Pinard-Byrne demands over $300,000 in court costs from Linton

The long-running court matter involving Linton is not over yet
The long-running court matter involving Linton is not over yet

The legal battle between Opposition Leader, Lennox Linton, and Chartered Accountant Kieron Pinard-Byrne in a long-running defamation matter, is not over yet.

Pinard-Byrne is now demanding that Linton pay $340,926. 39 in the matter which started in the local courts and went all the way to the London-based Privy Council.

In a letter dated, April 21, 2016, attorneys for Pinard-Byrne, DeFreitas, DeFreitas and Johnson, said, “We refer to the costs Order made by the Judicial Committee of the Privy Council dated 29th day of January 2016.”

“In furtherance of the term of the said Order that costs be assessed if not agreed, we attach herewith, a breakdown of the cost incurred by our client in prosecuting this matter before the Court of Appeal of the Eastern Caribbean and the Judicial Committee of the Privy Council.”

The letter stated that Linton should inform the attorneys no later than the 28th of April if he is in agreement with the costs. The breakdown of the costs is below.

The matter centers around the Layou River Economic Citizenship Program and the Layou River Hotel project and goes back to 2002 when Pinard-Byrne sued Linton because of an article published on the program on a website and statements made about the same program on a radio show, on which Linton was a guest.

In his suit, Pinard-Byrne said he was libeled by Linton.

In March 2011, the High Court in Dominica ruled in favor of Pinard-Byrne.

The matter was taken to the Eastern Caribbean Supreme Court (ECSC) in March 2013 and the High Court’s decision was reversed with a ruling in Linton’s favor.

The ECSC, in its ruling, said its decision was based on ‘qualified privilege.’

Qualified privilege gives the press some level of immunity from defamation charges for statements made in good faith, unless it can be proven it was done with malice.

Immediately after the ruling, Pinard-Bryne’s attorney, Tony Astaphan, took the matter to the Privy Council since, according to him, the ECSC’s ruling had narrowed the issue of qualified privilege ‘much too much.’

When the Eastern Caribbean Supreme Court of Appeal met in Dominica in March 2014, the judges granted leave to Pinard-Byrne to take the matter to the Privy Council after Astaphan said his client had fully complied with all the rules as laid down by the court of appeal.

The Privy Council ruled in favor of Pinard-Byrne saying he was indeed libeled by Linton.

In its ruling, the Privy Council said that costs before the ECSC and the Privy Council must be paid by Linton.

Recently, Linton was ordered to pay Pinard-Byrne $79,324.86 in the same matter by the High Court in Dominica. The Privy Council had also ordered Linton to pay £20, 000 in court costs before the Judicial Committee and the new costs will be the final payment.

Below is a breakdown of court costs as demanded by Pinard-Byrne:

Pinard-Byrne costs before the Judicial Committee of the Privy Council
-Anthony W. Astaphan SC – EC$28, 750.00
-Simon Murihead & Burton (PC Agent) Fees & expenses inc. Adam Speker – EC$177, 503.19
-De Freitas, de Freitas & Johnson disbursements – EC$3, 424.30
-Cost before the Judicial Committee of the Privy Council – EC$209, 677.49

Pinard-Byrne costs in Court of Appeal of the Eastern Caribbean Supreme Court DOM HCVAP 2011/0017
-Anthony W. Astaphan SC – EC$50, 000.00
-De Freitas, de Freitas & Johnson – $EC33, 333.00

Leave to appeal to Judicial Committee of the Privy Council
-Anthony W Astaphan SC – EC$28, 750.00
-DeFreitas, DeFreitas & Johnson – EC$19, 165.90
-Costs before Eastern Caribbean Supreme Court: EC$131, 248.90

Total – EC$340, 926. 39

I do not know the facts about the Layou River project. But what I do know is that some one must have made lots of money on a project that was not completed. Dominicans at some point have to demand more from their government. All these promises of projects and all these projects that are started and never completed some one have to give account for them. From the abattoir to thermal energy nothing seem to come to fruition in Dominica. The Layou River Hotel should be employing Dominicans and bringing well needed foreign exchange to Dominica, instead it is sitting there as a white elephant. In any other country somebody would be in jail.

Sometimes, I think DNO is so afraid, of some Dominicans, that they much prefer to allow the garbage that some of you write, but censor any sensible opinion.

Here you are running off your stupid mouth talking about Privy Council from England will do squat.

In the first place Dominica is not in the jurisdiction of any court in England, hence, verdicts rendered in England the defendant is not obligated to comply with such judgments. I am not a trained. Lawyer, however, challenge any Lawyer to argue that Lennox is obligated to comply.

Such are the type of debate that one should indulge, and not the fifty plus nonsense that posted here.

Linton has to pay additional Court costs. He will go bankrupt. This is a good example that people must be careful what they say about others. Some people are too free with their mouths. They defame the good character of others, tell lies, make innuendos and derogatory statements about them. These are cause for libel suits.
It is not a matter of having the interest of the people at heart I ask, is it really? Or is it pursuing a political agenda?

Ahem, I don’t think the Privy Council got your back this time, KPB. it seems you want Lennox to squeeze blood from stone. Enough is enough. You are only catalysing disunity in an already highly divided country – oh unless if you also profit from that.

    • April 24, 2016

Pay up and then you can dream. Jump high jump low many thousands of dollars will be paid KPB, crap talking won’t help. Linton now gets a salary from the treasury that can be garnished, his property can be levied against in order to collect this debt. The Privy Council has already spoken, read the judgement, all cost has to be paid by Linton. If Linton and his supporters can’t raise the funds Linton can seek protection by filng for bankruptcy. One thing is certain Pinard-Byrnes is definitely not afraid of Linton and he will leave no stone unturned in his quest to get paid in cash or in kind.

        April 24, 2016

Point, this amount is not by order of the Privy Council but a demand by Kieron Byrne.
I suspect the latter will have to sue Lennox Linto to get anything near this amount as I am sure Lennox Linton will contest any such demand through the courts. He may well have a case since it really was Anthony Astaphan, who should have been in London to plead Byrne’s case but was unable to do so, without exposing himself to the wrong side of the law.. All will be revealed in good time.

Looks to me that the real winner here, in monetary terms is Anthony W. Astaphan. I suggest mr. Linton, if sued for these costs, seeks a judicial review, in line with mr. Astaphans established practice or, alternatively seeks assistance from the Red Cross under their no 4. stated goal, which is: ” (to) promote respect for diversity and human dignity and reduce intolerance, discrimination and social exclusion”. I am not aware that the Red Cross in Dominica has been active in pursuing this goal, so now is their chance!

Can any of those people who are sueing the Oposition Leader (Lennox Linton) for so much money are seeing or watching his body looking like a money tree? does his body bloom with flowers as fruits to be bloomed ripe and reaped!? Or do we have a bunch of ridiculous people living in the Land, Never was there such rebellion in the days of our respected people “this is a disgrace”. Our beautiful and prestigeous homeland has gotten so poor every good thing gone; dissapeared. All I see and read is a bunch of jealousy and abuse. Lenox Linton is a born Dominican. You highty tighty as we called it before needs to take a rest and work hard at creating the lovely and sweet the Dpminica we once knew. Or a great earthquake in there will soon be the answer. I am tired of reading old news! Miss Bam Rolle born at Laudat Dominica/   :?:

When will this saga end, and when will Mr. Pinard feel adequately vindicated? There are so many broader issues needing attention and we are wasting well needed money to bankroll an individual . This insanity needs to end. What a shame and a disgrace. Such an embarrassment for us all. Dies Dominica.

Best Mr Linton use Sunday to ‘beg for money’ again to save his tail once more, instead of trying to take down his own co pilot.

Ok then. Well its only fair that a motion of no confidence be also tabled against the Leader of the UWP Opposition Party on Sunday. Hmm, Pilot and Co Pilot in trouble. Dominica on remote control? UWP Opposition Party on remote control!

$210,000 to take the case to the Privy Council! If there is one big advantage to switching to the CCJ this is it.

Those guys not serious. Lennox Linton is fighting for the Dominican people and the abuse of Government. This is what you call vindictive and frivolous. Pinard and Astaphans pushing the envelope and people a bit too far. You guys looking to start some serious crap. If Dominicans sir by and let this crap continue we will all be silenced. Dominica need a month long shut down. I smell a very ugly hurricane season

It depends which way you look at it. Others have a different opinion. There is only one correct one; not two; not many.
The loser must pay Court fees. This is the Legal Law.

This is a political witch hunt. If our people don’t wake up, who else will be left to fight on behalf of us? Anyway, the judicial outcome does not erase the fact that money from this costly venture is still unaccounted for, and that is soo sad!

Mr Linton, the honourable thing to do is resign as Leader of the party to avoid asking the party members to help you pay this huge cost.

Just leave it to “Matt in the morning”, he will start the bawl rolling . I’m sorry that I’ll not be in DA to listen to the first call. they raised more than 100 k’s in a day, this will take them about 2&1/2 days to raise the allotted amount. Good lock to Matt, Linton and the rest.

Well look coins, and the thing is after all that happened he’s still saying the same thing that got him in trouble.
