A nine-member jury of eight women and one man will by Monday April 27, 2015 decide the fate of Kenrick Tyson, who is charged for the 2009 murder of Cecil James at Hibiscus Inn in Concord.

Tyson was found guilty of the offense of murder in 2011 and jailed for life but the Eastern Caribbean Supreme Court (ECSC), on appeal, upheld and over turned the conviction ordering a re-trial citing major errors by the trial judge.

Day four and five of the retrial saw the recalling of investigating officer Inspector, Romelle Riviere, by the jury who wanted further clarifications.

He was questioned about clothing that he had taken from the aunt’s home of Nasha Daniel, a key state witness in the matter.

“I took away panties, bras and other items of clothing…I also recall seeing a swell on the head of Nasha,” he said.

Daniel was also recalled by the jury.

Showing her a photo album compiled by the police, she was questioned about her position when she went to Hibiscus Inn with Tyson, the day the incident took place.

She also told them that she was 15 years old at the time and was two months pregnant.

She described her position when the accused Tyson was in the house and said she recalled getting a swell on her head when Tyson crashed the jeep he had stolen from the deceased James.

Asked if she had seen a crack before on the piece of wood allegedly used by Tyson to inflict the wound on James, she said “No, I saw the crack when it was in the possession of the police.”

The defense then argued that based on the evidence, the State did not proven its case and asked for a “no case submission.”

After hearing defense lawyer, Bernadette Lambert, and then Sherma Dalrymple for the State, Justice Errol Thomas ruled that there was enough evidence that if properly directed, a jury can convict and so dismissed the no case submission.

It was then the turn of the defense to put forward its case and Tyson took the stand.

From the prisoner’s dock Tyson said he was in a fight with James, who he had some problems with, and as a result struck him with a piece of stick.

On Monday April 27th, 2015, the jury will hear arguments from the State and defense counsel after which Judge Thomas will sum up the case and then will ask the jury to retire to consider its verdict.

    I hope this time he will be nailed for good, for life since D/can Law will not execute murderers.
    He said he had a dispute with the man. He went to his residence while he was sleeping and hit him with a stick. This was no joke and play nor a small blow. This was the height of wickedness. He knew why he went to his home and of his murderous intent. That hard blow snuffed out his life.
    The poor man, while sleeping he was oblivious of what went on around him and who hit him and caused his death. Then he stole his groceries and vehicle and went for a joy ride, I assume, and crashed his vehicle.
    I suppose he broke and entered the man’s home. Then when he saw the police, he tried to run away. Why did he run away and brandished a cutlass at the police? Was he not charged for this?
    He tried to incriminate the woman who was present in order to avoid conviction.
    This man deserves the maximum penalty. No more appeal. Let us have the verdict and sentence.

    You killed him because of a fight. So, why steal his jeep?
    He will be set free on Monday. Another murder will walk free yet again.
