Dominican attorney Cara Shillingford-Marsh has secured yet another victory at the court, this time against the government of St. Vincent and the Grenadines.
Earlier today, the High Court in St. Vincent and the Grenadines ruled in favour of nine employees who Shillingford-Marsh successfully argued were wrongfully fired by the government when they refused a mandate to take the COVID-19 vaccine.
This case arose out of legislative measures enacted and implemented by the Minister of Health, Wellness, and the Environment in SVG in response to the COVID-19 pandemic.
During the pandemic, the Ralph Gonzalves government fired more than 300 public sector workers over their failure to take a COVID-19 vaccine, as mandated by Cabinet. However, in handing down the decision, High Court Judge Justice Esco Henry said the legislation by the government was unconstitutional.
Six individuals: primary-school teachers Shanile Howe and Novita Roberts; Cavet Thomas, a senior customs officer; Alfonzo Lyttle, an assistant supervisor employed with the Customs and Excise Department; Brenton Smith, a station sergeant of police and Sylvorne Olliver, a corporal of police, brought the lawsuit against the government.
In her judgement, Justice Henry further ruled that letters issued to the claimants, including letters issued by the St. Vincent and the Grenadines Community College, violated the Constitution.
The judge also said that none of the claimants ceased to hold the public offices to which they had been appointed and held at the relevant times, and they remain entitled to all of their full pay and benefits due and payable to them, including pensions.
“The crown is liable to the claimants for any damages, including interest of 6 percent per annum,” the judge ruled.
The claim was brought against the Minister of Health and the Environment, the Public Service Commission, the Commissioner of Police and the Attorney General in St. Vincent and the Grenadines.
The lawyers who represented the Claimants are Cara Shillingford, Shirlan Barnwell and Jomo Thomas.
Senior Counsel Anthony Astaphan who represented the Minister, the Attorney General and the Police Commissioner, had unsuccessfully argued that SVG was justified in its decisions to dismiss employees who failed to comply with the vaccine mandate.
In response to the judgement, Prime Minister of St Vincent and the Grenadines Dr Ralph Gonsalves, said he is optimistic that the judgement may likely be overturned in the Court of Appeal.
“We have given instructions to them to appeal,” he disclosed. “In fact, they orally indicated that they would appeal. The government is satisfied that our actions were lawful; we were so advised, and this matter is too important for us to just rely on the judgment of one judge in the first instance… let’s hear what the Court of Appeal thinks.”
He concluded, “I have been advised by Senior Counsel in this matter and I have accepted that advice, that there is a likelihood this decision will be overturned at the Court of Appeal and I am satisfied from the standpoint of our actions, we saved lives and livelihoods.”
Labour rights advocates, the SVG Teachers Union, Public Service Union (PSU), and Police Welfare Association (PWA) sponsored the lawsuits.
The verdict of the judge was made one day before the island’s commemoration of National Heroes Day.

Global Case Fatality Rate (for COVID-19) = total # of deaths / total # of confirmed cases x 100
Global Case Fatality Rate for COVID-19 (as of March 15, 2023 using WHO figures) = 6,866,434 deaths / 759,408,703 confirmed cases x 100 = 0.90%
In simple terms, 0,90% of all confirmed cases succumbed; 99.1% of all confirmed cases as recorded by the WHO survived COVID. Of course one death is unfortunate & my condolences to you & others who lost family members.
Further analysis needs to be done re: the deaths attributed to COVID as there is a difference between dying FROM Covid & dying WITH Covid. There are speculations in some circles that Covid may not have been the direct cause of death in a number of deaths claimed to be covid deaths.
