No charges filed against female driver involved in fatal crash

Police Public Relations Officer Inspector Claude Weekes said no charges have been filed against the driver involved in the country’s first road fatality of the year.

Weekes said the investigations into the Jan. 5 accident in which 44-year-old Kirk Ian Didier died is still ongoing, and cannot be classified as a hit and run at this point.

Didier was struck by a Nissan car in Silver Lake at about 5 p.m on Wednesday, Jan. 5 while walking along the road.

“He sustained head injuries and was transported to the Princess Margaret Hospital for medical attention. By 6:30 p.m. he succumbed, and was officially pronounced dead by Dr. Andrew,” Weekes said.

Reports are that the driver of the vehicle, a female residing in Shawford Estate, did not stop immediately after hitting Didier, who was left bleeding profusely on the road for some time before the ambulance arrived.

Weekes said all reports are being taken into consideration, and until this investigation is completed as well as a coroner’s inquest, no further action can be taken at this point.

Every time you get into trouble and the law have to get involve you then your husband and other close person says you have amnesia, Lisette you know that is not true.     I just knew that Weeks is no different from the rest of the Big Boys in the Force!!!!

    He gave the appearance of BALANCE with the Bubbles Gun Matter but we all see him falling just like the rest in this Death by dangerous driving or Death by careless driving leading to the death of a human being.

    You so know the law where firearms are concerned where nobody got physically injured yet basic and routine police matters like traffic violations are not known to you well enough!!!

    I am left to wonder if some senior law enforcement officers saw the Bubbles case as an opportunity to raise their personal profile in the eyes of competitive political parties in the hope that one day they may be rewarded with status of commissioner and other prestigious titles.

    Where is the justice for a man or woman with lucks on their head in Dominica? Up to now we still treating people with lucks on their heads as second class citizens? It is over 30 years since we as a country was confused with our young men and women who took up to the Hills of Zion and we the rest of the society stigmatizing their families as failures when their kids became Rasta and Dread.

    Have we taken the time to fully understand why this period came about? Have we harvested the full benefits of this period?

    Dominican people just before the era of Independence in Dominica we had a group of young intelligent sons and daughters of the soil who saw the downside to social and economic segregation and wanted to effect a lasting change, a change that would bring the coming together of rich and poor persons as their brother and sister keeper!

    Change always brings initial unrest of all kinds. In a society there is the typical group dynamics chaos among members trying to define the identity of the group and the wider society suspicious of the intentions of the new group and the compromises that must follow – recognition, acceptance, new norms, power sharing, and revised agendas!!!!

    Alas , the Labor Government of the 1970s were badly advised and the Opposition fearful of a revised social agenda that would see them loosing the most exploited the crisis to gain political power for over 15 years post Independence.

    The UWP came in between July 1995 to January 31, 2000 but was just another pair of khaki pants (6 of 1, half a dozen of the other).

    By then the original movers and shakers for change in Dominica got lost amidst other political parties. And so Rosie and Pierre Charles sold out the masses dream for meaningful change in Dominica.

    Finally today we see the first generation of a Rasta man’s son as Prime Minister of Dominica and yet again the dark forces in the Opposition with the most to lose are trying the same old tactics of divide and rule to prevent the revised social agenda – equal access to lands, education, social welfare, jobs, health, good roads, air access, and security.

    The revised Social Agenda for Dominica has started and all stake holders including the Police must get on board and be part of the Program. Skerrit being the Son of a Rasta man must go beyond the symbolism and lead to new and improved norms of behavior for the benefit of the masses of Dominica.

    It is taking much too long being in the storming phase of this revised social transformation that we all long to see Dominica enjoy. Opposing political and civic groups are not prepared to yield to a spirit of compromise though much has been achieved – for example the establishments of new Institutions like the Broad Base IPO, ECTEL, the IRC, and Laws governing the Legal Profession. Much more awaits – revised electoral list, Voter ID Cards, Office for the Leader of the Opposition, the tapping of the Diaspora Potential in the areas of managerial capacity, investment, overseas missions, and participation in elections. These outstanding matters are not beyond our collective intellectual capacity to achieve for the benefit of the Commonwealth of Dominica and its citizenry to achieve a period of phenomenal advancement in Dominica going beyond the Next Level to the realm of a First World Environment.

    We need to accelerate beyond the Next Level simply because of the amount of time that has already been wasted there will soon be another Social Upheaval wanting to bring Dominica to First World Status and our Political Parties in Opposition with the Most to lose will highjack the Revolution of our children and we will have three generations of post Independence people wondering why we do not seem to move forward at a faster rate.

    what i suggest is this

    before someone obtains a drivers licence this person should do a course in first aid and how to assist in the event of a road accident

    belive me if this is carried out i am sure there will be less accidents and death resuting from vehicle accidents
    Most people will agree with me thta some persons aquire driving licence without even doing a test just because the officer/s incharge is some kind of relative or knows the family

    secondly i beleive Dominica should have an emergency flying ambulance to fly persons to nearby islands for emergency medical care, if we dont have this in dominica

    the police force in dominca are a complete joke. you hardly ever see them patrolling the streets, when you do see them, every one is their ‘partner’ , they stop and talk at the corner of the street, completly unprofession. they command no respect, and they deserve none. no wonder there are so many murders, because out of frustration and total inaction from those jokers people take the law into their own hands. inspector weeks then comes on the media and spills out the same old gabbage, about one bad apple, no, not one bad apple but a barrel full of bad apples.
    we are forever being told that x amount of new police officers are being trained, but where are they, they seem to be invisible. another things you see the police cars being drive, i must add rather recklessly on most occasions not carrying out police duty, but for the personal use.
    please for 2011, police inspector get your officers to behave in a more professional manner, and do the job which they are being paid to do, because if you don’t the number of murders will be even higher and that would be very sad for all concern. yes, there will always be murders, but some of those murders could have been avoided had the police done their duty.

    We will never know if the driver was drunk, or broke the laws of the land in the form of;
    1. Driving without Due Care and attention (a crime a crime in Dca)
    2. Dangerous driving (a crime in Dca)
    3. Leaving the scene of an accident (a crime in Dca)

    The two first offenses are indictable and the police should have at least let the lower court decide if a crime was comitted instead of “refusing” to file charges. A smell a BIG cover-up somewhere along the lines. Mr. Commissioner we need to hear from you instead of the PRO. This one is smelling real bad and heads must roll.     If the allegations that the vehicle was unlicensed, and that the driver failed to stop but instead went to find an attorney BEFORE showing up at the scene ARE indeed correct, this is a VERY DISTURBING development….Leaves us all to wonder.     Please read again.. It’s not that she will never be charged. SImply, some procedures must be followed first. According to the article above : “Weekes said all reports are being taken into consideration, and until this investigation is completed as well as a coroner’s inquest, no further action can be taken at this point.” Apart from this, do you know whether the information in the comment by PETERSON is accurate? Just a thought! I am sensitive to the fact that a life was lost and if you kill someone you should pay for it, just that I think in this case, we should allow the police to do their investigations first.

    I think the lady just panicked…nevertheless the right thing to have done would have been to stop and then at least call an ambulance..same thing happened here in Antigua a few days ago and the driver killed the young man about 5:30 AM…he didnt stop either, but turned himself in a few hours after…i dont think he has been charge up to this day…

I have been away from Dominica for so long, I cannot even visualize where Bath Estate is. Now, up until she reaches Bath Estate, she can remember what she did; still with the state of mind to call the police and to call her lawyer. Would she not have to tell the police and her lawyer where the accident took place? Up to that point, her memory is still working isn’t it? She went back to accident scene with her lawyer.

    It is clear that the accident is a “hit and run” crime; another Life has been lost. Declaration of memory loss? Oh no! According to MOTS, “lady” not before the judgment of God. Please do not take this to your grave, especially if human beings never charge you for the crime. Your victim is now a “dead man”. You cannot ask him to forgive you, but God is willing to forgive you on his behalf. However, you need to show some form of remorse before your God, who is also your victim’s God and our God as well.

    My people the key words here are NO CHARGES HAVE BEEN FILED. Let us wait and after investigations are completed then we can accuse the police of not doing their jobs. As far as I can see there are several offences that have been committed, and am guessing the police are not that

    To many driver speed in the communities, when they no there is a speed limit, the lady was going to fast (as most drivers do)

    any conscience driver would stop to asses the scene, she have no heart to continue driving and leave a human being helpless on the road..

    I listened to one of the eye witnesses,giving an account of what happened,and from a laymans standpoint,the lady did not stay anywhere close to the spot the accident occurred.. This to my layman knowledge fits “HIT AND RUN” 1..Why did she return with a lawyer? 2. How far away did she get the lawyer? 3.Was the lawyer a passenger on the same car? 4.Why she did not have the courtesy to even stop and look at the man on the ground? 5. Was the man an animal?
    THIS LADY SHOULD HAVE SEVERAL SERIOUS CHARGES INSTITUTED AGAINST HER? Was the man a dog??? LET’S NOT BRING CURSE UPON THIS COUNTRY….PUNISH HER !!!!!!!!!!!!!!

    Isn’t that the guy who sells the jellies? He is a cool & quiet guy. I do not know whether he was a drug user, but he certainly did not appear to me as someone without control of his faculties. The news reported him almost as a stray dog. Homeless & under privilege people have rights and I must dare say “equal rights”. They are human beings.

    Accidents do happen & so the driver should explain what happened on that fateful day. If the vehicle was not licensed or insured, then the driver would have personal responsibility for the life of another (sad but real). The road in that area does not provide adequate safety for pedestrians, so maybe its time to put some “speed bumps” to control the traffic there.

    Let’s pray for our country – It is one too many unfortunate incidents: murder, violence, accidents, deaths, political, family, religious & personal strife.

    By the laws of Dominica if the person is dead after the accident the then ‘murderer’ should be arrested….I personally would like to know what excuses she is going to give as to why she didn’t stop when she ‘thought she hit something’ :-? . Any sane person would immediately stop the vehicle and investigate. I REFUSE to believe that she could not make out is a human she hit….that loud thud could not have been a speed bump….She needs to be held accountable for her actions, she knew damn well she needed her lawyer anywho.     In the event of any road accident where a person is injuried the emergency services should be called e.g Police, Ambulance and if necessary Fire. No evedience should be tampered with untill the law arrives. Secondly that woman knew she was driving without the proper documents and the car was not belonging to her. Inspector Weekes I do listen to his programme on a Friday evening and the advice he gives to the drivers should have digested in that woman mind as part of her family the law prevails there. I do not understand she cannot remember what she had done but she brought her lawyer with her and not only that she left the guy dying and called the emergency elsewhere.
    She is as guilty as daylight and if this was in England she would have been arrested for the simple reason she left the scene of the accident and that is contempt of law.
    Inspector Weekes I admire him all the way in England and we too have family members working for the metropolitian police and we know this woman should be in custody right. Rough Justice.. Hit and Run alright that is what has happened and there is no need for her to defend her actions .

    The driver did not stop to check up on the person that she hit. Head injuries are very serious and the driver should of stop. Animal or person one should stop to see the seriousness of the injuries.
    One can not leave the scene of an accident. This is considered hit & run. She her self could of called the ambulance thats why he was bleeding profusely. THIS IS MURDER!!!!!!!!

    I am always saddened to hear of fatal crashes. It is a God-given precious live which is lost, never to return which cause much grief for specifically relatives and for years.
    May his soul rest in peace. My heartfelt sympathy to his family and friends.
    Why did the other driver not stop immediately? Did she not know that she struck someone? Speeding too much I suppose? Just speculating.
    If drivers who speed and cause injuries to the point of maiming and fatal crashes should comprehend that they are responsible for same and should pay the full price of their actions.
    I always endorse, drive safely! If you drink, do not drive. If you drive, do not drink.
    There is no need to speed for you do not know who and what is around the corner and stick to your side of the road. Drivers are constantly warned about that.
    As it is stated in this article, the police is investigating. In time it will be proved who may have been at fault.
