Prime minister, Roosevelt Skerrit, is among several prominent individuals and a privately-owned radio station to be sued by Dr. Thomson Fontaine for what he described as ‘several months of unabated defamation’ of his character.
Others on the list are attorney Lennox Lawrence, senior counsel Anthony Astaphan, Kairi FM Radio and its owner, Frankie ‘Krazy T’ Bellot and Simeon Albert.
Fontaine told DNO the lawsuit was initiated because he has been the subject of a number of lies aimed at maligning his character.
“These I consider libelous and simply aimed at trying to destroy my good name,” he said, “including allegations from the prime minister that I was a thief because I have stolen money, I have stolen land and all of those different allegations that have been made against me.”
Fontaine described the allegations as ‘completely false and untrue.’
“I am seeking redress from the courts,” he stated.
For weeks, Fontaine has been the subject intense criticism by some members of the Dominica Labour Party (DLP) after it was revealed that he had transferred some US$27,000 from DAAS’ account to his personal account while he served as secretary and has been accused by the DLP members of misappropriating the funds. They also allege that he is involved in the transfer of lands belonging to DAAS.
Thomson said the allegations have been continuing for several months now and it is time for the court to intervene.
“It’s been several months now and it continued unabated and that action is to ask the courts to intervene … we will be seeking, of course, for monetary damages, as well as an order from the court that these allegations cease,” he stated.
He said the lawsuit is presently being drafted and those involved will be served soon.
Fontaine stated the allegations have not affected him on a personal basis but it has raised questions in the mind of the public of his truthfulness and integrity.
“It’s more a question of the public’s perception and how the public sees me as an individual and whether or not I am telling the truth,” he said.
He noted that even if the allegations stop, he will not put a halt to the procedure.
“I am going ahead, full press, because I think that given the length of time and the amount of harm that they have attempted to do to me, I think it’s only fair,” he said.
He is being represented by Joshua Francis and Gildon Richards.
Meanwhile Astaphan told Kairi FM news that he got knowledge of the lawsuit through the media and has not received any documents on the matter.
“I find it very interesting that we are going to be sued for relying on the very audio that Thompson Fontaine, the audio of Clayton Shillingford, minutes published by the DAAS and local Chapter, and Court documents in relation to the land and the declaration of assets of Mr. Robert A Phillip, and reading emails that have not been contested or tried,” he said.
He described the matter as ‘exraordinary.’
“It’s an extraordinary case, that’s going to be an interesting case,” he said.

Thomson situation is different, in that the Bank involved notified Clayton Shillingford of the transaction, which they were obligated to do, and one of the only question they could ask Clayton could be as simply as this:
Are you aware that someone has transferred, or has attempted to transfer X amount of money form the DAAS account?
The Bank was not even obligated to tell him how much the amount was, they would probably ask him do you know Thomson Fontaine. If his answer was yes, the matter would be dropped right there and then.
If he said I do not know anyone by the name of Thomson, the Bank would immediately call the police, or the Bank security would have detained Thomson until the police gets to the Bank where the would have arrested him. That’s how it works in America you see, when you do not know you believe every bit of nonsense the politicians in Dominica say.
Thomson did not commit any crime in America, nor in Dominica that we know about, perhaps he must have swipe some of his parents sugar when he was a kid, but all of us thief we mother sugar, and pinch of a bit of salt fish when they were not looking.

Here is another situation, one day I saw a signing ceremony on DNO where some Grenadian signed some contract with a man who claimed that this California company located in Solvang a city located between Los Angeles, and San Francisco, actually it located a few miles North of the City of Santa Barbara.
This so called CEO of the so called company gave the address of her recycling plant in Solvang, not knowing kid Francisco Telemaque, a modern day sleuth: Lives in Los Angeles.

I am close to Solvang, as a matter of fact I reside approximately 115 miles plus a few miles from Solvang, I got up one morning and drove to the address, where this CEO claimed she owed and operated a garbage recycling plant where she would recycle all of the garbage she proposed buying from Dominica.
When I got to the address, I was dumbfounded to find the address of her Recycling plant is located in a highly developed gated residential neighborhood.
No such thing as a recycling plant existed there; as a matter of fact the state of California, nor the city of Solvang would have issued a license for anyone to recycle garbage in that neighborhood. I took pictures of the house, and neighborhood, and disseminated them in forum, I also made the pictures to none other than Parry Belot,I thought they would make it on DNO, unfortunately they did not. So, Timothy can stay in Dominica, and lie, but if I wish to embarrass him, there are sources, such as fact finders I can use to prove him true or false okay!
If Timiothy said he sent children to the US for treatment; if we wish to verify his claims we can.

3. Are these voices not the same ones speaking in support of the sale of our passports to just about anyone?
4. Are they not the same voices that were very vocal on the true owner of villas?

2. Whilst being treasurer he did transfer an amount of money from the DAAS chequing account into his personal Account at his staff credit union – whatever the reason we don’t know…
3. He was asked on many occasions by many persons to return the money to the DAAS Account – which he eventually did
4. He did resign citing other directors lack of confidence in him
5. He did purchase land in Rosalie that once belonged to a Mr. De -Filips – His story totally conflicts with the past President story so it will be good for the facts to come out as to who sold him the land… he said from DAAS the past president said Rosalie Estate but the Fact is he did purchase the Deceased De-Filips land at Rosalie.
6. There is judgments against him for non-credit card payments in the United States…
So UWPITES please tell us on what grounds is he suing? Ask him which information listed above is misleading or damaging??

The problem for Doctor Tomson Fontaine he has agreed that he took the money and put it on his personal account and open a CD. But he never produced the CD at the request of the DAAS, Gabriel Christian.
He said he bought the land from DAAS and one hour later Doctor Clayton Shilling said he did not pay DAAS. Tomson also said the land measured 11,000 square feet. The certificate of title said over 14,000 square feet, Clayton told him his explanation was news to him.
Tomson said Clayton knew about the money transfer. Clayton said we know nothing about that.
I seems if tomson is concerned about his character the person he must sue id Doctor Clayton Shillingford since PM and the Next Level show was just reporting what transpired between Clayton and Tomson.
The threat to suit is a desperate move to stop truthful information from coming to the attention of the public.
On the question about his debt he will have to report the Court Record web site in Maryland.
On the question of misappropriation it is Tomson and Clayton that introduced the word to the Transfergate. They both said if he used it for his purpose it would be misappropriation. Doctor Shilling said that he did not have proof that Tomson did not use the money for his own. Tomson has not proved that he did not use the money for his own.
The question is where is Tomson going with that suit and how is he going to establish his case in the first place.
My twelve year old daughter asked me how can he deny what he said and want to take somebody to court for repeating exactly what he said?

Over the last three months, the Sued Team appeared to have gotten out of control with the Fontaine Affair. What they didn’t realize is that Fontaine was allowing them to hang themselves. They moved from politics to personal , in fact they even brought Dr. Fontaine’s wife in the mixed. Both Dr Fontaine and Dr Shillingford seem to agree, at least in part, with what the people being sued have been saying.

Dr Shillingford whom is President says it is a charitable and civic organization (so he is not the President of a college or school). Now, let us compare and contrast those made up assertions, with the following:- (1) Skerritt as minister of education, a member of parliament, and the cabinet of Dominica, allegedly issued a check in the amount of over $14,000.00 to National Petroleum (NP) in payment for a shipment of petrol. Issuing a check knowing that you do not have the funds available in the account to honor the check is against the law in Dominica (a Bounce Check). If you will recall some months ago a concert promoter was arrested in Dominica and successfully prosecuted for issuing a bounced check, yet Skerritt is the minister of finance, recall, the underpayment by the same Skerritt as minister of finance over $51,000.00 in taxes due on land transfer due to the state, the refund to the Treasury of over $500,000.00 in the bin bobol scandal, in which it is alleged came from a bank account in Dominica, under the control of Skerritt’s real estate attorney, sent to a bank in Antigua, and then to a bank in Barbados, and back again to Dominica.
(2) Mr Astaphan, as attorney representing the buyer of a piece of land containing 17.4 acres of land was issued by the National Bank in the amount of over $135,000.00 to pay for the land and provide the bank with the title to 17.4 acres of land His client was T. B. ) Mr Astaphan returned to the bank a title for 7.4 acres, 10 acres less) and a receipt for a little over $65,000.00 with no explanation for the over $75,000.00 difference, nor the 10 acres of land short. In other words the bank was defrauded of over $75,000.00 at least. This allegation has been around for many years now, in fact it was the result of a Marpin TV interview by a gentleman who was employed at the national bank as the credit manager, and Mr Astaphan is yet to mount a credible defense or denial.
(3) Lennox, a practicing attorney and officer of the court, currently has a case before the court, for allegedly defrauding the Washington Times of over $80,000.00 in advertisement fees for his company whose value was $20.00, yes TWENTY DOLLARS. The court is been asked to debar, in other words strip Lennox of his privilege to practice law.
These are the main prosecutors of Dr. Fontaine. Both Mr. Astaphan and Mr. Lawrence as officers of the court must be familiar with the legal term, that says “He who comes to the court seeking justice must come with clean hands” or something like that.
Clearly, from the issues surrounding these three, neither of them is in any position to cast aspersions on the character of anyone, not even a common thief, far less an innocent individual like Dr. Fontaine, who has done nothing wrong.

In a situation you said the allegations has not affect you on a personal basis, means that there is no damage, may result in a limited amount of awarded for damages. the greater the damage the allegations caused it the monitory compensation one can demand.
In this case if you applied for a job, and as a result of the allegations you were refused employment, and you can prove to a court that your livelihood was interrupted because of such allegations, you could probably be awarded millions; the greater the damage, the greater the award.
If you minimize the damage you suffered, you may not get anything, not even cost!

As for the person who suggest he simply has to explain his in-discretion, there is not much to explain since everyone knows the meaning of the term in-discretion, which is something as simple as an act, or remark; marked of discretion marked by lack of discretion, it is simply an variance from the accepted norms of society, which however does not always constitute thievery, although money was involved.
The discretion of individuals, are simply a matter of choice, or judgment; here the power of free decision, or latitude of choice within certain legal bounds. The question here is simply this: Was Fontaine placed in a position where he had the latitude to make the temporary decision he made. That question has already been answered, by Clayton Shillingford on more than one occasion.
Hence the opposition has no argument, except to try and politically assassinate the man’s character.

Such action has been strangely lacking, except in the continuously prolonged case of the issuance of economic citizenships and one wonders why. After all, he has the same recourse to the law as has Dr. Fontaine, if not more so and has the ability to finance such.
