UPDATE: Civil servants on forgery charges

Former President of the National Youth Council Nash Mitchell and Lyndon Marie of Sisserou Singers fame are in hot water after they appeared in court late on Monday afternoon on forgery charges.

They are facing charges of 14 counts of forgery, including the possession and uttering of forged Commonwealth of Dominica passports and birth certificates.

The crimes allegedly took place between November 11, 2005 to March 31, 2011.

The men were denied bail late Monday evening when they appeared before Magistrate Ossie Lewis at the Roseau Magistrate Court after being arrested last week.

During the proceedings, Magistrate Lewis heard first from police prosecution who objected to the bail of the accused.  Police prosecution alleges that the two may be part of a wider conspiracy to obtain and issue Dominican passports to persons who are not nationals of Dominica by birth or nationalization. They believe it is the tip of the iceberg in an investigation that involve many other persons and will take some days to unravel to any degree of thoroughness.

Already 40 forged passports have been reportedly identified by police.  Police believes there are more and that the alleged passport scam has placed Dominica’s sovereignty into the focus of the international community with consequences for legitimate passport holders.

Documents which Nash and Lyndon are alleged of forging bear names such as Mohamed Hajid, Abda Abdul Ambuka and other Islamic based identities. “Probably tomorrow you might hear an Al Quada person get caught and a Dominican passport is in the hands of that person,” police prosecution told the court.

The Prosecution asked the court to deny bail to the two accused saying  if given freedom the defendants pose are flight risk and could possible “tamper with witnesses and interfere with ongoing investigations.”

In her turn at the table before Magistrate Lewis, defense counsel Heather Felix Evans told the court that “the prosecution has no concrete and substantial evidence that the defendants would tamper with documentary evidence which are in the custody of the state.”

Evans reminded the court of the fundamental rights of the accused, including the presumption of innocence and the right to liberty. She also pointed out that both men were friendly and positively integrated into society, public officers of long standing, and their involvement in sports, church and community.

“There may be persons (co-conspirators) involve at the Registry or Immigration office,”  the prosecution rebutted.

“Bail temporarily withhold can never counter the question of liberty,” Magistrate Lewis asserted while handing down his decision to deny bail. He added that investigations a still in its “embryonic stages and if granted bail it may  defeat the cause for justice.”

The matter will appear before the court again in the middle of June.

    Why have we not heard about the Immigration officers involved? The passports (both the Old and the new machine readable ones) have to signed by an Immigration Officer on behave of the Minister of Immigration. If the investigating officers were doing their jobs properly they would have these Immigration Officers in custody. But I guess these officers were transfered and may be one of them is in CID working investigating the passport matter.

    It is said that these out of roseau boys have to pay for this big crime. For all we know these guys may have been the last of the chain. What about the legal affairs personnel and the police (immigration) officers? When is there going to be another arrest? Let us be real dominicans and let us think a bit, where would these two junior public officers have contact to iraqi’s? I am not condoning what was done but if there is such a big chain, why is the weakest link being arrested? Not too long ago some police officers did the same so call crime. None of them spend a minute in a prison cell. At the end of it all the officers still remain with their jobs. What about the inspector who stole the money at the marigot police station, he was just given a slap on the wrist. Life is so damn unfair. He is without sin of his own cast the first stone.

I shall and will not condone anything this gentlemen have done, however, many of “us” are quick to point our finger, and when we ran out of fingers, our toes and when we have no more toes left, our tongue at these fellers. But should i remind some of us on this blog that “we” have all, commited some wrongful act at some point in our lives. Some of “us” may even be involve in committing wrongful act at present, but yet still we are crying down at these fellars. Ce bab comawade ou ca pauis defay, ouse sa (not very good at patois). Even if some of us read this thing, we will still carry on, committing adultry (which is becoming a norm in Society), stealing, selling drugs, raping, lying, hating, bad talking each other, homosexuality, and the list can go on and on….so dont cast stones at lindon and Nash, “WE” are just as guilty!!!!

    After the initial shock I read this again.These people are fully aware of their actions.

    Whatever short term financial gain they may achieve from their betrayal of position and country, could never replace the long term implications.

    Visa restrictions will be implemented on Dominica, making it difficult for law abiding citizens to travel. Should the powers that ‘be’ consider Dominica a threat, they will not hesitate in taking preventitive measures. Especially if they feel the people purchasing Dominican passports are using Dominica as a stepping stone to elsewhere.

    This should be thoroughly investigated. The sale of Dominican passports, in Dominica and elsewhere, stopped immediately, and previously issued passports recalled and checked.

    Passports should be earned not bought.

    Before you guys start blaming the government, let me inform you all that these guys are not supporter of the ruling party as a matter of fact mr mitchel was seen as the next candidate for the uwp in the soufriere constituency. But let me say too that we are too quick to judge and say all types of things, these guys are brother, uncles, nephews, grandson, son, etc. Mitchel is my cousin and it is sad. But let us pray for them no man is perfect they have done a mistake and they will learn from it. we just need to pray for these guys.

    All these pple were granted passports with no problem even though their name was mohammed al fajid……but the authorities refuse to issue a passport to my child, who was born out of Dominica, in a country which does not grant birthright citizenship. i have been struggling for over a month with the authorities writing letters to all heads they refer me to. So my child who is born to a Dominican mother, who is well known and was sent there by the government is being left in the cold. I may never be able to return home as without a passport my child is stuck in that country so i must remain there too…..

    It was so easy for these guys to send in a phony birth certificate with the name mohammed al fajid and a passport is granted without any investigation. But they are dragging their feet to respond to my situation. Now i am on the verge of being exiled ….. Good bye Dominica.

    its very hard to know these great men of society are involve in such high crime,but what i do wonder is since the major investigation places are registry and police headquarter and the police officers are the ring of all this cause they are the one that process the passport how far is that investigation going. Are they all covering their tracks cause the heat is on or is there a system in place in the department where the passports are made that they can go back on,cause a number of entries are being made daily so to for alot of name in the system,im just wondering where this investigation is going,is justice going to be served bcuz some policemen are the biggest criminals in the country from drugs to money to passport.Its a ring of police offers for such thing to be going on for about 11yrs,the policemen are being promoted,send to different department,some get higher post.im really wondering about that investigation.there is a leader moving from place to place with help from others cause they getting their fair cut.man i want to be an investigator on that case damn.

    God will be your judge Lindon in the mean time remember that the bible says “Your call shall bring water to your desert land.” You are in the desert right now Lindon, call out to God, he is a forgiving God. regardless of what man may say or think or what they do in the end remember that only God can truly judge you. Alot of people are affected by the decisions we make and trust me Lin sometimes they seem like bad decisions but sometimes they turn out for your good. Do not mind the shame of being arrested or having this all over the news right now, God maybe allowed this arrest and denial of bail to save you from something worst……… who knows maybe if this did not happen we would have been attending your funeral.     If I recall the PM came out and ask Dominicans not to over stay there visit to the UK because the Brits are pissed off and will impose visa requirements for Dominicans. As an independent minded Dominican I ask myself the obvious question – How many Dominicans take trips to the UK annually. Logic tells me not enough so much so that the British government is concerned . Considering the cost to travel to the UK not withstanding the currency conversion I am sure that my 10 fingers are much more than adequate for the count. I knew then that the PM was again not telling the people the truth.
    Truth can never be destroyed – It is an utter shame that two smaller guys are now being used as shields to protect those who have had the very bigger pieces of the pie. Persecution and Prosecution of the two small fish will then cover up the atrocities of the bigger fish.
    That’s the way the story goes. I sincerely hope that these so call god fearing and men of good principle will not only claim responsibility for whatever part they may have played in the overall passport scheme but will also go the distance to restore the dignity of their family and our country by exposing those who are hiding behind the little fish.

    The PM should feel obligated to rescind the statement made about Dominicans overstaying their visit to the UK. Those of us who are objective enough know that the conduct of the DLP has done much damage to our sovereignty. There is much more embarrassment to come .

    Wow! where in the world have you ever heard of people selling passports? who ever the person who started in the first place, the person who was elected by people so stupid as myself, who were unable to secure funds for Dominica in no other way are the real criminals in this matter. Our birth rights are sold for nothing, foreign people bringing in goods loaded with lead, no duty paid at customs, we dive into it cause its cheep, not knowing that we are being killed slowely by them…, who reeps the profits? who is at the doctor’s office every day??? check the cancer rate in D.a over the last 15yrs. I felt so bad a few years ago at immigration in Canada when a man challenged my birth certificate that was in my passport. he asked me questioned me about things in Dominica that he did not even know about… then I started questioning him about the history of Dominica, andwe all laughed at the joke in the end. For me this was no joke.
    When these kind of crimes are being commited. there is always a chain, the person at immigration who signs the passport has such a big part to play in this, it is not even funny. no one or two people can carry this out. I know mr. Marie and family very well, and it would be wrong of me to judge someone on appearance. My church group went on a jail visit last week, and I saw the the most handsome man in there. I felt like he was the perfect gentle man, 6ft tall, well built… I had to ask the security what was he doing in there….dammm he was almost at the end of his sentence, which was 25 yrs in jail for killing his girlfriend… lyndon, may the peace of christ be with you, May you find the strength to over come your worste fears and speak the truth,..I know deep down that even if you did it , you were just the small fish in this whole thing..In this world only the strong hearted will survive,,,just a little warning, if ever you get out on bail do not enterany on the those who were involved vehicle or meet with any one by yourself.. a man does not care what he does to protect himself, and good name in times like these….you shall be in my prayers.

Let us be Frank- ) By the time evidence start pointing in the direction of those DLP cabals all investigation will “kybwash”. The next thing we will hear is that the accused men skip town. After all even if they confiscate their passports how can we be sure that the accused men did not set themselves up with additional passports.
    According to the police this thing went way back to 2005. Mark my words – the only reason the police is pretending to be on the matter is only because there had been some international concerns and suspicions. Six years ago and only now – in little Dominica???. I went to school under Wyas mango tree in the mang in Portsmouth but Carmen I wasn’t born yesterday.
    Dominicans of all works should be really concern and we should not take this lightly. While some of us may say well I have Antiguan passport , American, UK those passports clearly indicate your place of birth. So when you travel with the passport of your adopted country you are still a member of the country that is secretely providing your passports to terrorist organizations.

I am also old enough to know that one should not believe everything written in the paper or that which was broadcasted on the radio, television or even DNO. The more I read is the more I am beginning to think that Dominica is quickly becoming like the corrupt African nations with corrupt regimes while the people and country are make very little or no progress at all.     This is a serious matter. To those who doubt that those men are innocent, think again and put on your thinking cap on if you have any. You are gullible. Think, too, there is no smoke without fire. They were under surveillance and were being investigated when it was found out that people with Muslim names possess Dominican passports. These matters will come to light sooner or later. They will be caught and will not escape.
    Recall some years ago when some Chinese people who are non Dominican citizens possessed Dominican passports. If these people with foreign names travel to countries as the US, Canada and Europe, they and their passports will be scrutinized.
    It is for this reason why Dominicans must obtain a Visa to travel to those countries which places a financial hardship and anxiety on them who must travel to Barbados to obtain one. Some of them were not successful in obtaining one.
    You can call this treason, selling passports to Muslims of all to give them the liberty of traveling to all parts of the world which grants them the freedom to spy on other countries as the US and to commit terrorism.
    It is also for this reason, why I question what are those Muslims who are not born in Dominica doing in Dominica; i.e., those who are not Dominicans who converted to Islam. This is another sad story as they renounced Christianity.
    The government must investigate them prior to granting them residency, whether for studies. They could use Dominica for their own means under the disguise of studying and at Ross University of all. Wake up Dominican government – Dominican Immigration Department! Do not be lax! You have a country to protect from the enemies of the world, your precious God-given Nation of Dominica and its nationals.
    Those people are using Dominica. Do you think that they care about Dominica and Dominican nationals? What they are seeing and realize is a people who are friendly, trusting and vulnerable and who will never detect their underlying wickedness.
    They also check the Internet to find countries which will allow them in without any red tape.
    Those people have outwardly and proudly stated that they will eventually infiltrate and dominate the world. They are presumptuous thinking that they are greater than Our God. These are a people whom I do not trust. I have every right to state this. They have already made a bad name for themselves, thanks to Al Qaeda and Talibans.
    I will never forget specifically 9-11 and what I witnessed on TV that day. Whenever I think of what occurred and how much people suffered and those who died in the inferno It brings much sadness to my heart and tears to my eyes.
    Dominica and Dominican nationals are at risk with such people residing in their land.
    Magistrate Lewis is within his right to deny them bail. This is also to ensure the security of Dominica. They are indeed a flight risk.
    If they can sell passports and no doubt for an exorbitant sum of money (not yet proved but it appears so that they would not do this for nothing), they should be considered a flight risk.
    I have no empathy for traitors of all – to their country. They should have known better. People of their status with such an important and confidential position and a good future should have known better, selling their positions for some dollars. It is like selling their country, lives and souls to the devil.

The actions of these two individuals have damaged the integrity and value of our passports that were already under a cloud because of our persistence in them under the economic citizenship programme. Anyone travelling on a Dominican passport now will be subject to increased scrutiny. Pray this can be cleaned up soon and we will not be treated as pariahs.

    This case is not as simple as it appears and my guess is that this case will be swept under the table once the evidence start leading to trails that could make the government ( Plaintiff) uncomfortable. Corruption from the top trickles down in various ways and Dominicans red , blue and green know that there have been numerous unscrupulous passport transactions by those in authority. It should not be surprising that a few simpletons picked up on the trade and decided to get a piece of the pie. One blogger got it right – Monkey se Monkey do.
    It is sad that when people talk about the corruption in this passport fiasco part supporters claim that UWP or Freedom did it so it is OK for the DLP to take this corrupt practice to the next level.
    Maybe this occurrence will finally bring some reasoning and possibly expose the true nature of the passport trade – those who have benefited handsomely and the true identity of those criminals or terrorist parading as Dominican nationals.

    Here are my other questions:

    When the UWP sold passports, did they conduct the appropriate background checks before selling those passports?

    When the current government sells passports, do they conduct the necessary background checks before selling those passports?

    What agency (CIA, FBI, Scotland Yard, Mossad, French Secret Service, or Dominica Police Force etc) is conducting this background check if at all one is conducted?

    Which agency was conducting the background check for This particular operation?

    How many Criminals of international importance may now be holding Dominica passports?

    Does anyone realize how bad this can get for anyone holding a Dominican passport?

    WAW!!! We are getting large in DA…. Dem fellas trying to put us in the middle of the war on terrorism?

    I wonder what will be the US response if some of those passports were actually sold to al-Qaeda?

      if it’s a bad thing then how are they good people…….crime is crime ….. to many of us Dominicans think we can do crime and get away with it, because of who we are, which family we come from or because we dress professional, talk well and are in the public eyes….justice should be for all and not just for some….they go to church, play like they are good citizens but are willing to bend the rules for money and vanity thinking they are better than the drug dealer or “gangster ” on the street…..you see hard working honest people going to jail for smoking a little ‘joint’ in private, yet them high grade “white colour
      ” criminals always walk free…. How many times we hear about forgery in banks etc. yet no one get jail time …however poor folks with society looking down on them get jail for petty things…Justice should be fair…!!! In my opinion being a youth officer committing this crime should double your jail time..cause what message are we sending…..these people are suppose to be examples to our youth ..if they get away then it says to the youth that crime is the way….dress well , talk well , play the role and commit crimes with no penalty …cause I am covered…..wrong example…the law should come down hard….Where are our real role models….?????     I pray that one day we will all in this world realize that another person cannot answer for the sins of others when the Almighty places judgement on us. Whereas the Devil exist and initiates temptation, we have been given the right to chose. We act upon that right and most of us chose to do the wrong thing; or may i say the thing which brings trouble to us. They are innocent until proven guilty; and interestingly it is by the courts of Law.
    Dominica is not immune from the plagues of the world. I will continue to say that any nation which claims that they have no crime, these are the nations with the most; crime is not only a crime when it is reported. A criminal activity is something done in contrary to the Law. I have seen the people,s court and the Justice court liberate people who have done serious crimes and some people are jubilant while others build hatred aginst the persons.
    I feel sad about the situation my two partners are involved in, and let me tell them that if they are innocent the Almighty will take care of them. Even if man may condemn you, once you are innocent, no matter what you may go through, the almighty knows.
    But i will not uphold you in doing things contrary to the Law. I will not blame others for the acts that you have been alleged to have performed.
    I keep asking myself on a daily basis, why is it that some of us who blame other people for crimes committed by someone else, and yet, WE ARE NOT ENGAGING IN THOSE CRIMES ALSO. The answer I found out sits right infront of me; IT IS OUR DICISION NOT TO INVOLVE IN CRIME NO MATTER WHAT.

    Are we saying that because the country’s leadership fall over a cliff or stand in front of a moving vehicle to get run over we must do the same? I truly hope that this is not the message we are sending out there to the readers, particularly the youth. It would be ridiculous if the answer was “yes”.     This is very unfortunate considering that these two young men have served in reputable groups/council. I firmly believe that they were deceived and subsequently used. But as the saying goes, you gotta face the consequences of your actions – whatever actions they are. I sincerely hope that justice is done in this case because these are very serious allegations. One Passporrt is sold for $75,00.00 single and $100,000.000 family of 3. So who would not want to get involve in selling passport..An agent makes between $15,000. and $35,000.00 for selling one passport.. So this is the road that leads to that temptation..Passport seliing is the Biggest Job in Dominica Now..So I going to University to Study how to be an Economic Citizenship Agent and learn how to sell Passport… I in that..i am stil watching.

      I like the part about Chinese and Haitians having passports. I hope Dominicans don’t think that these two lambs to the slaughter are doing passport scam on their own!! It is impossible!! They are just being given a penny under the table. The people who getting the thousands under the table for the passport will never be taken to justice. A couple years back, there was another similar scandal involving a police officer and a civil servant. What happened to that case? The civil servant skipped the country and the police was reinstated and given all his salary back. Justice!! We cry about the small things to distract people from the big picture. While the lambs are led to the slaughter, the big fish will cover their tracks and run away.

      No one is rejoicing. Not at all. I just don’t like to see people condone wrong because is their family or friend. I am sure if these guys are honest with themselves, they will realize that maybe the shouldnt have gotten caught up in that in the first place.

      The time to express concern and sadness is not when they get caught by the authorities, but when you notice something is suspiciously different with the person. Especially if you are close to them, you will know. An unexplained change in their way of life. etc. We have to look out for our own and speak up when we think something is not quite right. Dont let it get to that point.

    Funny, when you have known someone for a long time, and ‘believe’ that they have good intentions.
    ‘Believe’ that person to be community minded, focusing on youth and youth development. Quiet and respectful. Only to hear of this on the street and then read, yes it is true. What a shocker.
    But what is even more daunting, is the fact that more and more people are ‘trying a ting’ or committing a crime, cause they realize so many are getting away with wrongdoing.
    It is a shame indeed.

    CORRUPTION filtering down and contaminating the youth. Dominica is up to its neck with all kinds of illegal, corrupt practices. People of ‘High Repute’ in Public Office commit acts and get away or through influence and unnecessary delays as regards the court system, justice is so delayed that people conclude that justice is being denied. Numerous examples could be mentioned. The famous ones in the public domain are the dual citizenship issue and the illegitimacy of the leader of the country as well as the Emmanuel vs. Isidore case (42 charges of alleged fraud and other criminal acts). Other serious matters include the Rubbish Bin and Fertilizer Bobols, the secret land deals etc. etc. etc. Those acts were done against the law, yet no investigation, no court, no nothing.

    The younger folks seeing and hearing of those criminal acts being done and nothing happens to the BIG BOYS feel that they could engage in illegal activities and escape too from the Law. It is they the youth, who will be dragged to the courts, fined, and/or jailed. The majority of youth very often will have nobody to protect them like the BIG WIGS. They will face the wrath of the courts. But what about that dual citizenship case involving Skerritt? The Law states clearly that such matters should be dealt with EXPEDITIOUSLY. Is that justice. Isn’t that absurd that those responsible to uphold the law are doing the exact opposite?

    Why are a FEW people, within the Legal and Political systems, doing those injustices to an entire nation? After almost 18 months Dominicans still do not know who their legitimate leader is? Are those the signs of a LAWLESS STATE? What about the Emmanuel vs. Isidore case? Same delay after delay after delay? What about the subsequent fire-bombing of Emmanuel’s home? GO Slow? reluctance? Is that JUSTICE? Is so Dominica come? Protection For the Boys at all costs irrespective of what criminal acts they commit? How could any one of those in authority convince the youth about staying away from crimes? What MORAL authority would they have?
