DPP drops buggery charges against Nicholas Roberts

Nicholas Roberts walked out of a Roseau court smiling on Tuesday morning after the Director of Public Prosecution (DPP) dropped a charge of buggery against him.

“The file is devoid of any evidence and it is very unfortunate that he has been on remand all that time… We at the DPP only got the file and it is a real shame…” the DPP office stated.

Roberts has been on remand at the state prison on that matter.

But the repeat offender’s troubles with the law is not quite over yet. He is scheduled to testify in court later this week in a shooting matter against Inspector Lincoln Corbette.

    And I never said that the DPP was supposed to investigate but they have to be involved from the beginning not at the end. That is why weak cases continue to go before the courts, there is a missing link that cohesiveness between investigation and prosecution. That is why there is a problem with justic in Dominica.

Wait for the file to land on his desk, that is what the DPP supposed to do ?????? WOW. Investigation and prosecution go hand in hand so you learn before you speak.

    When will the DPP’s Office in Dominica take charge of prosecution ???????? It has to be done from day one, before charges are initiated, the DPP is the one who is responsible for prosecution not the police. This system where you have police handling investigations and prosecutions is utter nonsence and I have said this from a long time ago. Take charge Mr. DPP, you should be ashamed to say that you are only now finding out about this. This is utter rubbish and the system should be improved. In a day like today it is ridiculous to say oh we don’t have resources – really ?????????? But we have money to do all sorts of things. In the US the District Attorney’s Office is involved from the time persons are charged. I am not saying we have to copy but the buck stops with the DPP. How can it make sense for a DPP to only be involved in indictable matters and appeals and a few magistrate’s court matters.

      It is not the job of the DPP to investigate or charge offenses. Their job is to decide whether to prosecute based on the evidence collected and presented by the police. If there is no evidence then they cannot proceed. They can only proceed when the files land on the desk. If you do not understand that then you should not make such slack comments. read the constitution and acquaint yourself with the law.

        Yes Educated ‘Commmentator” so is that the reason why Isidore case with Emanuel not calling? the file empty too or as u said lack of evidence, Hmmm . The system is corrupt thats all . I think they drop the charges so that he can falsely admit that he shot himself. Just to get the officer off the hook . Thats the deal , open your eyes people ,”sum fing wan” lol

    So here we are pressing buggery charges while murderers going free. I am only interested in a buggery case if the buggery is against a child. Otherwise, go and check all the murder and manslaughter, grievous bodily harm and all the other wicked cases and leave the buggerers and casual ganja smokers alone.

    Only in Dominica can someone be charged with buggery! So silly and hypocritical – given that it happens in the privacy of people’s homes every day and night. It’s almost 2013, time to move beyond this nonsense!

    Shouldn’t the office of the DPP be represented in court such matters are being heard. Why all that time before the DPP’s office could profer an opinion on the merits and demirits of the case? Why didn’t the police see the when weakness in the case. No wonder the DPP has to go to court and withdraw so many matters from before the court on account of weak evidenceor charhes that cannot be substantiated on the evidence. The police must do their job properly and they must be given the tools to do thier work Mr. Minister of National Security.

    Testifying in the Corbette case should be interesting. I hope yhe prosecution can get him to speak the truth. That will be the begining of thr end for a certain lawyer and the arrogant police officer

    Then, on what basis was the man arrested and subsequently charged?

    Is this for real? Did the justice system just incarcerate a man for “some time” only to tell him later “oops, we are sorry. we made a mistake. We have no evidence against you?” How could this have happened?

      Peeping, I am finding myself agreeing with you more and more, especially when you do not allow your political biases to cloud your otherwise clear judgment and reasoning. It is scary.

      Something is definitely wrong here, we would all admit. A charge of buggery? Why is it the DPP only gets the file just before the matter were to be heard in court? Why was the man locked up for so long on this bogus, empty charge?

      Do you see how the police could cause one to be locked up and present an empty file to the DPP’s office for prosecution without having conducted a proper investigation and without adducing sufficient, appropriate and relevant evidence, i.e no eye witnesses, no forensic or lab tests, no confession and supposedly without the “cooperation” of the victim?

      The Police has a lot to answer for…even though this guy Roberts is clearly suffering from some mental illness and requires medical attention. He has become a public nuisance and some well-connected people in society are using him as a convenient pawn in a high-stake game of corruption, political and legal intrigue.

      Peeping Tom, it is not often that I agree with you. Whatever we may think of thim, this man’s liberty was taken away for some time, on a charge that could not be substantiated with even a shred of evidence. This is very worrying. Would it now be possible for the State to arrest someone on a charge of treason, for example and keep him incarcerated for an indeterminable period of time without any evidence ever being presented? For the sake of all of us I certainly hope that such a scenario would not be possible under our jurisdiction. What recourse does mr. Roberts have for restitution/comppensation?

        This is a fair question. Justice must be served. Honestly, this case should be taken up by those qualified and hold the State responsible. We should use this misfortune as an opportunity to clean up the system. I am outraged!
