Colihaut man fined over 50k for causing injury to nose with stone

Hefty fineA 27-year-old man from Colihaut, Kelver Aaron, who was found guilty on October 29th, 2015 of causing grievous bodily harm to Myrone George of the same community in March of 2014, escaped a jail sentence but will have to pay over fifty thousand dollars in compensation to George.

According to the facts, on March 02, 2014, at the opening of Colihaut Carnival, an altercation between Aaron and George resulted in Aaron throwing a stone at George which struck him on the nose. As a result, George had to be transported to the Princess Margaret Hospital (PMH) for medical attention and was seen by ENT, Dr. Irving Pascal.

In his report, Dr. Pascal said Myrone George complained of facial pain, epistaxis (bleeding from the nose) and decreased sensation to his left cheek and upper lip. “On examination there were multiple abrasions to the nasal pyramid and left cheek with surrounding swelling and tenderness. Nasal airway patency was decreased bilaterally. There were no palpable bony abnormalities, but sensation was decreased in the distribution of the left infraorbital nerve,” the doctor stated.

The report continued, “CT scan of the orbit/facial bones revealed a depressed fracture of the inferior and medial wall of the left orbit, displaced fracture of the inferior right orbital wall. Multiple displaced fractures of the left maxillary sinus and multiple fractures of the nasal bones and septum and left frontal bone. The globes and external muscles were normal in density and position.”

Dr. Pascal said George was treated and sent for reconstructive surgery. George then traveled to Barbados to have the surgery. Aaron’s lawyer, Peter Alleyne, told the court that he was grateful that George agreed to be compensated. He also commended State attorney in the office of the Director of Public Prosecutions (DPP), Fernillia Felix, for her research and work in the case. Aaron, he told the court, was a hard working poultry farmer and was “remorseful for his actions.”

George had submitted his medical bill and expenses which amounted to EC$32,470.00 to the court. He was awarded that amount and for pain and suffering $20,000.00 a grand total of $EC52,470.00 plus interest at 5% from the date of the decision.

He has one year to pay and in default, one year in jail. He was also told that if he pays 50% or more of the amount and is having difficulty in continuing his payment, he can apply to the court for an extension.

    I just wish that they’d stop picking on people from Colihaut.

    Colihaut is a great place and it and its people deserve more respect.

    I know about the fight seeing that i was there.
    Kever was only defending himself cause the other guy hit him first and also confest for doing so.
    I am not supporting him but there is two side for every story.
    Kelver is a real struggler and the whole of Colihaut knows that, helped put a roof over his mother’s head, try to open his bar and selling his eggs. And the other guy is yet to accomplish anything.

    It is good to see people being held accountable for their actions. The only change I would suggest is the potential jail time increasing to 2-3 years in order to incentivize payment of the judgement as soon as possible.

(COME ON PEOPLE WHAT IS GOING ON WITH OUR JUSTICE SYSTEM)????????????? that’s a joke.

    Some people cannot disagree and argue without using some sort of weapon or the other to inflict injury and pain on their fellow people. That stone could have injured other people.
    He needs to take an anger management course. Flinging a stone at another could have killed him. Fortunately for the man he recovered to a certain extent.
    People must avoid arguments and heated ones. When they are wrong, they must admit it and learn to say, “I am sorry. Please forgive me.” This could avoid a confrontation, hatred and enmity, even injury or death.
    Consider the cost, $50,000. It is a lot of money to dish out for the second or minute that he lost his temper and threw the stone at the man, injuring him. That amount of money could set him back for his lifetime. He has much to regret. He still has to apologize to the man, be it through his lawyer.
    Holy Scripture tells us, “Love covers a multitude of sins.” It is a godly virtue to practice as God is looking on.

    No Jail?? That’s bull crap!! So as long as I can pay the fine, I can injure or hache anybody I want and doh take ah jail? Ridiculous!! But what about Punitive Damages? Shouldn’t he have to pay the State/Society for disturbing the peace/breaking the law in addition to paying the victim? No wonder man going in woman workplace and hacking them with cutlass…they feel they can just bankroll their crime and still be home for dinner, not to mention the “Bad Man” cred they get for committing such brutal crimes, a win-win for those criminals. I tell you, Dominica is the “Alice in Wonderland” of justice systems.

      I do not think that is the message which was sent. The man is a farmer and so I suppose he was given the opportunity to pay the fine. It is punishment for him that he has to pay over $50,000. I wonder if he will be able to pay the full amount If he does not pay it he will be sent to jail. This is only for one year, failing to pay it. It is not stipulated that if he does not pay the full amount without the Court’s permission/approval, that he will not be sent to jail for a longer period. This is how I view it.
      Consider, if he is unable to pay the full amount, I would think he will have to produce a statement of his income and expense to the Court before it is approved. Think beyond.

    The court is charging the accused over 52 k’s in default, he has to spend one yr. in the State Prison. The accused, I would think, would rather spend the year in prison than paying the fine. Its good to know that the victim has recovered from his injuries nicely and is doing well. People on a whole should learn to settle their differences, rather than resorting to violence.

      Are you kidding? Over $50,000 or one year in jail? Re-read that section again, “in default”, one year in jail. This is for not paying it for the year as set by the Court. Do you think he will get off Scot Free with only one year in jail for not paying $50,000?

        This is what I concluded. He will not get away with being jailed for only one year if he fails to pay the amount within the year. I would think he will be imprisoned for some years, if he fails to pay, if not for his lifetime.

      he is not owing the court he is owing the man. the one year jail is for disobeying the court order to pay the man so if he fails to pay he goes to prison for a year but he must pay the 52k . when he gets out of prison the guy inform the court that he havent receive compensation he is taken back to court they give him another date to pay if he fail to pay by the date prison again and this could countinue until he pays
