Leader of the Opposition, Lennox Linton, said he will dispute a bill of cost in a defamation matter sent to him by attorneys representing Chartered Accountant, Kieron Pinard-Byrne.

He has described the matter as political.

On his Facebook page and speaking to the media on Sunday, Linton made his position clear.

“Mr Kieron Pinard-Byrne has submitted what we call a bill of cost, he’s claiming money. As the respondent, I have the right to react, to disagree,” he stated.

In a letter dated, April 21, 2016, attorneys for Pinard-Byrne, DeFreitas, DeFreitas and Johnson wrote to Linton demanding $340,926. 39 in the matter which started in the local courts and went all the way to the London-based Privy Council.

The letter stated that Linton should inform the attorneys no later than the 28th of April if he is in agreement with the costs.

On his Facebook page, Linton said the costs before the Privy Council are to be assessed by the Cost Clerk of the Privy Council if the parties do not agree on costs.

“The Court of Appeal costs are also to be assessed,” he wrote “I do not agree to the bill of costs presented by Pinard-Byrne and will file my points of dispute. Accordingly, on its completion of its assessment, the court (NOT, DeFreitas, DeFreitas and Johnson) will decide the balance to be paid after the February payment on account of 20,000 pounds.”

Following a delegate’s conference in Mahaut on Sunday, Linton also spoke on the matter.

“The court at the level of the Privy Council, in terms of the court’s clerk, will make a judgement on what is the final balance owed to Mr Pinard-Byrne; it’s not DeFreitas, DeFreitas and Johnson or Mr Pinard-Byrne. We await the outcome of that process,” he noted.

He stated he will comply with the process of the court but is unsure of the April 28 date outlined by the lawyers for Pinard-Byrne.

” I don’t trust their representations because they’re all political, they’re part of the Labour Party propaganda machine against me. I don’t know why lawyers would get involved in that but that’s what it is. That’s what it is,” Linton remarked.

    Wow, that man must be a true Dominican hero/patriot. All this he has to pay for being ‘The Dominica WikiLeaks’. They say he exposed corruption in the failed multi million Layou project, then they say he proved gov’t gives friend almost a million dollars for garbage bins that never surfaced till he exposed it 18 months later, fertilizer etc. Wwow WikiLeaks, I can only imagine what will happen to Asange if they ever find him./

    if cost was awarded against him – who does he think has to pay the bill?

    and why does the court have to set the amounts in terms of disbursements fees etc. The lawyer can asks for cost and if costs are awarded then he will be given the lawyers fees.

I am telling you that declaring an issue against you to be based on political partiality is not the answer to solving that issue, you have no proof of that declaration, hence you conflict will always continue to remain unsolved.

    That may be the reason you have so many omens of existence, walking behind and before you–you do not try to acknowledge when you are at fault, and to humble yourself, for no human being is perfect through attitude and conducts–but that has to be the only solution ever so often.

    No one will agree with the call to pay $340, 000.00 in penalty, but by simply saying it is political– the Labour Party propaganda” will do you no good! That untamed tongue of yours is the reason for your troubles in the first place.

How the heck can this person be contracted to be involved in a hotel project that has produced nothing and he is being rewarded for it over and over again.     I am not a party suporter, I think this kind of system does more harm to Dominica than it does good, but Pinard can get lost , you will not go to prison or lose your house if we can help it . Let him boil in anger.

    When you make such statements as “it is political,” you must prove it. It is all in your mind.
    Have you forgotten it is a high profile case? Court and lawyers’ fees cost an exorbitant sum. First of all, wherever they traveled, to and from the hearing is also taken into consideration including hotel costs and other relevant costs. All add up.
    Linton cannot afford to pay that amount. He is playing for time. He had to come up with an excuse to delay paying and to try to get a loophole of not paying or to decrease the cost.
    Think twice in future prior to opening your mouth. This has proven to be expensive. It is not the people who are in hot water but you. They do not have the anxiety of paying. You do. You have to find the money to pay the costs. They do not. This is the price of the power of the tongue.

    If you want to kill a snake is to cut off the head. I am not accusing Mr. Linton of being a snake. It is just an analogy used to show the desperation of Skeritt, Tony, Aaron and the DLP to try to get rid of Mr. Linton. Skeritt has tried, he failed. Tony, Aaron and all his Labor supporters put together, they have failed. Pinard Bryne’s time has come, he will also fail. It appears, they have teamed up with Joshua, he too will fail. Do Dominicans really believe this letter of cost sent to Mr. Linton on the eve of Joshua’s firing was a coincidence, if you believe that, think again. Ask yourselves, why is it Tony and his gang have shown more interest in Joshua’s firing then Joshua himself. Why is it the other two men are hardly mentioned although they are in the same jewboom. The one man that is standing between Skeritt and Dominicans in terms of his alleged corruptive practices, his total effort to economically destroy Dominica is Mr. Lennox Linton.

Why is Lennox always in the spotlight?when is he gonna stop play journalism and start acting as a responsible elected official? How has he helped his constituents…? How has he helped the developmental process? What are his plans for making Dominica better?       Foreigner or not it was found by the courts that he had slandered the man’s reputation, for that he has to pay. Mr. Linton is still in a fighting mode after he has lost the battle and the war, he continues to spin the issue trying to make it political. The government or the Labour Party did not sue Linton, it was a private citizen. The government or the Labour Party did not determine the guilt of Linton it was the courts including the Privy Council, there was not one Labour Party appointee on the Privy Council.

Would you not take them to court because you’re a, ammm “foreigner”? The eyes of the law should not have boundaries in terms of nationality. With that said, LL should be careful with his words. You cannot spew things that you do not have evidence to. You open yourself up. I personally think the bill is huge. But considering how it dragged on and all the different levels of appeals, tt might actually be accurate. LL should have considered all of those costs when he continued to fight on. He would know he’s have been liable to repay those fees.     Thanks Hon. Linton for the clarification. The focus should be on Dominica and why are we in deep poverty, with serious lack of vision by this Skerrit lead DLP corrupt government. We, with your vision and leadership, and fortitude will continue to support the plight for decency in government as we remember the Layou Rover Hotel, Bin Bobol, Fertilizer Bobol, Passports’ fiasco etc etc etc.. the list is as long and thief in the night.

    I am honestly extremely tired of Skerrit, Linton, UWP and DLP. There are serious issues which need to be addressed at the grassroot level and all this bickering is getting us nowhere. To this day, Linton has yet to connect with the people. Yes, electoral reform and the economic citizenship program need to be address but the electorate would respect him if he spoke more on topics that impact our lives everyday. For instance, Marigot needs a community centre, a well-equipped hospital and more assistance for farmers and fishermen etc but I am yet to hear him advocate on our behalf. He came for our votes and left us hanging. He still operates like a journalist, all talk and no action. Skerrit is giving to young farmers and village councils everywhere, but Marigot that has so much agricultural potential is last on the list, if at all. Where are the other ministers, besides Darroux and Tonge? We should be getting monthly updates from them.

      Do you really think if he advocated on Marigot’s behalf for farmers, hospital, etc. Skerrit would just hand over the funds. Skerrit is supposed to be doing for the entire country and he’s not, so how exactly is that Lennox’s fault. By now you should know he’s not going to listen to Lennox and Lennox shouldn’t have to beg for things to be done in Marigot, it should be done because it’s the government’s responsibility. But Marigot doesn’t support Labar so it won’t happen, that’s just the way this government operates, support me or you suck salt!!

    Mr. Linton I would suggest that you leave it for your legal adviser to handle take yourself away until your lawyer tell you other wise after all you a just playing there games and I know you are a very smart individual. We have a lot more issues for you and you team to deal with I know you didn’t have much time to make open comment about the contract given to the company in Barbados and our people and companies in Dominicans are pushed aside, We know it was a difficult week end for you and the team but the high Officers in the party will handle that too, you have supporters and the party will stay strong there plan didn’t work so don’t fall for it now just move on there is work to be done.

The Privy can’t tell the man his lawyers charging to much, had he lost the case that’s the money he would have to pay, or shall I say he pay.
