Man gets six years for attempted rape

law weekKish Elizee has been sentenced to six years in the slammer after he was found guilty of attempted rape.

He appeared in court on Friday, March 11.

The incident took place in Chance, Portsmouth in February 2012, when Elizee was 19 years old.

According to the facts of the case, he dragged the young lady into an open garage where he attempted to have sex with her.

She pleaded with him to release her and although he was seen by an elderly man in the community who also called on him to release the young lady, he refused. Instead, he cursed the man. He eventually released  her when he couldn’t succeed in his rape attempt.

The matter was reported to the police and Elizee was arrested.

He denied the allegations and after trial, was found guilty.

In mitigation, his lawyer, Dawn Yearwood Stewart, asked the court to “temper justice with mercy”.
She asked for a non custodial sentence on her client and pleaded with the court to be lenient, if a custodial sentence was to be imposed.

“Be extremely light in sentence, he appears to be troublesome but is a well known  football player for the Portsmouth,” she told the court. She said her client fully accepted the findings of the jury was at the mercy of the court.

The social inquiry report indicates that Elizee was not remorseful for his actions and still maintains  his innocence. According to the report, the victim still feels embarrassed.

Before sentencing, the judge  said that the aggravating factors of the case seriously outweigh the mitigating factors.

“The victim was lifted and dragged. ..begged to be released, incident  took place 15 feet from public  road in an open garage with no windows or roof,” he said.

He said to not impose a custodial sentence given the circumstances now facing  Dominica, means that the court would be sending the wrong message.

He then imposed a 6 year jail term on Elizee.

    The victim waited four year to get justice.

    This is far too long and is hard to justify. It leaves time for witnesses to move away. forget, be bribed, or change their story.

    What the young man did is a serious offence. It should be treated the same as it would have been if he had achieved penetration. Six years is not enough. He should have been sentenced to whatever the maximum penalty is for rape. However, I realize the judge had to stay within the boundaries of what is allowed by the laws he has to work with. This is why people are saying the laws should be reviewed or revised.

    The justice system at its best can contain crime to some extent but it cannot change the human heart. Only the grace of God and His gospel can break the power and bondage of sin. Please read

    Attempt is attempt, Rape is rape, what ever it may be he took the chance in the knowing that it was a crime and with crime come the time. The time is to spend time behind bars whether or not he penetrate but he has filtrated and man you must serve your time. Man! make this lesson be learnt.

    Here is another double-standard: One pedophile raped and sodomized an eight year old child, he is given two ten year sentence to be served (run) concurrently, rather than consecutively!

    He will be out of jail in five years or less.

    Another man attempted to rape someone, and a judge hands him a six year sentence!; that to me classifies as “cruel and unusual punishment!”

    One gets off lightly, while the other is victimized.

    In any event I am not condoning his crime, nevertheless the justice system in Dominica stinks!

    10 years for raping an eight year old and six years for attempted rape!!
    Shouldn’t that 10 year sentence be life ? That 81 year old man should be made, to spend the rest of his pedophile’s life in jail.
    The minimum years for attempted rape, should be 10 years with mandatory therapy and rehabilitation.
    Although it is difficult to rehabilitate a sex offender, there should be mandatory education, to assist these
    people.
    With the increase and high awareness of these atrocities against women and children, women and parents need to be more vigilant in protecting themselves and their children, against the predators in our society. Women need to be alert, smart and conscious of their environment at all times.
    Our women are too naive and trusting.

      I have been listening to what is going on in Dominica and I can’t believe it. Now you all keep blaming the Police but ask yourself who governs the Police Department and stop pretending .. police are told what they should and shouldn’t do from those in high places. the document that was leaked was done for a reason.. Remember legal justice in Dominica is not possible and the people knows that. The creation of this injustice falls at the door steps of all of us Dominicans not just the Police .. OK.
      Dominicans I would suggest that you all start listening when BLISSING speak because he is full of knowledge wisdom and understanding, because he listen very carefully.

      Who said investigations are going on people stop fooling yourselves stop it, .. Dominicans are just to corrupt and love money top do anything else .

      It is a trauma for women who are raped and not something they could ever get over. It also affects their family when such occurs to their loved ones.
      I hope he will be rehabilitated. Rape is another crime, a vicious one which needs to be eradicated from society.
      God is good! This is why we must inform criminals what harm they do to their victims and to themselves, on earth and in eternity, the latter, if they do not repent.

      If he had many girls, it shows that a man as he is could never satisfied and with one woman. He is a sick man and a real rapist. If after he is released and he continues, he will be sent to jail for a lifetime which is the best place for chronic criminals/rapists. They do not deserve to be in the public arena. If they appreciated their freedom they would live a law-abiding life.
      He has no time for God; no time to do good but a lot of time for sex and pursuing women. This is why he committed these acts and is now in prison. He is in dire need of the blessing and grace of God.

    Six years for attempted rape ? I can understand that 6 yrs. can be a deterrent but why should a grown old man ,on the pretext of pleading guilty is sentenced to 10 yrs. for raping a little child who can barely understand life…the national anthem words should be changed..it is not more the isle of splendour…it is not the isle of prominent ,old and young rapists ..
