74 year old Leonard “Pappy” Baptiste, the leader of the Progressive Party in Dominica, made his first court appearance on September 26 before magistrate Bernard Pacquette where five traffic violation charges were read to him.

He pleaded not guilty to all.

Baptiste’s arrest drew heavy condemnation from members of the public after he was video taped in police custody under rain, crying.
He was charged by police constable Lockhart R for refusing to give his name and address, failing to comply to a “keep clear” at the corner of Old and Hillsborough Streets, failing to comply to a “no entry sign”, driving willfully thus hindering the free flow of traffic and failing to comply on Independence Street. All of the alleged traffic breaches took place on September 24, 2014.

The triall is set for February 27 2015.

Attorney David Bruney, who represents Baptiste, asked the court to order disclosure and specifically requested all medical documents which the prosecution would have since Baptiste was taken to the Princess Margaret Hospital ( PMH ) while in police custody for medical attention.

    For many people, wearing a uniform makes them believe they are above the law and better than ordinary people. Police officers in Dominica are following that trend, just like the thug-police in America. It’s in everyone’s interest that the police are held accountable to us, the public. They are public servants and their job is to serve and protect – not beat up or kill suspects.

    A 74 year old elderly resident being bitten up by the police, 5 police officers charged for the murder of a suspect in custody. This is the method of policing in Dominica.
    This is absolutely disgusting. And the police officer has the audacity to charge the man he has bitten up for petty traffic offences to justify his actions
    What is so sickening is the site of these police officers walking around in their uniform, thinking they are above the law. They are nothing but common criminals in uniform.
    What threat can a 74 year old pose to a police officer????
    This sickening culture of violence from the Dominica police has been ongoing for many years.
    Respective governments has turned a blind eye to this thuggish cultural behaviour from the police; because the government is dependent on the police to do their dirty work.
    They have been given a free license to behave in whichever manner they see fit towards the very citizens they’re meant to protect.
    What goes around comes around because nothing goes unpaid.
    How would these police officers who brutalise the citizens feel; if the same happened to a close member of their family?
    Alot of these officers do not have a clue as to what their job descriptions are; and alot of them are simply not fit for purpose.
    Alot of them would only get a job as a police officer in Dominica; nowhere else. Period.

    Come on Mr officer, everybody knows this man, the only time you should arrest if the person refuse to give their name ad address is if you do not know them or if you cant ascertain their name and address from someone around, come on, was this arrest necessary, i don’t think so, every police officer in Roseau and others knows pappy, in the interest of the public the commissioner of police should have an internal investigation, i think pappy should file a civil lawsuit against the chief of police, the Attorney General and this officer involved, pappy was no threat to this officer , physically or otherwise, nor was he defending himself, these young guys needs to learn the job, policing is not about that, gone are the days of dread and police, this is the 21st century we are living inn, i really gets disgust with these young officers who have no idea what their job descriptions are, they think that becoming a police officer is all about beating up people, the older veterans in the force needs to lecture to these young rookies.

    This is OUTRAGEOUS! Since when are people brutalised for violating traffic rules? Imagine, a SENIOR citizen being treated in that manner – and ALREADY charged. That was quick. So what about the charges still to be read to Stephen Isidore, to the five police who beat up the deceased from Portsmouth. What about justice for G. O. N. Emmanuel and his wife? When is that case going to be heard.
    Those of you involved in stalling justice, CAN YOU ALL REALLY SLEEP? You all must be tossing and turning in bed, although your beds are comfortable. If you don’t do the right thing, you will continue to feel the thorns in your beds.

    It is important that the police officer who abused or assaulted Mr. Pappy, urgently apologize and seek his forgiveness. Mr. Pappy is famous for giving his haters a limousine ride. I understood it is a short ride on the cemetery road. :lol:

      As crazy as this might sound. When I was trained as a police officer. I was taught that refusing to give one, name and address when requested by a police officer in the Lawfull execution of his duties. Is an arresting offence”. As far as I am concern that is still the law on the books. it did not say depending on who chooses not to give their name and address. Certainly it applies to every offender. Having said that I was trained that depending on the circumstances and the nature of the incident. A police officer can use his discretion as to whether he effect an arrest or charge the offender for violating the Law, or seek the name and address of an offender by other means. Mind you we were always reminded that as recruits fresh of training school and rearing to go, some officers have no discretion. That as it may Pappy was unfortunate to come across maybe one of those officers. As a people living in a democratic country we are charged with the responsibility to request that our laws be changed by the people we voted to do so. Where there is no vision we cannot fix ### pid and wickedness but it is what it is. Let the court decide. I respectfully request that our media houses of all types educate us on things that matters to all of us ie bring in persons with knowledge of the law to teach and Educate its people. We will be better off for that. Some of us a sick and tired of being sick and tired to live thru some of our beloved citizens proving to the world how ##### we are and that’s not the case.     We all know that Pappy is a nuisance. The man drives around town hurling insults at evry and anyone. He uses expletive that not even my granny would know. He obstructs traffic by deliberately driving slowly (stopping occasionally) and daring persons who honk at him to pass around him, knowing fully well that there is no way that they could. So, not only does he routinely obstruct traffic but he is also provocative, a nuisance. So, don’t come here acting as if the charges for traffic violation were not long in coming.

    As for the blows he got, at face value they seem over-the-top. However, Pappy has admitted to biting the Officer and striking out at him. Officers have the legal authority to use force so that they can protect themsleves and overwhelm the perp. The way i see it, Pappy should have been charged for resisting arrest and assault on an Officer; even based on the report by an eyewitness that DNO published previously.

      Well, Peeping Tom, for the first time I agree with your honest comment. :) His arrest was a long time coming in that, throughout the years the police were consistently patient with him.
      It appears he did not care about anyone and their feelings. He thought he was king of the road and no one dare challenge him and stop him. Putting it mildly, no doubt, drivers were upset with his indifferent attitude. The time came for him to pay for his actions. This might mellow him once and for all.

    I have one observation. Roseau is incredibly congested all the week and especially peak hours even more so during events, Xmas, carnival independence.
    My suggestion is to allow only bus drivers to drive in and park in their designated areas and keep all other vehicle owners from entering the city.secondly maybe underground parking could be an alternative..

      you must be a bus driver… I have a suggestion too…. the only reason buses are so close to congested areas of because of people shopping, also the only reason vehicles drive into to Roseau is for work and shopping. simply have bicycle , and motorcycle taxis like the do in India and china to move people around the city.

      You made an excellent point. When I visited, it was scary seeing all that traffic from the area which was once called “the Old Bridge” on Queen Mary St., – Independence Street. Pedestrians could not cross the street up to Cork Street and King George V St. There are no street lights and no police to direct the traffic to allow pedestrians to cross. Those who crossed did so at their risk. The drivers do not stop and wait for pedestrians to cross. It is worst during rush hours. Consider the other side of the New Bridge. Something should really be done about it.
      I hope, in time, when Roseau will be re-structured the situation will be better and all this traffic will decrease. May it be soon.

      This is not what I know, residing in Toronto. We love peace. There are Laws to be obeyed. It is a serious matter to disobey Laws; Laws also to respect others and their good name; not defaming their character especially in public and also on Websites. The police would have stopped him and arrested him a long time ago. Charges would be laid against him.
      Those who are a public nuisance will pay a dear price if they continue. They are given one warning. He would not have been spewing derogatory names at politicians and get away with it. Those who do not obey orders and directions from law enforcement and resist arrest will be doubly charged. Their punishment may also be a prison sentence.

    I hope the police chief look at the video footage that’s online and see where they do a bad job at policing, for one it took to long for backup to come the officer should have given a direct odder as to clearing the vicinity to at least 50 yards. the people that owned the house or business if that’s what the green building was should be asked to go into their house, with people shouting and saying these things I was surprised that it did not escalate into a riot. The bus where the people filmed the video should’ve been moved. A matter of fact he should have asked the house owner to use the porch to have the man sit while he waited for help, now what may have transpired before they show the man in the rain I cant speak on am sure there was eyewitnesses who saw what took place so only when all the evidence comes out I can give my opinion on the matter. I’ve been told by three different people who knows this guy the police officer that he does not back the DLP and it’s known he does not hide it, so for some people to make it seem like this guy did what he did because Pappy was talking about the PM that’s the reason he did what he did, but some how some way the man have to be dragged into this.

    I don’t think that the beating of Pappy has anything to do with skerrit directly but the police officer himself. These days them police frustrated bad and they passing their rage on any and everybody that cross them. You cant ask them no question much less have a conversation. Imagine I came down…went to town and wanted to find a place do some business, saw a police in uniform…walked up to him…and say excuse me officer ….the man turn around well awarjhay….and shout…what ….what you want? I just tell him forget that I mistake him for somebody else……now on my way back to the airport in the early morning….police road block…..boy gd thing I didn’t light the little spliff I had in my pocket…..

    They stop us….knock the window and say….roll down …roll down. I roll down, the man shouting where allu going!! where allu going??me and my fastness say…gd morning officer…the man answer ..gd morning what d mother…..I ask u where u f..ing going you telling me gd morning…boss last time where u going.

    Talk about serving the public..DA police force that more malkarsay, more awarjhay, boss them man and women just need to relax

    This is an abomination. Mr. Pappy is harmless. He was beaten for violating some traffic offenses. This is how we treat our senior citizens.

    Why should force be used during a trafic violation arrest? Something is not right there….During that particular traffic violation after the arrest was made ,normally this man should be taken to the police station,he should have a breathalizer test ,if the breathalizer test result is positive this man should remain in custody,because he is a danger to the society ,if the test was negative for alcohol abuse he should be set free till the court case,…in no way this man nor any other person who committed a traffic violation ,or someone who refuses to give their name should have injures to their head…Did he resist arrest? which might be the consequence for having such injures? if this man was beaten by that police officer why is he a hero? to me he is a zero and should be taken to court for police brutality.This police brutality episode seems to quite present ,like in the days of an ex-prime minister (P.J) we are not in the cave days ,this has to stop ,,,or sooner or later the population will retaliate…

        Those who experienced his attitude and driving habits will obviously not feel sorry for him. Their experience near him or behind him was a frustrating one. I hope he learns to drive better and safer and know that he is not the only driver in Dominica, in Roseau and he must be considerate of other drivers.
        He is a diehard who he needs to learn about road courtesy and also safety. It is never too late for him. If he continues to drive as he did, his license should be revoked for he is a bad driver and a menace to driving safely and respectfully to other drivers.

    but all them charges that was given to him the police officers themselves do this on the road on a daily basis , multiple times policemen park on the streets of Roseau having conversations , Papi was charged because they didnt know what to do so they issued traffic violations

    Since i know myself growing up in da papy has been vocal and hilarious. No one never beat him. Now u doing that to the man? Those charges there do not make any sense at all. those police need to go jail. Leave pappy alone. the Judge need to throw away these charges

      For his sake and age this could very well happen. If this occurs, I would not be against it. Nevertheless, Pappy would have learned his lesson. Everything happens for good reasons.
      In any case, the magistrate would give him a stern warning which he must obey. Failure to do so will land him in hot water with the Law and who knows, imprisonment. Let us hope he will not receive a severe punishment.

    No delay here in reading several charges to the elderly man. There is visible evidence that he was brutalized. I sympathize with Mr. Baptiste. The justice system is a failure. The people of Dominica need to stop being passive. Anyone who preys on children or the elderly is either cruel or mentally ill. Crying shame!

      see how easy to read charges, but a month is it? and none read to 5 police officers who have brought shame to being a cop, taken a man’s life. it has been said that they cannot be compared to the common criminal……..true….they are worse.

      I doubt it. Because then the police would all have to motorcycles to go after the real violators of traffic infractions…..the motorcyclists.

        In this technological age, one day Dominica will have radars and cameras installed to catch reckless drivers. We have them in Canada.
        Many drivers, unknowingly, are caught for traffic violations, not yielding to traffic and pedestrians who have right of way to cross, driving above the speed limit and not obeying traffic signs.
        A ticket is sent to their home address which they have to pay. Failure to pay it at the given time, they will have to face the Court and will pay a higher fine.
        Who knows? They may be imprisoned. If they fail to pay tickets for traffic violations, if employed or pensioned or are business owners, their income and assets could be garnished.
        People do not mess around with the government. When the government says you owe, you owe and pay up or else. You can dispute it in Court and probably win but this does not occur frequently.

      It’s a d–m shame your lack of common sense is dangerous for people in Dominica. this is a wicked system and we will fight it down with prayer and you better watch out because their is power in Prayer.. and what goes around comes around you and your friends turn is coming, who next teenagers and children .
      With the change that is coming all those in the police force that do not adhere to the procedures of the department will be put out,.
      I was rather surprised at Mr.Weeks comments about what happened I support him because he seeks out the facts first before addressing the issues but in this case he was lacking substance to what he was trying to say and that made him look bad I hope he does a better investigation of the matter next .

    I have worked in the Caribbean as a police officer, I have worked in different parts of the world serving the British armed forces and never have I ever lost control or treated anyone in such a despicable way even when they have tried to kill me in my line of work.

    Im lost for words when it comes to the actions of the police over the last few months. What sort of conflict resolution training and conflict management do these officers receive during and after training.

    The whole handling of these beaches of code of conduct by the police and the way that this so called PRO is handling these seemingly regular occurances lives a lot to be desired.

    Surely, the first thing that must happen in every situation where a police is accused of brutality or any offence as a matter of fact is, the PRO should assure the public that the matter is being investigated thoroughly. How can the public build a relationship with the police if they the police sees themselves as Judge, Jury and Executioner.

    I shall say this and do read carefully. Whenever there is a breakdown in the legal system that is a very good and precise indication as to the state of any particular country.
    Corruption, Police brutality, delayed justice is just like a cavity in your tooth. You know you gonna have to get a filling or get the tooth removed. If not you tooth will decay.

    Its the same with all corruption, police brutality, delayed justice and a host of others. Its a sign of a massive tooth ache which needs tending to. If you don’t sort it out then i’m sorry, anyone who has had a toothache knows the pain one endures. However this pain of delayed justice and corruption is even more excruciating than a toothache.

    So it must be dealt with and swiftly. So when the police kills someone in custody or beats up a 74 year old man because of a couple of traffic offences one must ask themselves, have we got a cavity in our country which needs rooting out?

    The police must respect the public and work with them. The public is not the enemy, the criminal minds are. Be more professional.

    I spent 4 years as a police officer and 4 years in the British army and I never abused the powers bestowed upon my by the state and I’m proud of that. Remember officers that what goes around comes around and toy won’t always be a police office.

      I hope that policemen / women take the time to read this comment because it is right to the point I know that their are some very good policemen/women in the force and it’s wrong that they are paying the price for the dirty ones But God will protect them all .

    Failing to give name and address! When I underwent police training, we got to know all the top politicians in Dominica. There is NO POLICE Officer in Dominica who can tell me that they don’t know Pappy’s name. Would they have needed his name to arrest him? At least one of the police officers on the scene could have positively identified him. My Learned Friend Dave Bruney will not allow that charge to proceed.

      Do you people really think that this is about an accumulation of traffic infractions all done in one day? Come on. They want Pappy out of the way. This is vindictiveness. They want to see how much you people are willing to put up with. Pappy is just the example that they chose. All of the sudden they decide to enforce traffic infractions after all this time and all one one person in DA, a place with a lot of crazy drivers……..especially the motorcyclists…..who get no tickets. Wake up and come to the defense of this poor man because it could be you next as the target.. We know the courts are bought. There is power in numbers.

    from all the viewing of the video clips I had via facebook I wonder why he was not charged for resisting arrest and battery/assault on police. The clips clearly showed these 2 offences thanks to the cameraman who thinks he is doing the best thing. oh, and yes, failing to give name and address is an arrestable offence.

    My prayers are with you Mr. Pappy. While a high powered delegation from Dominica is at the United Nation addressing the General Assemble, on the same day, a 74 year old leader of a political party in Dominica was charged in our courts after being beaten and had to receive medical treatment. Mr. Al-Nasser, President of the General Assemble at the United Nation should be notified to what appears to be political victimization.

    …… Lawlessness thrives when some think that the World we live in, persons Do not respect the Law of the land, and now a days every body is presenting them selves as Lawyers, The sad part no matter where in our sorry world its ok once those doing it to others they do not gives a blouse and skirts who they offend. But!!!! when the shoe is on the other foot all hell breaks loose. My preacher preached this sermon last evening and he`s right on “Q”. Dominicans wake up and smell the coffee. Yes I have a father! Yes we all have families and all what some might think. Regardless!!!! dammed, thou some might get away with lawlessness all their life. that too will come crashing some day. Lets be serious. Violation of the Law is no excused!!! Let the blouse and skirt courts do its work. We are in serious trouble and if we allow things to continue some day soon all hell will break loose and there might be lots of damage to the guilty and the innocent ones. The world is sick and we need to get our house in order but it must start with us doing the right thing. I Am Dominican, . Are YOU??????
