High Court Criminal Session to open with new judge

The Criminal Session of the High Court will open on Tuesday September 27, 2016 from 10:00 am at the High Court in Roseau with 42 matters on the Court’s Cause list.

A new judge will preside over the session. Former Director of Public Prosecutions in St. Lucia Victoria Charles Clarke replaces Justice Errol Thomas.

There are seven murder cases on the list including matters with Shane Degallerie, Sherman Webb, Vivian Charles, Mitchel Toussaint, Mackinley Williams, Daniel E. Bannis and Loweate Montelle Dederick Dick who is charged with the 2015 Carnival Monday murder of Ken Mitchell, 26, of Gallion.

In 2012 Webb was found guilty of killing Barbadian Corey Poleon and sentenced to life in jail but the Court of Appeal earlier this year quashed his conviction because of errors by the trial Judge and ordered a retrial.

Last year, the Appeals Court Judges also upheld a murder appeal against Shane Degallerie of Pottersville who was jailed for 18 years by Justice Bernie Stephenson after he was found guilty by a nine-member jury in 2013 for the 2010 murder of Justine Joseph of Fond Cole. A retrial has been ordered.

The list also has a number of sexual matters of rape, indecent assault, unlawful sexual intercourse (USI), attempted buggery and incest. There are over five matters dealing with unlawful wounding, wounding with intent and Grievous Bodily Harm (GBH).

One causing death by reckless driving, aggravated burglary/theft and Ason are the other matters on the list. Kenroy Paul is expected to be sentenced for a Money Laundering offence and Florence Telemacque is also expected to be sentenced for a GBH matter.

The prosecuting team will be led by Director of Public Prosecutions (DPP) Evelina Baptiste along with State attorneys Karlita Benjamin and Kayan Toussaint.

    Hope justice will be served to the family of Ken Mitchel of Gallion who was murdered innocently. It hurts everytime l see the accuser roaming all over the place. The family are still hurting. Two little boys left behind without a father. So sad.

    Just keep slapping them on the wrist, DOM Dominicans justice system, the general consensus is because he , or she did not waste the courts time therefore we will be lenient what kind of nonsense is that ,the people who work in the court are being paid by the people of Dominica, so don’t safe me any money, do your job give them the maximum, make the sentence fit the crime , and stop being mother Teresa.

    It never ceases to amaze me and also get me angry that some people commit murder, snuff the life out of a fellow person and they expect to get out scot-free, be acquitted, not receive adequate sentence and walk the streets of Dominica as if they did not commit a crime/murder?
    They are fortunate they reside in a democratic country. We know what would happen to them from the moment they are caught.
    No one can ever make up for a life lost. No sentence could be sufficient for taking a life. If it is not self-defense which has to be proven, the maximum sentence for murder should be life imprisonment with no parole. Even that will never be sufficient for it cannot bring back a life.
    Teach people to love rather than hate and become an enemy.
    Teach them to control their anger. These lead to injuries, murders and other crimes. Let them know the repercussion of their action. This discipline should commence from the home.
