$800 or two months in prison for a black eye

Anderson Joseph will have to pay the court $800 or spend two months in prison for beating Pernell Francis at a party in Soufriere over the weekend.

The Point Michel man appeared before Magistrate Candia George at the Roseau Magistrate court Tuesday morning and pleaded guilty to the charge of battery.

According to the facts of the case from police prosecution, on July 17, the climax of Dive Fest was being celebrated in the village of Soufriere where hundreds of patrons gathered including the defendant and complainant.

The compliant indicates that he was dancing in the crowd, minding his own business, when the defendant stepped up to him and punched him in the face. The punch resulted in a black eye for the complainant.

The complainant immediately reported the matter to Coporal Jno. Baptist. The police then followed the complainant to an area where the defendant was dancing.

“I really hit him Officer, I am sorry, give me a break,” Joseph said when he was approach by the police.

In his plea in mitigation before Magistrate George the defendant who was not represented by counsel was apologetic.

Before handing down the sentence Magistrate George cautioned the defendant that he should learn to behave himself.

Once again, I lament the decisions by the courts. According to the facts presented, this was an unprovoked attack. Also, there was no retaliation and the complainant was smart enough to report it to the police before allowing it to escalate into something more. What is even more disturbing is that we cannot go out to have good clean fun without some hooligan causing trouble. They have learnt to commit crimes and then apologize to avoid being punished fully. We all know that when they are out they speak with no remorse, some of them even boast of their exploits. They need harsher punishments to deter this kind of behaviour.
