Attorneys representing chartered accountant, Kieron Pinard-Byrne, have demanded that Opposition Leader, Lennox Linton, pay a Privy Council order of £20, 000 in court costs stemming from a defamation case no later than February 22.
In a letter dated February 3, Linton was told that if he fails to comply with the demand, enforcement proceedings will be instituted against him and/or property he may own or have any interest in.
“This will inevitably result in additional cost to you,” the letter stated.
The judgment by the London-based Privy Council was delivered on January 29 saying Linton has 21 days from the date of the order to pay the sum.
According to the order, Linton must pay Pinard-Byrne the “costs before the Judicial Committee, the amount of those costs to be assessed on the standard basis if not agreed between the parties.”
Additionally, the “Respondent pay the Appellant’s costs in Court of Appeal of the Eastern Caribbean Supreme Court (Commonwealth of Dominica), the amount of those costs to be assessed on the standard basis if not agreed between the parties.”
The letter from Pinard-Byrne’s attorneys, DeFreitas, DeFreitas and Johnson said, “We thereby demand payment by you of the full sum of £20, 000 within the 21 days stipulated by the Court, that is no later than 22nd February. You are therefore required to make the payment in full of the said sum or its equivalent of Eastern Caribbean dollars at the prevailing exchange rate applicable on the date of payment, to our Chambers by the way of Banker’s draft or certified cheque.”
Recently Linton was ordered to pay Pinard-Byrne $79,324.86 in the same matter by the High Court in Dominica.
The matter centers around the Layou River Economic Citizenship Program and the Layou River Hotel project and goes back to 2002 when Pinard-Byrne sued Linton because of an article published on the program on a website and statements made about the same program on a radio show, on which Linton was a guest.
It eventually ended up in the Privy Council which ruled in favor of Pinard-Byrne.
