Behanzin still a magistrate by contract and constitution – Christopher

A senior attorney, who successfully appealed a sentence handed down by the recently dismissed Magistrate Tiyani Behanzin, has come in his defense amidst government’s non-renewal of his contract and refusal to admit him to the Dominica Bar Association.

Don Christopher said he is convinced that Behanzin was victimized in both cases.

The lawyer said at a press conference with Behanzin at the Garraway Hotel yesterday that according to the constitution and the magistrate’s contract, which he holds, Behanzin is still a magistrate.

Christopher said that he has no choice but to stand up against such victimization.

“When I think there is a conspiracy, against people, I only step in,” he said. “We have something called the ‘code of ethics’ of the bar  and people do as if it’s a new thing.”

He added, “I don’t have to like Behanzin, I don’t have to hate Mr Behanzin but once he comes to me in my professional capacity I have to assist.”

He said that according to Behanzin’s contract, which was signed in December last year, his period of service was from March 9, 2009, for two years, but his dismissal letter came on March 1, 2011.

“Do you know that Mr Behanzin’s contract was signed in December 2010 and his period of service is from March 9, 2011? He received a letter today saying that he will not be offered employment.  Mr Tiyani Behanzin is still a magistrate both by contract and by the constitution. His position is protected under section 90 of the constitution,” he stated.

He further stated, “And when I heard a news report this morning saying that people he worked against can sue and all that, they haven’t got the facts, I have his contract here. From March 9, 2009 for two years and you’re telling me on the first of March his contract has expired?”

Christopher is also Behanzin’s attorney in a civil matter brought by Behanzin against the government for their refusal to call him to the bar after being promised he would be.

The matter is expected to be called in court tomorrow morning before Justice Brian Cottle.

    It appears time has not changed in Dominica pertaining to employer and employee relations and employer fairness towards employees, whether contractual or not.
    We must be fair and just. Too often employers have the monopoly over employees who are wrongfully dismissed. It is time for a change.
    For also ethical purposes if Behanzin’s contract was not to be renewed, he should have been notified a few months in advance.
    Employees and/or contract employees should be given ample advance notice of termination and/or end of contract.
    The only way employees should be terminated immediately is if they refused to perform their assigned duties; if they were insubordinate; if they stole from their employers and were obviously caught; if they were warned – in advance – of non and inadequate performance and did not rectify their performance and were continuously late.
    Employees are also to be given “a letter of warning along with a performance report” which they will be asked to sign. Failing to sign it may deem reason for termination. Of course, if employees feel that the performance report which is written about them is unfair, they should still sign it but with a notation “I disagree and whatever else they wish to write pertaining to this report.”
    This is the manner in which reputable employers operate, whether it is the government or not. Employers do not immediately terminate contract employees and by no means after the expiry date of the contract and without documented reasons to the contract employees.
    Here is another employer and employee Dominican Constitution which needs to be adhered to and/or revised.

    My comment is intended to encourage thought.

    Do you think it is prudent for an employer to give notice to an employee of its intent not to renew his/her contract? Bearing in mind that at the time the individual would be authorized to perform duties which, if done inappropriately, could have a negative effect on the employer?

    I would not inform anyone of my intent to fire him/her. That person could sabotage your institution.

      Good question – It may not be tactful for an employer to notify and employee of the pending non renewal of contract if and only if that employee posses a threat .However it may also be prudent or respectful to inform the employee so that he or she can begin to make plans for future endeavors.
      Did the government have reasonable reasons to believe that Tiyani could sabotage the government? Unless the government is hiding critical information that Tiyani is aware off then I would think that Tiyani in his position as magistrate has no clouting power to sabotage anything. As far as I am concerned Tiyani is just an independent minded person who is trying to do his job without fear or favors. Is there something wrong with that?

      Why it is that the man cannot become a member of the bar association. Some people try to destroy the young man with unfounded allegations. Note these are the same people who accept and praise those in power who show deliberate disregard for the laws of the land. The hypocracy in Dominica is overwhelming and True hypocrisy is a recipe for a broken democracy.

    On a similar note I learnt that an employer fired an employee based on hear say. He never consulted with the worker. The employee never took his employer to court, he only prayed on the employer’s head, ‘May the curse of God be on the oppressor,’ eight months later the employer DIED.

      Excuse me sir/Madame, but what Mr. Christopher is illuding to is one of Mathematics (Addition to be exact). Such that if your contract supposidly started March 9th 2009, two years from that date to complete the contract should end March 9th 2011. Keep in mind we have not had any leap year between these dates, therefore this constitute a major error and subsequently termination and not failure to renew Tiyani’s contract because of this technicality. The Lord works in special ways when people act in haste and malice, and Tiyani stands to enjoy a sizable compensation from a law suit should he persue this case in that direction (whose money? Tax payers money). We need to analyze things objectively without being emotional, because the decision will be based on our constitutional laws. I feel sorry for Dominica, because people do not take the time to ponder on things before they write or speak. Mr. Maynard warned that we should think before we speak. I hope you do as Mr. Maynard’s advised.

      It is obvious that you lack basic common sense. It is quite simple. He was not given ample notice. Put yourself in his position. How would you feel? Would you grin and bear it and remain in the background and do nothing? Based on the Constitution, he has rights too and the right to seek reinstatement with adequate financial recompense.

      I’d just like to know on what basis you make these observations.

      However, I will admit that I too have wondered about our education product. How or is it preparing our people to think critically about sundry problems – civic, political, economic, social – facing our country.

      Seems as if we respond ONLY with our gut reaction and fail engage in analysis of the facts/evidence and the merits of a situation.

    This is utter nonesense the Governmenet of Dominica should have more respect than that. This is not how things are done there is no code of ethics that is why the country is in such terrible condition. Common killings are happening in broud day light, people are missing or disappearing which ever is it. Lawyer home is beinjg bombed,police officers are being attacked because they are doing their jobs all this and we only get famous speeches from our ministrers. This is BULL and the Goverment knows that Tiwani was getting to close that is why the canned him!!!

    what you on about here really? everyone know the man is educated and he can always find educated people to bring his case forward. but the government has very many educated lawyers too. the best in dominica in fact. thing is, you cannot take gov to court over a contract you do not own. if he was fired then fair enough. but all that will happen here is that he will be given the remainder of the contract (if there is any) to work and then he will have no contract after its maturity. i dont see how this turned into such a big drama. if he want to be in politics he need to just do that and stop using the love of the public to manipulate things. he is actually using public admiration to blackmail the government in my eyes. reinstate me or i will take you to court. and he took it to every media possible. so he telling his employer, give me a new contract or else court, and it will be a bad move for your political careers if you dont. he not better than any politician if thats how he is going on

    Does it really matter what date you receive notice?? termination means contract not being renewed on said initial terms- meaning from inception to end…. GEEZ.. not renewed!!! as of whatever date this is your notification contract terms with x-party has or will not be renewed… time to get some common sense discussions instead of all this crap arguments polarizing our country.. much of a bone or challenge can be picked with Gov on many matters, and I’ll lead the way.. But this seemingly irresponsible actions by those who should and suppose to carry a little bit of legal savy and public responsibility… If you want to be a political pundit fine…..       I think you missed the point of what the gentlemen said. The contract was not renewed nor was he given notification that it would not be renewed by that 3 month notice. If the contract’s end date is March 9th and they terminated this said contract on March 1st it’s a breach unless there is a reason for termination. Based on the statements in the article the contract has not yet expired.

      By the way, this ‘personal matter’ as you state is yours and mine in this case. There is a general consensus that this magistrate provided a service matched by none else in his field on island.

        what 3 month notice?? you refer to time period(proper due notice) prior to expiration of contract, If said contract is to be renewed!! no action is required for non-renewal… Notice of non-renewal is not the same as forced termination! Let’s suppose that expiration date as stated in this article is correct, advance notice on non-renewal is not a breach… His performance as a magistrate is a total different story.. The perception of doing a good job based on sentencing of accused is up for debate.. an entirely different debate.. Lets not get it twisted..

      I agree with the commentator. Mr. Behanzin has himself to blame. He is the son of the late Prime Minister. That, in and of itself, on its own merit cannot keep him in a job anywhere – even in the public service. There are a number of issues that has to be addressed for someone to keep a job placement. Being the soen of a former Prime Minister is not one. It is rather regrettable that under the guise of freedom of expression (which Mr. behanzin has a right to enjoy) he seemingly preferred to take every issue he has with his emplyer to the media. If he has a disagrement over a particular matter involving his performance on the bench, rather than discuss the same in house and seek to find a solution, he runs to the media. The system’s failure to have him called to the local bar is a real issue that require dealing with once and for all. But can the “Hot Seat” or “Between You and Me” assist in that process? Perhaps he tried to get things done in the right way away from the prying eyes and ears of thsoe who run things in the media and did not get a responsible or assuring answer. But running to the media with every beef you have with your colleagues, who must be equal partners in your successes could never have been the best way to address the issues. Infact those he has chosen to represent his case or with whom he has chosen to champion his case are all up in arms against every, every action good or bad of the government. Could they have helped his case? They most certainly served to alienate him from the local Bar. Do you want soewmbaody who at every turn try to denigrate you to be an associate of yours.

      And what about the many complaints by practicing members of the Bar. What about the unprecedented complaints and reports about his performance by other attorneys? should that too be a no consideration.

      It has been advanced and argued that Senior Counsel Tony Astaphans, Counsels Alick Lawrence, Lennox Lawrence and now Mrs. Evans are always present and involved when matters involving government ministers (privately or officially) are taken to court. These attorneys are always involved somehow. For some this is a sin. In similar fashion, I could not help noticing who is or attorney’ s who are always involved when the state or its ministers of government are brought before the courts

It is not a crime….when certain things happen in the community some of us complain that the public never gets all the information on certain crimes that take place..Some of our employers often abuse their power hence they sometimes need to be exposed so others may think twice before they victimise or abuse our workers….we all here assuming all sorts of things about Mr. Ben……some of u always seem to think allu know what someone motives are..and the truth is that some of u aint know shit….
        FYI…i had sad serious issues with my employer..the issues were not resolved until I went to the media…now he is the best employer ever…maybe he is pretending..but who cares..at least all the employees are now bein treated better..i know it may not work all the time but at least i did what i had to do to get results

    I understand that the government did injustice to let the man go before his contract was up, but did we ever stop to think why all this happened? We Dominicans just like to jump the fence before we get all the facts. If the man did nothing wrong, then God will deal with this because he never gives us more than we can handle.     i thought they said they refused to renew his contract? what does that have to do with current employment? if he is still under contract and still employed then he should go to work till the contract has matured. when it has passed maturity then thats it. so if gov fire the man that is different from renewal of contract and they wrong. however he can only legally go to court over the remainder of his contract. unless the terms have been violated. anyway, this is interesting. i wish him luck still cos he serious with these CRIMINALS

    It is obvious that Dominica needs some serious help when it comes to law. it seems that Dominica’s laws are being used any way, people are doing what they want and are trying to convince us otherwise. The law should be more solid and this form of manipulation that is going on in Dominica needs to stop. It seems that the ‘learned’ individuals back home are really trying to fool us. When something happens it seems that people can just come up with a fast twist of the tongue and have the whole country in chaos. If the man’s contract is for two years then he was wrongfully dismissed. What is going on in my sweet country? Wee need some answers, we need a revising of laws and we need solid documentation.

    People, this is just a taste of what is yet to come. ..and its all because people get the gov’t they deserve.

    DOMINICANS WILL NOT PROTEST BECAUSE THEY ARE COWARD, IGNORANT, LAZY AND SEEM TO THRIVE ON MEDIOCRITY!! Tiyani has done alot in the little time that he has been on island. We have to give Jack his Jacket, the man has made a tremendous positive impact, the likes we have never seen from a magistrate, and the gov’t says to him, no we don’t want honest, hard-working QUALIFIED people, that too good for the citizens, is coshoni we want for them, get out Tiyani!!!

    Dominicans are scared of losing the pittance they get from the “Red Clinic”. They are blinded by their love for skerrit and his gov’t, they can do no wrong!! I am ASHAMED to be a Dominican!! I had plans of coming home, but that’s it! If this the kind of treatment an educated and qualified professional gets, then with my degree in hand I will receive no better. I will go one step further and encourage all qualified Dominicans overseas to think twice before coming home, because Dominicans on island hate hardworking, educated, qualified people. Is ignorance and coshoni they like.

    If Skerrit could take bread from Rosie child, I am putting nothing past him, the country done sell already. As you make your bed, so you lie on it Dominicans…

      Get a grip on your emotions. That’s quite a rant you just went on with no shortage of fallacies.

      There are hardcore Labourites, same way there are hardcore UWPites and maybe a few remaining Freedomites, but your generalizations are unfounded. The real reason why the DLP is in such a position of strength in d/a is because the UWP is in shambles with no clear leader.

      You expected people to vote for a party with no manifesto which spent an entire election campaign talking about bin bobol?

      You said “Dominicans on island hate hardworking, educated, qualified people.” Where is your evidence to support this claim? In case you haven’t noticed, the vast majority of persons commenting are dismayed that Behanzin was fired, so on what grounds are u using him as evidence that Dominicans hate qualified people?

      And why are you discouraging Dominicans from returning to develop the country? You are so emotional about Behanzin that you are abandoning your country? That’s weak and pathetic, not to mention unpatriotic. You’re a quitter!!

      What the educated people need to do is push the washed-up opposition leaders Ron and Edison out, and give Dominicans a credible alternative.

      Right now we have none.

        You know anti-hate I totally agree with you. A lot of Dominicans are displeased with this present administration, but they say to themselves, if not DLP then who? Who? Who is the alternative to lead Dominica. I for one have been struggling with this a long time now. I look at the Freedom party, I love the ideas of Pestaina, she is honest, well spoken and very intelligent but I am not so inclined when I look at the rest in her group. As for UWP, the only person there that I see looks ok is Ronny Isidore. I don`t know, I think Edison and Ron should give new intelligent individuals a chance to come forward. Hector John needs to find his own path as well and stop following Edo and Ron everytime. He needs to also get some schooling in public speaking etc.. etc.. And all parties in general need to stop insulting each other personally and speak to the issues. Yes this administration is corrupt, ettel building big house and have how much money blah blah blah… At the end of the day what the common Dominican want to know is if a party wants my vote what are their views on healthcare, education, housing, employment, building industries, tourism, what are their plans, what project do you plan to bring on string and how exactly you plan to do it…Too much of Sherritt this and Skeritt that, I mean man everyday is the same thing I hearing, that`s why after a while the people of this country go deaf to all this ranting cause they are just tired of hearing the same ole same ole everyday.

          I will not return to DA not after the way i was treated by this goverment to start a much needed foundation on the island in an effort to get the youth out of the blocks…u guys haven’t been in these types of situations hence you dont know what goes on…..there are so many things that took place but I will not give the details on this forum
          I just had to pack my bag and leave…at least i have made several attempts to make positive contributions to my country….

          It is so amazing to read some of the comments here .I can’t understand for the love of my eye, that some people think presently the labor party is the only party to run this country. The if not labor, who!! Is crap. Dominica today has more people with leadership skills and that are very capable to lead this country. A leader is not who can ask best or hold a certificate in begin. It is one who can use the natural resources of his country to help develop the people and nation. Any man who thinks that is it better to be a beggar; I say you have no vision. The question of asking people to lead, don’t you all notice every time some one decide to share a view different form the Govt they always call them UWP . Talking to Edison makes one workers and talking to skeritt you are labour. People of this country are so twisted, it is sickening. BLESS
