Pinard-Byrne goes back to Privy Council

Chartered Accountant, Kieron Pinard-Byrne, has said his attorneys have returned to the London-based Privy Council after Opposition Leader, Lennox Linton, failed to agree on a cost of court order in long-running defamation matter between them.

Last week Pinard-Byrne wrote to Linton demanding $340,926. 39 in court costs in the matter which started in the local courts and went all the way Privy Council.

Linton was given an April 18 deadline to respond but Pinard-Byrne, in a live interview on state-owned DBS Radio on Friday morning, said Linton had not agreed.

“As of yesterday, Mr. Linton had not agreed to my cost …” he stated, pointing out that he has been on a 14-year quest to bring closure to the matter. “That means my lawyers have now returned to the Privy Council to submit full details of those costs.

He noted that when the Privy Council made its judgement on the matter in October 2015, it said he was entitled to his costs.

“In January, they set out a process for those costs to be agreed by Mr. Linton and required him in the meantime to make a payment of 20,000 pounds sterling on account,” Pinard-Byrne explained. “He did do that but as of yesterday, the deadline, he had failed to agree to my cost.”

He stated that another process is underway where there will be an assessment process under the Judicial Committee of the Privy Council.

“In due course, they will issue an order demanding that Mr. Linton pay my cost including cost of this application for the assessment of costs,” he said.

Linton has already made it clear that he will dispute the bill of costs submitted by Pinard-Byrne, saying as the respondent, he has the right to react or disagree.

He stated that the costs before the Privy Council are to be assessed by the Cost Clerk of the Privy Council if the parties do not agree on costs. He noted that after the assessment has been made, it is the court, not Pinard-Byrne or his attorneys, that will decide the balance to be paid after the February payment on account of 20,000 pounds.

Last year the Privy Council ruled that Linton had libeled Pinard-Byrne is a matter that goes back to 2002.

    If indeed you are jurisprudent, for whatever it is worth, you have zeroed in on practically some of the argument I presented. There are people in Dominica who simply run off their mouth on this thing simply because they dislike Lennox, believing the Privy Council judgment is correct, not realizing that a Caribbean Court of appeal had already rule against Pinard!

    The same babbling ignorant people fail to present any argument remotely close to the light you have shed on the matter in my opinion. I hope you are correct, because I believe that Lennox can simply ignore the Privy Council, and Pinard, allowing him the…

      You are absolutely correct whatever happens in London right now has to be sanction by a court in Dominica, if a court in Dominica undertake the sanctioning of let’s say the executing a writ or warrant based on the Privy Council Ruling that could be illegal anyway, since Dominica highest court is now the CCJ, I reiterate no Dominican is subjected to any ruling of the British Privy Council at the moment.

    This case started in 2000/2001 (16 years ago), Lennox Linton was not the leader of UWP then.
    Why does he think its a labour UWP issue?
    Why cant he accept his wrongdoing?
    Another question… do Dominicans want someone who is indebted in such a manner for such a large sum publicly not to mention his private debts because he also has to pay for his council a similar sum, to be Prime Minister or the leader of the opposition?
    Isn’t this individual likely to misappropriate funds or misuse his position?

    Linton should not pay Pinard’s costs. He should wait to see what the PC comes up with (by the way our ‘suck salter’ Baroness Scotland, Boss of the Commonwealth, is a Privy Councillor, which should give every Dominican a very clear view of the integrity and impartiality of this colonial court which consists mainly of ex politicians.

    By the way, any judgment on costs by the PC will need to be sanctioned by a local court to which Lenny can appeal. All this should take a few years and more money out the pocket of Pinard.       Remember Linton won that same case in a local court, and again in a Caribbean Court of appeal: Pinard appeal to the privy council which on some minor technicality ruled in his favor.

      That does not prove Lennox did anything wrong except exposed some thievery and corruption in the country. If you and the vampire blood sucking bastard want to call it defamation of character so be it!

      Most of us Dominicans know otherwise.

      The fact of the matter is, a hundred years from now when another generation review and debate the issue, the truth will prevail, and Lennox will be vindicated!

        I am withholding my own right to express an opinion one way or the other on this, because I think people have a right to freedom of speech under the D/ca Constitution and aggrieved persons also have a right to defend their reputations under the same constitution.

        Accordingly, my comment is just to ask you to get the facts straight if you are writing so boldly on the issue. The case went against Mr. Linton in the local court, that is how he got to appeal to the Caribbean Court which upheld his appeal, which was followed by Mr. Pinard Byrne appealing to the Privy Council.

        So you see, actually he did not win twice. As insignificant as your error may seem, someone is going to repeat it and before you know it, the facts will have been distorted far and wide, as that seems to be the order of the day and we never know how that feels until we or our loved ones are on the receiving end.

First he had to accept the charges which he did, had they put the cost and fine together he could have argued but in as much as he accepted the charges he must accept the cost as well. You are trying to pull some strings but records are kept and you don’t destroy them overnight.

      You are a dimwit. A ruling by the Privy Council is final and can not be appealed. Costs are a different matter. If no agreement can be reached by the parties the clerk of the court will make a ruling.

If receipts have been submitted then my friend, sir LL, why would you Dispute? You’re simply adding additional costs to the bill! Including application and additional lawyer fees. LL, you should really try and draw a line under that matter. It is a big distraction and it is tainting your character and ability to admit you made the wrong decision. Not the traits of a great leader. Your beginning to really look like a rookie. Draw a line whether or not you know you was right about LRH.     Yes Sir, you are right about you own mentality; you are an IDIOT with a concept of Law that is warped and twisted!

    You have been singing that same old song since last year, some of us have tried to explain to you, still for all you still have not gotten it. Sometimes it is better for you to remain quiet because you simply make a bigger fool of yourself, claiming to be educating people who are much, much, smarter and wiser than you are.

    That case between Lennox Linton and Pinard-Byrne was the last one from Dominica to be heard at the Privy Council. Lennox was found guilty and now there is penalty in the form of money–a large sum of money.

    This means that whatever it cost Pimard Byrne to deal with that case must be charged to Lennox–and until the matter is completely resolved, the court at which the conflict was heard is not yet closed to the case.

    • But Lennox Linton, to whom the penalty is rendered, continues to make the situation worse, because of his foolish self conceited mentality; just imagine a few days ago, the strongest conclusion which he had pertaining to that case was that, as he said it:

      “I do not trust them they are of the Labor Party with their propaganda machine against me”

      So what good will that remark do for him; and what does he mean by propaganda–did someone lied against him pertaining to this case?

      Even if the Privy Council should reduce that charge–which I doubt they will–but they cannot cancel it, for this money belong to Pinard-Byrne. So Lennox is still left with a large sum of money to pay to his victim–the longer he remain from doing something about this penalty , the higher the cost will go. And whose fault is it, if not his alone

      I don’t normally agree with her but she is right. The matter was the last case heard by the Privy Council and new cases cannot be heard. However, the case has not ended quite as yet, despite the Privy Council’s ruling, because the court cost has to be settled as per the ruling of the Privy Council.

      Since Lennox did not agree to the court cost as presented by Pinard-Byrne, the Privy Council has to take care of it as part of the ongoing case.

      Elizabeth, once a case is concluded, both the court, and lawyers representing the plaintiff has met their obligation, anything pertain to the case after the obligation was met has to be regarded as a new course of action.

      Since you are smarter than I am I will not waste my time to how a new course of action in law works,because you already know eh!

      You must not think that your understanding of such matter is correct. What a thing is, and what you believe it to be, are two different things. especially when you are dealing with so called Law and The Privy Council which operates on esoteric knowledge.

      The Privy Council is a commercial court that’s why money is involved, it functions under the UCC, Uniform Commercial Code, within that code there is section( UCC 1-207.7)where a person can reserve their rights, if they do not reserve their rights, then it is presumed that they knew they had rights and chose to waive them so that lawyers, judges and courts could make arbitrary decisions about you such fines.

        Well, you even make it worst now: if it is a commercial court, how come it only serves nations within the British Commonwealth; who retain their jurisdiction.

        That penal code you quoted; on which law books you found it, Dominica, or the British. Even if it is in Dominica law, it is now null and void, and highly insignificant: Conclusion, Dominica is now obligated and subjected only to rulings rendered by the CCJ.

        So, now tell me if Lennox decline any further ruling from the Privy Council, what will be the alternative; what can Pinard and the British Privy council does to him?

        Answer my question from a legal point of view; give me something based on our nations laws and constitution to support yours or any other argument, and if you can’t do it perhaps you can get help from some so called lawyer.

      All Christians serve a good God. How well do some treat others?
      The Eighth Commandment: Thou Shalt Not Bear False Witness Against Thy Neighbor.
      This goes for each and every one of us. The manner in which people as you see Linton, is not the manner God sees him; likewise each one of us. In the eyes of God Linton is no more privileged than Pinard-Byrne.
      God is a fair God. He has no preferences and He cannot be deceived. God has spoken and He is to be obeyed.
      Linton is obligated to bear the costs since he lost the case. He feels he is free to dispute it. So be it. However, in the end he will have to pay it and additional costs.

    Maybe I am an idiot; or perhaps my concept of the law is warped, so twisted, that the fact that Dominica is no longer in the jurisdiction of the Privy Council, how can anyone take a matter back to; or any arising issue to the British Privy Council for a resolution!

    If we agree that the matter was presided over days prior to Skerrit removing; severed Dominica from the jurisdiction of the British court, and the defendant chose to honor the ruling, and judgment; that could be debatable.

    Nevertheless, this garbage of taking a matter back to the Privy Council to me has no legal bearing, because Dominica is a sovereign country no longer in the British Privy Council court system. If the British court can prosecute, and rule over Lennox, at this time I suppose it would be legal for anybody to come from Dominica, and file a case against another Dominican in a court of law in America.

        I am very much aware of that; and noted Lennox Linton has made history in his own rights, for it will be mentioned in history that his matter was the last prior to the severing of Dominica from the jurisdiction of the British Privy in the twenty-first century.

        Nevertheless, the question remains: Is Lennox still obligated to honor any obligations imposed on him by the British Court at this time?

        I feel he is not obligated, since no warrant issued by the British Privy Council can be any longer executed on a Dominican citizen in Dominica.

        Perhaps a warrant issued by Interpol in a criminal matter could be firm as providing Dominica police is a recognized member of Interpol: but as for the Privy Council past ruling I think it has now become null and void.

        Let us face it assuming Lennox simply ignore the issue, what can Pinard, or the British Privy do? This is an intriguing question, is it not?

      Lennox should fire that guy, and seek council elsewhere, perhaps from someone more learned in law from some other part of the Caribbean.

      A citizen of Dominica cannot be subjected to two courts of the same level, in that the CCJ is the highest court in which jurisdiction Dominica comes under, it is similar to the Privy Council; so it is difficult for me to understand if the British Privy Council has no power, or jurisdiction over our country; and people, how can that court order a citizen of our country to honor or accept any of their judgment or ruling!

        Sorry sir but you are complete wrong. This matter is within the jurisdiction of the Privy Council for determination. Mr. Linton has rightly challenged the Bill of Costs presented for assessment by the Costs Officer of the Privy Counsel in accordance with the Court’s Practice Direction No. 8. Mark you, one of the factors taken into account in determining costs for such matters is the public interest dimension of the case. It is possible that the total amount requested could be reduced. The amount requested does seem a bit exorbitant.

        There are always exceptions as in this case. The Privy Council ruled that Pinard-Byrne won the libel case against Lennox.
        Granted, it was the last case to be heard. However, since Lennox is disputing the cost of this case, Pinard-Byrne has to return to the Privy Council to assess the cost and decide one way or the other. It is a matter for the Privy Council and no other Court.
        How then could it be decided if Lennox disputes the cost? Who would?
        We are not lawyers but we can learn from this case and costs dispute. I will state, interesting!

        Mr/Miss Roseau Valley, I have written my opinions on the matter: I could care less who believe I am right or wrong, just saying I am wrong, and not countering my argument with something legal to substantiate your argument is like a drop of water running off the back of a duck, leaving no actual trace.

        Its like a single drop of water in the entire universe. I reiterate Dominica is no longer in the jurisdiction of the British Privy Council, base you argument on that and proving that Lennox or any Dominican should be subject by law to recognized any further decisions of a court which no longer presides of the reviews of any case for Dominica.

        And I do not want to hear that crap, that’s where the case was last hear. Because the court and the lawyers who took the case to the Privy Council met the obligations the Privy Council rendered their verdict. Anything after that in law has to be considered “another course of action.” Base your legal argument on that,because the term…

    Well Lennox needs to start deciding how he’s going to get this amount of money to pay his debt. The UWP members has run out of money and cannot help this time. He still hasn’t learn to behave himself; only thing he does is causing problem and expects his members to pick up his mess.

    The cost goes up every time the process is delayed because there is a cost associated with the Privy Council for the application for the assessment of costs. Linton is digging a bigger hole for himself. I suggest that Matt begins the fund raising now in spite of Lennox’s lack of sacrifice while his supports dig dip to come up with the funds to assist him.

      Warrington the clerk of a court does not review cases, that is carried by a judge, or judges. The Clerk simply complied the cases on the docket for hearing by the justices!

      One of my son is married to a clerk of a federal court in Los Angeles, and she does not review cases. The clerk of a curt official duty is to keep records, among other administrative duties.
