Kimana James granted bail for forgery of birth certificates

A civil servant, who has been slapped with five counts of forgery of Commonwealth of Dominica birth certificates in the ongoing passport scam investigations, was today granted $30,000 bail in a Magistrate’s Court in Roseau.

Kimana James was granted bail by Magistrate Candia George who considered the defendant’s medical condition and holes in the prosecution’s argument.

The prosecution objected to bail, saying: “The prosecution will need some time to continue investigations without hindrance. We believe that the defendant will interfere with investigation and deter the course of justice if given bail.”

However, James’ lawyer Wayne Norde pointed out that the police prosecution was misleading the court by not indicating what transpired while his client was kept in their custody.

Norde, while handing a medical report to Magistrate George, indicated that James collapsed once at the police headquarters and was sent home twice during the period of her incarceration.

“If the prosecution could trust the defendant on two occasions after she had been in their custody, they have no reason not to trust her now, ” Norde told the court.

In handing down the decision to grant bail, Magistrate George pointed out that the prosecution’s justification that the defendant would interfere with ongoing investigation if given bail was unfounded.

“It is something (interfering with investigations) she could have done if she wanted to from Thursday to today,” George said.

Sonia Williams of Castle Comfort, the defendant’s aunt, stood as surety for her bail.

James is expected to surrender her passport to police as the only condition attached to the bail.

The preliminary inquiry for this matter is set for October 21.

James is the third civil servant charged in relation to the ongoing passport scam investigations.

Nash Mitchell and Lyndon Marie have been charged with 14 counts of forgery, including the possession and uttering of forged Commonwealth of Dominica passports and birth certificates.

The crimes allegedly took place between November 11, 2005 and March 31, 2011 and already 40 forged passports have been reportedly identified by police.

The men were denied bail.

Police believe there are more and that the alleged passport scam has placed Dominica’s sovereignty into the focus of the international community with consequences for legitimate passport holders.

Several other persons are being investigated for the crime. If found guilty perpetrators could serve a maximum of 25 years imprisonment.

    It is true we must not judge because we all do things that are wrong sometimes and we could comment without getting personal also. so my comment is i am disturbed at this because places like this where we trust people with our identities should be more secure and trustworthy. the persons taken in to work at these locations should be trained and screened to make sure that they have sound characters, not just take anyone who needs a job that’s not the way to fill positions in these institutions.

    I must say that as a personal friend I am very, very dissappointed in you girlfriend. Not only am I surprised but it lends to the saying that you really cannot trust no one. Getting rich fast is not the way to go, it’s not the answer………… is best you had come and ask me for money and if I didn’t have I would go fast cash, easy money, bank one of them places there and lend it on your behalf. I would have done that as a friend………..

    Dominicans are so xenophobic it is appalling. So much ignorance in this place. I was actually starting to believe that all these different people coming to Dominica would help open our eyes to different cultures and make us a bit more understanding of others. But then again, what else should one expect from 70 000 people on a rock in the ocean.

    So many countries have been developed because of different people, from different backgrounds and who hold different ideas. Countries like America and the UK are proud of how they embrace differences. We go to other countries and give our skills to them. I am not saying we have to be naive and that we should not protect our interests but why look with so much distrust and fear at others.

      Generally, they may be suspended or given leave of absence with or without pay, depending on the circumstances of the case.

        To be fair and just if she is bailed out, she needs somewhere to live as well. She is not employed. Family members or friends are obligated to help. IT IS A CHRISTIAN THING TO DO WHICH GOD EXPECTS OF US, AN ACT OF COMPASSION AND LOVE. GOD IS THE FINAL JUDGE.
        We are to help those who are in need, no matter what their crime especially if we know them.
        This is a time they need the support of their family and friends. For the love of Our Lord Jesus Christ, may they not forsake her.
        In time, when the case is called, she will be judged and rightfully so by the Dominican Law for her indiscretions.
        It is sad that she found herself in that position. She has lost a good job and may be imprisoned for some years, if not for life.
        Pray for her too. Consider how she feels and how embarrassed she is at what she has done.

    i thought when someone is in custody and they feel ill it is the responsibility of the officers call emts to take that person to the hospital. I have never hear such and then they asking not to grant hear bail! Now all the magistrate had to do is just send her home and don`t ask for that $30,ooo co`s she can be trusted

    Well there were “loopholes” on the prosecutor’s side naturally so the defense attorney made the case. The police were in the wrong to send her home in the first place thus it can be argued that she will not interfere with investigation as she was “trusted.”

    This is the justice system for you, loopholes are exploited and people are released on these technicalities. It is just sad that our police officers and the prosecutors team are doing a poor job.

    Anyways, i must agree with some persons who said what’s good for the goose is just as good for the gander! If the can’t get bail since they’ll interfere with investigations, nobody who’s connected should get bail either. I think whoever is involved in this scam should get a chance to be on the outside. Whatever will be, will be. Let’s just wait and see the outcome. Furthermore i strongly believe they all benefited, even if they haven’t gotten all their dues yet.For some reason, they each got paid for their parts played in this.

May be she was the mastermind behind all of that, no one knows for sure at this stage.     I can not judge whether this young lady is more deserving of bail than the other two young men already in custody for the same alleged misdeeds. However, I do recognize prejudice when I see it. The names and photographs of the two males were disclosed from the outset and only now the name of Ms. James is mentioned in the local news media, whereas both her name and photograph were posted on the alternative, non-domiciled “The Dominican” web-site from the beginning.Such hypocrisy!

    I cannot understand this one. To me, I trace it to political roots and has nothing to do with justice. 1.Who is Sonia Williams? A very close friend of the DLP. 2.Who is magistrate George? She is the daughter of Police commissioner Carrette, who will do whatevere it takes to protect the interest of the Prime Minister and the DLP. This my friends is further proof that justice is not for all in Dominica and therefore, the time those religious people waisted matching for peace last week, they should consider calling for justice for ALL Domininican’s.

    With the wide spread corruption in Dominica nothing surprises me. Our judicial system is just a comic book. The police and lawyers who took an oath to honor justice , law and order are themselves purveyors of criminality , lies and deceit.

    This government is known for polluting the justice system. They’ve allowed a child molester from Porssie to escape the police custody go through the airport take a flight to the US and not even a word of an escape prisoner.     I know the passport form very well and there is a section that deals with recommendation of the applicant. If Mr Bernard wilshire signed the declaration stating that he knew the individuals and the birth certificates were forged he too has committed an offence and should be prosecuted .Lets not leave stones unturned.

      Why are you so sure that Lyndon and Nash are 100% guilty and Ms James is not. Why not wait for the police to investigate. Why be Lyndon’s and Nash’s judge and jury.

      I’m not passing judgement on any of them,as I dont know the facts, but I have to agree with the comments stating that if Lyndon and Nash were denied bail, then so should James.

    No arrest,no name on news portals, for the Lawyer called for questioning. Is he super human, more important than anybody else or protection again for the Boys? Dominicans know who is that Lawyer by now. Did that lawyer allegedly also sign scores of forms? Are all EQUAL before the LAW?

    But Where are the passports kept for safety? Is it with the immigration Dept., Ministry of National Security, with the Police, or at an ordinary farmer’s home? Two civil servants charged with possession and uttering of Dominica passports. Where or from whom did they obtain those passports?

    That is not the first time those forgery, deals and bogus sales are going on with our Dominican passports. What Economic Citizenship Programme? It is all about the selling of passports willy-nilly to all and sundry? A few people are making $$$$$$$$$$$$$ in passport sales and scams. There are agents amassing thousands upon thousands of $$$$$$$$. Dominicans know nothing about who they are. The country’s sovereignty is at stake.

    Remember the passport sales, $$$$$$$ made, no transparency or accountability and promise of 5-Star Layou River Hotel? Where is that Hotel? Skerrit even after the famous BVI case involving Felix Chen announced that His Govt would partner with Chen to rebuild the Hotel. Where is it? Internationally, Dominica will be seriously affected. Innocent Dominican born citizens will face problems as a result of those scams. But who cares? Nothing happens to the BIG BOYS involved. It is those in the lowest rung of the ladder who face the court. Poor Dominica. Lately, the country has been mired by one scandal after another. One corrupt practice after another. But who really cares? Corruption breeds corruption. Irrespective of numerous scandals regarding sales of Dominican passports and handing over of Diplomatic passports, the authorities are still stubbornly allowing such nonsense to continue.     That’s the way things role in Dominica. This issue is very convoluted and could potentially be a huge stink bomb. Once names start calling and the investigation start leading to certain politically influenced neighborhoods then either the police will create their own road blocks or they may find themselves running into cul-de-sacs.
    The forging of passports is obviously not a one person operation; experience tells me that those charged and arrested are part of a network with strong political ties.

You see when you are in certain positions and you trust other people to do their jobs and you signature has to go on a document you just sign. So if Kim got a pile of documents so sign and the ppl were doing their bobol they put it on her desk and she sign it. Teaching people to pay attention when they’re doing their jobs.

      When the case is called and concludes, let us see how many will be further charged and imprisoned for forgery of Dominican birth certificates and passports, selling Dominica’s precious passports to Iranians.
      Iran is an enemy of democratic countries. Obviously, the U.S.A.
      How did Iranians come to play in this? What were they doing in Dominica in the first place?
      How did those government employees get themselves involved in this scam?
      Government of Dominica, Immigration authorities, beware of foreigners, visitors and students to Dominica, those who are specifically non-nationals. They could be enemies and traitors in disguise.
