught to pay the punishment for their crimes. So when they are caught hang them and you will see the result by those who intend to commit crimes. Trust me, no one wants to die. After committing a crime they alwaya asked for mercy but never offer the victim mercy. I fully support capital punishment because it is a method to eradicate the criminals from walking the streets.

    imagine being the family of a murdered person and in 5 years the murderer walking same road with u? it does not only bring on anger but much fear.

      Someone just sent me an email of a state of the art new prison in Canada. Foolish government. This makes my blood boil. If prisoners are allowed such a premise, is it any wonder that they will continue murdering and committing other crimes? They even demand a good meal, beef, turkey, etc., and at Christmas, Thanksgiving and Easter of all. They eat better than hard-working nationals. They do not pay taxes and if they are released, will be given a certain amount of money, even pension for those who qualify for it. When released, they are better off than those who have worked hard for years.
      Life is sweet on the inside. This makes law-abiding nationals angry as ever. This includes their victims who are alive and some who are maimed for life. I say hang them all and let them go to their eternal judgment with Satan and his corteges where they belong! Why should any law-abiding national feel sorry for them?

      I wrote to DNO last year after the murder in marigot/concorde area for which the three wesley guys were charged and asked them to conduct a poll on capital punishment (hanging) for those found guilty of murder in Dominica. I specifically asked for two such polls to be run. The first after the guys were arrested and the second identical poll during the trial, they ignored my request and did not publish it. It is good to see somebody else almost 8 months latter making a request for such a poll.

      You need to read your bible more. God is the One who instituted the death penalty – “Whoever sheds man’s blood, by man his blood shall be shed, for in the image of God He made man” (Genesis 9:6). That verse you quoted, Jesus was exposing the hypocrisy of the Pharisees.

There are other ways we can deal with that, and if crime is on the rise ” The PM needs to evaluate what is going on in the country and needs to put measures to remedy or curtail the situation.       This young attorney is a former well round police officer from Dominica. While he served in the US Military and may now hold US citizenship he is well placed to know the laws having served excellently in the CDPF after graduating from Morne Bruce in June 1985 in the top five. Matter of fact, he and Superintendant Carbon were trained together. Products of the great Supt. Philsbert Alfred (Retired). So stop your “American Mentality” nonesense. What happen, you have family on death row?

    I concur with the use of the death penalty. It’s time to take the necessary steps to protect our citizens from criminals. The fact that these guys know the death penalty is not an option, they will continue to committ crimes with impunity without thinking of the consequences of their actions.
