“Alcapone” still awaiting his day in court

After three years and eight months on remand at the state prison, Edward “Alcapone” Green is yet to have his day in court.

Green was arrested and charged with the murder of 35 year old Damien Dorival, whose headless body was found on Elmshall Road in June 2008 – Dorival’s head was later discovered in the Palm Grove river.

“The case has been in the magistrate’s court preliminary inquiry stage, it’s been about a year now that it has kind of stopped because the investigating officer has not been able to give evidence,” Green’s Lawyer Peter Alleyne told DNO.

He says the setback is because the results of forensic tests were still being awaited.

The wider delay of almost four years to have that matter reach the high court is something Alleyne said he was not in a position to explain.

But he indicated that the court has had a very tight schedule and delays which may have contributed to the extremely slow pace of that matter involving his client.

He was asked how soon the preliminary inquiry was likely to conclude:

“Well we were on in January, the 30th, it didn’t go anywhere.  We were on the 5th of March, and it’s coming up on Monday coming, the prosecution says they have forensic witnesses to come and give evidence,” the lawyer said.

He is doubtful that the matter will be dealt with in time to allow it to be heard at the May Assizes of the High Court.

A more realistic date, he says, is the September Assizes.

While Green sits in a prison cell awaiting his coming trial, his health is said to be deteriorating.

One “good Samaritan” who visited him earlier this week on Tuesday described his situation.

“Edward was there behind the bars and mesh.  He looked no better than when I last saw him.  If it is true diabetes will take you out, he is on borrowed time.  He can barely see it seems.  Less than 2 feet away and he was squinting,” the individual, who is not a medical doctor, observed.

Lawyer Alleyne says Green does have serious health issues, with prison officers alleging that he sometimes refuses to take medication that he needs for his diabetic condition.

“They say that he refuses medication or he refuses treatment on many occasions, but I don’t know how authentic that really is,” Alleyne told DNO.

When he first appeared in court Alcapone, as Green is popularly known, was denied bail.

However years later, he has not given up on this..

The individual who visited on Tuesday, someone who has in the past been involved in law enforcement, indicated that the bail issue was still being given some attention.

“I spoke with someone this morning who was prepared to be a surety, and among those discouraging him were Prison Officers.  Whether or not Edward has become a greater threat to society was not made clear,” the ‘Good Samaritan’ said.

For many, Edward “Alcapone” Green is a character with a less than savory reputation.

Peter Alleyne has acknowledged that that perception is hurting his client.

“That is his biggest downfall.  He is a dog with a lot a lot of bark.  But it’s questionable as to how much bite there is or there was.  And certainly now in the later years of his life I doubt he has much bite,” the lawyer said.

“He has been a person very aggressive in his mouth, and that hasn’t helped his case at all,” Alleyne conceded.

For relatives of the murder victim, Green’s health condition in prison isn’t their concern.

They want to see the judicial system speeding up its operations as it relates to that case to put on trial, the man accused of brutally murdering Dorival.

    Personally ,i think this case is long overdue for its hearing and something seriously should done about it. Irresponsively of who the person is No one should be convicted and sentenced without proff of an act and without their day in court. Our legal system cannot be more corrupt.For some it’s in and out and for this man its like no justic? Is he in jail awaiting a acourt case for a murder he has been accused of without proff or for the life that he lived in the past?

    i thought you were innocent till proven guilty……WE have a well know Rapist in and out of jail,we have a well know drug dealer who short and killed a young man in front of many eye witness and he got bail,and many more such cases and and old man you keep in jail for more than three years…..well well…..if this man dies before this case is call what happens…..i hope the case continue to prove him innocent or guilty because some body should have to be held responsible for that….WHAT A COUNTRY….WHAT COUNTRY

    Maybe Alcapone has the heart to kill but does he have the physical capability…this has always been a question on my mind. This young man that was allegedly murdered was a strong young man, how was Alcapone able to physically overcome the guy?

    My question really is…did Alcapone act alone? I guess this is why investigators are having so much problem, if Alcapone have a good lawyer, I suspect he can walk….

    These are the thing that we ned to be concerned about. Whether he committed the crime or not he has rights. Just delayed justice denied. I believe that both sides are being unfairly treated and again the government just sit back and worry only about their pockets. Its not a complicated case. How many murders we have in a year.Compare to the states that have 100s in a day. This case is not complicated. You have the body have the accused what is the problem. Evidence dont take three years to surface. He was not killed by a toxin that other test needed to be done. He neck was severed please uneducated officers.

    Dont know who this Dominica Alcapone person is but this is human right violation. What if the man is innocent ? He would have spent 4 years in prison for a crime he didn’t commit. If this is not condemning evidence of a system “ Up side down inside out” then heaven help us. What is going on with our country. Where is the AG ; where is the minister responsible for social development; where are the senior lawyers of the land (too tainted with corruption).

    Denny Shillingford had a case pending for a few year and as soon after he made the famous confession his case was put on the priority up to stock farm he went.

    An investigating officer cannot present his case for 2 years ? The officer should either fired and the accused man released pending a complete investigation.

    It is time we stop pretending that all is well. Our country is spiraling into chaos- A disorganized state where people who are paid to work for progress and development are simply to dishonest to work honestly for the state. Unfortunately the people who rightfully criticize the status quo be it political or not are labeled enemies of the state. The enemy is your head my people – get them out , clean up shop , arrest the corrupt lawyers, politicians etc. Fire the manager .

    he is a human being and he is my great grand father and he is in the right place. I am not judging but if you commit a crime you face the punishment. He killed a man. despite whatever problems they had it wasnt his place to take a humans life. There is a saying 99 says for the criminal and 1 day for the law. I guess he is getting his one day.

      The man is my grandfather but I don’t know him personally, I just heard these stories about him but I never believed it..well starting to believe some of it now. I never knew him but this is an awfull way of finding information about your family. I don’t know what to believe anymore, if he did it then he should be where he’s at but then again you never wanna believe such awfull thing about your own blod. My heart goes out to the man who was killed and his family, god bless!

    Some of you talk like you find the man guilty already. If the police have he evidence to bring th case to trial, they have a duty to do so as quickly as possible. If they do not have the evidence to get a convoction, they should release he man. You cannot hold a man ad infinitum because you cannot build your case to convict him. What the system is doing is convicting him without a trial. That is not how our justiuce system was designed to work. it is based on the presumption of innocence until proven guilty.

    Isn’t he the one responsible for the condition his son is in today- the boy lost his legs. It is sad that I have not heard one good story about this man. I hope in those 3 years he has surrendered to God.

    Also I know the prisoners get medical attention so if he is what they say he is then he probably wants to kill himself.

    That being said the man should get his day in court.

    The funny thing with us D/cans we seem to forget very quickly. Now all the sympathy is being poured to Alcapone, what about the victim’s family they are still hurting. Alcapone should have remembered at his age there should be some water in his wine and should have changed from his wicked ways. Do the crime and face the time, the victim may not have been a saint or whatever the motive was no one had the right to kill him.

      There is the law for dealing with provocation. You cannot willfully crank up a machine and chop somebody’s head off for provoking you. This is way too grotesque…that is a dangerous man.

    Irrespective whether the man is guilty or not, to have him incarcerated that long before bringing him to trial is a travesty and an indictment of our judicial system. Shame on our nation. We hardly have 70,000 residents and we can’t even handle this?

    All what the lawyer has said holds alot of truth. i always wonder why this particular case is taking so long to be delt with. they fail to submite evidence because there is NO EVIDENCE. they fail to complete the case because they DO NOT want Alcapone to come out of prision even in his old age. ask me what he can do at the state he is in. I am sure he has no power now than he had before. so no need for people to be afraid.

    I’m sorry but having lived in Goodwill and witnessed this man beat down on a woman I have no sympathy. This man was scary to look at from the word jump. Why should the victim family have pity for him? He may not be a threat to society but his case should be called and he sent back to prison. Alacapone in his hay day was nobody to mess with, his lawyer doing what he must to downplay the mans’ character for bail, however even Peter Alleyne himself knows the truth.

    If Alcapone felt like pushing you in a shop he frequented for no reason he did just that in his huge jeans and belly out, you could be 5 or 15 he would torture you. I used to be scared to go to certain shop for bread past 4pm all because of his mean ways. Daniel Green on the other hand was someone to look forward to seeing at the very shop. This man was kind and caring of kids. He always had an animal story to tell and to pass on wisdom.

    This is a man who was driving around and now his vsion seem to be very very bad. Looks like an eye doctor should be checking him from to time. That should have been started a long time ago.Hope that was done.
    That is long years to wait for a trial. What is good for the goose is good for the gander. The law and the constitution is all messed up.

    The man was capable of beheading a human being you are telling he had “bark” and you are questioning “bite”. How much bite can one dog have for you to get it?

    This is a mentally unstable individual who should not come in contact with people and should not be allowed to get out where he has access to society.
