Senior Counsel, Tony Astaphan, has said ‘preemptive strike actions’ will be taken very soon against Opposition Leader, Lennox Linton, and Thomson Fontaine in court matters they have involving Prime Minister Roosevelt Skerrit.

He said the action is being taken in light of a recent London-based Privy Council ruling against Linton in a defamation matter involving chartered accountant, Keiron Pinard-Byrne.

“There is a second fall out of this judgement,” Astaphan said on state-owned DBS Radio earlier this week. “The present case the Prime Minister has against Linton for the rapist ministers and Thomson Fontaine on this passport business.”

Astaphan said he and his legal team are now taking another look at both cases.

“We are taking a fresh look at these cases and we will be mounting a clearly defined, focused, preemptive strike actions against these cases in the very short future because that irresponsible behavior must have a price,” he remarked.

The so-called ‘rapist ministers’ matter has its roots in a speech given by Linton at a United Workers Party (UWP) “Youth In IT Too” rally at St Joseph in May last year during which he referred to alleged activities by ministers as rape and noted that there is no honor in a government who harbors them.

“There can be no honor in a government that harbors rapist ministers and upholds extortion of sexual services from young people seeking the facilitation of ministers to get personal development assistance from the public purse,” he had said.

Astaphan was quick to condemn the statements describing them as “intolerable, scandalous and totally unacceptable.”

Linton was asked to apologize but he said he was standing by his statements.

He was subsequently served with legal papers on the matter and the claimants include Skerrit, attorney general, Levi Peter and all members of cabinet.

The Fontaine matter goes back a couple years now in which the Prime Minister’s team took legal action against Fontaine, alleging that he is the source of claims that Skerrit was involved in the sale of a Dominican passport to Darwood Ibrahim, a notorious Indian national.

    You may have studied American government or perhaps read ” Lowi & Ginsberg; how you cannot relate America government to the crap in Dominica. In America the constitution provided in Article I, Sections 1-7, for a Congress consisting of two chambers; a House of Representatives, and a Senate. In order to detail their functions will take forever, so I can’t touch on that.

    The constitution also provides for the establishment of the presidency in Article II. As Alexander Hamilton (born on the island of Nevis) had put it from the beginning; the presidential article aimed toward “energy in the Executive. It did so in an effort to overcome the natural stalemate that was built into the bicameral legislature as well as into the separation of powers among the legislative, executive, and the judicial branch.

      In establishing the judicial branch in Article III, the constitution reflected the framers’ preoccupations with nationalizing government power, and checking radical democratic impulses, while guarding against potential interference with liberty and property from the new national government itself. Under the provisions of Article III, the framers created a court that was to be literally a supreme court of the United States, and not merely the highest court of the national government.

      That crap you all have in Dominica do not compare to the American government and the constitution of the United States.

    Hey D N O, word on the street is that media houses can be sued for publication. They can also be sued for discrimination and preventing freedom of speech when they refuse to publish postings that is not in their favour.     Flash Floods and landslides in California:

    Cannot help but wonder who certain Dominicans will blame for the flash floods and landslides happening in California. Imagine, how many US States have had flash floods this year. God is in control people. Whether, First World, Second World or Third World Country.

    Each time I see the pictures I remember what happened to Dominica still so fresh in our minds, happening elsewhere. The floods came without warning hear that people!!!!!!!

    Hope any Dominicans living in California were not affected by the floods.       You will recall through the years to this year how many homes were destroyed by fire, be they brush fires in California – too many of them.
      California is still waiting for the big one -earthquake.

    Facts, you are missing something here, you do not know so I tell you! A lawyers job is to represent people in a court of law, and in most cases try to settle an issue out of court whenever possible. An Antony’s job is not to pick fights, or make provocative comments which cause someone to commitment, and as soon as they speak the lawyer takes them to court!

    The statement he made in reference to preemptive strike, that is a dangerous position he has taken. Such terminology means he has declared war, on Lennox and Fountain, which means he is going all out to instigate something, in order to have a case to take to court. That is malicious!

    One of the most effective military strategies are to strike preemptively, take the enemy by surprise; and annihilate them, are we at war in our country?

      In the common law system, there is an abuse of law known as entrapment; that is very random, and popular in Dominica, I do not know how some people live with themselves with all the wickedness that they do in the country.

      Someone need to remind Dominicans that the guaranty period of time God gives us to live on this earth is a mere 70 years, and he said by reason of strength we can live beyond that. Those are the years when our evil deeds returns to haunt us!

    Referring to election, on Monday, Canadians will be voting for a Federal Government. I am looking forward to that. I hope my preferred candidate will win and be Prime Minister. I am not hiding that he is now the PM. :lol:. For the past four years I have listened to him and concluded he is a dignified man, a gentleman and a Christian. He has morals and principles. This and more I like about him. Not everyone likes him, obviously but this is politics. I hope the majority vote for him. From my point of view, they would be stupid not to vote for him. :)
    Election heat is on. The present PM\’s and other candidates, those who are vying for MP\’s are busy campaigning. Their helpers from the campaign offices are making phone calls, knocking on doors and sending out their brochures via mail and placing them at doors.
    Come Monday evening we will know which Party wins. It is already getting excited. I am certain, no one can wait for that time.

        I was at a gathering today. Later on we discussed the election and Parties. Of course, everyone has a different opinion. I think there were only two of us who support PM Harper. I told them we have our opinion and we are free to agree or disagree. I also stated, if Harper is not elected, it will be because he has had three terms in office and some people say they want a change. Someone stated, people cannot just say they want a change without knowing what that change is. How true.
        The Caribbean Camera newspaper headline posted their support for Liberal. I heard on the News The Toronto Star, Globe and Mail and their likes support Liberal. The Media could be effective in convincing some people who do not have a mind of their own who to vote for. Not me.
        Likewise myself I do not support Trudeau. He plans to legislate marijuana. He will be raising taxes with the help of the Ontario Premier who is eager to see him elected so that she too will do likewise.

        I was born with a middle ear diseases, which should have been looked after when I was a child–not only me of the family–they are younger, so they are not as bad as I am–hope they don’t get to that point, not in Dominica.

        To tell you the truth, I am not following with any Church right now–I am searching for Spiritually grounded people, whom I can worship God and fellowship with them–the Church which I was following is not one of them–My Church is my people in Dominica, I am going to go there–God’s Will be done!

    Only in Dominica…do poor people PAY TAXES to a man to carry out bogus lawsuits then turn around and beg other nations to help them close the gap in tax shortfalls.

    While VAT is used to pay Astaphan for each of these lawsuits, his family is too smart to pay VAT so that their money doesn’t go to waste.
    Astaphan can’t use his skills to figure out legal approaches to reduce the epidemic of child sexual abuse. He can’t use his skill to identify best practices to improve the health care system. He can’t do anything to help bring more funds to our struggling economy…but he can TAKE TAKE TAKE from the meagre treasury, all with Skerrit’s blessings.

    Erika has done nothing to Dominica compared to what will be left when Tony is finished. He will take his middle eastern tail to the high life in Miami while you black people will still be scratching your head wondering why we are still so…

      Get your self sorted. Government consists of the party in power, with or without coalition partners, which is not the case in Dominica at present.
      Parliament consists of all members elected by their respective constituencies plus senators. In other words, members of Government are not necessarily the same as those of Parliament. They are two separate bodies.
      I would recommend you read the Constitution, it is as important as the Catechism if not more so.

        You are an insect for real. There are three branches of Government. (1) The Parliament which includes the Opposition. That’s where laws are made to GOVERN the state. (2) The Judiciary which is our court system which interpret laws passed in parliament. (3) The Executive is a group of elected officials responsible for the day to day running of the country according to the Constitution of the country and the dictates of the Parliament. When you understand the meaning of the word Govern, you will understand that according to our constitution the Opposition, any opposition is an integral part of our government structure. Ma moses you need to read over the constitution because I believe you read some other constitution, not that of Dominica. Don’t take my word for it, ask Tony Astaphan. Those are the things he must educate you about instead of making public mischief. Skerrit supporters are amazingly ignorant.

      I must inform you, you are wrong. Unless it is different in Dominica which I think it is not.
      The only Government is the elected ruling Party. It alone has right to the claim of Government and being called Government, as long as it is ruling, in power.
      The opposition is not considered government or the government and by no means in the true sense of the word.
      It is simply called, the opposition. Remember this Party had less votes and came second which is why it is called the opposition, not to be mistaken with the elected government.

      In Dominica only Skerrit is the government, the rest of his cabinet has no say, they do as they are dictated to by Skerrit. The opposition in Parliament has no power excepts to object, and in rear cases accept Skerrit’s wish, when it is necessary!

      The opposition in Dominica has no say in Dominica’s budget, unlike the United States, in Congress the opposition has the right to present a budget, the same as the Republican regardless to whom is
      president, republican, or democrat. The most effective budget is accepted, and adhere to.

      No one side Republican or Democrat can decide on a matter, there must be a vote, in Dominica anything the ruling party decides is final! The opposition in Dominica are considered elected officials, they have no ministry, so how can they be part of the government.

    The notion that the Laborrats continuously pursue those who disagrees with them, is getting to be an obsession to win at any cost. Beyond doubt, this is infringing on the rights of the citizens of Dominica. Skerritt can get on the radio and say whatever he wants without any repercussion, but on the other hand targeting those who oppose them. The pillars of democracy seems to be crumbling underneath our moral foundation and the people’s right to free speech is being modified.

        Hello and good morning my people. This Lawsuit is related to an allegation that was made against a member of the Prime Minister Party about two years ago. The allegation was that , that person engaged in sexual intercourse with a female that was Fifteen years old and the age to consent in Dominica is sixteen years. They further alleged that they didn’t arrest that person because the victim and her family was paid off and that perpetrator was a member of the PM party. I hope that give you a clearer view of what is happening.

      He might be of Lebanese decent, however the majority of Lebanese decent in the Caribbean are from Suriname; located between Guyana, and French Guiana in South America; not too far from Venzuela!

      Need you be told that Tony and his family, (if you are referring to especially his immediate ones), are Dominican-born. Did you know them in Dominica? If you did, you would not have made such a discriminatory comment.
      As I have stated, these days everyone has a computer and they think they are more important than others and know it all more than others, also comparing themselves to others and that they are at par with them.     Skerritt submitted his declaration of his assets to the IPO. The IPO requested an interview with Skerritt, in order to verify what he declared. Something wasn’t meshing. My people, you know Skerritt’s lawyers filed for judicial review, to block, prevent the IPO from asking the ‘Supremo’any questions?

    Remember the burning questions regarding quick enrichment by a few, while in public office. Salary just couldn’t support such life-styles. No answers up to today.

    Since 2013, the IPO cannot interview Skerritt on his declaration to satisfy themselves, if what declared is alright. What is the fear?

    The Court granted Skerritt and his lawyers judicial review. The IPO blocked/ toothless, although the IPO has the constitutional right to seek clarification, the truth about any declaration of assets.

    It is unlawful to disclose any information given to the IPO.

    Who leaked out Skerritt’s info to the IPO? Who made up a story to have Linton arrested? Who…

      The police saw it fit to go to Linton’s home, questioned him about the leaking of Skerritt’s declaration of his assets. If Linton was found wanting, surely, he would be arrested, hauled before the courts, found guilty of that unlawful offence and maybe jailed.

      Linton, with his investigative skills, broke the news that it was Tony Astaphan who leaked his friend’s,Skerritt info, that was supposed to be secret with the IPO. Blatantly, boldly, disregarding the Laws regarding such irresponsible and mischievous act.

      Dominicans, no police has visited, questioned that man, who unlawfully disclosed, leaked the info from the IPO. Up to now, that man has not refuted the statement, that it was he who leaked the info. But police ‘fraid him!!!!!!!

      Even the IPO cannot take any action against he who leaked the info submitted to it. Although a serious illegal act was committed against that same IPO.

      Wickedness? Injustice? Dictatorship? Plain to see.

      Some people do not care what they say. Their aim is to hurt others. They scandalize their names. There are some things that are better left unsaid and/or should be stated in the right place.

I too lost my dad to the negligence of the DR,s and NURSES, at the PMH. The health care should now be given PRORITY. Lets start to put a proper health care in place. Where pregnant women could go had have there babies born alive instead of being born DEAD, where elderly persons are given there medication as prescribed and not preventing them from taking it, where nurses can monitor patients 24 hrs, where there are more doctors on call and not only one , where inexperience doctors are not capable of handle patients the right way, where the young nurses act like they are doing you a favor when they are paid to do the job and the list can go on and on. TONY ASTAPHANS PLEASE PLEASE help us there, we have seen how dynamic you are in bringing justice to Dominicains, help us bring justice to our healthcare system.

      Neutral, I hear you. Tony, if you suddenly were taken ill and were rushed to the PMH hospital I would hope you would live!! A 26 pregnant young lady has just died at the PMH hospital this is totally tragic! I think two weeks ago a very talented 30 year old young man died of appendicitis! This is unacceptable! I was taken ill this week! I telephoned my doctor! He advised me to go to the PMH casualty department!!!! I asked him if he was joking did he want me to die! My doctor was silent for about a minute and said NO DO NOT GO TO CASUALTY!!! If you are any worse I will visit you!! Now the doctors are frightened to send patients to the hospital!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! :mrgreen:

      Are you not aware there is a time and place for everything? You do not make such statements in public. It was as if he was present and heard it. What he heard was hearsay which is not acceptable in Court.
      The bottom line is watch what you say. This was no way to win an election, going about making such statements. They were irrelevant to the campaign. Linton willfully said it, thinking that the general population would fall for it and elect him as PM. Let every man, woman and child know and learn it.

      Some Dominicans are too free with their mouths. They may think they can impress people with their indifferent words; not all are impressed.
      There is a Law in the so-called civilized place(s) that such words would not be acceptable. Those who make them are liable to be sued. Some of them make comments about others without knowing them or have never seen them. They go so far as to judge them. Who would tolerate such comments about them?
      When Linton said it, he could have been asked to resign from his post and not campaign for election. I think there is a certain degree of slackness in Dominica.
      Tony is Senior Counsel and has now put a stop to it. Thank him for that. Otherwise, next it may be you or someone whom you know.

      Retribution is the dispensing, or receiving of a reward or punishment, either while someone is alive or in the hereafter, it is something given in recompense either for the evil we do to others, while we were yet alive. Sometime when we the old suffering, with no one to help them it is not even good to have pity on such people.

      Because of the evil they have done on earth they might be paying for it whiles they are alive! Here we have an attorney, stating publicly about striking preemptively: Those of us educated enough to know the definition of the word, simply means strike first.

      That is warfare tactics, used in war! The army which strikes first usually get the advantage over the enemy. Are the politicians at war in Dominica? If Tony was practicing law in any state in America and conducted himself in that way using such callous language he would be disbarred!

      In the first place his cases would be considered frivolous, and would not see the light of day in a court of law…

      There is a US man, a so-called comedian who has a fowl mouth in the most disgusting manner. He was given a radio license and was able to operate in Canada. As soon as he commenced, a newspaper enterprise, an advertiser for his show pulled out their AD. It was not long after that he lost his radio license. I never listened to his crap which was unworthy to listen to. Many people complained about him. He must have lost listeners.
      I personally cannot stand it people bashing others consistently and utilizing bad language. It isn\’t funny. It is uninspiring. After a while it becomes boring just as the same to read.

        Emil, I could not respond in the sequence in which you wrote: I wrote the way Tony intends to strike preemptively. The only way he can accomplish that is to implement some illegal tactics!

        He can use the illegal tactics know as entrapment!

        To entrap someone is to lure them into a compromising statement, or act, we can broaden the scope by using the word entrapment which is the action of luring an individual, or individuals into committing a crime in order to prosecute them. In America that is unethical, and illegal, any lawyer who would try that here would be disbarred! People’s reputation usually precedes them, I hope Tony has no intentions of practicing law in any of the United States.

        All a victim of such would have to do is go to court and plea entrapment, and if found to be so the judge would sent the lawyer to jail instantly!

    This is a broad statement that can include anyone running for political office and not an accusatory statement of any particular person or minister.
