Court rules in favor of Blaircourt Property Development

courtHigh court Judge, Errol Thomas, has ruled in favour of Blaircourt Property Development Ltd owned by Renneth Alexis in a matter of trespass involving Atherton Martin, Dr. Clayton Shillingford, Frederick Baron, Severin McKenize, Floyd Capitoline and Joan Etienne.

All six claimants had entered on the said property in 2009 without Alexis’ permission saying this was done in the public’s interest.

They argued that concession allegedly granted to allow the construction of the villas on the property was a matter of public interest as the public’s purse was diminished.

However, Justice Thomas explained in a 16-page judgment that before such stage is reached, “the question of the implied license in this context must be addressed.”

He explained that the defendants conceded that they were on the property at the material time however, that alone does not constitute the implied license.

“The further requirement is that the person must have a lawful reason for doing so and then proceed to ascertain whether he or she or they may be admitted to conduct their lawful business,” the Judge wrote. “There is no evidence that any of the defendants asked Renneth Alexis to permit them to enter the villas. In this regard, the court notes that part of the evidence of the said Renneth Alexis is that when he saw Severin McKenzie on the day in question he asked him, ‘Sev is you that doing this to me?’”

Thomas said this suggests some level of familiarity between Alexis and McKenzie “which paved the way for seeking permission to enter even at a late stage.”

“But the evidence is that once Alexis learnt that 12 to 15 persons were on the property, he moved from his house to the villas and ordered the persons to leave since, according to him, he did not give anyone permission to go on Blaircourt property. Importantly, however, the question is whether the defendants have lawful business to conduct,” he stated.

The Judge wrote that the matter can only be judged based on the evidence before the court.

“In this regard, the court notes there is no documentation before the court to support the assertion of financial concessions contained in an alleged decision of Cabinet. And with that comes a lack of the nature of the concession and what would have been lost by way of government revenue,” the Judge stated. “…it is the conclusion of the court, quite apart from the defendants not seeking permission to enter the villas; the implied license was revoked by Renneth Alexis immediately after he emerged through the gate. And further, the defendants had no lawful business in connection with the Blaircourt property. They all trespassed on Blaircourt property.”

Justice Thomas further wrote, “The claimant’s prayer is for damages including aggravated and exemplary damages. It is noted in Halsbury’s Laws of England that a claimant is entitled to nominal damages for trespass to land even if there are no damage that is caused. In this case there is no evidence of damage to the property so it is a question of nominal damages.”

In the case Thomas ruled that the 1st (Martin), 4th (McKenzie) and 6th (Etienne) defendant, each must pay Alexis $1,500 “by way of damages for trespass since they entered at least one villa.”

The 2nd (Shillingford), 3rd (Baron) and 5th (Capitoline) defendants must pay $1,000.00 each to the claimant, the Judge ruled.

“In this case, the court can find no evidence of highhanded, insulting or oppressive conduct on the part of the defendants. In fact, they ceased to trespass within 2 to 3 minutes after being asked to leave. Accordingly no award of aggravated damages will be made,” the Judge ruled.

Additionally, Thomas ruled that each claimant must pay $5,000 in exemplary damages.

“The claimant is entitled to prescribed costs,” Judge Thomas stated.

    Read the law on trespass people. There was NO trespass, as the place was not fenced. The judge misdirected himself and made the ruling to justify the obvious charge against bubbles for threatening the life of Joan with an unlicensed gun. It would only have been trespass IF the defendants in question had entered on the property going through a fence or by passing a “NO TRESPASS” sign. That matter will evidently be thrown out on appeal, as the judge for whatever reason was not following the established legal guidelines on what constitutes trespass. My legal training convinces me that the defendants will win their appeal.

    Fair is fair for all. So is justice in this case. Trespassing on private property and invitation to visit are two different matters.
    Everyone should know those who trespassed on others’ property are liable to be sued for it is a crime. They had no business being there in the first place.
    Why should anyone disagree with the Judge’s decision? How can anyone expect the Judge to be in their favor, who trespassed on someone’s property?
    Consider if it were your property, what would your reaction be? This is what this case is all about – trespassing.
    Defendants, sorry for you. You are obligated to pay your fines. Call it a day and recognize that you committed this crime. Whatever you think were your motives, you erred. Therefore the Judge could not uphold your defense and rule in your favor.
    May this be a lesson for others. Let it be known, there is a Law to protect proprietors. In general, no matter what, respect the property of others.

    Alexis was found guilty in the criminal case. Interesting note..while the case was in progress with Carbon and Weekes prosecuting on behalf of the State,,the gun exhibit in evidence was not in custody of the police and had been returned to Alexis according to the police prosecutors by orders from “higher authority”,Magistrate Behanzin ordered the police to go and retrieve the gun. Further drama..at appeal the DPP Pestaina asked a Mr.Joseph to deal with the matter of defense of the police in case Renneth Alexis vs Police. The DPP’sa offiice essentially said they had NO DEFENSE since Behanzin did not supply the notes of evidence prior to the appeal trial. Questions..is that true? why could the DPP Pestaina and Chief Magistrate Evalina Baptiste knowing the appeal was coming up not order Behanzin to submit the notes of evidence??..Odd , very odd. The appeal judges told Alexis he got slap on the wrist and Dominica is not the wild wild west and then quashed the charges. Fascinating!!!

      That is exactly the problem in Dominica. That ‘higher authority’. And that higher authority controls, amongst others, also the judicial system in Dominica. Ultimately that means that the law is applicable to some but not to others or in other words, there are some people that are above the law. Worse even, these people are so full of themself that they make statements to that effect in public (I quote Skerrit saying: no law and no constitution can prevent me from…). I will never understand why we let them get away with it and pretend everything is well on the Nature Island. We need to get up from our behinds and fight for what is right. This can not go on!

      Clayton have guts eh! here is a man who write Thompson Fontaine so many emails demanding the return of the DAAS money to its rightful address the DAAS account. It took the threat of legal proceedings to complete. Thompson Fontaine to return the money. Years later the same Clayton Shilligford told the Dominican people that Thompson Fontaine did nothing wrong without the DAAS money and that it was just an unfortunate incident. We leant later that a portion of the DAAS lands at Rosalie was bought by the Treasurer of the DAAS and registered in his name. The other portion of land was registered in the name of the DAAS with the President of the DAAS as joint owner . All that happening during the time when Clayton was President of the DAAS President of the DAAS. Then Clayton blamed the owners and solicitor of the Rosalie Estate. Did he forget the string of emails he originated on the matter (land and money) and the warning of his general counsel against insider dealing.

    The matter of trespass went to mediation before Julian Johnson. I admitted that my Pathfinder was parked in driveway. Mr Alexis and his attorny Heather Felix Evans claimed that was trespass.. I asked how much such parking would cost and I paid Alexis and the matter was settled. Additionally when Alexis came out of his home with his gun and threatened us plus the gun to Ms Etienne’s head he met, saw and addressed us all on the public road which does not belong to him unless the law has changed to the extent where a public road belongs to a private citizen. He said get off my property..the public road???and with threat of gun I advised him that we would leave..We went to the Portsmouth Police station and lodged a complaint which led to the criminal charge against Alexis. It is interesting to note the caste of characters who were in the Magistrate Behazins’ court on those days presumably in support/sympathy with Alexis..Pastor Joseph, Steven Isidore, Nanthan, Levi Peters.

      Clayton, be fair and real. Who were the cast of characters in your corner during the court cases? Did you or somebody from your party call a live radio talk-show to report you alls presence at Blaircourt before going to the police with your complaint? Was the host on the radio awaiting your call to report to the “people” about your small excursion. Better still didn’t the host of the radio talk-show ask all other callers to refrain form calling the show because he was awaiting your call? Didn’t the planned tresspass advertised the week before as an excursion to see a property belonging to Dominica? Who do you think you are fooling. I was not there and did not see what happened. But it is possible that at the time “Bubbles” met up with you all you were on the public road, But are you denying that your group did not trespass onto the man’s property.     Any case involving individuals close to the PM will NEVER lose in our court system.
    If de PM friend is proved guilty then it automatically casts a shadow on de PM.
    De majority of Dominicans disagree with the judgment, especially because justice came so late……….i thought de case was thrown out. Letting bubbles walk free doesn’t add anything positive to de conscience of de nation as a whole.
    If i was selling crabs for a living and built a multi million dollar house de police force would be on my back…except if i was a friend of de PM or de DLP executive.
    De judgment doesn’t help make us a better people.

    Well for weeks Q95 run this story morning noon and night stating that the villas belong to Skerrit and now we know these guys are a bunch of LIARS. I believe the Honourble Prime Minister should make an example of these guys and take them to court so hopefully in the future they will learn their lesson. It’s over a month since the judgement and not a whisper from Matt in my estimation he has lost all credibility. I feel sorry for Joan following a bunch of loosers.

    That decision was handed down in December 2014. There was no “Matt I, I, I just don’t know BREAKING NEWS”. That is the sort of journalism we are exposed to. The result of this court case was of no significance to those who have claimed unto themselves the license to determine the nations moral values. After so many years of air play, night and day, it cannot be that the decision was handed down and Mr. “Can Lie” never heard about it. Mat and Carlisle like very other Dominican are free to follow a political party of their choice. They are free to associate as they wish. What they are not free to do is to play around with the Dominican intelligence in their reporting of daily developments. This is a classic example of how the UWP has and continue to control the media, even the government owned and managed media. Shameful reporting or lack thereof at its very best.

      The same court, same magistrate handed down a judgment convicting Renix Alexis for brandishing an unlicensed firearm. Alexis alone has to pay Joan Ettienne as much money as he will receive from those trespassers. What is wrong with us. When we win it is OK and when we lose it is corruption? UWP went to the general elections. They won 6 seats, doubled their seats form the elections before. The election process in those 6 constituencies was beyond reproach. They have however found everything wrong in those constituencies where they lost. Aren’t they ashamed? Are they hearing themselves?

        What is the injustice if people enter on private property without permission and the judge rules that they did so and orders them to compensate the aggrieved party for trespassing on their property? What is the cry of injustice and how long, not long about? I really think you did not even read the story.

        When you all destroy faith in the justice system with your injustice mantra once there is a judgement against you, you think that if/when the party you seem to support gets in office all bad attitudes inculcated about this and other matters will suddenly disappear? No, in fact it will be a living hell for you because some unrealistic and unreasonable expectations would have been established! Think about it!

      Are you saying these people did not trespass on property that did not belong to them? So what is the problem. The number of people who went to a place they had no reason to go there; if someone were to come to your home and stand under your window and kept on talking loud while you were trying to work would you be happy? Would you ask them to leave? If they do not would you call the Police

      If a suspicious individual were to be seen in a school ground would that person be trespassing? If the principle or the teacher asked the individual to leave and they do not, would you call the Police? Could there be charges laid?

      That was the topic on The Heng this morning. Interesting as others pointed out, the Radio Station that was giving us the ball by ball play of the trespassing has no comment, interesting. Or is it possible this particular radio station is a defendant also and decided not to make matters worse for them, since they were part of the team on that day. I wonder

        If they had done this in the USA they would not only have broken legs. They might all have been dead. Remember the “stand you ground law” in that country which allowed that guy, Zimmerman to shoot and kill a young black male (well that was the final outcome) in a “compound”, not even Zimmerman’s yard you know, because he looked suspicious and Zimmerman felt threatened. I believe Dr. Shillingford lives or lived in the US.

        Dr. Shillingford had his day in court and he played it safe by denying having made certain statments because, of course he could not prove it in court so I’m not sure why he is now trying to retry the case on DNO.

      Trespass on property has nothing to do with ownership of property. It is who is in physical possession of the property. If I am renting a house and you come into my rented house without my permission, you are committing a trespass on the property.

        Not a herd follower & Jane Doe. Thanks for that clarification. This is how misinformation is spread around and after a while becomes Dominican fact!

        That said, I secured a copy of the judgement because I like to inform myself and analyse issues myself rather than repeat people’s mantras. I was amazed that at least two of the defendants, Martin & Shillingford (I’m giving the others the benefit of the doubt) put forward a defence that they never said publicly(I’m summarising) or even “inferred” that the villas belonged to the Prime Minister. I couldn’t believe what I was reading! You mean a small test like that one had people perjuring in the courts? People who have hurled insults at Dominicans who don’t toe their lines about being cowards and worse cannot stand behind their convictions? Should they now apologise to all the simple minded people that they and others have whipped into a hate frenzy over several years over this matter? No wonder the media silence…

      So it’s only you, the UWP and it’s supporters that’s not corrupt, eh? When matters are ruled in YOU all favor things are ok once against it’s corruption!

      I fear for my Country. It seems like the only thing which is right is only what the UWP says is right. We know that God is not sleeping. They talk about democracy under threat in Dominica, yet after his reelection, we all heard Mr Linton threatening anyone in his party who dare to challenge his authority! That same man is dying to be Prime Minister. Can you imagine a Dominica under the rule of “Prime minister Linton?” We must not fear. God is in control. I am sure that he shall not last as the leader of the party for the next five years. He shall do a lot more to embarrass himself and the party. Time will tell! Today is the 5th of March 2015. Please take note!

      As I always say, you are a bold person and fortunate you reside in D/ca. Otherwise you could not get away with calling of all, government officials, corrupt. How long could you or others utilize that debasing and insulting word against government officials without being sued and paying a price for your words?
      If you called a D/can corrupt, I would think the person would sue you, to prove your libel in Court and would receive monetary compensation. The same thing for you, your day is coming.
