ATM cash thief gets lucky break

A major theft charge imposed against a Bath Estate man for allegedly stealing over $17,000 from his uncle, has been withdrawn.

Allister Irish was said to have stolen the money from Keverne Irish via his ATM card between December 24 -31, 2010. The defendant allegedly purchased numerous items including clothes and traveled to St Martin using the said money.

This morning, after presenting his testimony during the preliminary inquiry into the matter, the complainant decided not to offer evidence against his nephew fearing that he (the defendant) would be sentenced to a lengthy jail term when the matter reaches the high court.

His decision came after he asked the court whether there was the possibility that a stiff sentence would be imposed if his nephew is convicted. The magistrate explained to him that while it was not in her hands to determine what sort of punishment the defendant would receive at the high court, there was the likelihood of a prolonged jail term- one which would surpass any sentence handed down by the magistrate’s court.

“Your uncle saved you years of prison,” the magistrate told Irish.

The defendant also faces two summary charges of deception and theft for which the trial is set for April 3, 2012.

He had been on a $25,000 bail for the indictable offense with his mother as surety.

That bail was revoked today after an objection by the prosecution on the grounds that Irish had not followed his reporting conditions.  The defendant was supposed to report to the Roseau Police Station every Mondays and Fridays.

Bail was opened in relation to the summary charges.

He pleaded with the court not to have him remanded stating that he had an ulcerated stomach, a small daughter and had been reporting to the police most of the time. He told the court that he was going through a phase because of family issues which was the reason for not reporting. He said that he had telephoned persons at the station on the days that he could not report.

Before remanding the defendant, Magistrate George said that the defendant had shown blatant disregard for the court’s decision and that none of his excuses were adequate to convince the court.

“Anybody can miss a day, but not a whole month,” she said.

She warned the defendant that bail conditions ought to be taken seriously.

The prosecution also asked the court not to accept the defendant’s mother as surety as she had not displayed enough control over the defendant to keep him reporting as he should have.

    the lord is my shepered alister is a poor woman’s child , i don’t like what he does but it has worst thing that happening in the country investigate in the police station even in the court crimes happening , those who have glass windows don’t throw stones who laugh laughs the best…

      Some children will do whatever they have/need to do out there. What does his poor dad have to do with his behavior? Most children are like chameleons: Act one way in front of mommy and daddy and another way on the outside. I am certain the dad is ashamed, but, some kids will do whatever their little minds tell them without thinking about the consequences of their actions.

    He is fortunate to have such an uncle. It appears that his uncle has a heart of gold and after all was said and done he felt sorry for his nephew. This is genuine sorrow and forgiveness. I must state God bless his uncle for that. This is a lot of money to steal from anyone. May he not suffer too much financially for having lost this exorbitant sum of money.
    I suppose that the uncle lost every penny. Money and such an amount is not easy to get and to work for. Did the uncle retrieve any of the money?
    This man is irresponsible. He failed to adhere to bail conditions. His mother stood surety for him. He telephoned to say that he would not be able to report according to his bail conditions? Only in Dominica you say? This was not good enough and not acceptable and without a reasonable excuse or a doctor’s letter. Did the Police not serve him with a warrant when he failed to appear?

      Christianity has taught us to be humble. God detests those who lack humility.
      You also know what Our Lord Jesus Christ said among other teachings: “Whatsoever you do to the least of these you do to Me.”
      Pride comes before the fall. People who act as “proud as a peacock” and think they are greater than others will soon be humbled and fall, if only they learn that lesson.
