Man chooses jail over fine

jail barsNathaniel Wallace of Portsmouth has opted to go to jail instead of paying a $1,200.00 fine imposed by magistrate Bernard Pacquette after he pleaded guilty to the charge of malicious damage.
According to the facts of the case, Wallace, who is in a relationship with Dinna Serrant of Cockrane, went to her home at about 1.30 am on December 24, 2013 but she refused to open her door for him and instead, asked him to “leave”. He refused and proceeded to break a window valued at $632.28 to force his entry into the house. Serrant called the police.
In an interview with the police, Wallace stated, “Officer, is not my fault…my mind go off a bit.” He has previous convictions and when asked to mitigate he said he had no comment.
“She told you she did not want to see you – go. Instead, you broke your way through. I understand you are in love, but you need to show love, not break down the place,” Magistrate Pacquette told him.
He was fined $1,200.00 to be paid in three months or in default, 2 months jail. He was also ordered to pay compensation of $632.24 the cost of the window by January 30, 2014. Otherwise, he would go to jail for one month. 

He then asked the court if he could fix the window instead of being fined and was told “no”.

“Best I go jail instead,” Wallace decided. As a result, he was sentenced to 3 months in jail and given one month to pay the compensation fine or spend an additional month in jail.

      Is he really your brother? You are not alone in this belief. They are shocked their family member could do such a thing and will state, “It was not him. He did nothing wrong.”
      There are some people who never think and admit their family members could do such a thing. They think they are beyond doing anything wrong. This is upholding error and encouraging them.
      You do not assist someone by denying that he/she did not commit a crime. You must face the truth that no one is perfect and people, whether family, friend or other are quite capable of committing crimes.
      If his girlfriend said he broke her window to gain entrance to her home, are you stating that she did not tell the truth and fabricated it? She telephoned the police who arrested him. Are you still admitting that he did no wrong?
      Do not live in a fool’s paradise. You should speak to him and try to make him amend his ways. He should also apologize to her.

    At 1.30 am he went to the woman’s house? Where was he all night long? She did right not to open her door. This man is not truly in love with her. So what went into his head to cause him to break her window? That is a cop-out excuse he gave. He broke and entered and should be given a stiffer fine and/or a higher jail sentence.
    Some people allow their temper to get away with them, their head.
    If he cannot afford to pay for the damage, who will assist her to repair it?

    Read thru the lines he sentenced himself. He did not need a Lawyer to tell the court he did not waste the court`s time. Noted here is the attitude, and arrogance, of persons like him who against all odds does not want to take “NO! for an answer and resort to violence and other illegal means to back their action. Such, in my opinion is a clear indication how monsters are created. When a woman says NO! it should mean exactly that.SMH.

        For one, why are you lashing out on “O”stress? You act like you have clear knowledge who is behind that name and presume it is a person of the Law ( Judge, lawyer Police Chief, and so on). How dare you spew such sarcastic remarks? You are , making a valid point, but you are lashing out on someone who could be a teenager or maybe “like yourself”, assuming that you are…. a concerned citizen. That is why all this talking of Dominicans don’t enact positive action, to much back-lashing and not enough UNITING to deal with social issues that are affecting us ALL. Just support and move on.

        Support and Unite I have seen other bias comments from this O Stress blogger and I know exactly why I lashed out at the comment. You talk about positive action well positive action starts with calling a spade a spade and condemning what is wrong. What I did is point out what is wrong by the action and past comments fro O Stress and note that I did not insult anybody. So if calling out and identifying what I think is double standard and phoniness is wrong then I would rather be wrong than right in that case

      Duh… if he cannot pay $400 per month for 3 months to make the $1,200 where will he get over $600 in one month whether he is in or out of jail????? He will just spend an additional month in jail and done with it.

      elementery,what would you have them do,allow him to disrespect the courts or punish him forthwith,the courts gave him time to pay the fines,no but in his crazy mind he think he can do the time and do not pay a dime,he just fool himself,he will the additional time and still pay the fine,
