Belles man to fork up over $800 a month to cutlass attack victim

(DNO) After pleading guilty to inflicting several wounds to the body of Lindel Benoit with a cutlass during an incident in Belles in 2006, Chester Seraphine, 22 of Belles, was burdened with the obligation of paying $800 compensation to the Benoit every month end for the next 10 years as directed by the court.

Seraphine, who appeared before Justice Birnie Stephenson-Brooks on Monday, inflicted wounds to the complainant’s head, hands, and feet following an argument and struggle over an axe pick on December 7, 2006.

According to the facts presented by the state prosecutor at the High Court , a doctor’s report stated Benoit had received a 9cm laceration to his frontal bone, a 4cm wound on right shoulder, a 10 cm superficial laceration on right leg, 5cm superficial laceration to right foot, and abrasions to right thigh. He also suffered a 15 cm laceration to the palm of his left hand.

According to the prosecutor, Seraphine had ran into the kitchen for his cutlass after the argument began.

Attorney Peter Alleyne, who represented the convicted man, asked the court for mercy on his clients behalf. He alerted the court that his client had already spent 11 months on remand for the incident.

The court ordered that if Seraphine misses any monthly payment he will go to jail for 14 days and still has to pay the fine thereafter.

He was also fined $5,000 in six months or in default he will spend 24 months in prison.

Seraphine was also bound over to keep the peace for three years.

    that sentence is hash you punishing the man how many times come on he already spend 11 months in jail have to pay 800 a month for 10 years and stil have to pay 5000 in six month the f o @@ ing judge to wicked and am not saying he did not have to be puynish for his crime but lord that is too much

    $9,600 a year .. $96,000 for 10 years. Not too bad. Sadly, the victim might be cripple for life.

    Now that is what I call the Crime Control Perspective in sentencing!! WOW!! I like that until I there dancing and singing. Finally we get a judge that is as bad as Tiyani. Next week the lawyers will gang up and say he not following “established” sentencing guidelines. I hope the other other magistrates and judges taking note.     Very good!..Hopefully that should be a deterrence for others who think they can take the Law into their own hands and do grievous bodily harm to others with a cutlass or other deadly weapons.
    His passport should be seized, so he wont leave the Island,and run away..The ruling of the Court must be strictly enforced……..That Justice should be applauded,for sending a clear message to other idiots out there…..Thank you, your Honor!……
