Injunction filed to prevent autopsy of PMH death

injuctionThe High Court in Dominica on Tuesday granted an injunction until October 23, 2015 preventing an autopsy on the body of Lisa Peter who allegedly died under strange circumstances while under observation prior to giving birth at the Princess Margaret Hospital (PMH).

The family went to court seeking an interim injunction to stop the autopsy and also to stop the disposal of her remains and the fetus being carried by her at the time of her death.

Her father, Michael Peter the Claimant, believes that questions needs to be answered surrounding the circumstances of the death of his daughter. He has joined the Attorney General, the Chief Medical Officer and the Medical Director in the suit – DOM/HCV: 260 of 2015.

The court stated that “upon reading the Affidavit of the Applicant in Support of the Application; and upon counsel undertaking to file an amended statement of claim to reflect a cause of action as stated to the Court; and, upon the applicant undertaking to abide with any order for damages which may arise as a result of this in junction; and upon the Court recognising the interest of Michael Peter the father of the late Lisa Peter,” the following were ordered.

1. The Administrators and medical staff of the Princess Margaret Hospital immediately stop from proceeding with an autopsy on the remains of Lisa Peter an adult female who died on Wednesday 14 October 2015 at the Princess Margaret Hospital and that there be no action or procedure commenced or continued on the said body and or remains.

2. The Chief Medical Officer of the Commonwealth of Dominica, Medical Director and The Hospital Services Coordinator stop proceeding with the autopsy on the remains of the said Lisa Peter.

3. That the Hospital await the arrival of the independent Pathologist Dr David Gaskin whose services has been retained by the claimant herein to observe the autopsy within 72 hours hereof.

4. That the body of the deceased Lisa Peter and any part thereof including the fetus of her unborn child shall NOT be removed from the Morgue of the Princess Margaret Hospital or disposed of in any way.

5. This injunction is adjourned to and shall remain in force until Friday 23 October 2015.

    i agree 1000% with the boyfiend/baby father. majority of the staff at the pmh is lacking professionalism. this young lady was a high risk patient and therefore should be treated like a high risk patient, not by the government of dominica, not by skerrit but by the staff of the pmh. the nurses, the doctors etc. i had a bad experience myself when i was there with my little girl. some of the nurses are very harsh and unprofessional.
    i’ve been to the casualty department with my sick 2 year old and i can tell you the entire time i was in with the doctor she was on her phone whatsapping. i could only shake my head. she was the only doctor on call and there were at least 15 other people sitting outside and this doctor was on her phone the entire time and moving around like she had no care in the world. honestly i had no choice,because my child was sick and there are no private doctors offices opened at night so i had to stay.

    We may never understand those who have lost loved ones unless we too go through an experience ourselves. Honestly i do not expect much from a public health system not that i am making excuses for ours. Making it worst from captain down to cook many in the system, not only health, are political appointees. Moral would be low and there would be serious problems with professionalism and quality of service. Those who should be rewarded for hard work are victimized. Unless you print 666 in red on your forehead, you are discarded. I know of people who work in the system who say they only have one Boss i.e the Honorable PM this implies they don’t have to report to no one on what they do for a month. Unless we reward hard work and have a just society we are going to have a society which is incompetent.

    I can just imagine walking by and hear one of those Ruff nurses saying ‘Doctar she die wi’ then it gets swept under the rug. Keep fingers crossed that atourney general don’t just suddenly drop this case like others.
    But seriously, I hope this becomes a WAKE UP call for health dep’t and gov’t. The solution to keeping these incidents down could be (as unrelated as this may sound) as simple as investing in and implementing solar power system (Domlec rates will ‘Kill’ the hospital) just for the hospital, to deploy air conditioning to all units of this important hospital. Something to consult with the Chinese for, even England is asking them. Cool air in a hospital is very very important, and cold air in surgical units. Seriously!

    The poor woman probably hemorrhaged to death giving birth. PMH is not set up to handle emergency situations. Too many times the medical personnel don’t listen to the patients, especially women giving birth. In addition, many people die waiting for treatment to be undertaken. I feel for her and her family.

    My Sympathy to the family. Having one family member die is hard enough, Two at the same time is double the sorrow. May the soul of the deceased rest in piece.

    Having a mother and child die in childbirth is not something unusual. It happens all the time and thank God we have more healthy deliveries than not. However, many pregnant women have very difficult pregnancies much more than we know and sometimes they do end in death of either one or both. Some women have bed rest for the entire 9 months; Others never get sick a day.

    We know complications can happen up to the time of delivery. I know a woman who saw her doctor in the morning and everything was okay; she was expected to have a normal delivery by early evening she went into labour and the baby had turned meaning she was going to have a breach birth and that meant complications.

    Reading the comments, I hope this case is about the deceased family finding closure for their loss and not a political wish hunt.

    To the family of the dearly departed take comfort that god is in control. May her blessed soul RIP.

    However, for too long medical professionals practicing in Dca have gotten away with murder. Yes I say murder :twisted: . There is a certain lady doctor from the valley area whose father went to PMH a few years ago for a minor illness only to be operated on and stitched back with surgical instruments in his body cavity. What happened? He kept complaining of stomach pains after surgery but no one listened.

    The man eventually died and the post mortem revealed the instruments left in his body was the cause. The said doctor was never disciplined and the family was lied to as to the cause. But after the lady finished her studies and got employed at PMH she got her dad’s file and learnt the truth. She was so hurt that she refused to work with the guilty doctor.     It is a sad situation. I am sorry about her death and that of the baby. I hope God had mercy on her soul. May she rest in peace. Amen!
    My sympathy to her family. Be consoled that God is with you in your grief.
    Utilize common sense. First of all, no one should be quick to judge the hospital, the medical profession for they may not know the full story as to what caused her and the baby’s death.
    Many questions will be asked and must be answered. She was pregnant. How healthy was she? Did she have any medical condition? Knowing that she was pregnant, how well did she take care of herself nutritiously? Did she visit a doctor during her pregnancy and how frequently?
    How many months pregnant? How long was she in the hospital and what transpired there? These questions and more will be asked be they in a different manner. Then comes the verdict of what really caused her death and her baby. The results of the autopsy should reveal it.

    My sister is there and is due to drop. I told her get herself together and do like skeritt – Me tell she to go have an American bay, cause I want to see my nephew ALIVE. I could have sued them at PMH when my brother went there without any pain; and the boy just went down down down and died within a week or two. This hospital needs to be torn down. This place is cursed. I mean it. Don\’t go there if you have a pimple; cause you\’ll come out with a growth.

All these people making their kids in US and then leaving and the hospital bill is on who? It will not happen for much longer.

    My deepest sympathies and the comfort of the Holy Spirit to the entire family of the deceased. I am totally convinced that if the “head ” is sick, then the whole body will be sick. Therefore if the hospital personnel has poor hospitality issues, then check who runs the hospital. And this could go on even up to the government. (By the way, Dominicans who live overseas please stop accepting tickets from political parties to come and vote in Dominica. You are causing a negative effect to the political climate and this is not the just thing to do since you don’t reside there!)
    I will not end this by playing a blame game but instead choose to address the “Church”! What is your responsibility? What are you doing? Are you part of the problem or part of the answers? Will you just sit by and do nothing while evil increase in the land? My admonishment to you is to wake up, put on the whole armor of God and execute in the land the will of God to be done on earth as it is in heaven!

    It is indeed sad the circumstances of Lisa’s death, but I would like for everyone on here to answer to these question? So the pathologist performs an autopsy and rules her cause of death and in his reports states that if X, Y or Z was done, her death could have possibly been avoided? What’s next? The PMH and the people listed above are going to be sued for negligence a monetary award is going to be awarded. Where is that money going to come from? How is that going to benefit the operations of the PMH?

    While we all acknowledge the need for better equipment/facilities, we all must not be so quick to try to bring something or someone down because we do not agree with them or their ideas or because of one bad experience, people die everyday in hospitals, some due to simple mistakes and some due to serious negligence. Let me be the first to tell the lawyer, that one cannot get any damages for negligence if the negligence was due to lack of facilities or proper medical equipment…

        I feel for her family who are grieving her loss. I hope they get some satisfaction from the autopsy. Those close to her knew if she was healthy or not. They knew her condition, whatever it was.
        I reside in Canada. I have heard some medical stories and no exception also about the US. Some nationals go away, some to the US and other countries for medical treatment. Their emergency rooms in hospitals here are filled to capacity. Hours are spent prior to a doctor or a nurse seeing them. I pray to God to keep me as healthy and for as long as possible.
        A few years ago, a very good friend of mine, a St. Lucian was ill. She was treated here. She went to the US for further treatment. She returned here and eventually died. This is an example.
        I would state to everyone who lambastes PMH and the medical profession who are employed there, please wait for the results of the autopsy. When it is revealed, then form your conclusion and opinion.

This happens in hospitals all the time not in PMH only maybe she might have travel to another country it could have happened. God is the only one who has the answer.       Hmmmm.That PMH has been covering up malpractice and negligence for a longtime now. 25 years ago,I gave birth at PMH and went through 2 weeks of toture.I was healthy no underlining issues but the negligence of the head nurse at the time to allow a student midwife to give me a cut almost cost me my life.They did not call my doctor for the delivery and so the student midwife cut a blood vessel when she cut too deep. It was horrible! I passesd out , wasn’t properly cleaned ,started to get gangrene and had surgery two days later.Long story short ,few years later went for my records at PMH cause of issues related to the birth, only to find out my record only stated I gave birth on that date.nothing more. So they do hide records after negligence so as not to be sued. RIP Lisa

    Many of these comments give the impression that it is only in Dominica that child birth deaths occur and we use sad occasions like these to vent our political frustration. In the USA where they are supposed to have top class medical care with state of the art medical technology, 1200 child birth death occur every year.

    I am saddened at this unfortunate news. May God give the relatives strength and courage at this trying time.
    Im sure this is a wake up call for staff at PMH. I believe there is some level of unprofessionalism and negligence for sure because I have experienced it.
    However, People like MR GRELL, whoever you are, please stop saying that Dominica is doomed. Life and death is in the power of the town. I hope its not ever your intention to come to visit this island much less to live here again for the number of negative confessions you are always quick to speak about this land. I want to live in this land so I certainly don’t want it doomed.
    I think we have to stick to the matter. I am sure its not the government that tells a doctor or nurse to be negligent. Come on. No matter which government people can and may make stupid mistakes and display negligence. Lets put the blame where it really needs to go.     The thing about some of us is that we are all posting about how upset we are and it is high time that some thing be done and someone be held accountable who the ineptitude that has been practised at PHM for so many years, but if I call for a show of people to express their frustration in person at the ministry of health buiding, how many of you will show up? Words are weak , so unless we do not support words with action these complaints will go nowhere!
    There is no leadership in the country so the corrupt and incompetents are fulling in the gaps.

    That’s was Doctor Dale Dangleben is and was talking about, our people are dying at the PMH OF simple medical conditions that can be fix in a compent medical environment ,some of the staffs are over work frustrate cant speak out cus they might lose there job. I have no political leanings , I just want the best medical care for all of Dominican ,think of bringing one of your family member with a headache, or lower abdominal pain. and they tells you the Doctor wont be in fore 8 hours and die waiting. what would you do ? ,your love one is gone ,the obituaries on the radio are all from the PMH a great percentage of the DCA population dye at the PMH ..DOMINICA OPEN UP YOUR ALL eyes Don’t wait till get to your door step.

    When a few can afford to travel for medical care because we vote them in and as such they have access to all the financial donation$ that was given, while we the poeple for who the donation$ were intended cannot even get the basic care in our medical facilities.     It is high time that some one answers for all the rubbish that goes on. Some nurses do not care and have very bad attitude. they do not give you any information about your loved one are sick and when you ask they give you attitude. children are dying at the hospital, ventilator not working, doctors who are on call, when they are contacted they do not come, so do speak very little English and others cannot understand. One of these days these two shall pass.

    Kudos to the family of the deceased and to the attorney for the family for taking a stand in this matter.This issue is very personal for me and my family, because we lost our dear mother at the PMH and before a post mortem was conducted we were giver a death certificate stating the cause of death.We had to leap through circles of fire,to eventually get an autopsy performed.It’s high time we in Dominica raise our standards and give responsible service to our nationals.
    People want answers to issues especially in the case of sudden death of a loved one.If one person cuts off the head of another they will perform an autopsy to ascertain cause of death.This is the right thing to do yet in other situations, especially when negligence is at play at the hospital, instead of investigating the matter fully so as to put corrective measures in place to avoid the similar thing happening in the future, they are quick to try and sweep it under the rug. I hope for changeat the PMH in such matters.

      And what exactly so grand is it that you think he has done? In case you did not notice, the Court did not attach blame to PMH or any other entity or person. All that has happened is that the Court has ordered that, if it had not already been done, the autopsy must be delayed for a short time (presumably to allow an pathologist to be in attendance at the State autopsy or conduct one of his own). The PMH definitely needs to improve the service it provides to the public and these deaths are certainly tragic, but that does not meant to say that we should condemn the hospital just yet.

    Let us assumed that the father knows something we don’t know. Take a look at what we can see. Have you noticed the garment a pregnant women wears? They carry heavy objects, climb steps, ride on buses, it is frightening, so the first responsibility is to ourselves. No one wants to take the blame for their mistakes. The professionals cannot be everywhere. Let us look at negligence and on who’s part.

      Caretaker you make no sense at all. If a pregnant person does not have a vehicle of their own and need to get around should she walk? Taking a bus is the only option she would have. I do agree though that some of the clothes they wear are not appropriate since it is too tight on the stomach. But it is high time we as Dominicans look into what is happening in our health care system especially at PMH

    All that money available for lawyer and overseas pathologist now that she is dead, where was it when she was alive? I support the motion to stop the autopsy and investigate but we must do better when our family is alive, we make them suffer and die, now she is not even there to benefit from anything after her death, sad. Please learn a lesson people. I still thank the family for taking a step that may help the rest of us but if is Tiyani that is your lawyer, get another one or that will go nowhere fast!

      This is very sad news. Can you imagine the pain that the family is going through? There are two lives involved in this malpractice/negligence. Why is it that so many patients are dying at PMH? Are the nurses inept, lazy or don’t care? This is a profession where one has to demonstrate love and care towards the patients. If one cannot do so then he or she is in the wrong field. This problem needs immediate attention and the Ministry of Health needs to investigate what’s been going on and fix the problem. It is sad that this continues and no one is held accountable. What message does this send to the world? If the nurses are inept then they should be fired. Enough is enough and questions must be answered.

      I trust that justice will be served on the behalf of the Peter family.

    THANK YOU JESUS. Finally action is being taken against the PMH (NURSES and DR,s) For those who have read and heard my cry , I will continue to repeat the terrible experience I went through with the Dr’s and Nurses at the PMH. Due to ……… my dad died on the 8th of August , 2015.

    My dear fellow Dominicains all those who has suffered and loss there loved ones under the negligence of the PMH staff please come forward and state your issues which you encountered. I will continue to fight for my dad because he was not suppose to die so soon. Rally with MR. PETER

      What a sad and cretinous individual (I almost said creature) you are! You pretend that medical care outside of Dominica is all roses, that there are no deaths and questionable events in the medical systems of other nations. If so, I wonder why there are so many medical negligence claims and more importantly successful claims in the USA, UK, Europe and elsewhere in the so called developed world? Of course our medical system needs improvement, of course our doctors, nurses and other health care professionals need to step up, but please, do not condemn the entire country in such ignorant terms. Incidentally, it is virtually certain you have not made, and will never make, a single positive contribution to Dominica.

    Too easy in Dominica to get a death certificate saying natural causes. When was there ever an inquest or a a conviction of the so-called professionals. People scared to talk, Government out of control and few rotten apples give everyone a bad name. Time for change, for real!

      Change for the worst? When are we going to stop blaming everyone else but us the real problem. Dominicans need to look in the mirror and fix what they see. Change their bad attitudes, their lack of customer service and do their jobs properly. That’s the change we need to make.

P.M. himself said the hospital is outdated but he going overseas to look after his own. What kind of example is that? I’m just saying.

      Negligence, ineptness, laziness rotten from the top and it stinks all the way through. the best way to fix it is to get rid of the rotten fish –the whole gang!! The folks that is allowing and sowing this inefficiency don’t stick around to enjoy the hopelessness they create, in other words the run to where they can get the best of service.
      Poor people is is time to rise up and demand the best !! Not because you poor you should accept sloppiness, backwardness and inefficiency. Get rid of the head and its supporting parts, they don’t care about you!!

    We have to start some place. And it is high time that our health care system be held accountable for its failings. We should not be prepared to sit back and read horror story after horror story about “strange circumstances” at our main hospital whilst in the supposed care of medical experts.

    My sister gave birth to her baby in a toilet and this was swept under the carpet like it never occurred. In fact she was given paracetamol for her pain and was told that she was lying about her contraction pain by both the nurses and doctor. TS Erika is the beginning of the punishment for Dominicans and the way they treat each other. We don’t need a new hospital. We need better loving and professional behaviour.

      Yes i back u on that. Itw time to punnish dominicans specaially those labourites that put skerite back in power. The man build a 27000000 dollar state house and young people dieing in dominica. The man making all his children in America what happen the hospital doe good for him it good for us. Sue the damn hospital tired of that garbage and is time to force skerit them out of office.         BS! U really blaming Skerrit for this??? While I am no Skerrit fan, the fact remains: You can build the biggest, most beautiful, well equipped hosptial in Dca and have lazy, unprofessional, uncaring, BEFFY nurses and doctors topped with BAD ATTITUDE, absolutely NOTHING will change.

        I do understand ur level of frustration. But we do have a problem that needs
        to be fixed and I hope that this incident as sad as it is that this will open the eyes
        of the doctors and nurses at the hospital .There is a Minister of Health he is a doctor
        Supposedly he should look into the matter .Some of the nurses are horrible and that has to be
        fixed. But we should not make this a political issue .This is what we have and all the politicans
        should attempt to identify the problems and fix it. Because if any one falls sick this is
        where we have to go .Any country/island without a proper health care system is doomed
        to fail.. Condolences to the family

        You should know that he is the PM for all those years Do you not expect him to have money? Due to his status, the bank will be quick to loan him money, whatever amount he needs to build his house.
        His wife is a US citizen. Have you overlooked that? It is not surprising that the decision is hers to have her children born in the US. Parents who are US citizens are entitled to have their children born in that country. It makes good sense.
        Consider the children have a future. It is better for the parents and for them that they are born in the US. I see nothing wrong with that. You should comprehend that. Cease your grinding and stick to the issue of this article.

    We are all sadened and offer our deepest condolences to the family and friends of the deceased. But we need clear and precise information as it relates to the deaths of the deceased, that might asist to aliviate and correct what ever nedds to be adressed if it is deemed necessary. R.I.P.
