Former Auto Trade employee denied bail

A former employee of Auto Trade Ltd is now an inmate at the Dominica State Prison on remand for theft after he was denied bail in a Roseau court.

Michael Bunche, who resides in Bath Estate, was arrested when he returned to Dominica from an overseas trip, on Wednesday, November 28.

Bunche is alleged to have stolen over $36,000 dollars from that institution between January and March 2012.

In court Police prosecutor Inspector, Claude Weekes, strongly objected to bail stating that Bunche was “a flight risk” because he has obtained employment overseas and was due to leave the island within days.

“He was being sought after for a while but always keeps evading the police,” Weekes told the court. “He was picked up on his return from Barbados at the airport based on a tip off. His passport is not with him and he has already gotten a job overseas to depart the island soon so he is a flight risk.”

The court was also told that the monies in question are yet to be recovered by the police as investigations into the matter continue.

Bunche is represented by Glen Ducreay and Wayne Norde in the matter.

Ducreay, in response, told the court that his client was not a flight risk even if his passport was not in his possession. “The passport is with the US Embassy in Barbados and we can make it available to the court as soon as it is returned to us. He has to eat and should not be denied a job … bail is now being used as a punitive measure,” he said.

The court was also furnished with documents by the prosecution about the work which Bunche is supposed to take up next week.

Magistrate, Candia Carette-George, told Ducreay that the alleged offence is “very serious and all was in place for him to leave the state and that he already had a contract for a job.”

The matter is set for trial on May 17, 2013.

The magistrate also disclosed that she was recusing herself from that matter.

Meantime, Nola James Peters of Fields Lane, Roseau, who earlier this week was denied bail for handling stolen goods amounting to more than $48,000, was further denied bail and remanded in custody. The prosecuting team led by Inspector Claude Weekes argued that since more persons were being sought by the police and the gold, which was allegedly stolen, was yet to be recovered, that Peters should continue to stay on remand.

Her lawyer, David Bruney, stated that his client was “innocent and she was being denied her constitutional right to bail.”

After much argument from from both sides, the magistrate upheld the objection to bail for Peters.

    DNO you see this is the problem when you publish incomplete and poorly researched articles. All the facts are not presented so your dedicated readers can make informed opinions and comments. But it is interesting to see how many here side with the alleged thief without knowing all the facts.

    Another mentioned about some case nassief lost against the sister of the accused like that is any proof that she or brother is innocent. That’s the thing about the law, because you win a case doesnt mean you are innocent.

    Dominica is infested with white collar crime that is a fact.

    Another fact is Dominicans continue to prove their immaturity as a nation with their boring age-old gripe against the upper class. Way too many of you secretly love it when they are stolen from but all you do is strengthen and, unfortunately, provide validation of the stereotype that if you poor and black or come from that backgrund, you will steal. Bad enough your politicians prove that daily.

    From November 2011 to now the company realize money missing? “Evading the police” is just another strategy used to dirty Micheal’s name!! Auto Trade heard Micheal had a new job overseas and wanted to see him fail, so they came up with that scheme to block his success! He is a wanted man and a poster with his name and picture was not in the airport? He passed through Customs LEGALLY and was not stopped, and only by a tip off the Police knew he left?! Doesn’t that sound fishy? Murderers are given bail and they leave the country. That should be considered more a ‘flight risk’ than a man who is arrested for ALLEDGED theft! Mr. Carette, a man of your standard should not be speaking in such a manner! Open your eyes and see the truth! Micheal, my prayers are with you! I hope your family is hanging in there! But they trying to frame him but the lord is on his side so he will get his justice and as for those people that responsible for this God will punish them, and i want God to give them a severe punishment.     micheal was a very honest,hard working,dedicated man.ok.i can boldly say that cause i could always rely on him when i need a vehicle.its sad that auto trade/nassif would try so much to ruin this man’s good name. nassif knows well enough that the day he fired micheal WAY BACK IN 2011!!!! that alot of the well paying an big boys (CUSTOMERS-LOYAL CUSTOMERS) WENT WITH MICHEAL.and because of this nassif/ ISLAND CAR RENTALS LOST ALOT OF BUSINESS.when micheal was there the parking lot was always empty.but now…alas it is as if all the vehicles have problems.the way they always sitting there,begging to be driven…the business went down hill after micheal was gone.a bunch of unqualified children with NO CUSTOMER SERVICES SKILLS and CUSTOMER CONTACT SKILLS alone that works there now.ALAS.     I don’t know it may be be but I believe Auto trade, Archipelago and all companies run by these people need forensic investigators. Something doesn’t add up, a whole lot doens’t add up with these companies and their dates of certain people conviently stealing from them. I am against people stealing from employers, you knew what your were going to get paid, don’t let the people stuff and money tempt you, but I wouldn’t be surprised that these super inflated amounts are under the guise of fraud. Everybody jumping on the young man, but it’s rather unbecoming of this company and it’s subsidiaries. Nobody paying attention to them, they have title in society so we can’t entertain that this may be a grand scheme of greed while ruining other people’s lives. It happens everyday.       Some time ago it was alleged that an employee of one of the subsidiaries stole 14k. correct me if i am wrong, this person has been walking up and down in court and nothing have yet to come from that case, becuz all the parties involved doesnt show up for court. Should i say all the parties involved evading court as they say bunche evading police. Is that what is going to happen to that case.

      the days of the bourgeoisies are over. When certain people in society use to think that they are more than our average ancestors. Get with the time. Every and anyone now can make a live for themselves without being intimidated or without predujice. People of the roots must stick together and support each other. Why crucify the young man. Do we have facts, is it certain that he did it. Dont we have laws governing those type of things.
      And if he did it, is it possible for him to have done it without the help of others, who by the way may be still employed and supposingly taking from the companys purse. Bunche wasnt employed at the period of the alleged theft duhhhhh. the public would like to know when and at what stage was a report made.     DNO, this is avery late comment. I do hope you read it and adjust the information. It is more than a year – in fact 13 or so months since Michael was employed with the company. He could not have defrauded the compnay as alleged in 2012.

    Michale has been living in Bath Estate, at the very same address when he worked for the company. Evading police? No Inspector Weekes.You are a man of the cloth. Everybody in Dominica hold you up in high esteem as a man of great moral and spiritual values. Check the information you are given before speaking. Michael left Dominica and there was no indication that he was required. Commonsense would tell us that had he known he was a wanted man frustrating the police,he would not have returned freely? In other words he left Dominica through a legal port of departure, he returned to Dominica through a legal port of entry manned by police officers – not back door. he was not escorted back to Dominica by a law enforcement officer form overseas.

    Whatever Michael’s sin, he has his conscience to deal with. teh compnay lost money on account of his actions they say. Is that enough reason to deny the man his freedom. Shouldn’t he be at work to pay back the money it is alleged he stole from the company. There is reason to believe as well that when Michael sought other employment in Dominica throughout 2012, he was denied such employment because the business community does not want to be on the wrong side of that particular big man. So then Michael must die, his son must be left in dire need, his disabled mother must now get up and go beg and employment opportunity for him in Dominica must be denied. Like Lennox Linton some time ago when he was lamenting about opportunities or lack thereof for employment for him in Dominica. Should he simply fold his arms and go beg to feed his family? The outcome is mere speculation. i wish Micahel every luck. I also wish that shouldhe be convicted of the crime, he would be given the real opportunity to pay back the money.     I am confused. Seriously confused. Did they actually say between january to march 2012? Are u kidding me? Should I believe then that Bunche broke and open auto trade since he wasnt employed by this company during that period. From what i know, Bunche was last employed in november. In the event tthat he broke and open AND stole the money, why wasnt a report made.
    So u mean to tell me, no officer questioned any one who is close to bunche in that matter.
    why does the report make bunche out to be a fugitive. If he knew he was being investigated, he left the island, u think he would have come back. So to make it look like all effort was used to contact him and he was evading the police is misleading. someone is trying to hide someone, or to save there sorry self. if infact he stoled that money, then someone gave it to him, since there was no break in and no report of a break in.     alas mista foolish, all he had to do is stay Barbados for at least a week; give the embassy a bajan address at which to send his passport to for him, he should receive that passport within 3 days,then take a flight to wherever he has to pick up his job….. latar or Dominica and auto trade eh eh, sico seko escape…. why cant a poor man’s chile doh escape for taking from a rich syrian? lol

    Sometime you ask employer for a loan for medical. They push you around saying get invoice from doctor etc just for them not to give you. When you get it ey say, i fink you have to go to a financial institution and after you do medicals, bring d bill for them. But in d same breath, dey giving some female staff money for them to go out of country to do what you doh want to know. some of dos same female staff teefing dare money under dare nose. I dont fink it is right for employees to steal employers money, but some employers victimizing some workers so much dat is dare money dey have to steal. Not paying people right is another factor.

      Please look at CRime Documents..not fiction but real crimes..then come back here to talk…guilty persons sometimes return home sometimes they are even present at a crime scene and offer their assistance in finding the perp when they are the ones who committed the crime..

      No sweetie u can leave ur passport.there is a dhl office right there in the embassy.once u have ur birth paper or another form of identification to travel with u straight.that is one lie he didnt tell.

      Fool, yes if your visa is approved they keep it and you can return to your country without the passport. THen the Embassy sends it to you via DHL. SO he was waiting on it for him to leave DA.

      When you go for your visa it’s not given to you right away. You receive it some time after by fedex or so. You are allowed to travel with ID and they give you some documentation.

    Well this I can understand, if there is proof that the alleged thief in this case is considered a flight risk, it would be idiotic to grant him bail: On the other hand, bail can be granted as long as the court order him to surrender his passport, and report to some probation officer daily or weekly as recommend by the court.

    If Weeks is sure that Bunche actually have a job waiting for him somewhere, then he could be classified as a flight risk, however, the woman held in custody without bail for receiving stolen alcoholic beverages, to me is unconscionable.

    They need to grant bail to the lady, and if they believe she is also a flight risk, the simple thing to do is confiscate her passport also if she has one!

    Weeks need to go and hunt down the many murderers on the loose in Dominica and capture them and bring them to justice rather than wasting time on insignificant matters as denying petty thieves bail.

    Murder is a capital crime, a felony to the highest degree, second degree murder is another, something that was not actually intended. Nevertheless, someone stealing a few thousands of dollars though that can be considered a felony, in most cases such charges can be reduced to a simply, low misdemeanor, unknowing receiving or buying stolen goods is a misdemeanor anyway, even though the police in Dominica treats it as a capital offence.

    You let murders out of Dominica Jail on bail, yet you victimize petty thieves by keep them in jail by denying them their duly constitutional rights; that is classified as cruel and unusual punishment!

    I suppose someone will have to define in legal terms what is ” Cruel And Unusual Punishment” to the Weeks of Dominica since he is not a professional or trained lawyer!

    The job of a court prosecutor belongs to an train attorney, someone who has studied law and pass the Bar, we have people in Dominica who may have not even went to secondary school, joined the force came up through the ranks, they get promoted not because they are capable, because they are a long term serving member of the force, they are crowned inspector of police; the next thing we hear is that they are prosecuting people in court!

    What a joke, we many such persons throughout the Caribbean!

      I read your post. Before i continue i did criminal justice at the university level. With regards to Officers moving up the ranks and then obtaining a prosecutoral role without being trained is something i had many concerns about. Even the chief today doesnt have a degree. But i know for a fact that weekes do have some form of qualification with respect to law. In terms of the lady not being granted bail. Who knows she might be the key player in the crime and having her granted bail she in turn can be influential in terms of interacting with other players that are involved that will make it much more diofficult to have her prosecuted. So Mr Telemaque sorry you dont have a case. next

        If that is the case, and the authorities believe that she might be an influence other who is involved, if you studied law, criminal law, perhaps you would know that when many people are involved in a crime, and travel documents are surrendered, there is also a court order which goes along with it.

        Bailed suspects are forbidden to have contact with other persons involve in the case, they are ordered not to make any contact with others involved in the case!

        Well I know in Dominica all things are up-side-down, so accordingly, the rules established in the British Magna Carter of so long, and is still recognized, and practice within the judicial system within the Commonwealth of Nations may have evaded Dominica.

        What else can I say maybe we have a different system, which appears to be a kangaroo system.

        The prosecution of criminals should be carried out by a professional trained attorney, someone who is trained in law, and not only attended some seminar, and read some guide book!

        (I doh is lawyer eh), but I know something is wrong with our legal system: It just dawn on me that you said the now chief got his position by coming up through the ranks.

        I mean there was a time in our history when that was acceptable, in those days murder and the more sophisticated crimes was foreign to our nation, but these days to have someone as head of the police force who has not had a single class in criminology or something of this sort just should not be in such a position!

      What I think the court should do, is come up with an amount for the bail money and ask both lawyers to pay half of the money then the lawyers would ensure their client attends court
