Astaphan demands answers on ‘Seko’

Senior Counsel Tony Astphan is demanding answers from acting Director of Public Prosecutions, Julien Prevost and Police Chief Daniel Carbon, concerning charges brought against Earl ‘Seko’ Grant earlier this week

Speaking on state-owned DBS Radio Astaphan said ‘something stinks’ and noted that both men have an obligation to tell the public what led to the the decision to prosecute Grant.

According to Astaphan, the former DPP and Police Commissioner did not do so “because of the complete lack of credibility of the alleged confession and the complete absence of any corroborative or independent evidence relating to Mr. Grant.”

“I think the commissioner of police and the DPP have an obligation to the people of this country to tell us what is it they rely on to make those decisions to prosecute,” he said. “What was the new evidence they have seen which Commissioner (Cyril) Carrette and DPP (Gene) Pestaina hadn’t seen and what triggered the situation. what triggered that change, when did the change take place and who made it. We have an obligation to know what that information is.”

He pointed out that Grant returned to Dominica of his own will without an arrest warrant or extradition order and he was promptly arrested and detained

“Something stinks. This matter concerns this allegation propagated by the opposition of state sponsored terrorism,” Astaphan said.

The senior counsel also alleges that there was a meeting on the matter between the commissioner, the investigative officers and the acting DPP “and rumors have it that there was a particular decision made and subsequently another decision was made revoking the earlier decision which was made.”

Grant was charged with conspiracy in relation to a fire at the home of former magistrate GON Emanuel on Christmas morning of 2010.

He appeared in court on Thursday where he was denied bail and he is presently on remand at the state prison.

Denny Shillingford has also been charged with arson in connection with that fire. Following the fire in 2010, He confessed to committing the crime and claimed that he set the fire on Grant’s orders.

Grant left the state shortly after the fire in 2010 and returned on May 26 after he was given an ultimatum by Ag. DPP Julien Pevost, to return to Dominica willingly, or face extradition from the United States where he resided.

    Dominica is becoming a pappyshow. These lawyers are watching american TV and now they are embarrassing everyone. Dominica needs to produce less lawyers and more farmers. The more case they try, the more money they make, When I was leaving in DA, there was abundance of everything. Now, rain ready to send the land into the sea because there is no crops to hold the soil. Seko, hurry up and leave them in their coshony. Only come back for carnival to jump up in the street.

    I don’t know who gave some people the idea that the U.S. authorities would not extradite the gentleman to Dominica for questioning.
    Mr./Miss Smart used the Amanda Knox case to prove his/her point.She, Amanda was charged for murdering another fellow student in Italy.The trial began January 16.2009, about 250 witnesses were called, and after many months before the court she was set free and was allowed to leave Italy.
    The Italian authorities reopened the case.I am not sure if Italy asked the U.S. to send her back to be retried.One thing I know, in America you cannot be tried twice 4 the same offense.

    I really would like to see this case tried in an impartial way, because from my observation and experience with fires, what the Denny man said does not add up.

    To avoid a war in Dominica it would be easier if Seko goes down. But he should not go down on account of lies.

    secko will be vindicated of these false accusations. So many has judged him, condemned him and sentenced him without knowing the facts. For those that speak their truth and their bias posts please allow him to speak his truth without being persecuted. It is nonsense to think that secko would leave the states to go to a country to be arrested and held prisoner. Everyone with common sense knows that the United States would not have turned their back on one of their own. He wanted to be in the country that he loves so desperately. Secko has been slandered and his reputation tarnished but justice will prevail. He knows that he would not have been extradited to DA based on stupidity and the word of a known criminal but he wanted to lay this to rest and set everyone mind at ease. The DPP wants answers:he should be careful what he ask for. GRANT-was my given name and I carry it proudly no matter how much the name was defamed.

    on a matter of national security tony wants the cop to explain to the public ? is this man ok I mean every thing is like he is incharge of the country so why don’t he apply for these to jobs? law enforcement and national security information is sometimes on a need to know basis and tony knows that so he better behave himself and let the court and the system do its work. all he can do is be the man’s counsil and keep the public out of it . come on tony you know better. you are just trying to side track the system and get the public involved . you want to use the public.that cannot work and I think the politician should be more careful with people like you.

    I think former DPP, Gene Pestaina, needs to clear the air on parts of what Tony has said. I heard Mr. Pestaina say recently on air that he was unable to proceed with the prosecution of Seko because “the file was incomplete and still with the Police investigators.” But I am now reading that Tony is saying something completely different to the extent it makes Mr. Pestaina looks like a liar. Tony is saying that:

    Conspiracy to commit a crime is not the commiting of a crime. If Seko was guilty he would not leave America and come to DA to face prison. You cannot lay that charge without evidence. The so called eye witness is a known felon who constantly tell lies.

      I hear you but you need also to consider that Seko stood to lose his US citizenship if he had gambled and remained in the US and eventually got deported to Dominica. So it is quite possible that his decision to voluntarily return home was not prove of his guilt or innocense but a strategic one to protect his US citizenship.

        He cannot loose his citizenship, if he is a citizen of the United States. once you take the oat of allegiance to the United States, and vow to defend the United States even against the country of your birth, that’s it.

        I do not know of anyone who was stripped of their citizenship for any reason, in the history of this country.

        There are people who became citizens of this country, and held positions which afforded them to spy on the United States, i.e. Chines who have stole technology, and military secrets and passed them on to China, and even at that they were not stripped of their citizenship.

        They are in jail, and are not facing deportation upon their release!

        Once one become a citizen from there no even if you commit the most heinous crime in the United States, you are punished by the laws of the land the same as if you are born here.

        Only Dominicans I hear constantly talking this nonsense about loosing citizenship.

        Anybody living in the U.S. Virgin islands; Puerto Rico and the United States, with a green Card, can loose it at any time, depending on the sort of crime they commit. And that can be on a strong misdameanor.

        For that matter if you have Green Card, and you decide to stay out of the United Stats for a long period of time, upon returning, you are likely to be refused entrance, lots of Dominicans has lost their permanent residence likes that, but the notion that citizenship is revoked is unfounded.

        That notion exists only in the mind of the know it all Dominicans. If you know anyone who’s citizenship was taken away for one reason or the other, please state the name of the person, and when, in what era this took place.

        Let me just add this ” Stokley Carmichael” Trinidad born, one of the creators of the Black Power movement, and effective in the Civil Rights Movement of the late Martin Luther King was the leader.

        Carmichael, took Malcolm X with him to Trinidad in 1962/63 and try to organize\zed the Black Power movement there. The late Prime Minister Erick Williams thought he was a trouble maker, and was instigating trouble in Trinidad.

        A citizen of the United States, Erick Williams ordered Stokley Carmichael deported from Trinidad the place of his birth, back to a country where he was not born, however became a citizen of that country the United States of America.

        Are your eyes open yet?

        Carmichael eventually went to Africa, where he lived, and died about five years ago, he was married to the popular African entertainer Merriam Makaba, who herself died about two years ago, you people need to know what you are talking about before you babble!

      The return of this guy does not mean he is innocent, he may have returned voluntarily because he knows if the Federal government got involved in the extradition process, he would be arrested and thrown in jail where he would have to retain an attorney to file a protest against his extradition.

      That would have cost him money which he probably does not have!

      You need to understand there are certain legal processes which must be followed and complied with before someone can be extradited from America, the process could take months or even years, unless the culprit waves their extradition rights, to a court hearing.

      If you are in this country illegally, and someone reports that to the immigration, the immigration will pick you up, you will be placed in an immigration detention center until an immigration judge review you case, and order your deportation, it is not as if you will be arrested today, and by the next morning,or month they put you on a plane heading to Dominica.

      The same thing apply to the extradition of a criminal suspect.

      I see a lot of sympathy building in Seco’s favor one idiot has already called to fee Seco!

      What happen to the days when he was at large; and the cry was justice for Gong Emanuel?

      Are Dominicans so shallow, and so quick to forget?

    Based on statements made by Tony Astaphan immediately after GON Emmanuel’s house was firebombed, the manner in which he conducted a live radio investigation with Earl Grant when no one seemed to have known the where about of Seko, statements made by him immediately after the DPP gave Seko a choice between coming to Dominica to answer questions or face extradition from the USA, I agree this time with Tony Astaphan that SOMETHING REALLY STINKS.

    Tony seems to know a lot about that stinking thing and we should get help from the USA to help us get to the bottom of this stinking rat. The FBI have some very good dogs that are professionally trained in helping find things that don’t smell, let alone things that do stink.

    If Tony is not representing Mr Grant why is he so concern how the Commissioner and the DDP handle the case? I thought the two main charges were attempted murder and arson? This case been handled wrong from day one. No one is ever happy with any criminal results because even if you are vindicated someone always think you are guilty. As an investigator my first question to Mr Grant would be what’s your issue with Mr Emanuel. And i am sure his answer would be i don’t have an issue with the man. Then on whose behalf were you working?

Why dont Astaphan represent Seko at the next hearing in September,their, he can ask as many questions as he wants. One thing, though,he cannot get him out of jail until the hearing in September.My wish is for the Magistrate to prospone the hearing until next year with no bail.

Seko, I presume is also Dominican;the USA can only intervene if Seko’s rights as you claim, have been violated in a THIRD country so there will be noooo FBI coming to Dominica. Moreover, the US government has a most herrendous history of violating its OWN citizens rights. Just ask former president Clinton why he apologized to the Blacks who were used, UNKNOWINGLY, in experiments with the syphillis virus.

    Boy Tony have guts… What is his role in the case? Something truely stinks about this case and we all know exactly what stinks.

    Tony you and your clients have an obbligation to tell the people of this country the truth about the vielle case house, the bin saga, the Villas, the election of the president, the charges that were brought against Isidor that got lost in the system, the rampant victimization of citizens, the passports, just to name a few.

    So please have some shame and realize that you have no credibility and you are not in any position to point fingers.

    And one more thing, I think you would make it big in stand up comedy, you have the looks and all the jokes.

    Senior Counse, let justic previal. let this matter be treated as if it were any other Dominican. We know u have interest in the outcome but stand aside and let the DPP, magistrates, lawyers, police commissioner etc do their work. there are countless decisions which the head public figure (the PM) needs to come forward and explain and we dont hear you asking him to. Earl Secko Grant will be tried fairly. Quit trying to interfere.

    Earl Grant did not have to leave the US to come down after seeing an article on DNO. The United States Government would not have extradited him to Dominica for questioning on hear say. Lets focus on the young ladies case who served time in Italy for murder, the Italian government wants her to return The US Governement is not going to extradite her to Italy and this case involves murder. I smell some fat rats in this matter. The US Government would not extradite their citizen on hear say….Earl Grant purchased his plane ticket and decided to return to the Island of Dominica, lets face it not so many people want to return to the island but its obvious he loves his country and would like to put that matter to rest once and for all….

    mr. Astaphan, please leave it alone. You are in no position to demand anything. It was you who arranged for mr. Grant to undertake to come and surrender to the Dominica police in a public broadcast, nearly two years ago. Well, mr. Grant did present himself to the local police, so what you want again? I’m not a lawyer but I’ve heard about “sub judice”. Doesn’t what you demand interfere with that?. Let justice take its course. You are not involved in this case unless you want to be mr. Grant’s defence lawyer but would you work “pro bono” like mr. Shillingford’s own?

    From Day one I always felt that there is something fishy surrounding that case. Some of the comments made by the former C.O.P did not make sense to me. Since the public was not privy to the questioning of Mr. Denny Shillingford by the police, we are not certain that there were indeed inconsistencies with Mr. Shillingford’s story. I wonder who is Senior Counsel Astaphan trying to protect. However, what is hidden must come to light as God sees and knows all and he will certainly punish the wicked for their misdeeds.

    Hahahahahahahahahahah!. Who the hell this PENGUIN thinks he is nah? Tony you are not the DPP, Attorney General (AG) or Comm. Of Police. Not even the Minister Of Legal Affairs.

    The office of DPP and Commissioner of Police does not have to answer to you or for that matter anyone in Dominica except in a court of law when decisions are made to prosecute suspects. His only obligation or courtesy I believe is to inform the President if there is an imminent arrest of the Prime Minister (right before it happens) or other minister of government in the interest of the state security. If you wanted to make that decision you should have applied for the position of DPP or Comm. Of Police.

    One thing you all must understand is that Comm. Carbon does not mix matters. He is a protege of past Comm. Simon Darroux, Supt. Egbert Alfred and Supt. Duke Savarin. A no nonsense guy when it comes to prosecuting those who are deemed to be criminals. If he could arrest his own officers (Corbette, Durand etc) for criminals acts just think of ALL those that are in the line of his fire. Time surely has a way of telling these days because we all know that the evil that men do live with them.

    The only thing you Tony can do is pressure Skerrit to fire Carbon for some nonesense but there shall be riots in Dca if that ever happens. And please, tell the…….Door opener that judgement day is coming so put his assets in order. Who NEXT? Hmmmmm :twisted:

    It appears Tony is talking all this stuff in the media to give Seko and his family a false sense of security that he is on their side and that there is nothing to worry about. He who has eyes let him see: It’s a ploy to keep Seko on side so he won’t implicate the powers that be while he has the chance. In the meantime Tony isn’t going to court to defend him, none of the big boys are standing there with him. If Seko falls for that very obvious ploy he will find he is taking the wrap alone and then it will be too late to cut any deals because the same Tony will appear in Court for those Seko point his fingers at and argue that Seko only implicated them after he was found guilty and as such its a desperate ploy by a guilty man. SEKO BOY SPEAK NOW OR FOREVER HOLD YOUR PEACE. DO NOT TRUST THESE PEOPLE, YOU ARE A PAWN IN A POWERFUL CHESS GAME!!!
