UPDATE: Denny Shillingford matter traversed

Denny Shillingford has had his appeal traversed to the April 2013 sitting of the Eastern Caribbean Supreme Court (ECSC).

Shillingford, who was convicted  and jailed on a charge of grievious bodily harm, was hoping for a decision in his favour when he appeared before the court on Thursday.

However, his lawyer Dawn Yearwood-Stewart, who had filed several grounds of appeal on his behalf, was unsuccessful in her bid to have the appeal heard at this sitting of the supreme court.

The judges ruled that they needed more time to study the documents in the matter and it was traversed.

This is the second time Shillingford is going before the ECSC on that matter.

In 2010 he was found guilty of the offense and was sentenced to seven years in jail but he  lodged an appeal against the conviction which was upheld, with the ECSC ordering a new trial before a different judge. At the retrial, he was again found guilty and given a lengthy prison sentence which he again appealed.

According to court documents, Shillingford allegedly instructed his pit-bull to attack the complainant, Davidson Joseph, in the early hours of September 24, 2009 at St. Joseph.

Joseph told the court that the incident occurred in an area called Back Street in St. Joseph,  when Shillingford ordered his dog to to bite his right leg causing him to be hospitalized for several weeks.

Court reports indicate that the confrontation occurred when Shillingford accused Joseph of following him after Joseph noticed that the door of his house had been forced open and his purse containing $310 was missing.

“When I reach between two houses, I hear footsteps running towards me. Then I noticed is Denny Shillingford. There was light from the post lighting… He ran to the corner. He asked me what I monitoring him for…. He had a white and black dog in his hand,” Joseph testified during the trial.

He continued, “He say ‘take him, kill him; …It (the dog) grabbed me on my right arm …. When I swing my hand the dog mouth moved. Then Denny Shillingford jumped on me, pull out a cutlass …The dog hold me in the right foot … In wrestling, he was asking the dog to ‘take him, kill him’. I keep on screaming for help, ‘Somebody help me, please. I dying’ … He was lashing me with the cutlass on my back.”

The complainant also stated that the defendant struck him with a stone at the back of his head during the incident.

However, Shillingford had told the court in his testimony, that Joseph was the aggressor and had attacked him with a cutlass, which led to the dog biting him. He said he never told his dog to kill the complainant.

He insisted that he was only defending himself during the altercation and was the one who actually called upon the pit-bull (named “Milkshake”) to stop biting Joseph.

    I saw SEEKO with my 2 cocozye about 1 month ago debarchaying de no 3 train, he was directly facing me. He got off at Sutter Avenue/Rutland Road. Lavewitay! I just smiled and he gave a slight grin, as if “yes it’s me” and kept his head down. This is not the first time I am seeing him, so how they can’t find him.

    denny i firmly believe that if you break the law then you have to be punished, but the predicament you have found your in with issy,seco and skerro and to be against them you may pay with your life. dont let your guard down in the prison and also they control the court system, you may never get your day in less than the seven years your locked up for.

    Denny boy, can you not understand that they DO NOT want you out boy? If you are out they feel you have some classified information that you may leak out to the ‘Q’ and as a result, by keeping you in, the feller that hiding in the US will feel safe and those hiding behind big titles here will continue to breath a sigh of relief. Be strong boy cause the network will soon come tumbling down like Jill did in the Jack and Jill rhyme.
