FULL STORY: Renneth ‘Bubbles’ Alexis found guilty; defense appeals

At about 5 Tuesday afternoon, Bay Street in Portsmouth resembled a  carnival Monday as hundreds of persons and curious onlookers converged outside the Magistrates Court in Portsmouth with another 30 inside the court to hear the verdict of  Magistrate Tiyani Behanzin in the case of the State against Renneth  ‘Bubbles’ Alexis.

At just before 5:45 pm, all the speculation was brought to an end when Magistrate Behanzin found the Portsmouth businessman guilty on three charges: intimidation, possession of unlicensed firearm and possession of ammunition. The defendant had conceded earlier in the trial to the charges of possession of an unlicensed firearm and possession of ammunition.

In delivering his judgment at the Portsmouth Magistrates Court Tuesday evening, Magistrate Behanzin said that “while the court agrees there was some  level of provocation, the court does not believe he (Renneth Alexis) could have held the gun in such a controlled manner”.

Under cross-examination, defence witness, Lovell Ravalier, had said earlier that her “uncle” Renneth Alexis held the gun at the time of the incident at his side, up and down at waist level.

Magistrate Behanzin told the court that the “defendant may have overreacted”. The magistrate asked whether there was a need for a weapon and suggested that Alexis was never under any threat.

“Even if they were on your property, you should have assessed the situation,” Magistrate Behanzin told the court.

In mitigation, lawyer for the accused, Heather Felix-Evans, pleaded with the court for just a reprimand for her client. The defence attorney told the court that her client had been very cooperative with the investigating officer from the start. She explained why the firearm in question had not been licensed at the time of the incident.

Felix-Evans spoke at length about her client’s exemplary qualities and his success as a provider of employment to many in Portsmouth.

“Renneth is god- fearing… one of the biggest employers in the district. He is a successful businessman. He may be among the most successful businessmen of African descent in Dominica.

“He is a first-time offender,” she said, he has never been charged before. The evidence is that some of them trespassed on Blaircourt property. He was not an aggressive person. He was sleeping. Just the fact that 15 persons, uninvited, are on your property is and of itself a threat.  All these are considerations for which credit should be given to the defendant. If the court is to give any sentence, in the circumstances, a reprimand would be more than sufficient as a penalty.”

Despite the plea in mitigation by the defence lawyer of Alexis, Magistrate Behanzin found Alexis guilty on the charges of intimidation, possession of an unlicensed firearm and possession of ammunition.

On the charge of intimidation, Renneth Alexis was fined $2,800 to be paid by November 20, 2010 and in default six months in jail. On the charge of possession of ammunition, there was no separate penalty. On the charge of possession of an unlicensed firearm, Alexis was fined $1,000 suspended for two years and in breach six months in jail. The firearm of Alexis is also forfeited.

Within seconds of handing down his guilty verdict, Felix-Evans and flanked by Attorney Stephen Isidore to her left announced her decision to take the matter to the Eastern Caribbean Court of Appeal. Appeal papers and recognizance were signed by Emmanuel Nathan and Pastor Bernard Joseph.

While stating that the matter of the ownership of the villas at Savanne Paille and Blaircourt Property Development Limited were not the focus of the trial, Magistrate Behanzin told the court that based on the transcripts of the trial, the appropriate prosecuting authorities should look carefully at  any potential opportunities for investigation.

    i am proud of our magistrate and the good job that he is doing in our country,mr alexis as a christian should have used other method ‘call the police or something , the devil seeks to destroy believers , so you must be on guard at all times .but what i dont understand ,why an UNLICENSED FIREARM? he choose to get that that kind of attention so he deserves to pay the fine. he has a business so i am assuming that he would be allegible to own a reistered firearm. mr bubbles do the right thing . you know how christianity is taking blows so please dont give people more to talk about .God has blessed you tremendously, we all make mistakes, he forgives and wants us as belivers to also obey the laws of the land

    This case bothers me

    If he is the owner he has the right to defend his property against un-welcomed trespassers,
    therefore “No Intimidation Charge”

    But if his is just a property manager disguised as sole director of Skerrit “Blaircourt” Property,
    waving an unlicensed gun at citizens investigation fraud, then, the fines should have been higher.

    Now as a businessman, the gentleman should be allowed to keep his gun. From my personal experience, police arrive after the fact in Dominica. So if you feel frightened, you either have to run and hide, or beg for mercy from perpetrators. In America, police response within 20 mins on average – what the average in Dominica? 2 days?

    Lets get real – was his gun originally licensed, and he failed to renew his permit, or was it an illegal gun, he bought from god knows where, and never registered with police? If it’s an illegal gun, he should be going to jail, if it’s an unlicensed gun, then it’s just a slipped in judgment, $10,000 fine, he keeps his gun.

    Dominica needs businessmen don’t scare them away. But please investigate who owns Blaircourt Property, inquiry minds want to know!!!!!!!!!!!!!!!!

    I applaud the magistrates handling of this matter. He seemed unmoved by all the attention that was given to this case and delivered what seems like a reasonable sentence, all things considered. The defendants character and exemplary history would have weighted on this decision as it should. Putting my emotions aside, I feel that he has been justly fined.
    I question the strategy of the defence to appeal because I believe that a higher court acting without the pressures that the local magistrate was subjected to, may very well deliver a stiffer sentence. This is only my opinion and so I keenly await the ruling of the appeals court.

    How long ago did PM Skerritt announce to the Nation and the World that any one found with an unlicensed firearm, draconian action would take place because of the increase in crimes? The person would be JAILED, with no questions asked? NOTE WELL, he did not specify, WHAT CLASS of persons, or which Party he supported or who those persons friends were that would be jailed. Dominicans, the records are there to prove. How many youths now in jail for the pettiest of crimes?

    TWO YOUNG SISTERS from MASSACRE, AGES 13 and 14 were put in JAIL, YES in the STOCK FARM JAIL AGES 13 and 14. REPEAT AGES 13 and 14. THEY SAY the two sisters WERE BEHAVING BADLY. Placing an UNLICENSED GUN to the head of someone is a lesser crime in Dominica. The culprit is charged $2,800.00. The POLICE was ‘RIGHT’ to give the Guy the unlicensed gun back, after it was taken as EVIDENCE by POLICE of the same FORCE or institution . NO SIGNATURE by the culprit ON RECEIPT of that gun. The Police Officers who confiscated the gun and brought it to the Police Station were all wrong. So Dominica come, nuh?

    The Ag. Commissioner proudly, boldly, indicated to Dominica, the Region and the World at a Press Conference that the Prosecutor was wrong to retrieve that same GUN, the Evidence, not the police who gave the gun back without signature. The Prosecutor truthfully cleared his name saying,’ It was the court which demanded that the Gun, the Evidence MUST be brought back to the Police Station as EXHIBIT for the CASE. Sounds like a fairy tale story, Right?. Top Police Official Preaching LAW and ORDER, RIGHT? Preaching respect and obedience for the laws of the land, RIGHT? Those are the FACTS of the matter. Dominicans, do you all love this beautiful country and really want to reduce CRIME? PLEASEEEEEEE TAKE TIME TO THINK THAT OUT. IS So life come in Dominica nuh?

    Bubbles will prevail!! Behanzin is a good man with a political axe to grind. Unfortunately, he has allowed the dishonesty of Lennox and Trevor to get the better part of his judgment.

    I’m convinced that Lennox has some serious self esteem issues. He is so obsessed with the PM that his hatred for him has clouded his judgment. So far he has accepted all the crap (doctored e-mails) that Trevor has provided him as the gospel truth when everyone knows his track record. As i have always said, he is the only one able to come up with the so called evidence. I’m actually starting to feel sorry for him. This man is simply sick and someone needs to save him from himself. I hope that DA sees him for the desperate person that he is.

    No matter what they try, the truth will come out and the handful of Skeritt haters will realized that the Bubbles case is just a lousy attempt to get at the PM. The prosecution in that case was untruthful as one could ever be but time will tell and heads will soon roll. Bubbles is a good man and must not let the detractors through him off course. I say to all the haters do not allow yourselves to be fooled anymore. The truth is beginning to come out and the detractors are feverishly trying to lead you astray. DA remain focused and let us build our beautiful country. These loonies are being ignored by all because they are simply a propaganda machine or entertainment.

It is true that you are a young adult and that you are overseas. For your good i hope that you never overlook the fact that your place and status of residency in anothers land exempts you from the punishment of that country. For your sake you better walk the straight and narrow, you better be the most law abiding (citizen) that you know, and never be met with contension self inflicted or not that puts you before the law of your new (citizenship).     @gwatanse: I have been a licensed firearm holder since 1985, long before Mr. Alexis and always know that when you draw your firearm you have to be prepared to use it. If I have a concealed firearm, it should be concealed and not brandished in the open. I am only supposed to expose it when I see my life is in danger. He said in court that he never felt threatened. His niece said that she never felt that their life was threatened. Alexis did not follow proper rules of engagement and does not deserve the privilege to hold a firearm.

    ok so the firearm was unlicensed and he got charged for that and that i understand. every citizen regardless of social standing must respect and appreciate the rule of law……but what of the intrusions? what of the provocation? so the other message here is that dominicans no longer need to respect the rights and property of others? any gang of 15 or more can now step unto my property and do as they bloody well please? criminal groups are now free to intrude, investigate and do whatever else they find convenient on a man’s property knowing fully well that the affected party will get the longer arm of the law if he tries in anyway to defend his own.

    i am not taking sides here i have every respect for the law and make every effort to operate within it’s reaches but i also subscribe to the belief that every dominican has the right to protect his property, as little or as much as it may be.

    i’m looking at the other side of the coin here and the other message that this sends out to the floyds, joans, athies and all the other political fanatics looking for every opportunity to violate the privacy of and tarnish a good man´s name and character, at whatever cost.

A man has a right to protect his property and person. And if he is the owner, director or entrusted to the property he has a fiduciary right to protect it by any means possible.     I cannot help but comment. You are so correct. This occurs a lot in Canada and the US. If a criminal enters people’s home, they cannot even use a gun to shoot the person. They will be charged. Imagine, it is you and the criminal, your life or his. If the criminal is injured that criminal could sue the property owner.
    I am all for law-abiding, peace and justice but I call it a stupid law which should be changed. People have objected to it but the government will not relent. They probably fear that many people will take advantage of it.
    Those authorities have protected homes, some with security personnel. The public do not have that privilege. Who is to protect them from intruders who steal their property, tie them up, injure and may murder them? They also do this to senior citizens. It is such a disgrace.
    There is a case before the Court in Toronto. A thief went into a Chinese store and stole some items and escaped. After an hour he returned. The store owner noticed him and gave chase after him on the street near his store. Someone or some people assisted him. They caught the man, tied him up and placed him in their truck and called the police :). This is worth a smile and a good laugh.
    When the police came, the thief was arrested. However, the Chinese man was also arrested and charged for holding the thief against his will. The case was called. We are waiting to hear the results.
    The public is told to keep their eyes open and to assist the police. Is it any wonder that some people will act as if they do not see or hear anything. In so doing, non-law abiding people will get away with murder, as the saying goes.
    The public is supporting the store owner. They are fuming mad that he was charged but that is the law as it presently stands. I support him. Criminals are a menace to society. They prefer stealing than working and create havoc and also fear in a society.
    I heard a politician state that the law will be changed to inform people that they should not go after criminals. The fact that they tied him, this, too, is against the law. Anyway, from my point of view, the law is a stupid one.
    Ever since I resided in Dominica, I heard that criminals are worst than murderers. In that, criminals come to steal but could kill. This occurs too frequently. Note that they carry guns which are clear indication that they are capable of committing murder(s).
    If you listen to CNN of all you will hear a lot about those criminals and murderers. There is a case which occurred in the US. Some of you may have heard that a doctor’s entire family, his wife and two children were killed. It will take too long to relate this extemely sad case.
    There was also another case where a couple who were taking care of 16 handicapped children
    – physically challenged as they are called – were murdered. The wife stayed home to take care of them. The husband owned a car dealership, as I heard. The husband and wife were at home that evening. Their home was ransacked for valuables. Fortunately, nothing happened to the children. One of them was able to go to the neighbor’s home and report what occurred.
    The house had security cameras. The criminals/murderers were eventually caught. Those types of stories are too many. They could make a person lcry and ament. Society could do without these types of people.
    We have our share in Toronto. The police must be careful not to use their guns and tasers. It appears as if the police have no rights. Generally, the public support the police. I am no exception.
    We do have a stupid law that property owners are not allowed to defend themselves against criminal intruders – on their property, a law that should be changed and which I am not afraid to inform my Member of Parliament about but respectfully as usual. I doubt that it will ever be changed.
    We just have to be careful and pray to God and ask Him for his divine protection. I never cease doing that especially when I am leaving to go out. We need to pray always.

    Have faith in the Dominican judicial system and do not debase it. You are totally wrong. I have confidence that If it was clear and there was evidence he did not have a gun and did not intimidate the lady, the Court could never have found him guilty. If then he was proven guilty, that would have been unfair.
    It was obvious that what he did was against the Law of the land. When are some people as his supporters going to comprehend that? You must be fair and just.
    Justice was met and must prevail. We will hear in time what type of sentence he will receive.
    For one, since he acted so negligently, he should not be allowed to possess a gun and not for a long time. The gun should never have been returned to him. Both gun and ammunition should be confiscated. Who knows who he will use the gun on in the future? Why have a gun and ammunition in the first place? For what reason? The picture of him does not look like a kind person.
    All the same I hope he has learned a lesson and in future he will act in a Christian-like manner and a loving one at that.

    The charge that should have been brought was assault. An assault is carried out by a threat of bodily harm coupled with an apparent, present ability to cause the harm. This is not a poltical issue but the question of application of the law.

    Ownership was not central to the case and was an error on the part of the Defence. Even if the Defendant was defending his own property his action would have to be reasonable. Pointing a gun at a defenceless person can never be reasonable licensed or unlicensed.

    There are too many guns in Dominica and we need to stop this now.

    you cannot own a property n say u own it and defend it with all ur gut and then wen court case call…u cannot give sufficient evidence to prove that it is realy and truly YOURS…if u cannot prove that the property is realy and trully YOURS then that means that there is a chance that the property ISNT yours and as a result …you will be MORE wrong than before because not only are u threatening others with a weapon…you are not doing it on your property (since u cannot prove that it is yours)….

    Disappointed, this was a case against Roosevelt Skerrit and he lost the first round. This incident occurred during the height of the election campaign and was a very charged atmosphere. In sports, the person who retaliates is the one who is usually given the foul or red card….But the game is never lost.

    So take this little parable and take it in slowly….Bubbles has not lost the game.

    The guilty verdict comes as no surprise given the evidence that was presented in the court. The defendant himself admitted to arming himself with a firearm which he must have known had an expired license and confronted the persons on that day. To the extent that the firearm was loaded at the time is another admission on the Armunition charge. On the charge of intimidation, the magistrate seems satisfied that there was evidence of intimigation presented to the court. So it would seem to me that the way was paved for guilty verdict my friend and you admitted it yourself.

    This is the opportune moment to see if the judiciary is indeed independant as it should be or not. I will await the sentencing which I am sure will be appealed.

    I agree with the ruling and I hope it serves notice to others who feel they can obstruct persons exercising their rights.
    It is one thing to protect your property (and this was certainly not the case here), it is another to endanger becasues the person is being a nuciance to you whislt exercising their right in a public place.

    So for all of you who say our Judiciary is impartial and compromised, take note!

    This day is forthe honorable magistrate and his unyielding integrity!!!! Depsite the pressures and the witch hunt of those who were trying to intimidate him, he did what the LAW required of him.. You Go Honorable Behanzin, and shame on those who went all the way to England to dig dirt on you with the intention of intimidating you!!!

    People here seem to be missing the important fact that in this case. The people were on public property, the road is public property. Bubbles came out of his “so called” property, approached the young lady standing on public property, and pointed a loaded gun at her head. That is not intimidation, that is reckless endangerment. The charges should have been more serious than intimidation, possession of an unlicensed firearm, and possession of amunition. Reckless endangerment should have been added to that because what if his finger had slipped and accidentally pulled the trigger? The young lady would have been killed. She was standing on the road, public property she was well within her right Bubbles had no right to walk up to her and point a loaded gun at her. And wasn’t that just the worst act of cowardess though? There were so many men in the group but Bubbles singled out a helpless woman. Why didn’t he point his gun at one of the guys? Because he know a guy is more likely to retaliate. I hope he gets the maximum sentense.

If the property is really Bubbles’ then I guess the next time people with camera come over to your property then maybe Bubbles should be more tactful. If the property is not and really belong to the PM then it would a disgrace and I do hope that the PM has a guilty conscience.

    See where all of the politiking of the UWP has brought us. Had they not visited the property in question, this matter wouldn’t have arose. they were damn wrong for having trespassed on a property knowing it to have belonged to another, without that person’s or persons consent. In my books, this is call Criminal Trespass and they should have all been charged with they said offense.

    On the other hand, brother Bubbles, you should have been well aware of the fact that your firearm licensed would have been expired at the time during which you would have allegedly brandished it. The fact is that you did admit in court to have left your house with the unlicensed firearm.

    The prosecution lead by Mr. Weeks was well represented.

    The defense had put it’s hands in its own mouth and tried bailing out at a time when it was obviously much too late.

    The good magistrate was by no means wrong in finding the defendant guilty, as such is the only verdict deserving unto the defendant for the events that would have unfolded on that day. I would not have expected it any other way.

    can mr. claude weeks update me on the police officers absent of office during the murder incident at soufriere. Especially the coporal who was drunk on the scene. what has become of these officers.

    You see these police officer are only interested in their monthly pay and that it and every friday they close the station and go to sleep with their girl friends or drink rum by the bay.

    During the weekend, so much was happening in Scott’s Head after the cultural activies and there wasnt any police present. There could have been another death, some people had to run for their lives.

    DNO please ask Mr Weeks why are the police officers in the out district are so lazy and dont do their job.

    Mr Alexis seem to think that he lives in the wild wild west or the OK Coral where gun play is like a profession. Dominicans if you need to protect yourself with a gun, first have it licensed then only use it if and when your life or your families life are threatened by another. Right now much too many people ones a gun in Dominica with most of which are unlicensed. Mr Alexis, you should never be permitted to own or carry a gun for you are a major threat to the public.
