The Organisation of Eastern Caribbean States (OECS) has drafted and submitted to Member States five (5) harmonized Family Bills namely Children (Care and Adoption) Bill, Status of Children Bill, Juvenile Justice Bill, Domestic Violence Bill and Maintenance of Children Bill for consideration.
The Maintenance Act, Chapter 36:61 provides for spousal maintenance, parental maintenance and maintenance of children.
The Draft Maintenance of Children Bill 2017 provides solely for the maintenance of children. A repeal of the present Maintenance Act, Chapter 35:61 would mean that the obligations to maintain spouses and parents would cease to exist. It therefore became necessary to consider a new Draft Maintenance Bill. The coming into effect of a new Maintenance Act would mean that the present Maintenance Act, Chapter 35:61 would cease to exist.
The Bill for consideration, the new Draft Maintenance Bill would provide for the maintenance of spouses and parents and for other related matters.
Consultation on the Maintenance of Children Bill has already taken place with the coming together of stakeholders from various institutions/ agencies and civil society.
The Ministry of Social Services, Family and Gender Affairs invites comments from institutions/agencies, representative organizations and members of the public on the provisions of the Draft Maintenance Bill.
