Jacqueline Theodore and government to face off at appeals court

A matter involving former parliamentary secretary Jacqueline Theodore and the attorney general will come before the Eastern Caribbean Supreme Court of Appeals court this morning.

Atribunal had awarded Theodore over $3 million for land belonging to her husband in Calibishie, which the government had acquired for the use of a road some years ago.

Theodore took the issue to the media some time ago when she was not fully compensated by the government.

Government then announced that it would appeal the amount that was awarded to the former parliamentary secretary in 2008 for the land.

She has already been paid $ 210,737. according to the Government. Several other criminal and civil appeals are also to be heard at the hearing.

The appeals court will run from November 8-12, 2010.

    Listen and/or pay heed! To all of you who appear to be negative and always spew negative words and insults to those who disagree with you and who state that the lady is not entitled to the amount which was awarded to her by the Court, what is this dispute about? She did not award herself $3M. The Court awarded her $3M because her property is worth it including lawyer’s fees.
    Whether it was the previous government who did not pay her $3M, ask yourselves, why is the government refusing to pay her the balance? What is the hold-up for? It is unfair to her and deceitful. It is breech of promise to pay and that is wrong. Need I state any more?
    As for those who offer advice to her, my advice to you is to refrain from doing so. Not everyone’s advice is worth accepting and adopting. People need encouragement and not discouragement. Allow her the freedom of right to pursue this case. Give her all the support you possibly could, be it in writing.

Well for your information I am quite familiar with that case and i know the lady got enough for the road, I tired advise Jacqueline to accept what she got and leave well alone, instead she spending all her money on legal fees!!!!

    I am being objective but it’s obvious your mind is clouded with POLITICS, so it is almost impossible to have a fair discussion with you, so go ahead and eat your heart out.

    Look they charge her lawyer $700 for not properly filing the case which is causing the case to be delayed by another 21 days, get your facts before commenting – IT IS BETTER TO BE THOUGHT OF AS A FOOL THAN TO OPEN YOUR MOUTH AND REMOVE ALL DOUBT – MATT PELTIERRE.

    Let’s get the facts straight…

    Granted the Labour Party was in government when the judgement was handed down in 2007. However, it was the UWP Government that in 1998 tresspassed on Ms Theodore’s land to construct a road. Further, the UWP Government acknowledged that tresspass and agreed to pay her adequate compensation for the inconvenience.

    The AG acting on behalf of the current DLP government simply requested a review of the amount awarded ($3 million) as it seems quite excessive for providing road access to Ms Theodore and others in the area. The government has already paid $ 210,737 a considerable sum for the land in question.

    @dkt: UWP was in power in 2007? Come on read this again. Roosevelt Skerrit has been in power from 2004 – present. UWP was in power from 1995 to 2000. The Labor party has been in power since 2000 to present.

    What is the big deal – The government paid a Taxi driver in Pennsylvania almost US $300 for some garbage Bins that really cost $20.00 US at home depot (maybe $15.00 at Walmart). Pay the darn lady for her land and stop playing these stupid games. Somebody paid thousands of dollars for a carousel at Melville hall air port nand the carousel is useless. Somebody paid exorbitant prices for fertilizer that was inferior.

    It seems like the price is right only when their cronies stand to benefit and kick backs are in order. Note though that UWP would have done the same thing. Only the people can cleanup the political mess w have in Dominica.

    I wonder how many miles of road the cut through that land because $3m for cutting a road appears to be extremely high if you ask me!!!

    The court should not accept this exorbitant figure, the $210,737 sounds more reasonable to me, that is the final payment, the road enhaces the land whats wrong with Jacqueline?

    This case is a typical indictment of the Government’s approach – an over operatic style of grabbing in the absence of any formal process of land acquisition. Other outstanding cases exits, where the Government has got hold of people’s prized real estate (possession) by seizing quickly and easily.

    I’ve been pursuing my case for almost ten years now but to no avail. Every god damn attorney engaged in D/ca seems to collude with a government that is intent on disregarding people’s rights. The decision in this case may well set a precedent for others to follow.

    The jury is out – this may well explain the pervious AG’s decision to resign, failure to renew contract of employment. It reveals either gross incompetence or a cynical dereliction of the most elementary professional duties.

    Looking from the outside in, land/property does not depreciate in value.
    Property for especially cultivation is worth a mint which could amount to billion of dollars through the years.
    Consider someone owning this type of property and another expropriating it and/or purchasing it. The amount they stand to gain from this property in years to come could amount to billions of dollars. Who is the loser? In this case, the owner of course who was approached by the government and was persuaded to sell the property for whatever reasons.
    Let me further inform you governments never want to pay what the property is worth. I mean, governments of any country. The government may have to be taken to Court.
    To be fair and just the lady deserves every bit of the money which was awarded to her, if not more. The present government you owe the lady the amount that she was awarded. Pay up! Please do not pursue this matter any further which is costing taxpayers additional costs. Give the lady the money which she deserves.
    I bring the Lord of all into this, the Creator and Ruler of the world who governs it, as he observes and notes from his heavenly abode. For the love of God be fair and just to her.
    I wish her well and that she will be awarded the rightful amount.

    First of all DNO, the government never acquired the land of Jacqueline Theodore. The Government in 1998 tresspassed on her land to construct a road. The Government acknowledged that tresspass and agreed to pay compensation.

    I am seriously disappointed in the government’s approach to dealing with this matter. The lady has been wronged and irrespective of the government of the day she should be compensated. The former Ag made her mess and now she is gone. If the rule of law is worth its salt we will see this woman successful in the outcome. I have followed this story and she is within her rights.
