Elderly man walks free from indecent assault charge

An elderly man from an eastern village in Dominica has been found not guilty of indecent assault at the high court of justice yesterday.

It was alleged that the man indecently assaulted a four-year-old twins from that area in July 2010.

The defendant was represented by attorney Darius Jones. He maintained during the two day trial that he was innocent of the crime.

Prosecution witnesses testified that the incident had taken place at the children’s mother home.

Witnesses said that the defendant and a friend were drinking a bottle of rum under a tree when the defendant’s friend fell asleep.

When giving evidence the friend said when he woke up he  went to the kitchen, looked through the bedroom window and saw the defendant pulling up his pant zipper in front of the children who were sitting on the bed.

He (the friend) according to evidence, informed the children’s mother of what he allegedly saw.

The mother testified that after being informed of what allegedly happened she went to the bedroom and saw the two children sitting on the bed with the defendant standing in front of them. She said she did not see him do anything.

The mother told the court that at that point she got angry. She ordered everyone out of the bedroom and subsequently the defendant went into the kitchen. Then she said she questioned her children about what happened.

She told the court her daughter had said the defendant had done nothing to her. However the boy reportedly said that the defendant had some form of indecent contact with both him and his sister.

The mother then said she was taking the matter to the police and claimed she was offered $1,000 by the defendant. He said that he would soon get that money from the sale of a piece of land he had.

Under cross examination the friend of the defendant said that he did not believe that the defendant committed the crime.

The investigating officer Corporal Copiel said in his evidence that the defendant had admitted to the crime when he first interviewed him after the incident last year. This he claimed he recorded in his pocket book. However afterward the defendant denied committing the crime.

In an unsworn statement, the accused gave his account of the situation. He said that he had gone to the mother’s home on the said day but did nothing bad to the boy or girl. He did state that the four-year-old boy had kissed him on his lips.

The defendant was found not guilty 8-1 by a three-man and six-woman jury. He  will return home for the first time after being in police custody for several months. His bail had been withdrawn for some time.

The prosecution was represented by state lawyer Clement Joseph and Director of Public Prosecutions Gene Pestaina.

    these woman from d/ca always have those no good men in their bedrooms, why? i would never have a man friend in my bedroom , much more wit my kids, she is to be blamed also, they are all nasty people , and why would you let a boy child kiss you on the lip? nasty nasty man.

      :-x Set of majee that…cannot believe the jury found Mr. not guilty…four year old kids man..man ought to get life for that….was there and i checking awa eh….watching Mr. walk out the door and i almost hit him a ting eh…alas those ppor lil chldren

    The man confessed to kissing the little boy on his mouth!…. He admitted to the act and then changed his mind!..he offered the mother $1000…….~

    How much more do we need to condemn his nasty ass?!
    This man is sick…… and rum or no rum…… “No action occurs if it does not come from your heart”.. .

    We have not heard the last of this “man” from an ” Eastern Village”

    Next time his name will be BOLD…….and his place of residence BOLDER…….. cause he isnt done with his nasty ways.

    I do hope that …when it happens again…….a better jury is chosen!

    Hoe can you convict a person whn you produce three witnesses and each contradict the other. The main prosecution witness said he did not see anything. That he believe that the accused is innocent. Did the DPP vet this case.

    one thing i no..guilty or not you wouldnt come close to me or my kids..them days there you cant trust no one by your kids..as a mother u handled the situiation well..took it to the police..well done..we need more parents like this in our country..to many cases of children abuse..all now a 14yr old is missing…we need to protect our kids always….and to many times we take money to cover up..stop putting money before your kids …protect them..they are our future..

      ya – makes me sick – I will always maintain, children do not lie about anything – you can rest assured they will say what they saw and heard. If you tell them to say “mammy is resting” sure enough they will say, “mammy say she resting”.

      i agree with Ya’ll a hundred percent, when the justice system do dem tings they don’t expect for the other dirty ass men to do the same to other people children, why would the child kiss him on the lip, does that make any sense. all i can say is any man or woman who attack my child in that way will not have time to see the police.
