UPDATE: Kenrick Tyson found guilty of murder

Murder convict Kenrick Tyson is scheduled to be sentenced next month, after a nine-member jury found him guilty on Wednesday of the murder of  Cecil James of Concord.

Tyson, according to witness testimonies during his five-day trial, killed James by hitting him on the head with a piece of wood while the victim slept at his residence some time between May 9-10, 2009.

She testified that she had travelled to Concord with the convicted man.

She stated that Tyson had struck James on the head with a piece of wood several times before stealing his wallet, grocery items and his vehicle.

According to the witness, when she later confronted Tyson “He tell me I looking like a person that could sell him out. I didn’t answer,” she told the court.

A few days after, Daniel and the accused were near the Mahaut River in the Kalinago Territory when he spotted the police and began to run, according to Daniel.

According to the witness police fired gun shots at him.

Dr. Martin Christmas, who pronounced the body dead shortly after the murder, testified on behalf of the state.

He told the court that the deceased appeared to have died from a blunt impact to the cranial region.

He also said that James had died in the exact area that he had been sleeping.

Meanwhile, another prosecution witness , Investigating Officer Romen Riviere told the court that in a statement taken from Tyson following the murder, the convicted man admitted to being involved in the crime but said that prosecution witness Daniel, who was his girlfriend and child’s mother, had given the final blow which killed James.

“She was involved. She last that use the wood to beat the man,” Tyson said, according to Riviere.

“I hold the man down and she started making lash with the two by four,” Riviere quoted Tyson’s statement.

Tyson had been shot in the leg by police when he attempted to attack them with a cutlass when they approached him about the murder.

In response to the prosecution’s witnesses, Counsel for the defense Wayne Norde filed a no case submission.

That application was based the grounds that no cause of death was established as a pathologist report had not been submitted to the court, neither was there a pathologist testimony before the court, Norde argued.

However the application was rejected by Justice Birnie Stephenson-Brooks who presided over the matter.

Tyson did not testify on his own behalf.

He will be sentenced on March 28 following a pre-sentencing report which is due to be submitted by March 21.

    he is still young to change his life otherwise he will be depending on charity or social security if he ever had it for the rest of his life.plus the torment of killing someone will haunt him forever. what a sad bed to sleep on.

    wait a minute..yeah i am happy that this murderer is being convicted but isnt miss daniel an accessory to murder?she says she travelled with the convicted to the deceased house.she went in with him.Dno did you miss a part that said that he forced her?or is it that she willingly went with this guy?i must have missed the part where it said she tried to stop him or that he threatened her or something to get her to accompany him.why is this lady not charged with her involvement?

      Social Security going up, cost of living going up and you want to support more of these criminals with life imprisonment? I think they should be done away with.
      Give them 5 years to make an appeal that would constitute reasonable doubt or an extension for appeal. If they can’t come up with anything, free up the prisons without releasing the prisoners.

      y so many of you are disliking my comment? i blive there should better usage of tax payers dollars. all murders should be used for nuclear testing, or should be sent to fight war or something, obviously they don’t value another human life so why should we value theirs???

        Because according to the laws of Dominica when I last looked the sentence for murder is Death. It is a mandatory sentence which the judge cannot change. It may be commuted but otherwise it has to be carried out. Now the PM has been saying for a long time that he is going to crack down on crime. Let us see what happens.
