UPDATE: Astaphan petitions court to throw out case against PM, St. Jean

The dual citizenship case against Prime Minister Roosevelt Skerrit and Education Minister Petter St. Jean will continue in the High Court tomorrow.

Earlier in the day Tony Astaphan had asked the court to throw out new witness statements filed one week ago by the United Workers Party. He also wanted the court to throw out subpoenas filed by the UWP to force Skerrit and St. Jean to give evidence in court describing the subpoenas as a ‘fishing expedition’ and ‘abuse of process.’

He further argued that the deputy registrar who signed the subpoenas had no jurisdiction to do so in an election court. “I don’t think this is acceptable at all,” Astaphan told the court.

He stated that there is nothing that can force Skerrit and St. Jean to give evidence in court and said he that none of the petitions filed showed evidence that either men traveled on a French passport.

Astaphan also said Edison James made no reference to passports when he spoke at a meeting on November 30, 2000 but the petitioners are making reference to it.

The matter is being heard before Justice Gertel Thom. Astaphan and Heather Felix Evans are leading the legal team for Skerrit and St. Jean while Trinidadian Senior Counsel Douglas Mendes is leading the three member UWP legal team which includes Trinidadian Stewart Young  and Dominican attorney Geoffery Letang.

As the matter continued this afternoon, the petitioners’ submitted that their subpena of the defendants be upheld as a right.

Mendes, for the petitioners, contended that according to law the judge in an election petition matter has the same authority as in a civil action, which includes issuing subpenas to parties to the civil action, as long as they are competent and compellable.

Mendes futher stated that the subpenas can be issued as a matter of right in a civil action to any of the parties to the proceeding.

Responding to Senior Counsel Anthony Astaphan’s claim that the petitions are an abuse of the court’s process Mendes stated to Justice Thom, “if you have the authority as in a civil matter to subpena, and we invoke that power, how can it be an abuse of the court’s process?”

Mendes further contended that the defense should not request that the subpenas be disallowed and the defendants not be compelled to testify durng objection, but that rather they ought t take the oath before invoking the right not to self-incriminate.

He also mentioned that the defendants had never denied or confirm whether or not French passports had been issued to them, asking that the court interpret the meaning of the failure to do so.

Court resumes at 9 am with Mendes continuing his response to the objections by the defendants to the petitions.

    A fruit falling from the tree will not grow when under the tree; but a child will not be well nurtuered if his parents dont look over him until he’s grown.

    In peaceful societies there is always a place for the elders.

    In serious communities, there is always a committee that looks over its youths; part of taking a village to grow the child is because the elders are usually playing their part.

    We have elders now who are doctors, lawyers,

    scientists etc. and we are sure their experience will help us avoid the pitfalls.
    While we have a place for them, they too must know their place. We suspect that is the argument.

    Remember the “ripening” process is for all of us.

Trust in the degree you mortgage your life to give your children. Forget party politics and instead support those who will enable them to harness the true value of the things they’ve learnt in order to earn that degree. Support those that will continue to stand behind them so you can have a chance of paying off that loan in your lifetime and enjoy some of the good life. INVEST..own a business, be of significant value to my family and my country. It is time to step aside old folks, let ethics prevail in our land like it exists in all great societies

    That section of Dominica’s history, regarding the historic case of dual citizenship of Skerritt and Petter St. Jean, will live an indelible stain. The elements of that case, from beginning to end, have to do with the dishonesty, lack of integrity, mistrust, disrespect for the Constitution and Laws of Dominica, disrespect for the Electoral Commission, disregard for the democratic process.

    There is no defending that Skerritt and St. Jean were French Citizens on Nomination Day 2009. They knew they were French citizens at the time. Didn’t they hastily try to renounce their French citizenship? Why?

    No denying that they possessed French passports. To have fought to prevent those passports from being shown in court is proof already of GUILT. Obama had no problem in showing the world his birth certificate to prove where he was born. If Skerritt and St. Jean were honest to themselves and the Dominican people they would have done the honourable thing long timen and expose their French passports for all of us to see if it is true or not.

    Why don’t they want the passports in court as exhibits? Why they do not want Skerritt to take the stand to be cross-examined? What is wrong with the subpoena? What other technicalities will arise? Tell us something Mr. Skerritt. Be honest. Why should an entire nation go through such uncertainties and suspence, not knowing whether the Leader of such a beautiful country is legitimate or not and whether the parliament is legally constituted?

    Justice for one should be justice for all. All should be equal before the Law. Rule of Law, not rule of the jungle. Wrong is wrong is wrong. Citizens should always obey the law. All true sayings. The outcome of that dual citizenship case will either uphold those noble principles or sink the country into mistrust and disebelief in our system of justice.

    i mean this will all close with skerrit still being the prime minister. lets assume he loses the case and has to stand down. he will choose someone to assume leadership in the meantime and do an election in the veille case constituency and get re-elected and then assume the position as prime minister again. Uwp has not achieved anything but waist time!!

    It would appear to me that for once Senior Council Astephan has met his match with Senior Council Mendes, The sound logic of his submission to the learned judge is indeed sensible and lawful.

    One has to bear in mind that facts need no laws to support them they are by the very nature of fact and truth and law inviolate

    Reticence to disclose requested information to determine fact is therefore not sound and requesting them is abuse of court process in any way, rather it demonstrates to me that this attempt to have the matter dissmissed shows how weak the defence case is.

    A lot of comments on past deeds IE corruption have nothing to do with this matter before the court, however what can be said is that appart from the entire Carribean watching this case so is the USA, China, Europe etc etc etc

      Some of us feel the same way on this matter. We should at least try to change this Constitution pertaining to ex-patriots as we are referred to, not being able to be a PM or Political Leader because they hold a passport of another land. There are various reasons why some of us hold another passport. We migrated and are employed; for some,were employed.
      It is our right and to our benefit that we hold a passport from the land where we migrated, paid taxes and lived for a number of years.
      This does not mean that we disowned our land of birth. We should not be required to renounce this citizenship specifically if it was issued in a sovereign and democratic country. I view it as a form of discrimination and unfair against our very own, considering them outsiders and outcasts as if they do not belong.
      It is for this reason I refer to this Clause or Chapter as a stupid Constitution which is in dire need of re-writing.
      Dominican is in dire need of educated nationals and those who are experienced; for now anyway. Yet, this Court complaint was allowed to be lodged and continue to be challenged in the Court. We should consider it a waste of money and time. I do hope it is thrown out. Let us pray for that. May God assist and put a hand. Help Jesus help!

Anyone please show me or tell me 1 qualified member of the opposition with at least 5 or 6 qualified colleagues who can really represent Dominica on an international level and change things for the better…If there are I am not seeing them in the opposition.     A few questions to Tony Astaphans: If Mr. Edison James had contested electons with dual citizenship would you ask the court to dismiss the matter? If Mr. Norris Prevost had openly told the Dominican people that no law, no constitution cannot prevent him from contesting election would you see him as a dictator? If Mr. Ron Green had french citizenship like Petter and the PM would that be a subject of your agenda on the animal programme? Tony you will argue on grounds of technicality and you will continue to mislead Skerrit, Petter and others in the labour party. I am convinced that both Skerrit and Petter are fully aware that they have violated the constituation but Tony you seem to provide them with hope that they will pull through. Hear me Tony, there is a court above that decides every matter so sorry for those who you mislead. Tony you will pay a hard, hard price; time will tell and time will show. Skerrit, Skerrit Skerrit, take a look at the leaders in the world who taught they were above the law; they all fell and so the writings are on the wall. The falling of Skerrit will mean the falling of many and please do not get me wrong for i am not merely talking about the decision of the court; i am speaking about God’s impending judgement for the corrupt and lawless practices that has become the norm in our time. Mendes, young and Letang may you deliver good arguments but do not get disappointed if some technicality prevails- it may just be preparation for divine judgement which will be much more impacting than the decision of the eastern caribbean court of appeal.         The constitution is clear, dual ciitizenship is not ok whether it be French or American. Acquaint yourself with the circumstances as it relates to Mr. Green’s american citizenship that he formerly held. Tony Astaphans knows the legal facts and knows very well that Mr. Green was not in violation of the constitution. Had he been the nature of Tony Astaphans would not allow it to go unchalllenged. I stand for national pride and not for a political party. Whats at stake is more that politics, it is about wrong and right. We need not to confuse the next generation as to the proper interpritation of our laws.Peace!

      This is the reason he has a lawyer. In such a case he cannot be compelled to to stand. The prosecution has made the allegations, the burden is on them to bring the proof. Sadly as always, they speak before having their evidence, so if the allegations were true, because they tried to have a “public court” it has allowed Skerrit’s time to know all the details and so prepare to defend it.

      The problem with us in Dominica is we do not know what we want. So we accept anything as high quality.

      I can find many faults with all things Dominican. But I will not. Instead I applaud those – like Tony Astaphan, who take his job seriously. Too seriously some might say.

    There is no respect for the constitution by the PM and his followers. This case will prove the integrity of our justice system. Where as the petitions are valid. I am skeptical about the court system. It appears that across the caribbean there is widespreaad political corruption and some judges and lawyers are tangled up in it. We don’t need the court to tell us Mr. skerrit and St. Jean are guilty. We know that and it is time to put a stop to it. The question is do we have the courage to demand his resignation? This whole thing makes me sick to the stomach. What a shame Dominicans. wake up.
