Former general Manager of Marpin 2K4 Ltd, Pericson Isidore, has filed a civil lawsuit against the company citing wrongful dismissal and breach of contract.

On November 29, 2013 the company, through its board chairman Francis Emmanuel, terminated the services of Isidore with “immediate effect.”

Isidore, through his attorney, Cara Shillingford, had written to the company explaining that his termination was unlawful and that the company also owed him for the wrongful termination.

However, through the law firm of Isidore & Associates, Marpin’s response was that they found no problems with the termination and that they would not accede to the request of Isidore and his lawyer.

But Isidore has fired back and in Claim 314 of 2014 filed on September 5, 2014, he claimed that his termination by Marpin was “wrongful and in breach of contract.”

Isidore and his lawyer also claimed that on the day of his termination, (November 29, 2013) the electricity supply at Marpin’s Morne Daniel studio was disconnected and he was being blamed.

That claim has been denied by Marpin’s lawyers.

According to Isidore, the decision to terminate his employment and the timing of the termination of his employment were “calculated to cause maximum damage to his professional reputation and his prospects of finding future employment.”

He is asking to court to rule that his dismissal was “unlawful” and is seeking damages for wrongful dismissal inclusive of loss of salary, loss of free cable, phone, internet services and loss of gratuity, damages for breach of contract, general, special aggravated and exemplary damages.

    A man in his position, a General Manager, should not have been fired on the spot and without a certain amount of compensation in view of his status in the company and time he worked there.
    It must have been a shock and trauma for him when he was told that his services were no longer needed. It seems he was treated as a clerk. This is lack of consideration and respect. He has the right to sue. I wish him good luck and success.
    What makes them think that a new employee could do better and in the long run?

    his point is that they fired him at the same time Marpin lights was disconnected. So it had the appearance that it was all him as his fault. And that is damaging to his professional image.

    The company has the right to dismiss anyone at any time any for any reason. After they terminate the employee, they only question thereafter is the size of the settlement.
