UWP challenges the election of Dominica’s new president

The United Worker Party (UWP) has filed documents in court challenging the validity of the election of Eliud Williams as President of Dominica.

In its claim form filed in the Roseau High Court dated October 26, 2012 by attorney J. Gildon Richards, the claimant, Hector John, lists Prime Minister Roosevelt Skerrit, Speaker Alix Boyd-Knights and the Attorney General Levi Peter as the defendants.

“The nomination by Prime Minister Roosevelt Skerrit of Mr. Eliud Williams for election to the office of the President of the Commonwealth of Dominica, without first consulting with the Leader of the opposition in observance of compliance with the provisions of section 19 sub sections (1) was unconstitutional, null void and of no lawful effect,” one of the petitions filed in the court documents reads.

The UWP is also seeking a declaration from the courts on the actions of Boyd-Knights when she summoned the House on September 17, 2012 “knowing that there was no consultation or proper consultation by the Prime Minister with the Leader of the Opposition in compliance with the provisions of section 19 sub sections (1) of the Commonwealth of Dominica Constitution, violated the said subsection and the provisions of subsections (4) and (5) of the said section hereof.”

And finally the UWP is asking the court to declare “that the purported election of Mr. Eliud Williams by the House of Assembly, meeting on September 17, 2012 is unconstitutional, null, void and of no lawful effect.”

The UWP had also taken to the streets to protest the matter.

    boy “F” Mr. Williams, F for FAIL!!!….failing to be the upstanding man I thought him to be…. if DNO would permit me. I am tired of the men I look up to LOWERING themselves at the TOSS OF A BONE…. I would respect Mr. Williams more as a SIMPLE MAN, with the fortitude to stand up from what we should all collectively revere and hold dear….. I never thought a man of his stature was so “HUNGRY” for the lack of a better word. anyways….just my two cents…. so much for LOOKING UP to the older men in Dominican society. where oh where can I find a REAL MAN of substance to look up to…where are they all gone….. they can’t ALL be in someones pocket….

    If Sir Brian Allyne is of the constitutional view that Eluid Williams was not properly elected as President, that to me is sufficient reason for the opposition to take the matter to court. Based on the clear and unambiguous reading of the constitution at sections 19, 28 and 119. it is quite clear that Eluid Williams is an illegal president.

    Since the Speaker had no letter of resignation from the President, consultation between the PM and Leader of Opposition was not required. The President can only write to the Speaker of the House concerning his resignation and no other person, not even the great and mighty Skerrit. That is according to law. check sec 119. It was the AG (Levi Peters)who informed us that the letter the PM claimed to have received from the President informing him of his pending resignation was a RED HERRING and should be ignored since it was of no consequence. He said that the only letter of significance is a letter coming from the President written to the Speaker (Not Skerrit)informing her of his resignation. According to Sir Brian it is only after that letter is received by the Speaker that the process of consultation should begin. In this case consultation took place before the Speaker of the House (not Skerrit)received a letter of resignation from the President.

    The letter of invitation to consult received by the leader of the opposition from the PM, invited the leader of the opposition to consult pursuant to section 19(1) of the Constitution. It is now crystal clear that the conditions of 19(1) were not met since no vacancy existed in the Office of the President. As a result the consultation which took place on the basis of the letter of invitation is null and void.

    We have since learnt that both the Speaker of the House as well as the AG have problems with the meaning of the word “WHENEVER”.

    Incidentally this is the same AG who informed the world in a press conference that outside individuals were giving instructions to his staff at his office who he doesn’t know about but is concerned about the situation. I am just wondering if the AG solved the problem of people outside of the AG office directing the work in the AG’s office?

    I support Sir Brian, I can’t in good conscience recognize Eluid Williams as President. I support the opposition taking the matter to court since we can’t allow this administration to continue riding rough shod over our constitution unchallenged.

    Peeping Tom, that’s a good point! UWP doesnt have much of a moral leg to stand on and it’s their lack of credibility that is probably one of the main reasons Skerrit’s control will remain unchallenged.

    But they are still playing a role in stirring the sewage. I hate the thought of Skerrit just being able to do whatever he wants without any frustrations.

      An opposition exist to propose and oppose whenever necessary. The opposition does not exist to sing the praises of government, especially when that government is clearly corrupt and deceptive. In Dominica for instance, had it not been for the opposition, the DLP would have escaped with the bin bobol, they would have escaped with the fertilizer bobol, they would have escaped with the illegal land transfer deals, They would have forgotten about the attempted murder of GON Emanuel and his wife. If you had any idea as to how parliament works, you would know for certain that the speaker has no right to prevent the opposition members from speaking in parliament. I guess you would not know that since DLP SUPPORTERS DON’T LISTEN TO NEWS AND FOLLOW THE ISSUES TO BE ABLE TO MAKE THEIR OWN DECISIONS. THEY WAIT UNTIL TONY TELLS THEM WHAT TO SAY BEFORE THEY CAN SPEAK.

      By the way what is the DLP vision for Dominica? Does it involve having relations with China based on an MOU that you know absolutely nothing about?

      Did you hear Mathew Walters say that they placed agriculture on the back burner?

      How much goods Dominica is exporting to China? Do you notice that the Chinese are working in Dominica while Dominicans are struggling for work? Do you know that Skerrit took a loan from China of over 20M to employ Chinese in Dominica?

      The DLP PRO said publicly on the Heng program with his wife that DLP does not believe in the politics of truth. He said that truth is for the church and UWP believes in the politics of truth.     I suggest to education officials that we should introduce the constitution of Dominica as part of the schools’ curriculum at all levels. I’m saying this because it seems to me that our politicians are really uneducated about it. If they were then there would be no need for all these controversial decisions that have been taken.

    While I understand there was probabably illegality, UWP loses every case not because they are necessarily wrong but Skerrit owns the judiciary so will always get favourable ruling!

    And each loss makes Skerrit stronger in the eyes of a majority uneducated public who only see the win not the stealing of the win.

    Anyway, I applaud UWP for continously battling but cant they multi task? While battling in court battle on the stage too. Tell us how they plan to create jobs, bring legal non-AID foreign revenue into the island and fight crime!

    OK… let’s put politics aside for two minutes. Claim number 1 states that the nomination was unconstitutional because Mr. Skerrit did not consult with Mr. John. Claims number 2 and 3 are based solely on the first and so the real issue here is whether or not there was adequate consultation as require by the constitution.

    Now, I heard Mr. John say on Channel 5 News that he had indeed met with Mr. Skerrit and they spoke on the issue. He said that he knew of Labor Party’s nomination choice and that he did not agree with their choice. This meant that UWP would have the opportunity to make their own nomination known with XX number of days (I don’t remember how many).

    So what is his case about?! Did Mr. John lie to us?! Because I heard him myself and I remember thinking, “thanks for doing it right this time Skerrit.”

    This UWP is simply looking for attention as they see a lot of Dominicans are home for the Independence Celebrations.

    They are a confused bunch of people that know people that are stupid enough to make their scarce resources available to pay richards money to represent them in court.

    I mean to say why go through all of this foolishness just to simply not attend the November 3rd Independence celebrations. It is well known that you all do not attend for almost 10 years now – old president , newly elected president, same old tactics.

    When will the UWP move on with organizing themselves into being a viable opposition? Start developing an agenda that can appeal to a broad spectrum of the population. Speak about how you will create jobs, how you will raise the standard of living, how you will increase the population; what about housing programs to allow ordinary people to own a home without breaking the bank? Come up with a plan instead of just focusing on what is wrong with the ruling party. Build your strength so you can get back into power.

      When will you speak out about the wrongs and the inefficiencies of the current administration. If you were not so bias you would realize that UWP is not the opposition. If you are u happy with the performance of your government and dislike the policies of your government then it is your duty to oppose and become the opposition. On several occasions you have made the same request. You would like the UWP to state how they would fix the problems we face yet you refuse to let your government know that you are not happy with the status quo. Stop being a hypocrite and be true to yourself and country. Hypocrites like you make all kind of excuses for the corruption that exist.       You support a party in power for 14 years , the country has regressed during that period yet you think that the best approach is to leave a corrupt and worthless administration in power until the opposition tell you how to fix the economy and take Dominica from this sad state.     On many occasions we are told that the UWP is not a strong opposition political party,but I sometimes ask myself,has Dominicans and the Caribbean by extension seen such interest shown by any political party with the positivity,visionary and strength to do what this political party has done over the last two years.Dispite their monetary contrains, the party will not sit by and allow Dominica to sink in the bottom pack of democracy of the Caribbean and world by extension.I hope the people of Dominica will understand that democracy isn’t only for the Americans,English,French and some Caribbean countries but also for his small country called Dominica.

    Wasn’t Mr. John on the news confirming that he had met with the Prime Minister to discuss the resignation of the then president and that their meeting was a cordial one, only that he was not in agreement with the Prime Minister’s nominee? Wasn’t that a consultation?

    Wasn’t their (UWP) initial issue about they not having received or seen the resignation letter from the president and about article 19 in the constitution?

    Why are they now presenting “no consultation” as their reason for taking the matter to court?

      Hector John was in agreement with the PM. He and the PM had discussed it as was stated by him during a interview but apparently after that interview, he got a bashing from Mr’s. James and Linton, now he has no option than to retract his statement.
      Mr. John! if you are the opposition leader, behave as one and stop taking orders as a little boy from James and Linton
      No money will not be coming from me to assist in paying their court fees.

    TREASON

    TREASON, crim. law. This word imports a betraying, treachery, or breach of allegiance. 4 Bl. Com. 75. 2.     The wheel of justice is very slow but it worth fighting for. Slavery did not get abolish in one attempt. It took years and it took lives but finally we overcame the physical chains of injustice.
    This is no different. As many may think this is a challenge and a fight for justice that our children will enjoy a better and safer Dominica. Am behind UWP with 100% support. Poverty and and crime don’t choose color or status but evil men and design it to be.

    it pains my heart to see many dominicans lay their head down to the face of injustice… seemingly hopeless to do nothing about it…. sad reality is none of us are ignorant of the fact that our constitution has been hijacked by unworthy men n women….
