Bernard Wiltshire arrested

Former attorney general Bernard Wiltshire confirmed to Dominica News Online late Monday that he has been arrested by the police.

Speaking from the CID office, Wiltshire told DNO that he was arrested at about 4:45 Monday afternoon, for according to the police “conspiring with persons unknown to sell a Dominican passport”.

The outspoken attorney has described this as a “bogus charge” being imposed by a corrupt regime.

He said he was informed by one police officer that the person with whom he is alleged to have conspired admitted to the police that he doesn’t even know Bernard Wiltshire.

Both the Sun Newspaper and DNO reported earlier Monday that attorney Wiltshire had filed a civil lawsuit against the police for alleged wrongful arrest in connection with his alleged involvement in a major passport scam.

Wiltshire was detained in June 2011 for ten hours and then released without being charged.

In an interview with DNO earlier today he said he had been treated unjustly and very “unfairly” and his lawsuit was aimed at preventing such acts by the police, whom he suggests abused their power in focusing on his signing of one passport form for an individual, while other lawyers said to have signed over 40 such forms for suspects in the alleged scam had not been targeted.

    Bernard signs one passport form and he is arrested not once but twice.

    Another lawyer signs a pachay (alot) passport forms and is not arrested not once nor is he not even called in for questioning?

    A warrant is issue by the Chief Magistrate to arrest a lawyer on 42 counts of criminal charges and up to today nothing has happened.

    So where is the rule of law in Dominica? The principle of the rule of law states that all men are equal and should be treated equally in the eyes of the law. So why only Bernard?

    Coincidence that only yesterday the story about his plans to take legal action against the police and his being arrested; i think not.

    He’s a lwayer and I think he may have justed used the media to gather some sympathy. I was surprised as to why he waited so long, since June 2011, and only now stated his intent to file a lawsuit against the police. However, now that he was re arrested, it all makes sense to me.

    I would also think that as a lwayer he knows that it is possible and reasonable that 1 can be held and interrogated without charges being laid for a period of time. However, in many jurisdictions, you cannot be held for more than 72 hours without being formally charged. Of course, Dominica law is different, but the police can detain him as long as is justifiably necessary but no longer than the statute allows.

    So 10 hours is reasonable in the real world.

    The ignorance of our people is quickly becoming more and more laughable. A man files legal action against the Police for wrongful arrest,7 hours later he is arrested by the same police on a false claim where the one of the accused does not even know who the other is.

    Instead those idiots ask themselves what’s really going on in their country, they talking garbage about “take infront”?

    It seems it takes minutes to prepare a legal suit?

    It seems it takes over 24 hours to find Mr. Wilshire? That he could have time do all that while they “going to arrest him”. The man’s office is a 2 minute walk from the police station.

    Do these people even think before they speak?

    Is this labour party politics totally blocking their brain?

    What absolute garbage is that about take infront?

      The police are doing the right thing. To many people are abusing our passport for a $. They needed someone from the registry to make the birth certificate and someone seemingly credible to sign the form vouching for the passport recipient (a lawyer). The recipient paid a lot of money and they all benefited. The documents went to the Immigration purporting to be valid, true and correct. The immigration made the passport and handed over to someone on behalf of the fake recipient. The recipient was arrested in Italy and the info. relayed to the police in DA. The DA police took action and rightly so. This deception should not be allowed to go on noticed not withstanding who is involved.

Because I know better I see that’s how the powers at be want things to be in Dominica (chaotic, divided and clueless). I’m waiting to hear of other arrests and prosecution of suspects on this matter of passport prostituting and other cases where citizen safety has been threatened (e.g. GON Emmanuel and wife), destabilization of our constitution so that it favors a select group, malappropriation of country funds for personal gains or on projects with little to no sustainable returns etc. As it stands now Dominica is in peril. A clear indication of dysfunctioning bordering on a failed state.

    Those who say the country is functioning well, please take a look at issues like per capita income, standard of living, unemployment rate, employment growth, private sector growth, entrepeneurship, viable foreign investments etc. If after scrutinizing these areas one can conclude that things are rosy in Dominica then I will plead the fifth.

    Many of us are caught up in an illusion gravitating towards personality and idolizing of select individuals rather than demanding professionalism, accountability and productivity (PAP) from them. If not for us surely for our children. We say we are Dominica but we best take heed for it seems as one calypsonian once said “plenty water” will wash Dominica soon.

    Careful about eating sour grapes that seem sweet for the children’s teeth will stain (i.e. The children will suffer.). The father’s teachings are intense and harsh. As we say if we are on the road to consistent justice then “bring it on” without fear or favor. Until then it’s simply a mirage!

    Yes ,they have to hold them one by one.Our passport every where,where ever you pass someone has a dominica passport.I mean somebody who wasn’t born in dominica.What that burning me is that, when we go to a foregin country we have to wait so long before we get that country passport ,sometimes they never give it to you ,they just keep giving you papers all the time.Hold their backside self it’s about time eh eh.

    The Chief Magistrate signed and issued a warrant for the ARREST of a certain Lawyer some time ago. 42 charges of FRAUD and other CRIMINAL activities were filed against that Lawyer. Everybody knows millions were involved.

    That said Warrant was sent to the police for follow-up action. My people, Jik Johdi (UP to Today), No Arrest. Police Chief claim that he, the Chief, was out of State, so No arrest. You all Remember that?

    Didn’t another Lawyer sign 40 times the number of forms Wiltshire signed? Isn’t that other lawyer also a main sales agent for our passports?

    What about Transparency and Accountability in those sales? Have any Dominican diplomatic passports reach the hands of some people of questionable repute? Have some non-Dominicans who have our diplomatic passports in exchange for money or whatever, and appointed as our Ambassadors overseas, been rejected by respective foreign countries? Isn’t that true? Authorities cannot refute that.

    Nothing revealed about those secret deals are true then? But the info found out cannot be REFUTED? Only twist and turns and lies. Nothing. No arrest. No court. no sleeping or standing in cell. No Case. No Charges for the UNTOUCHABLES in Dominica. If you dare speak about the ills in Dominica, victimization. TRUTH could never be buried forever.

    Wiltshire will never be daunted or silenced for exercising his RIGHTS to SPEAK. A few in our Society cannot be allowed to do whatever they want and honest patriotic Dominicans are harassed for expressing their concerns against corrupt practices and a system where justice is not for all in our land. There are several examples recently of outright victimization of our brothers who are fearless to speak about national issues. Is so Dominica come, nuh?

        It is common during an investigation for the police to arrest someone and release them pending investigations. After the police have gathered all the necessary evidence, rearrest the suspect who in that case is the lawyer and prefer the necessary caharges.

      What I dont understand is why it so easy for allu to understand that Bernard made a “mistake” re: signing /conspiring to sell a passport and without he even begin to prove his innonce you can believe him…and its victimization?

      And on the other side of your mouths call for the arrest of people that you can only allege to have fraudulently sold passports and hide them under de jail without evidence to support your claims. Now the only evidence you have is the sayings of people including BW himself.

      What do you Dominicans want? How is it do you decide who should be believed or not? By the party they vote? By profession?

      Not long ago you praised the court for charging a young man $10000 for a a fraudulent $50 bill but BW too squeaky clean to be arrested?

    yeah Gom….both in Dominica and the states….eligible people have signed passports forms for me including pastors and lawyers…and they did not even know me for the time stipulated on the form….they knew me however and one lawyer did not even know me from Adams they simply helped me out…seem to me like this guy is being victimized……….those wicked people on here papa….

      yep at a notary public office …all you need is identification and you get it singed right away….and my identification was expired…so at one office i was not helped they stuck to their stupid rule claiming that i need a current id while i was helped at another office…

    I am not sure what is going on in Dominica but the news coming from Dominica is very disturbing.

    They arrested Mr. Wiltshire once before and released him, so I take it they have concrete evidence if they arrested him yet again.

    I hope the police will also arrest all involved in the sale of Dominican passport.

    Power and Justice does indeed make for strange bedfellows.
