Frances Frederick faces manslaughter charge

Frederick

Frances Frederick of the Kalinago Territory was granted bail on Tuesday morning when she appeared in the Roseau Magistrate’s court.

Frederick is facing a charge of manslaughter following the stabbing death of her boyfriend Nixon Francis in Gullet River on Saturday, March 17 2012.

She is represented by Ronald Charles and Joshua Francis.

The preliminary inquiry for the case will begin on 13th June, 2012.

In the meantime Frederick will remain in custody until she gets proper surety for bail.

    I don’t know the lady personally and i don’t know the circumstances of this crime, so i am not going to say:”she belongs in jail” or “she needs to return home”. I will instead let justice take place, after all that is why we have lawyers, tribunals and all that… Now, I am not a priest, but i do believe that she needs to pray, ask God for forgiveness whether she goes to jail or not. She also need to leave that bottle alone (i have seen people mentioned that she was a heavy drinker) and try to have a new, fresh start again getting back to life…

    i am sorry for the guys family…but if them self know what was going on they should try and find counselling for him or them both or advis them to move on. same for the woman family. Its real sad to see people get together so happily but part so sadly. To this woman i dont know what transpired, but i believe this was done because of abuse and self defense and i know if thats the case which i am more that 90% sure, she will go FREE!!

    from what i heard, the woman was a heavy drinker, and always threatened the man whenever she was under the influence. This was not the first time that she had used a knife on him. If anyone of you knew him, you would see that he was not a fighter, he was barely 120 pounds. After she stabbed him, she ran to tell the children that she had killed their father. Now, tell me, does that sound like a woman who was abused??????

    I am certain she didn’t meant to kill him. I more believe it was self defence but unfortunately he got killed in the process. I hope the court sees it this way, which I’m sure that is probably what happens.

    my dear lady i do not know what happened but the letters that i am reading that domestic violence is part of what happen,i can tell u myself was battered for 20 years of my life threaten, beating,i finally left with a fracture jaw given by my boyfriend,i known it is wrong to take a life just ask god’s mercy,hope every thing goes well for u,i feel ur pain i took it for 20 years.

    perfect love casteth out all fear. if a man and a woman loves each other as the love that is in the bible they will cling to each other and fix each problem in love without a fight. none is suppose to raise a hand to hurt the other, thats not love. once beaten you run from that relationship, but what about the coward women who have no jobs and no where to go? they have to stay and be abused over and over but the mind is very funny, at one point in time it will say i have enough and that swhere you feel like you lost every thinking. ladies run from abusive relationships. let go and let God!!

    Maybe it is a good thing that this is coming to the light. The women in the Kalinago territory have been used and abused for so long. I lived with this womans cousin and let me tell you it was joy one minute and slap and kick the next. I got out asap but he kept hunting me down, the police could care less, they find it amusing. The bottom line is if you abuse your children they will most likely grow to be abusers. I can’t tell you how many times I’ve heard women in public dreading their children.{I’ll give you one good slap.} Really people is that what you consider taking it to the next level? I am sorry for the dead man he was abused also. And for the record this woman well knows how to poison a man she wouldn’t need a knife. Men in this family die already and we know why and how? Dominicans need to talk about abuse in the schools and the church and break the cycle of violence before it’s too late. A very sad day let the woman go home and give her mental health counceling and training in child care.

    Rhis is not about politicks, and the caribs have right to their land, they own it as a collective, unlike some of all you negroes, who are landless, and unale to own any land because you have no opportunity to inherit or own land.
    This is a battered woman who have finally freed herself, the courts should take that into consideration. She should be free on bail, because she is not a threat to the community. Let us have some real justice here, this woman is innocent. The real murderor is the man who was beating the living daylights out of her, I would contribute to a fund for her defence, she needs help not jail. Time those in authrity show they are serious about real change in Dominica, too many insecure men in Dominica beating on women.
    The man should go to jail even though he go and die, one lttle cut she give him and he decide to die. Allde time he dere beating her, she stay alive for her children, de potash he die on purpose to put the woman in trouble, all see how men stay. Free the woman.

    Firstly, I would like to empathize with the family of the deceased. We wish them health and strength through these trying times. If they do have children, what are their ages and were they exposed to the actual alleged manslaughter? If so, if the children are very young then serious and deep counseling is strongly advised because these violent acts are extremely dangerous to the psyche of children.

    Secondly, from many comments here there seems a lot of emotions especially at the appearance of the picture. It is not healthy as a people to simply jump to conclusions especially if one was not an eyewitness to the incident to conclude that the woman was the disadvantaged one. One cannot look at a photo and say “ah” the man is the “bad” one. It is unreasonable and unethical to approach the issue like this. It could be a number of issues for e.g, both were exchanging words, it could be that the woman started first in slapping the man across his face, then a fighting between them ensued until the woman stabbed him. Or, it may be that the man started battering the woman for no reason thus she defended herself with a knife which caused his death. The point is so many things could happen if one examines the issue from different angles. IF THIS WOMAN DEFENDED HERSELF THEN SHE UNDER DIVINE LAW HAS EVERY RIGHT TO DO SO EVEN IF IT ENDED IN THE DEATH OF THE MAN.

    Thirdly, we need to recognize that men are abused by women as well. I remembered broad daylight in Roseau a woman beat up supposedly her man in the heart of Roseau. There was a large crowd and I remembered seeing that man running away from the woman. He never lifted his hands on her yet she scratched him so much, his face was scratched with blood. The police was there, never arrested or restrained the woman from what I saw; what was the reaction of the crowd? It was as if since it is a man it’s no big deal. If it was the man beating and scratching the woman like that then there would be a spin on the issue. This is very sad and this shows the sexism that occurs in our society. NO MAN OR WOMAN SHOULD EMOTIONALLY, ECONOMICALLY OR PHYSICALLY ABUSE EACH OTHER PURE AND SIMPLE! IT IS WRONG ON BOTH SIDES.

    Lastly, the N.G.O’s need to step up to have serious workshops and educational programs to address the issues of domestic violence in Dominica. Too often when one hear of domestic violence it automatically paints a picture of a man lifting his hand on a woman. There must be dialogue, wisdom and balance in addressing these issues. Leave the politics out of it, the N.G.O’s need to step up and do something in the society. God’s willing I would like to be part of that process as well.

        I understand your passion as it relates to the abuse of children. This is true, it is wrong to physically and emotionally abuse children.

        Parents must be role models themselves, they must lovingly teach their children ethics.

        However Tiny, children who are rebellious must be disciplined, of course not in a manner which leaves marks on their skin or cause undue harm to them.

    It’s sad that a life was lost but….men need to stop abusing women…..It’s not easy being in a relationship when all you experience is violence. One may say, “why didn’t she leave him? or why not run away?, these men sometimes threaten these women if they tell them that they will leave them…in such a case I guess they can only fight back…and that’s what she did, it just happened that he ended up dead while it was self defense. I’m sorry that it had to end this way but it could have been her, and WE would be saying but why didn’t she leave him or FIGHT BACK?

    We know that there are some strange women who behave as if they have full authority to behave as if they just come from a cage and disrepect other women; but that is because the men prompt that kind of behaviour…no apologies

    So while all must behave responsibly, the onus is on the men to drop their eyes and hands.

    Good women in many instances “fall” in love and for the first period joy is flowing..with a man in their lives

    Fortunately some men do change; but by golly the life of mental and physical abuse is like the man has an agenda of putting a woman in her (cage) place.

    He becomes satanic and horrible, sometimes as soon as he leaves the bed or as soon as enters the door.

    Children are unhappy when they see their mothers in tears but the man is all about his ego.

    How do we help the man who has no control.
    I wish it didnt have to end in death but for the life of an abused women, her spirit is dead long long before she walks away or reacts in defence.

    The dead man reflects the dead woman who usually keeps her body alive just because of her duty as a mother.

    I’, sure that there are Caribbean cases of “battered women syndrome”

    Get your lawyer to use this defence to help you – it has proven tried and true many a times, especially if you were a battered woman and you fit within the “battered woman syndrome” category.

    I hate to hear of ppl killing each other, but as i always say, each and every man is a potential kill – it just takes the right circumstances, and wham…you actions make you a killer. Some actions though, can be excused, no, sorry, rather accepted and justified. If you suffered assault and battery at the hands of the deceased, then your actions maybe justified if it can be proven – battered woman syndrome.

      You feel sorry for the poor lady and what about the man she killed and his family? Some of us forget that in life we do have a choice. We can stay with our abuser or we can move on. Assuming she was abused, she should have reported it to the police and leave. You cannot choose to stay then take the law in your hand. We cannot condone this type of behaviour in Dominica.

      It’s high time women put a stop to this from the onset! that is, from the first time the verbal or physical abuse surface. I do remember one woman (and many may share this sentiment) who repeatedly said “unless a man doh hit you he doh love you”. Sadly, she believed that very much.

      You are right, these are women with very low self-esteem and who feels that they must have done something wrong to trigger such abuse and they feel that the men are justified in battering them. I hope this is a wake up call to those in authority to implement programs re domestic violence prevention, education, etc.

    To many women are battered in Dominica and the caribbean,I am glad that there are women that are strong enough to fight back, but there are those who unfortunately, thinks thats its a normal to be in such relationships, because it has become the norm in their lives. All we know is that a man is dead and one woman (the alleged perpertrator) is in police custody. That’s all we know. Legally she is innocent until proven guilty but that’s as far as her innocence goes for now until we know more. So stop these pity comments.

        Well said my friends, i have read the comments posted throughout yours is paticularly artist in its approach and Waitukubuli I like your style and the conversational approach.

        What I will say is firstly I do not aggree with killing or do i condown domestic violence but what I do have is a set of eyes and I can see that this women has been dragged through wars.

        I can see that her life has been difficult so does that mean she has the right to kill, no it does not and on the other hand was this done in self diffence, more than likely.

        I am a proud Dominican, a large man in stature who grew up both overseas whilst spending time in DA, one thing I heard when in Da is that your man does not love you if he does not beat you, what rubbish but Domestic violence seems to be accepted way too much in Dominica, I once saw a girl stab he parter in broad daylight in Dominica and it was just seen as “action, down the road”.

        My people our society has made it easy for this violence to go untracked, I can bet that many times when she took her beatings no one ever helped and maybe she was afraid to leave, so like I said I do not condone what she has done but I can see why she reacted back after so long of the abuse.

        Think of your mother and how you would have felt if she was the one being abused.

        Dominica I love you but your justice is not only corrupt but also unfair, I hope she gets a fair trial.

        To all my brothers who like to play the big man and beat their women, take heed its 2012 and now they see what its like else where and now they are hitting back!!

    From the picture I saw of the man, she didn’t try to kill him. She stabbed in him his shoulder. The sad part was it maybe hit a vein and he bled out. If people were there watching, they could have helped him by bringing him to the hospital while applying pressure to his shoulder. It’s sad what happen and I hope she doesn’t end up in jail. Women, as well as men go through so much things it’s just sad.

    I’m looking at this woman with tears in my eyes. All I seeing is my aunty. She was beaten by her husband from day 1 in front of her children to. Broken nose, broken jaw, broken teeth and so on and so on… She finally left the bastard and he was looking for her to kill her.

    Well Miss Francess it looks like you killed him before he kill you, and that is how I define SELF DEFENSE. It was his life or yours and just like anyone else you chose yours. Please let the woman go. She needs therapy instead of jail time!

    There is no doubt the amount of misery that woman endured. Alas, if only things could be turned around, but that is not reality.

    Only GOD knows the heart of men, only GOD is judge, only GOD knows how best to handle this.

The lady is from the carib territory…..hence i would believe the majority of the people who knows her and would be willing to stand bail for her would also be from her community. Hence my question what are they going to use to stand as surety? The people dont own the land that they are on. My God! What are we doing in DA? The welfare division needs to come in on this one. And dont we have a Carib ministry neh? So what is the minister saying or doing? Well! Well! Well! Where is DA going to. The poor will always be poor my boy.

    Can u believe it? she did it of self defense and it not yet a month but a date for court already put up. what happen to that lady who wasn’t on drugs who killed 2 of her innocent children over nothing n was send to rehab out of the country an the case is dead now.i want to know what is going on.as everybody can see on this lady face that she was abused over an over again.

    Lady, now dat i see ur pic.. I am starting to think differently.. Seems u were tired of being abused.I pray that u ask God for forgiveness and I hope that people in the community will come forward and plea on behalf of this lady..

    I could imagine that the prosecution did not put up any case against the denial of bail. Where is this woman going to find someone in the Carib territory to put up bail. We have deprived the people of the Carib territory the right to own land. Hence the possibility to secure loans to build proper homes. I bet this woman doesn’t have the support she needs I may be wrong but I thing the women’s bureau or an organization against battered women should look at the case and appeal to the DPP to grant bail on her own recognisance.

      Second this comment….I thought the same myself. People in the Carib Territory don’t have ownership to land…farless for a woman. This case is so sad. A battered woman to put up bail…impossible.

      very good GR8. I think if the government is so interested in the Carib people why keep them poor. They are human beings even though they are indigenous and they have rights. Why keep back their progress in the name of preservation…they are humans not endangered birds….give them C.O.T’s for their lands and a Carib territory bank to safeguard the lands allocated to them.

      We have deprived them the ability to own land…NOPE..
      The Carib Constitution denies them to own land. If a carib owns land then if he/she marries has to leave the reserve. What happens to the property?

      I think they need an over haul of their constitution.

    Ok, please tell me when in Dominica we have started used Black or Negro-or any other race to identify persons accused of a crime?
    That said, from all accounts- this was a victim of repeated brutal spousal abuse…my deepest sympathies are with her, her children, their families and our community… Let us do what we can to support, educate and empower victims of domestic violence and rehabilitate the abusers.

    Boy, I see the photo of the dead man lying on the ground in a pool of blood and boss the person can swing a mean knife.

    I don’t know what went down and drove her to that desperation, she may be wrong, she may be right.

    All I can say is that growing up in Dominica I have seen the cycle of men advantaging our women. I have seen way too many women being beaten by their men for no real reason whatsoever. That was so natural that it was accepted as the norm.

    I totally refuse to continue that cycle.

Why is it that everytime a report is done in regards to our native tribes they are called caribs or Kalinago.Believe it or not its a form of “Racism” towards our own people.       I don’t think you have been in Canada long enough, so don’t call your kind “ignorant”. First Nations are usually refered to by their tribal name. Canada especially is noted for that. If you think DNO is “ignorant”, you should write to the UN who refers to the First Nations/ Kalinago/ Amazonians as such, and query why they are so racist.

      When in ignorance (I use the word in proper context here), it’s better not to talk. I see alot of people having some small-mindedness about racism by calling a people Kalinago. Folks, this is actually a highlight of the prestiguous position that these people hold to be protected even by international law by virtue of who they are- the First Nation-. There are special privileges for First Nations. I hope all those saying it’s racist, if they are Kalinago, will also deny themselves of these privileges. But you know, funnily, I have NEVER heard a Kalingo use that name to identify himself/herself out of shame.

        Ah the court of public opinon! Recently, they sent Sarah Lynn home without a trial and we all made noise … that she should have gone through the process and foubnd not guilty by reason of insanity (or something like that). Make up all you mind! I think this case should follow due process the same way the other one should have.
