UPDATE: ECSC dismisses election petition; PM vindicated says Astaphan

After nearly four years in court, the battle questioning the legitimacy of Prime Minister Roosevelt Skerrit and his Education Minister, Petter Saint Jean as elected members of parliament, has ended.

On Monday the Easter Caribbean Supreme Court (ECSC) ruled that the United Workers Party had “failed to prove its case” against Skerrit and Saint Jean.

In his decision, Acting Justice of Appeal, Don Mitchell, explained that “The burden was on the appellants to have brought the necessary evidence before the court to prove that under the law of France, the respondents being in possession of French passports was an act which amounted to an acknowledgment of allegiance, obedience or adherence to the state of France. It was necessary to plead and produce evidence which would prove the principles of foreign law which would disqualify the respondents under section 32 (1) (a) of the Constitution of the Commonwealth of Dominica.”

Petitioners, he said, making specific allegations in their petitions about the existence of a disqualification  “must bring the appropriate evidence to prove their allegations.”

According to the judge, the pleadings before the trial judge were confined to narrow issues of fact. “Mr. Green alleged that Mr. Saint Jean had been issued a French passport between 2000 and 2002. There was no pleading that Mr. Saint Jean had applied in person for, renewed or travelled on a French passport. The judge rejected the evidence of the witnesses who claimed that Mr. Saint Jean had shown them his alleged French passport,” he stated.

He went on to state further, that “there was no attempt to produce evidence he had been issued a passport between 2000 and 2002 as alleged. On that basis, the petition should have been dismissed. The allegation against Mr. Skerrit was that he had admitted that he was the holder of a French passport. Mr. Joseph conceded at the trial that this pleaded admission was false. The petition should have been dismissed on that basis alone.”

“I would dismiss both appeals and the counter appeal. For the reason given by the learned trial judge in her judgment, viz the great national importance of the matter, I would not make any order as to costs of the appeal. The order is that the appeal and the counter appeal are both dismissed with no order as to costs,” Mitchell said.

Two members of the opposition United Workers Party (UWP) had gone to the courts attempting to disqualify Skerrit and Saint Jean as Members of Parliament (MP) on the grounds that they had breached an electoral code since they reportedly held French citizenship on Nomination Day, ahead of the December 18, 2009 general election.

The matter was first heard in the High Court in Dominica but Judge Gertal Thom, had ruled in favor of Skerrit and Saint Jean rejecting the petitions by the UWP members, Maynard Joseph and Ron Green.

The decision was handed down by Her Lordship the Honourable, Janice Pereira.

Meanwhile lead attorney for St. Jean and Skeritt in the matter, Tony Astaphan, said the prime minister has been vindicated for his ‘no law, no constitution’ speech, which has been widely quoted by critics.

“This raises once again, the comment by me, that when the prime minister said that there is no constitutional law that could prevent him to be nominated, he has been absolutely vindicated in that respect because not only there was no law preventing him from being nominated nor could he be challenged from being nominated,” he told Kairi’s Heng Program on Monday after the ruling was made public. “The fact is that there was no facts to justify anyone challenging his nomination and election at all.”

He described the entire matter as ‘nonsense.’ “This nonsense has now ended and it is now behind us, we now have to move forward with this country to continue the great work that Roosevelt Skerrit and his government has been doing,” he noted.

Astaphan also pointed out he respects the decision of the court and would have respected it if it had not gone their way.

    Hello my people and good afternoon. Well I cant believed how so many of our people are so naive about court procedures. This case ruling is correct because there wasn’t any evidence provided which would resulted in a reversal. The Court in Dominica ruled that the Prime Minister and Mr Saint Jean didn’t have to turn over their passports rather it was the UWP that had to prove they had such passport. The only way that was left for UWP it was for them to Subpoena the records/Passport applications from France Immigration Department but they failed to do so therefore this case should have been over . We must remember that hearsay isn’t evidence and a defendant don’t have to give evidence against themselves.

Not once have Brian Allyne, Julian Prevost or no other candidate get more votes than a Labor candidate in Massacre itself. Even Roy Shillingford beat those guys. Leave us celebrate

    What exactly is the JAM in Lagon for? Skerrit admitted he had French Citizenship. I personally felt UWP was fighting a loosing battle once the court deciced the Passports were necessary, and of course they couldn’t expect the men to present their passports and incriminate themselves further. However by their very utterances that they can’t provide the passports, because it would self incriminate them, no one needs anymore proof. Since they gave up those rights, and clearly would have won if a bye-election were to be called UWP wasted their time further. Forcing them to give it up was victory enough. Dominicans need to understand that this is about the Constituion, everywhere else people stand on the Constitution for their defense, in Dominica we prance on it.

    So much for GOd fearing and christian nation. Give them rum, after the population will increase, they will fight amongst themselves, the politicians will blab, and tommorow they still ignorant.

    It would appear that Skerrit is the most perfect righteous human being on the planet. No matter what he is accused of, he gets away free and clear with not so much as a speck of mud on his $5000 suits.

    But we know that is not possible that a mere man is perfect. Only God is perfect. So Labourites seem to have accepted that Skerrit is corrupt but don’t care. As long as Skerrit continues his red clinic and giving us concrete to eat and flashing those dimples, Labourites will turn a blind eye.

    Not to say UWP supporters would be any different if tables turned as they too turned a blind eye.

    Dominicans planning on entering the arena need to understand this. Dominicans don’t care about theiving, criminal politics. New blood. The blood of this country’s future, will have to find some angle other than corruption to get Skerrit and other potentially corrupt politicians, out of office and a passionate leadership in.

      Nothing is settled (over) untill it is settled right. This is a serious miscarriage of justice, and a cop out by the justices, by concluding at the appeal level that there was insufficient evidence. This is one of the most ludicris decisions ever made by any court in the region.
      For persons to now accuse those of us who choose not to have our intelligence insulted , as not loving country, is to not understand the gravity of the situation.

      The constitution is the pillar that supports the country we call DOMINICA. It is the bedrock of the society, when we can allow such flagrant violation and disdain for the constitution, we signal the end of the rule of law, and welcome in frontier justice. This is indeed a sad time for Dominica, and I take offense at anyone who will challenge my love for Dominica, because I challenge the misguided decision of a court that is comprised of people who do not respect the santity of the Constitution of Dominica. Is this a harbinger of what is to come under the CCJ? Please Sir Dennis tel us it is not so.

    Ok time to move on. Election is around the corner. UWP has spent all this time and money in trying to remove Skerrit. Not saying they wrong or right, but wondering how much energy and resource they use on preparing for the next election. If none, then it will be another defeat.       My God – its the principle…..certainly there must be some morality in fighting justice. What did Martin Luther King die for? He was told give it up, what happened to Rosa Parks, they suffered and we have some level, or acheieved some level of decency as human beings. Why must we have our politiciians lying to us day in day out. Look an MP and his wife in London sent to prison for 8 months for cheating and lying but in Dominica and Caribean we celebrate the lies and cheat of our politicians and they will sonn have a big celebrate that they have cheated the system and then we send our youths of to jail. We are not yet a mature people, we hide things under the carpet and we support and promote corrupt leaders. The talk now is we need proper, good and accounatble governance in Dominica.

    Man,I admit I may be wrong, but I will still maintain that UWP’s case was against the Electoral Commission and not Skerrit and St. Jean eh.

    It is the EC’s responsibility to ensure that all candidates are on the up and up. If they failed in their duty to properly investigate and certify election candidates then the onus is on them.

    I am quite certain that the EC acting in its official legal capacity as the guardian of the national electoral process of a sovereign country could have appealed to France and get all documents and information pertaining to this matter.

    But then again, I am not a learned lawyer….

    I always knew the case would vindicate the PM. The case was always spurious based on the facts. The PM knew that he was within the law so he was able to state that no law could prevent him from being PM as he was within the constitution of the Law. The opposition have very bad advisors. They need to evaluate how they are spending their money. They need to concentrate on building their party support base. concentrate on understanding demorcracy and law, they need to start looking like a viable alternative,instead of a set of sour losers.
    The opposition really eed to drop all the court cases and start concentrating on changing the image of their party as really being about a better Dominica rather than being about let us hate Skerrit.

    This is the strangest decision i have come across. The judge referred to the fact that you had to intepret french law. What about Dominica laws, does it matter? Isn’t the case based on Dominica’s law which refers to dual citizenship? very very strange.

        And even more importantly, French Law prohibits continuation of citizenship privileges when one becomes a public officer or head of a foreign state. Thus the interpretation of French law as pertains to what appears to be a strictly unilateral condition had to be investigated by the Court.

    Does this case set a precedence for persons wishing to run for political office? The verdict in this case was that the plaintiffs were not able to provide proof. I am sure if the judge had requested that the passports be presented as evidence, we would all see that the defendants indeed had dual citizenship.But how could they prove when the document that holds all the evidence -the passports-were omitted from the court? Right now there is nothing that can prevent someone with dual citizenship from running for office. All they need to to is to ensure that their passport do not appear in the public domain. As a matter of fact this case clearly showed that no one can force you to produce your passport to verify your citizenship status, so everyone can use that as a defense against self incrimination.

      Honestly your comment is so on target, and sadly true.
      They don’t see themselves as one unit, but fragmented factions, working to gain the favor from those they put in power,
      Funny enough, whether the person has leadership qualities or not, or is the best for the country, they don’t care, the person could be out of state, and careless about the well-being of the constituency, they will still support them, biting the very hands that’s feeding them.
      They tend to forget that resources don’t come overnight, and our topography is really difficult and very challenging to work around, still taking into account our nature island status. Generating revenues back then was easier because the smaller country were with economy like our were favored and protected but we now living in a global village where everybody has to fend for their own food and individual entrepreneurship is the way to go, but alas this is one of those key ingredient that is lacking in this country, they are still waiting on government to even clean in front their door.

    dear UWP / DFP

    I am not a political operative just an objective observer. The opposition must listen to Daryl Bobb and go back to the drawing board. A comatosed DFP is playing hard ball and want to do things on their own. Is it that FREEDOM is still more vex with WORKERS for removing them from office in 1995, than they are with LABOUR for helping them beat UWP in 1999? Even with a united opposition its going to be very difficult to stop this administration. Our Political culture is such in Dominica that when you are in power with a huge mandate then its hard to get you out of power. Workers won by 11-10 in 1995 ; this was too slim a victory to sustain power and in one single solitary month ROSIE came down and the rest is History. What were the people saying ? ” I was always labour we ” ” my mother my grand father allmy aunties all my family longtime ago was labour we ” I going back to my roots ” That’s the reality that we have to face. There was no ideological rooting for the UWP and hence it just fizzled out.
    There is the view that a new political party is needed. I think that this will not work. A fragmented Partisn electorate will only favour Labour. The main UWP must regroup..too many people talking on its behalf. I think that people get lost over listening to them. They need a sense of direction and some believe that the leader of the opposition is classically weak and doesn’t seem to have the support of the mainstream supporters. Many believe that L L will be better suited to not only lead the UWP but also become the leader of the opposition. However this is an elected office so he has to run and win either in Marigot or even attempt political suicide lets say in Newtown.

    Realistically I don’t know how much more WAKE UP CALLS UWP needs. They continue to be delusional and continue to believe in their own impropaganda ! Theyre too easily distracted whether it is through calypso, and d king puppet writer, talk show hosts etc its the same nonsense over and over again. Oh what about the well acclaimed unjust enrichments I guess radio fund mania will be on soon. WAW I WANT TO SEE an independent audited financial statement on all those monies that are being raised in the name of ” democracy ” and transparency. Bye the way they the UWP wasn’t called upon to pay costs for that appeal they loss.

    Am not surprised at the final outcome at all. The people shall have an opportunity to read it in toto at some later stage when its published on the courts website etc. Well we expect all the test tube Chief Justices of talk show politics to continue to vilify the courts. The justice system is so bad yet they seek redress through it….waw that’s new Mathematics. I guess people must be convicted on circumstantial evidence and the same must be done on inference…come on we have to be a wiser people than that. The substantial majority of independent observers are of the view that justice was seen to be done. The Eastern Caribbean Supreme Court continues to be one of the ,most respected courts in the Commonwealth Caribbean . It consists of some of the brightest legal luminaries in the region. These men and women go about their task with honesty , independence and professionalism. They do so without fear or favour but with knowledge , wisdom and understanding, humility and great conscience . They do so fairly.

    I think that the opposition elements must convene a special gathering to discuss joint approaches with the desire to unseat the ruling DLp. They need to restructure, get new personel, get serious funding, mobilise support on the ground, set up opposition party branches and put an alternative plan for Dominica’s development . They must also put an intelligentsia mechanism in place to collate the necessary evidence so if and when the possibility arises to take the government to court for any alleged breaches of the constitution or any law then they will be more likely to be successful.

    I thought that when an appeal is heard what the judges are looking for is for judicial errors or wrong interpretation of the law. I didn’t know that at an appeal the judges are looking at evidence.     This is a civil matter against the state not a criminical matter that requies jail time. Therefore the foriegn passport should have been subpoena by the judge in making his judgment. That is whats happens in other civil cases like divorce and child support, records of finiancials are subpoena by the judge to provide a right judgement for financial support or equitable distribution to the plaintiff.

Why not hug one another, and give thanks, that the Country has gotten another opportunity to move on for Progress. Why not focuss on the fact that there is an institution in Place like the ECSC, that is existing to mediate, and decide our justice/injustice for our People. Well, some of you might discard my opinion as B.S, but my blood pressure is very normal typing this post! People of Dominica, it doesn’t matter, who is in Power, there will be Division. In my opinion, I can say one thing, in all my Life, it’s the first time, I have seen so many Developmental Projects in D.A, by an Elected Party! I can related because, I have international Education and Experience. My heart is for positive Growth for the Island. So I say, build that 40 million $ hospital quick! and Let’s get a quick Solution for the Airport, to enable the best customer service ever for our outgoing/incoming travellers. I see a Stadium, that encourages not only Entertainment but, Youth Development in Sports, I see better Road Contruction, ease of travelling, I see security (U.S Aid), reducing illegal nacotics in our Island, I see University Contruction, increasing Education opportunity for our children, I see, State accommodations so we can present our hospitality to International visitors etc etc etc! I want to see more positive Development for our Island, because when our current People are gone, and our Children are left, Hence, The American Indian prayer,

    Mendes cannot be that good if he could not present his case properly. All that was hinged on seeing the passport and mendes failed to make his case. How were these kind of cases presented in other courts. In the other OECS island all these cases were won. When the judge refused to allow the passport in the courts, was there another way to get it. This is the question.

        Hello. The court in Dominica said the Prime Minister and Mr Saint Jean didn’t have to submit their passport . Then Mr Mendes should have subpoena the passport applications from France Department of immigration then everyone would have learned the truth.

      The other cases were won because the use of the passports were displayed as material evidence. When one uses a passport, the passport information is surrendered to the immigration officer; thence it becomes public information. Why did the plaintiffs not obtain any substantial evidence to support the allegations is both beyond belief and a flagrant display of lack of commonsense judgement.

      i think the local legal minds on the team here could have done more n building up the case knowing how the courts in the region operate…

      relying only on the letter was not enough wait on the courts system in the caribbean, they should have tried to get a date of travel, say from one of the french islands to another destination or get a insider from the french system to give them his renewal or acceptance of the docs…

      so honestly the legal team should have gotton more beef on the bone period….

      rather than walking around playing big and not worth your salt not knowing your field of work..
      maybe another local attorney would have built on the case far better than the one the UWP used locally…he doesn’t get it at all…

        Windy Hill, the question of evidence at the appeals level appears to be novel to Dominica. The justices had to determine if the trial judge erred in law, not whether there was sufficient evidence.
        They are yet to tell us whether the trial judge was correct in disallowing the respondents to present their passports, and themselves in court. Ad that my friends is the bottom line.
        We have judges that do not know their jobs convently, of course.

      Dominican nationals, those who speak of poverty must also help their country and get others to do likewise. It also includes to do something concrete for themselves which will enhance their lives. The government should not be expected to do everything for those nationals who are specifically irresponsible and who, as abled people do not exercise their obligation to themselves, to others and the nation when they do nothing to help themselves.
      You should have heard/read the words of the late President Kennedy, “Ask not what your country can do for you. Ask what you can do for your country.” These words of wisdomwill remain with us forever and will always be repeated when necessary until the end of time.
      Such nationals must be taught accordingly and also reminded about it.

    This is all a technicality loss. That is, the UWP members filed a case on ‘possession of passport’ rather than dual citizenship, because I can’t believe that the letter by Skerrit denouncing his citizenship after nomination was insufficient. That’s the way things are – the ‘justice’ system is not necessarily just or ethical.

      It is rather interesting that the appeals court uses the lack of evidence to dismiss the appeal.
      I am not a lawyer, the extent of law that I know is business law, but I have a good understanding of Jurisprudence, so when an appeals court talks about evidence, it mystifies me.
      My understanding of the appeals process is where the application of law applied or the reasoning, or the interpretation of the law by the trial judge, or whether proper directions were given to the jury, or in this particular instance whether the trial judge was correct in the first place to exclude parts of the evidence, and whether the trial judge was correct in law and procedure to not use the “Inherent Jurisdiction” principle.
      Obviously it seems to be that these ECSC justices are all taken up with evidential matters at the appeals level, to the extent that one SC in the case of NBD V Corbette at the privy counsel hearing wanted to ask for minutes of board meeting as evidence. The SC was rightfully laughed out of court.
      I do not see this as any vindication. Another observation, is the court affirming the principle of self incrimination in a non-crimminal matter, and affirming that the court does not have inherent jurisdiction?

      Skerrit never denied having dual citizenship. He admitted it however said that he obtained it as a child, a fact that was never contested. The UWP was trying to make a case that “technically”, once he renewed his passport as an adult and travelled with it, under French law he was no longer a citizen by his mothers hand, but he now implied his own allegiance to France. Why is it so hard to understand that the burden to prove this must lie with the UWP if they want to make that accusation? Lets move on and deal with real issues, rather than fighting over words and laws that the same men make.

Last night I witnessed hearing on Canadian TV what many stated about Chavez and how he built homes for people who were living in share poverty. A woman showed the well-equipped home with blender and other necessary utilities which came with the home. She said that when election time comes around she will vote for Chavez’s Party. Therefore, your comments are only a matter of your opinion and Chavez’s non-supporters who did not see the good that he did and obviously are non-appreciative of also what he did for Dominica and its nationals.       You are joking, not serious and are not fair and patriotic to your land of birth where you obviously still have relatives, friends and visit from time to time and enjoy the visit.
      Many of us who reside overseas do not share your sentiments. I do believe that if some of us had remained in DA we would have been better off and Dominica would have been a better place. Many would have been still alive. This includes other islanders.
      The opportunity was present and so we took advantage of it. Many were employed at that time with government and other jobs. You know, the grass appears greener on the other side.
      Today, Dominica is far better and has many opportunities which did not exist in those days, university/college, etc. Frankly, as I read the articles on DNO pertaining to this and other information, I am impressed and realize that Dominica has come a long way and is progressing.
      Do you think residing abroad is better than residing in Dominica? I recognize that there are many opportunities which we should take advantage of and which some do not due to certain personal situation.
      Opportunities come with other problems. However, think again and open your brains and eyes. One day you may bite your tongue, eat your words and wring your hands about that.
      One of the things that come not back is, “The spoken/written word.”

    That whats happen when court cases are filed based on the emotions of the moment. It can be argued long and hard, on radio and elsewhere. What matters is law and what the law says. Now let us go on and argue the law indefinitely. Soem other judges could hacve ruled otherwise becuase judges themselves are lawyers and they understand the law in a particular way. What matters now is that the judges we have serving us have ruled a particular way. No amount of eloquence “belly-aching” will turn things around. To suggest that the Privy Council would rule otherwsie is ludicrous. The matter could not have been heard by the Pricy Council. Our constitution does not alow for the mater to proceed tot eh Privy Council. “No constitution, no law” can facilitate the matter going to the Privy Council. We believe in our constitution as the supreme law of our land – don’t we?.

      Dominica does not need need any ‘new ideas’ or the UWP for that matter. What Dominica need is 50 more years of Skeritt and his offspring. If UWP spend any more time, money and effort trying to convince Dominicans that there is another way they will just be wasting their time. The best suggestion is for the party to go into hibernation and allow Skeritt to rule in a 1 party state. A month was all like 45 days long… I remember when marpin and dowasco used to call me about my bills not having been paid by monthend. I think they should stop focusing on all what the prime minister is doing wrong, congratulate him on the things that he does right and find out what he is not doing in order to gain an advantage. We need to get a solution for our country. Yes, the world is facing an economic crisis but yet still, people continue to go on expensive trips and spend unimaginable amounts of money. we need to market our country as the “nature island of the world”. Dominica is one of the few places in the world with this much to offer; white and black sand beaches, mountains(hiking), boiling lakes and sulphur springs, a serene atmosphere, hospitable people and a dynamic culture. so why aren’t we the number one destination in the world?? we also have agriculture; the world is requesting more and more organic and natural foods…. For too long we have focused on politicians as if they were celebrities, we have made enemies with our friends while these politicians sit together and laugh in meetings, we have settled for exploiters and corruption… We NEED to FOCUS on Dominica!!!

    Those who were expecting otherwise were either too naive or trusting of our Jstice system. I for sure never thought that after three years the judges would decide to boot out the sitting Prime Minister. Besides the opposition should have noticed the confidence of the government side weeks or even months in advance. Take for example the decision to go meet with the Vrgin Island Diasporans; if the PM was really doubtful of his position with the courts I am not sure that he would make such plans – that can be disputed I am sure. Nevertheless , behavior, demeanor or otherwise indicated that the government was unsure of the results.

    There is no use crying foul as far as I am concern. What we all must accept ReED, GREEN OR BLUE is that justice is an illusion and truth is perception – that Tony Astaphan continue to demonstrate. Even the bible and the teachers of the bible demonstrate the same. The history boos too.

      What is your perception of justice. Do you believe that he should have be forced to produce a passport? In which justice system is anyone forced to produce evidence against themselves. It is responsibility of the plaintiff not the defendant to produce the evidence. How would you like to be accused of a crime and asked to show the evidence that you committed the crime. It’s been almost for years of little progress because we Dominicans refuse to give politics a break and work for the development of the country. Anyone who tries to be objective is quickly attacked by both sides no one is willing to have an open intelligent conversation it’s all about bringing each other down. So unless you have evidence that something illegal happened with the supreme court accept the verdict encourage the opposition to do dome soul searching and preparation for the next election. And if in your opinion the courts are so unfair please stop using them you are just encouraging a corrupt court and if you do win it would be in a corrupt court.

    Here’s the thing that disturbs me about the case: The Court ruled that Skerit and St. Jean did not have to surrender their French passports nor testify and then turns around and says that the petitioners did not produce the evidence when the petitioners had asked the Court to request that the respondents surrender their foreign passports or take the oath to give evidence! Incredible! It is a great pity that the case cannot be appealed to the Privy Council for fresh perspective on this most important case.

      If you`re taking someone to court for stealing something, is it not up to you to prove your accusation? Would you ask the court to demand that the accused bring forth the stolen goods to help you win your case?

        So are you saying that the lawyer for the UWP does not understand law? It would be interesting to see how the appeal court answered the questions which were asked of it. Remember that no new evidence can be brought to th appeal, so what is the answer to : whether Thome erred in ousting the inherent jurisdiction of the court, whether she erred in not allowing disclosure and was enough evidence was adduced to draw a inference.

      You take me to courst for stealing your money. Our system say you as the complainant MUST produce the EVIDENCE. I do not have to prove to you that I stole your money. Why shouyld it be different for a seating Pm. the constitution does not set him apart from anyone else. He is bound by the letter of the law both in privilege and responsibility – just like you and me.

      The opposition took the matter to court and fsiled miserably to prove their case. So why blame the court or the P<. last week the court handed down the opposition a victory. The courts system was good then and suddenly bad now.

        You can’t have it both ways, on one end allu say that this case is a CIVIL matter and as such it should not assume the dictates of a criminal case, yet you are quoting STEALING, which is a criminal matter.

        When people get accused of having marijuana in their possesion, the police does not wait for the acuser to prove guilt, instead they will go and break down your house or tresspass your land to get the necessary evidence. So your argument is full of holes and as such is worthless.

    We have the courts’ decision now we have a choice. Are we going to continue saying that as long as the decision is not in our favor that the court is wrong? Local court, regional court – all of them wrong? It seem s all of us went to law school.

    Even if we against Skerrit, at some point we have to concede that we are wrong.

    By the way, it would be truly wonderful if the UWP recognises that elections will soon be due. It is time to start the campaign for re-election. Put the focus on the UWP.

      You are entitled to your vies, but not your ‘own’ facts.

      The UWP case was doomed from the start.

      Instead of presenting themselves as an alternative to the present Gov’t and presenting views/ideas/platforms for sustainable governance in the near future, these guys have embarked on a litigious journey.

      Every dislike is now challenged in court.

      When the court rules against them, the judges are bad. How about examining the facts of the case.

      The judges in St. Kitts must be Labourites too!
