Man occupies house, gets fined

CourtfineMichael Seaman, with no fixed place of residence, has pleaded guilty to malicious damage and vagrancy after he damaged two locks at a house in Lower Kingshill.

The house belonged to Barbara St. Louis and Seaman had decided to move in without her permission.

The locks cost $160.

St. Louis does not reside in the house but according to reports she had secured it three months ago and subsequently received information that someone was occupying her premises without her permission.

She called the police and decided to pay a visit to the house.

Upon arrival, Seaman was met occupying the house.

He told the police that he is from Capuchin but decided to move to the Roseau area since his mother and father had “disowned him.”

He also said that he intended to speak to the owner of the property but denied breaking the locks.

“I am sorry…was just trying to help myself,” he told the police.

He was warned of such behaviour and was told by the court that because he was coperated, had pleaded guilty and it was his “first offense” he would not be sent to jail.

“You are standing on the wrong foot, you can’t just enter someone’s house without their permission and occupy it,” magistrate, Candia Carette-George, told him.

He was fined $160, as compensation for the damaged locks to be paid by January 31, 2014 in default one month jail.

He was further fined EC$500 for vagrancy to be paid by February 28, 2014 or in default will be sent to jail for two months.

    To me the magistrate should just send him to jail for a month at least he would be housed and fed. But asking him to pay $660.00, he is unemployed, homeless, and failure to meet the deadlines he will be send to jail; it is just a waste of energy and time and even paper work. Stupess!!

    he had people to care for him only if he had obey his family but most off all his mother/ i know she was talking to him and other children .michael did not grow up in a bad home his mother and stepfather do the best for him ,as long i know them. his mother would all ways talk to him about the good things and the bad thing in life ,michael do not let people say bad about your mother you know she do all the best for you and your brother and sister.one love

      Fool to be considered a squatter under the law you have to occupy the premises peaceable and uninterrupted for a period of about 12 years so the gentle man did not meet the legal requirements so how could he be considered as a squatter??? All yuh people so ignorant and wearing your ignorance as a badge of honour…geeez

    If only Dominica was free of criminals, squatters, those who live useless lives as also those who think society owes them something instead of trying to do something fruitful for themselves that they may be useful nationals who will contribute to the good of society.
    I feel that governments could help such people who are left on their own to their own devices and with no direction. It commences from childhood, in the home and in school.
    Something better must be done for them to discipline them accordingly and imbed in them the purpose for their life and its usefulness for also their personal benefit later on in life. If as children they are not given that direction, they will end up on the streets as this man. Too many have gone astray and live worthless lives.

    Reading this brings tears to me eyes :cry: :cry: , he came over to my home few months ago and had a Job, i never knew he was such in a bad state, if he wanted help he could have ask me i would have not said no. This is so sad. Michael you are a nice smart young man, and you know your family loves you, and your parents did not disown you, they tried to help but your stupid attitude is what got you all on bad terms. I just pray that you get a turn around and start your life over.

    Stop making excuses for micheal and playing politics with everything. Micheal is my nephew he had his bread all buttered and instead he throw the bread into a garbage bin and took up getting high. Micheal has more than enough homes and houses to live. Micheal need to get clean. Miheal lived in his uncle home while his uncle is overseas. He had a descent job and move to his aunt for work convenience instead he wants to smoke. Well sorry you people can play politics about it its you all but miheal was in a very comfortable life until he turned to drugs. In our family we won’t tolerate any form of drug use so you people can twist and turn the truth of the matter for political crape.

    we closed our Coconut Beach hotel due to some litigation, and lo and behold the complete hotel on Picard beach was literally destroyed every single door window thirty toilets, fridges stoves beds roofs all gone, destroyed what they could not steal in Portsmouth, vandalized destroyed like was a vengeance .

    This is not a new trend, people will just move into hour house and occupy, once you are not there. Some of them will also give you a hard tim.e to get off your property. They have a name for it, some right, can’t remember! But after I take all my snow and cold, let anyone occupy my property and all he’ll Will break loose

    This magistrates have serious problems. D man have no home to sleep nobody to help him but yet still u charging him $160 and $500…. u expect him to go steal from somebody to get it paid and find his self in more trouble ….Lord help Dominica.

      Are you condoning and encouraging him for breaking and entering the owner’s property and comfortably setting himself up in her house as if he built it and owns it? If he cannot pay the fine he should be imprisoned. This man is too bold and non-caring. He needs to learn a lesson and the hard way.

      He is a vagrant? He very well knew what he was doing. He either pays the fine or be imprisoned.
      Such people who have all their faculties must have the sense to seek financial help from the proper authorities if they are in need of.

      How would you feel and what would be your reaction if you came home and found one of them in your house?
      These people who are not insane had the opportunity to obey their parents, attend school, conduct themselves appropriately while in school, complete school and seek employment. Many of them have failed in this respect. Do not blame society for this.
      Get to the root of the problem. You should question them why they found themselves in this situation; also question their parents and other family members. Some family members do well for themselves; others not.
      Too often they are defended without knowing their past and present lifestyle. Those who trespass and take charge of people’s property as if it is theirs, deserve to be fined or imprisoned.

      D/a is apx 85% uninhabbited there should be no reason for homelessness among us. Govt should encourage agriculture. You don’t have to give the land away free let them pay for it over a period of time. The ministry of finance and agriculture should work on opening new markets for our produce. They should also encourage growing non traditional produce. Lets do better Dominica we’re blessed with so many natural gifts our fertile soil is the main one.
