The murder trial of David St. Jean entered its third day at the High Court of Roseau on Friday before High Court Judge Birnie Stephenson Brookes.
The accused gave an unsworn statement there.
St. Jean is alleged to have murdered Clement James, a Good Hope man, in Portsmouth on 20 September, 2010.
The incident occurred on the Indian River Bridge.
The accused from the prisoner’s dock in the court room explained to the court his version of the events of that day.
“The deceased was staring at me in a sexual manner while holding his crotch” declared the 23 year old electrician of Glanvilla Portsmouth before a nine member jury.
He informed the court that he crossed the bridge to warn the deceased when the deceased grabbed the stick which he was holding in his hand.
St. Jean told the court that he was aware that James was a homosexual because he had told him before that he admired him and that he heard since his young days in Glanvillia that “he was gay.”
He told the police that at the time of the incident James was staring at him while licking his lips and watching him like he “wanted” him.
St. Jean continued “he started to wrestle with me and struck me in my back with the stick. I saw a knife in his pocket he was trying to reach for. I was only trying to get him to let me go so I reached for the knife and made a blow for his hand.”
The accused told the court that he left the scene as soon as he was released and was sorry and surprised when he had heard that James had died.
He denied calling the deceased derogatory names as stated by state witness Vernon Matthew, who alleged that the accused walked up to the deceased and said “what you watching me for boy, you don’t know all batty man have to die” while under oath Thursday morning.
Matthew in his testimony claimed that the accused attempted to lash the deceased with a stick after making this statement.
St. Jean dismissed this testimony claiming “I never saw Vernon Matthew at the time of the incident and everything he is saying is a lie”.
He again reiterated “I never meant to take anyone’s life, I am sorry.”
The matter has been adjourned to Monday, when the defence and the prosecution are expected to address the jury on the facts and evidence presented during the trial.

I saw the scene unfold infront me like some part of a movie that afternoon…crossed the bridge and attacked the man, beat and stabbed him just cause he was defending himself with words while he was walking down on the opposite side of the bridge…after your deed was done you “St Jean” bounced off like nothing happened…this is sad, justice must be served. In all criminal cases an eyes witness is the most powerful evidence the prosecutor has to prove his/her case. In this case based on the accused testimony, It’s clear that he demonstrated some typed of heatreated towards the deceased. The question is (1) He accused the desceased as a homesexual (2) He crossed the bridge why? He intented to hurt the deseceased at some point or the other. This type of killing behavior in Dominice at some point or the other must stop.

Why there is not a legal fund set up for lawyers to represent those Jail house lawyers who does not have a clue of the laws of evidence and certain technicalities dealing with the application and delivery of all cases?
