Bail denied for two Fond Cole men charged with murder

A 24 and 23-year-old are remanded in custody at the Dominica State Prison following a charge of murder preferred against the Fond Cole men by the police.

Tyrone Theophille and Jervon Vidal now stand charged with the murder of Pascal “Neg” Frederick of the Kalinago Territory who resided in Fond Cole.

Pascal, who is Dominica’s thirteenth homicide victim, was discovered in an unresponsive state with a puncture wound to the left side of his chest on the floor of a shop at Fond Cole at about 7:00 a.m. on July 18, 2022.

Following an investigation by the police, Theophille and Vidal appeared before the Roseau Magistrate court on July 28, 2022, where the charge of murder was read to them.

The accused men were not required to enter a plea as the matter is indictable and is expected to be tried at the High court before a Judge and jury.

After the charge was read to the two men, defense attorney Wayne Norde attempted to sway the court in granting bail to his clients pursuant to section 7 of the bail act.

In his bail application, Norde said it is in the public’s interest to grant bail to the young adults as according to him, they  should not be remanded in custody for their own protection.

He further posited that there was no threat against them by anyone in the community nor are they a threat to any member of society.

The attorney gave the assurance that his clients will surrender to custody, will not commit any offense while on bail and will not interfere with any of the state witnesses.

However, in response to the defense bail application, acting Director of Public Prosecutions (DPP) Sherma Dyrample, told the court that it was not in the public’s interest to grant bail to the accused men since the firearm used to commit the said offense has not yet been discovered by police.

The following day, July 29, in handing down his decision, Magistrate Michael Laudat referenced several case laws which he said assisted him in his ruling.

He reminded the court that in keeping with the new bail act, a person charged with a serious offense is not entitled to bail as a right unless there is just cause in doing so but the prosecution must provide substantial grounds for their objection to bail.

Albeit, Magistrate Laudat ruled that it is not in the public’s interest to grant bail to Theophile and Vidal and remanded the men in custody at the Dominica State Prison.

“There has been a wanton use and abuse of unlicensed firearm use to commit serious crimes in the state,” the Magistrate stated. “This in itself is… a serious threat not only to public order but to the country’s national security.”

He informed the accused men that they are free to apply to the High court for bail.

The matter was adjourned to December 5, 2022, for Preliminary Inquiry.

I myself telling her is fake news because Tyrone still under medical treatment and other treatment given by a DPP only to come here and read this article with a Tyrone Theophille for real. :mrgreen: :mrgreen: :mrgreen:

    So what is the relationship between the two because I myself well confuse because the West Indies one is not that old to have a 23 years old son unless he started breeding at 12yrs :mrgreen: :mrgreen: .       There is no way that there is only one Tyrone Theophile in this World. I am not the only Elizabeth Xavier, in Dominica, without my middle name.

      Since no guns are manufactured in Dominica, it means that the borders are very porous. A government’s #1 priority is to protect its inhabitants and their property. National security should get the most attention.

      In Dominica, instead of National Security, we have National Insecurity. Here is the indisputable supporting evidence.

      There is an unprecedented proliferation of guns, murders, child sexual assaults, rapes, kidnappings, robberies, wounding with intent, and praedial larceny gripping the country.

      Roosevelt and his intellectual pigmies are at a loss as to measures to be taken to arrest these rapidly developing existential threats.

    Is it poverty, idleness, illicit drug dealings, gang warfare, vengeance, a sense of hopelessness? What is it, all of the aforementioned?

    It is said that ‘Poverty is the mother of crime’. Is this applicable to Dominica? Just asking.

      Dominica has always had its share of poverty. I have live long enough to remember when there were years where there were no murders in Dominica and the odd time it happened, it was a MAJOR story on the island. Now we have 13 homicides and the year is not even over yet.
      There is a different mindset among our youth where they place less value on human life. They are more materialistic and are influenced by cultures and norms that are foreign to our country. They are emulating those foreign cultures that are leading them down the path of destruction.

      Ibo France, and I am answering to your “It is said” observation.

      I grew up in Giraudel in Dominica, where I know no one who was or is rich today.

      My father was poor man, working for a Farmer for $5.00 a day, when I was growing up. I am his eldest daughter, through my mom, his wife, for 50 years, before they passed away, 2013 & 2014.

      He worked to raise 10 of us, 2 sons & 8 daughters. Today, if you go to Giraudel, you will find my 2 brothers and 6 sisters, with their own homes and family. One of my sisters and I live in Toronto.

      I have a huge number of relatives in Giraudel, living by God’s grace of harmony, peace, and the strength He gives to us to seek and find for ourselves, as we walk in His Love

      Crime committers are carnal minded and lazy; God’s enemies, dead from His Love. Poverty is not the reason for their crimes

      It has nothing to do with Poverty…Men choose to live like this. Fast life and drugs. Want to impress these girls. Designer stuff. Quick money My mother had 9 of us my dad left and she had seven no father until she got married. He went overseas and never came back. My mother instilled respect, hard work into us. We had no food most of the time and the only time I see candies was on Christmas Day. We worked very hard and whatever value she put into us and God we all turned out very well and financially stable. Stop blaming everything else. These young people have no respect and no care for life. They are following the USA fast life. God bless them and hope they will realize that you live by the sword and die by the sword.

        I grew up VEGAN most of my life before Veganism was popular. WHY? because we could not afford meat maybe on Sundays. We made our own bread and our own oil Coconut oil free of Saturated Fat. Wen had our own chicken and God knows how many two eggs would feed. You want to talk about Poverty but this life was very healthy. No fridgerator we grew our own foods. Ok Now I really appreciate this life style. Again has nothing to do with POVERTY…IBO you seem like you were rich growing up with a good education so please stop making excuses for these young THUGS.. Stealing and stealing and killing.

    It’s a good thing that bail was denied. The murder accused must not be given an opportunity to freely roam the streets.

    However, this trial will come to its final conclusion five or six years from this present date. Delayed justice is injustice. Our judicial system is a colossal failure.
