Green, James take witness stand in dual citizenship trial

Court resumed its sitting yesterday with Leader of the United Workers Party Ron Green continuing his testimony from Wednesday afternoon as the election petition trial involving Prime Minister Roosevelt Skerritt and Education Minister Petter St. Jean went into its third day.

Green had previously given testimony, during examination, that he had been a US citizen from 1957 when at the age of 17 his mother got it for him. He claimed that he had applied for renunciation on December 11, 2009 and while it was not confirmed until a few months later, it was in effect from the date of filing.

Green had also said that the issue was raised in 1995 by then attorney general Sir Brian Alleyne but was dismissed when it was determined that he had not obtained it by his own hand.

As court continued, Green admitted that in an application in defense of the petition filed 8 January, 2010 no mention is made of St Jean’s alleged boasting of his French citizenship to Felix Prosper, an allegation which is included in Prosper’s witness statement and no mention made in an affidavit in support of the petition, filed 28 March 2010, about Prosper. There is also no mention of allegations that either respondent had a French passport.

Green also said that Prosper told him about an alleged boasting incident, in which St Jean had revealed his passport to Prosper after the 2009 General Elections. He made it clear that a leaflet circulated with reasons why Petter St Jean was not qualified to run for election was not issued by his campaign, agreeing to have read it sometime before it was published and conceding that it made no mention of French citizenship or a French passport.

While one of the witness statements says that Edison James had spoken of the issue at a public meeting in La Plaine on December 17, 2009, Senior Counsel Anthony Astaphan suggests that no such meeting took place since there was a ‘last night’ rally held on that same date in the Carib Territory. No transcript of that event exists and the meeting was apparently not broadcast nationally.

Green did acknowledge, along with Astaphan, that James asked St. Jean to come clean or to say whether or not he has French citizenship at the Carib Territory meeting, in accordance with one of the witness statements.

Documents sent from another of the witnesses, French official Claudette Duhamel whom the petitioners had written to, included Certificate of French Nationality and Birth Certificate for St. Jean but Green also concedes that no mention is made of a passport. Documents relating to the Prime Minister only made reference to the passport of his mother and not to one that was issued to him.

Both sides agreed that under French law Duhamel cannot give information that suggests one possesses or does not possess a French passport and that type of  information can only be granted to officials, police officers conducting investigations or a judge.

James took the stand as the petitioners’ second witness and during cross-examination by Astaphan admitted to having told the public about Skerritt’s French citizenship at meetings during the election campaign, but also conceded that, even then, no reference had been made using the word ‘passport’. He affirmed that no recordings were made of meetings for the party’s own record, although recordings could have been made of the meetings that were broadcast nationally.

He also said, “I knew that Mr. Green was a US citizen as that had been a matter of public discussion before but I considered him a Dominican.”

Court adjourned shortly after James stepped down, until 9 am Tuesday. Attorney for the petitioners Douglas Mendes had previously requested that the judge adjourn early so that preparations could be made for those who had to leave the island for the weekend, as reports indicate that regional carrier LIAT may cancel flights today due to inclement weather.

    This whole case was all about distracting the government of the day and sowing seeds of no confidence among the support base of Labour Party and hopefully win back support for the UWP.

    The court case is a loss leader.

    Overtime one notices the strategy of UWP and it has not changed. Remember the bugging case? It was a loss leader that threw doubt in the minds of the least educated and distracted the Freedom Party that had to waste time defending a senseless and baseless allegation with counter attack by the UWP that there is no smoke without fire.

    It is high time that judges take a stand with Caribbean politicians that in Opposition and make an example out of them.

    Now look at our two court loving politicians who prostitute (use) the existence of the court. Once they can clear themselves from a possible jail by saying to the judge that they simply want the court to clarify matters for them they will be there every day of the year. Out of the court they have plenty big mouth, in court they agree among themselves to take the blows because if and when they fail they hope to get sympathy from the electorate by voting them into office.

    It is all a game on the minds of the electorate.

    Freedom Party that had more lawyers in government never dreamt of abusing the court system in all its years of existence. Not once! But boy UWP will use it to build its support base.

    You can see that the man in the blue shirt is leading the man in the white shirt.
    Guilt is written all over their faces , hence the heads are down in shame and the next lies are now formulated to take to Q and all other media and continue the game of winning sympathy.

    The UWP has blundered once again. I do not know who are ther advisors, but I am very disappointed. In God’s own time he will provide a deliverer for Dominica. Skerrit is certainly c,but the opposition is s. They have double standards and need to do some soul searching. Now is the time for Eddison and Ron to mentor young educated people to take the reigns of the party. It appears as if they want to hold on to power forever. To show that they really care about Dominica they need to get more Claudius sanfords on board to save their party and they the older folks take an active, supportive backseat role.

    Somebody is giving the UWP VERY BAD ADVISE. Where as it may be true that Skerrit and St. Jean has dual citizenship. They should conserve their energy and strategise on how they can win the minds of the Dominican public. Skerrit would evetually meet up with what he does or doesn’t. They need to take into consideration that a wide croshssection of the public wants Skerrit wether he deserves it or not. Ron and Eddo should relax in their older years. Chose their battles wisely and let things take its natural course.

    Ron Green and Edison James are not on trial. Roosevelt Skerritt and Petter St Jean are, that is the fact. However to look at the case without examining the individuals who are petitioning the court would be laughable. Mr. Green was a US citizen while he served in Parliament and according to his own words he was a Us Citizen on nomination day for the 2009 general election. Mr.Green was also the holder of a US passport, which he obtained as an adult, he was a member of the US peace corps, these are also undisputed facts. According to Mr. James .., “I knew that Mr. Green was a US citizen as that had been a matter of public discussion before but I considered him a Dominican.”If this is not arrogance at its best, I would like to know. What Mr. James as a former PM is saying is that he was aware that Ron Green was a us citizen, but he James in his own deliberate judgement considered him Dominican, so case close. Unfortunately the same consideration cannot be given to Skerritt and St.jean. This statement by Mr. James brings a new dynamic to the situation. It is no longer a question of the constitution been violated, it has become matter of who is doing the violation. The energy and resources expended to bring this matter to court could have been put to better use if ony Mr. James as president of the UWP had said to his party …I KNOW SKERRITT AND ST. JEAN ARE FRENCH CITIZENS BUT I CONSIDER THEM DOMINICANS.. CASE CLOSE..

    I’ve notice that there are a great number of people residing in Dominica,holding a birth certificate,a Dominica passport,born in Dominica,and are not citizen of the comonwealth of Dominica.

    They blind fold themselfs in such a way that thay can only see a paticular,either green,red or blue.

    As far as i understood,a citizen of the commonwealth of Dominica is someone who respects the constitution and supports everything that is in the BEST INTEREST OF THE COMMONWEALTH OF DOMINICA.

    Dominica is over populated with thoes who pledge alliegance to political paties and not to this blessed island.
    Political parties can’t build this land but only the citizen and good government

      There are some who were not born in Dominica and hold a Dominican passport for their own means and ends. Of course, if they reside in Dominica for approximately 5 years, some owning a business and others who work in Dominica, eventually they could apply for and be granted citizenship. Consider also the Chinese.
      I do think it is a shame that they who were not born in Dominica and became D/can citizens are more regarded than, as an example, the PM and St. Jean who were born in Dominica just because they hold a portfolio in Cabinet, Skerrit being the PM and the other a Minister. This is a two-tier and discriminating system against their very own who are sons of the soil which needs to be changed.
      The more I consider this situation, the more I reiterate that this Constitution should be quashed and a new one written. This includes this Court case against the PM and St. Jean which should be thrown out of Court. May this be so.

Although Jean no longer holds citizenship in her native Haiti, her marriage to French-born filmmaker Jean-Daniel Lafond allowed her to obtain French citizenship several years before her appointment. Article 23-8[33] of the French civil code allows the French government to withdraw the French nationality from French citizens holding government or military positions in other countries.

      This is only on paper. You cannot take away a person’s right who was born in a country whether they lived abroad and became a citizen of another country.
      She got a rousing welcome when she traveled to Haiti as Governor General. They love her. No matter what, Haiti is in her blood. She still considers herself a Haitian and always will be. She loves Haiti and its people. Every one in the world will always look upon her as Haitian.
      Make note of this. There are times what is on paper is not worth the paper which it is written on and can be revoked as well.
      In any case, Haiti is not Dominica. Too often some countries adopt the policies of other countries. Each country stands alone and should be alone in their decision making as in this case. They must cease being a copycat of other countries. Do your homework/research as well and cease using the word Wikileaks for you are not a real Wikileaks.

        Michaëlle Jean was not ask to renounce her Haitian citizenship, she was ask by the then prime minister of Canada Paul Martin to renounce her French (Paris) citizenship before swearing in as the Governor general of Canada! and that she did, no one is disputing the fact that she was loved by her country men, for there was no reason what so ever not to love her, she made her people proud, both in Canada and Haiti, as a matter of fact world wide…. Although she left Haiti at a very young age she spoke the Creole language…so she had no problem communicating with her people….

      You make me laugh. :lol: God gave every one a freedom of right. You can renounce it and go and live under a dictatorship government as in Cuba, etc. :lol:
      On another note, once a citizen of the soil, a Dominican-born always a Dominican citizen. Nothing can erase that and not even on paper. This is why I am unable to comprehend what this Court case is all about because of an out-dated Constitution which should be re-written to suit the times in which we are living in. Every one speaks of modern age. Then, this Constitution should be re-written; some of it anyway pertaining to dual citizenship and holding a government portfolio such as a PM and Leader. This happens in other countries although I do not wish to sound like a copycat of what other countries do. It is time that this Constitution be updated. Let us wait and see the outcome of this case. I do hope it will be in the favor of the PM and St. Jean. Then, the change should be considered. This will avoid such future problems, overall time and costs and in the event I wish to permanently return home and run for PM in Dominica with my Canadian passport. :lol:

        That alone tells me that Satan uses his men servants to impregnate females. Hence Satan has his own children in this world, creating havoc in the lives of God’s children.

        Finally Jesus tells us through the man Nicodemus: “You must be born again, of water and the Spirit”!

        What is the reason that Jesus is suggesting that I undergo a spiritual birth, if I am already a child of God.

        Because as long as I exist with my carnal mind, not knowing God and His influence from conscience, I am simply a mortal being who can pass away, with a dead soul, anytime. God is Love of Spirit, Truth, and Holiness and I must become like Him, through faith.

        Apostle John confirms: “Behold what manner of Love the Father has bestowed on us that we should be called children of of God! Therefor the world does not know us, because it did not know Him”.

        The world and us are both “people or children” but “us” are the children of the Heavenly God, the “world” are the children of the god of this world–his name is Satan.

        The father of this world and his children are at the centre of this political turmoil, which we should be talking about here, to beging with.

        But I must continue, to say that God created people and He loves all people, becaus He has the nature of Love. However, unless one is born again of water and the Spirit, he remains a child of mortality, his human parents of flesh and blood alone, not a child of God.

        That which is born of flesh is flesh and that which is born of Spirit is spirit. You must be born again! Says the Man, Himself, Jesus Christ.

        Sorry readers for having gone off the topic. But I could not let that one pass. The reason too many people are blaming God, when their troubles come.

        They asked why, if I am a child of God, why does He allow me to go through so much pain? That is not a fair question against a God who is Love, full of mercy and compassion.

    The line of questioning from Tony Astaphan is not geared towards winning the case for Mr. Skerrit and St. Jean. It is geared at keeping the ignorant, ignorant and setting up the environment for unrest in Dominica, should Skerrit and St. Jean be found guilty.

    Mr. Astaphans knows fully well, that the two persons before the court for dual citizenship issues are Skerrit and Peter. However, he chooses to question Ron Green about his dual citizenship to side track the court and the members of the public.

    Now that DNO has done a story on it, this is exactly what the DLP wants, to keep the people ignorant of the facts and of the issue at hand.

    They know fully well, that the circumstances surrounding Ron Green’s Us nationality is totally different from that of Skerrit and Peter, but they will play on the minds of Dominicans who JUST DON”T READ and LEARN and EDUCATE themselves….for themselves.

    Very unfortunate, but this too shall pass.

      You do know that one of the job of cross examination is to discredit a witness, make the witness look noot credible…make him look unreliable right?

I think if anyone holds dual citizenship they can run for public office but NOT “PRIME MINISTER.” I also think that even if a person attends school in Dominica and that person was born in another country that person could represent the school but not the Island as a whole as Miss Dominica. You CAN NOT be MISS DOMINICA because you was NOT from Dominica.

I think it is past time for us to remove our blinders and see who is really there to help us and who is not.       A point of correction. Creole is a patois. Patois is a term to recognise a dialect or local language amongst a specific group of persons,so there is for example Jamaican patois, Barbadian patois etc. Cocoy (broken English)spoken in Marigot, Wesley and Woodfordhill is a patois.

        Efforts have been made over the past two decades to standardize creole as the kweyol language. There was a committee to advance the development of the language in terms of uniformed spelling and grammar. Marcel Djamala Fontaine and Felix Henderson were part of that effort.

        Note that the US state of Louisiana, St.Lucia, Haiti, Seychelles, Dominica among others, were involved in that effort. The Haitians have made great stride in having it recognized in Florida to some extent.

    when i look at things… is best dominica get under the french or u.s.a if that was possible or even the dutch… too much seen going on… yet remember when those witnesses take the stand it will be trouble on skerro… the interesting scenario here is that and i quote

WILL THE JUDGE PERSONALLY BY ORAL OR WRITTEN FORM…ASK FOR SUCH INFO TO BE BROUGHT TO COURT…

        Since I feel so offended being called dotish let me add further that MOTS was quoting from the above article; not from any past article. Check paragraph 9 above.That paragraph says that an official, an investigating police officer or a judge, can ask the French official, Duhamel, (paragraph 8), for information relating to passports. That information could not have been given to those who wrote to the French official, (UWP). MOTS was arguing that since there was no investigating police officer or other official, why can’t the judge request it herself? I don’t think that the judge is in the collection of evidence business but that’s MOTS’ argument. Who’s the dotish now?

      That same system of justice is demanding that the person bringing the chaqrge has to prove thier case. The person being charged with a wrong doing cannot be asked to prove the wrong doing. That is not our system. If we find fault with that system, then let us work to fixing it up. In the mean time we have to abide always with the existing system of justice. We are not in court talking about moral values or ethical values. In court we discussed the law. Discussions on moral and ethical values are good but we all must undertsand that the law is the law. Indeed the law can be immoral. Let us therefore change our laws to reflect our moral values. We will soon find that morality is a very subjective issue.

        In fact, questions of morality are never monolithic. If you examine society well you may find that issues of morality st with time and especially with the power elite.

        Those in control get to make the laws and determine right from wrong good from bad.

        Incidentally, study the theories of the great philosophers like Plato and Socrates and you will find questions of morality dogged throughout their practice.

        Extremely bright men who devoted their imaginations and intellect solely to matters of the heart. They dared not give definitive answers to such dogged issues.

        Go figure.
