Lestrade to stand trial next week on shooting charge

Linden Lestrade

Linden Lestrade, the son of former Police Commissioner Matthias Lestrade, will stand trial on Monday next week on a charge of shooting with intent to cause grievous bodily harm.

Lestrade is charged in connection with the shooting of Greg Joseph at the Krazy Kokonuts Nightclub on October 3, 2009.

Both the defendant and complainant appeared before Roseau Magistrate Ossie Lewis this morning, however the proceedings were adjourned based on a request by Lestrade’s lawyer, Zena Dyer. The lawyer told the court that she had received the disclosure date late with no notice and time to prepare her case.

“Under the circumstances I need time to prepare… Disclosure was given with no notice,” the lawyer said.

The police prosecutor assured the court that he too had only received the related file on Friday from the Director of Public Prosecution’s Office.

Four witnesses who are to present testimonies for the prosecution also appeared at the hearing this morning.

According to the court, the complainant is to travel on February 8, 2010 to receive medical treatment on February 11, 2010.

“I’m not sure how long it will take. The complainant has an appointment on February 11 out of state and we are not sure as to his return….”the prosecutor said.

Since the incident and the charge of the defendant, Joseph’s family has been very public on their opinions about what they say is leniency by police and the law on the charge and bail given to the Lestrade.

Lestrade was granted bail in the sum of $50,000 on October 5,2009 following the incident on October 3, 2009. Following much speculation about the incident and the treatment of the defendant, Deputy Police Commissioner Cyril Carette had denied that the police were involved in any cover-up to protect the former commissioner’s son.

Joseph, who appeared in court on crutches today,  is expected to testify against Lestrade when the trial commences on February 1, 2010.

    Well, Well,Well. There’s always two sides to a story, and Gregg finally met his match. Those who are his supportters and family memebers turned a blind eye as to what kind of life he was really living. He thought he could intimmidate people, and everyone would turn a blind eye. I “no him very well” and i chose to no longer be part of his life because he is trouble. As for Linden, my heart goes out to you. You are a great young man,and you have never been in trouble before. You chose to do the right thing and liscenced your gun,to protect yourself. Unfortunately,you had to use it. Knowing you, i can just imagine how you feel. Stay strong,i will always stand by your side, no matter what. And gregg, remember, the way our lives ends often reflects the way we lived. Good luck to you to.

    The fight was never Linden’s own in the first place. …

    Someone said to me years ago, that no elected government will expand the prison because such an expansion is equivalent to political suicide. That was twenty years ago. Sad to say, I believe that individual was correct in his assumption.

    While the recent infrastructural developments are welcomed, there appears to be no intention of addressing over crowding at the state prison. Additionally, we also need to look at creating juvenile facilities for juvenile/ youthful offenders.

    I sincerely hope that non-governmental entities and local citizens alike will keep this issue on the fore front at home.

    Typical Dominican ignorance being expressed here.
    Why is it we are always on the negative for almost everything??
    Why do some of you people don’t get the facts before expressing your views on here. I honestly don’t see the reason for getting over-whelmed over all this. We have so many things happening in our country, that need so much attention and everybody’s focused on wanting to know the outcome of one particular case. Come on, give e a damn break!!
    Let’s pay attention to the things that are affecting our society:- drug trafficking, robberies, teenage pregnancy,rape, Aids, constant fighting(for simple things too),lack of jobs,high school dropouts,etc.
    We make mistakes to learn from them! Aren’t we learning anything from all this?? Stop blaming our problems on the authorities!!
    It’s sickening just reading the irrelevant statements “educated” people are leaving.
    I will continue to pray for out nation.

    If people stand by and just watch the case go by then he will walk… obviously the laws aren’t for everyone. He might go overseas and never return however!!!! If someone travels to the U.S to escape prosecution in another country then they can be reported to the U.S police..F.B.I

    Over the weekend I was told that in the law books of Dominica a life sentence is 15 years. Someone can correct me if I am wrong but if this is so then the laws need to be amended. Also, they are not willing to build a bigger prison to accommodate more persons. That is why prisoners are given short sentences and are let out before they serve their entire sentence. Maybe that is something we as a people can really discuss and get the law makers to amend the laws.

    I didn’t know that DA had gotten so bad that you have to go to clubbing with a gun! What happened to the good old DA I knew growing up?

    Whatever the circumstances this guy is facing a very serious charge and according to the story he is to “travel” within a week or two to receive “medical treatment” and no one is sure of his return…. I smell a dead rat.

    Let us wait and see and I know DNO will keep us informed on the outcome.

    Linden Lestrade simply defended himself. There are many fools hanging around in DA doing nothing. They feel that they can impose there will on people that are not like them….Bad Boys take this as a lesson that the people of Dominica will take things into our own hands if need too.     Is this linden a cop, he is walking around and even going to a club with a gun, is this how things is done in Dominica, i thought if you have a licened weapon its to protect your home, not to go to a club with it, it is tragic that people need to go out now in Dominica with guns, very sad.

    Well i think that if this is the case that people are going to clubs with guns then the clubs need to search and protect the unarmed people by taking the weapon away …….

    What type of crime does one have to commit in Dominica to be charged with attempted murder?
    The law looks really mild.

    Everybody should get equal treatment under the law.

    Are people saying the law is biased and some are treated better than others?

    If that’s the case then some sections of the legal establishment is corrupt.

    The gun …licensed i must add was Linden’s gun….the witnesses in court were those of the prosecution (Greg’s people) … The case was delayed because the DPP submitted the paperwork late…hellooooo…who’s stalling the case?

    Let due process take place people and follow the case open-mindedly….otherwise you miss the important parts.

    “Shooting with intent to cause grievous bodily harm”- That sounds like leniency to me . Shooting someone in the head is an attempt to murder as far as I am concerned. The foundation is set for the accused to walk away with a slap on the wrist.

    I want to know how come the witnesses for the case were not summoned to court. They only knew about the case when someone told them had it not been that they would have not been in court this morning.

    I just knew this stalling tactic would begin on the very first day of this PI…let’s see how long it will go on…it’s nothing more than an effort to frustrate the judicial process which in the end may result in the case being thrown out…but in Jesus’ name it will not happen and Lady Justice will prevail…
