$1.5-million for former Parliamentary Secretary

The Eastern Caribbean Court of Appeal on Monday handed down its decision in a matter involving former parliamentary secretary Jacqueline Theodore and the attorney general of Dominica.

A tribunal had awarded Theodore over $3-million for land belonging to her husband in Calibishie, which the government had acquired for the use of a road some years ago.

Theodore took the issue to the media some time ago when she was not fully compensated by the government, who had also appealed the matter.

Government claimed that Theodore was only entitled to $ 210,737.

However, the court now sitting in Dominica, has awarded Theodore just over EC$1.5 million.

    Next it Fenton Telemacque. One set getting paid in 2 days for land that will never see road in layou valley catchment basin on top of all the perks and malaway can’t be compensated.

    This case goes back all the way to 1997.

    Who was in power again in 1997?

    How comes I not hearing anything from the blues? Where are the chain emails blaming the gov’t for everything bad under the sun?

      This is a disgrace for the two parties and is indicative of the terrible state of governance. The best countries in the world and governed by laws. It is in the interest of you, me and everybody when our leaders respect the laws and adhere to them

      If I recall correctly, she did say that she was on her way to being compensated fairly by the “blues” as you put it. When the “reds” came into power they decided the money that the blues were willing to pay her was too much and so they refused to pay the lady.

      Here we go again! As far as the Court is concerned it has nothing to do with party politics but everything with justice,thank God! It is irrelevant, which party happens to be in powe. It was the Govt. that was in the dock and not any political party! The previous Govt. did not adhere to the law when appropriating the land and the present one offered inadequate compensation. That’s all there is to it and I pray that Justice continues to dispense its verdicts as they should, impartially and free from any political bias.

        Wow….so all of a sudden the court has nothing to do with party politics. When the PM and St. Jean won the dual citizenship case everyone crying it was a political decision. Even the judge the blues gave a bad name. Everyone said the courts in Dominica had gone down the drain….but all of a sudden the court has nothing to do with party politics.

    There seems to be some merit in govt reluctance to pay the sum of 3 million.

        I n the first place, the proper process for the acquisition of private property was not followed by the UWP government.
        Interesting to note now is what was the purpose of the road and is the country benifiting from the road?, how much land was taken for the construction of that road and was that much land necessary?

      I would like to know, who owns the land now, does government owns the land or it is own by the previous owner Jacqueline Theodore? If Govt. owns the land, I hope that they are going to sell to recover some of the money they are going to pay the plaintif, I would like ti buy some acres of land for farming in that area

    This matter has been on for some time and it is good that this lady exercised her patience based on her conviction that the state acted illegaly and was immoral ,the state over ride the right to personal property and it is good that the courts can protect the weak against the state. Mr Theodore the long wait and stress this may have caused you you now deserve to give yourself a treat

    Well well well; Taxes have to go towards the payment for someone’s incompetence or lack of procedure – it would be interesting to sum up the amount of fees Government has had to pay to individuals for wrongful acquisition of property over a ten year period. I know for sure the hospital could do with that million plus award.
    Speaking of appeal cases I am awaiting with interest the results of Lennox’s appeal against Pinard Bynre and just to add I find it strange that DNO nor any other media found it fit to comment and or condemn the outburst of Crazy T franky Bellot and Kamala on the Heng last week as it relates to comments that were made by Lennox Linton. Both individuals publicly claimed not to have heard the statement themselves but they went on to take Lennox to task one of the individuals even going as far as making reference to the use of a gun if needs be and there is nothing on DNO EMMMHH!; Lennox, Matt and Angelo are regularly criticized for being this or that – Linton was even scutinized as to whether he qualified to be a true journalist by the same host of the Heng with now DNO reporter and editor. yet still she allowed herself to be part of the outburst. The interesting part We are yet to hear of any so called professional media house or person much to hear a condemnation of this grossly unprofessional behavior.Is it because it was being said on a certain radio station no one wants to speak of media ethics, no reference or mention to professionalism. If that us said on Matt on Q ALL HELL would have broke lose. but being a frequent listener to Q, Matt, nor Lennox nor Angelo would allow that level of unprofessionalism to take place on their programme. Boy I tell you D.A is the best.
