Police reminds media of anonymity in sexual offense cases

anonimityPolice PRO, Inspector John Carbon, has brought to the attention of the local media that the anonymity of those involved in sex crimes must be maintained in accordance with the laws of Dominica.

“Any information that is to be made available to the public should be done in such a way that it does not lead members of the public to identify a person as a complainant or accused,” he said in a statement.

According to the Sexual Offences Act of 1998 the identity of an accused in a sex crime cannot be published even after that person is charged in court.

“After a person is charged with an offence under this Act, any matter that is likely to lead members of the public to identify a person as a complainant or as the accused in relation to that charge shall not be published in any written publication or be broadcast in Dominica…” section 38.1 of the Act reads.

It stated, however, that the name can be published “after that person has been tried and convicted of the offense.”

The Act made it clear that any newspaper, periodical and editor who publish any matter in contravention of section 38.1 of the Act “is guilty of an offence and is liable to a fine of $50,000.00 and to imprisonment for three years.”

Recently two men were arrested for allegedly having sexual contacts with minors.

“Please be advised that I have not made a statement on the two recent incidents of alleged sexual assaults,” Carbon said. “It is a fact that two individuals have been remanded in custody for the separate incidents.”

    In some countries the name of somebody arrested for an alleged sex crime may be published but the newspaper must clearly imply that he or she was charged (not convicted) and that the allegation has not been proven in court.

    If and when the person is convicted his or her name may be published. Many people feel the individual’s
    picture should also be published. When the person has served his or her sentence and is released back into the community many believe the individual’s name and picture should be posted in police stations, post offices, and around schools in the communities where the person will be living. Not everybody agrees with this. Some feel once they have served their time they should be given a chance to start a new life.

    Most agree maximum protection should be provided to the communities and the children. Judges decide if this should include ongoing counselling for the offender, and for how long.

    The PUBLIC DO NOT have to know the names nor SEE the pictures of anyone in these cases. The VICTIM and HIS/HER FAMILY know who the perpetrators are; therefore, what is the FORCE about seeing pictures published. What do YOU EXPECT TO ACCOMPLISH. YOU ALL pretty much know the people. I HOPE YOU ALL REALIZE BY WANTING A PICTURE PUBLISHED YOU ARE NOT PROTECTING THE VICTIM, WHO REALLY NEEDS PROTECTION.     You see; I will forever be angry at our legal system, and the idiots who are involved; especially the police. It is alright for people to write all sorts of stupid laws pretending they are protecting the innocent, it is another thing to withhold information from the public, and protect criminals.

    People need to know especially when it involves their relatives and love ones.

    Last week we read on DNO the police is investigating the death of a 35 year old woman from Wesley living in Roseau. It is a known fact that this lady was beaten by some man, she went to the hospital, and the pseudo doctors kept tossing her around like a football, hence she succumb to the injuries.

    That thirty-five year old kid has a name, the man who beat her causing her death has a name, however the victim name was not mentioned by the police though she is dead! Thanks to DNO, and the people who contributes comments on the site. I must say thanks to the person who mentioned Vava. Had that person not mentioned her by that name I would never know that my niece was brutally beaten which resulted in her death!

    From the time I read the story, my mind became troubled, it just so happened that there is an old friend, an relative and School mate visiting home at the moment staying with another relative, who called me to talk to the visiting relative, in the conversation I ask my cousin who is Vava, he pondered for a minute before he told me that’s your sister granddaughter.

    It turns out that she is the granddaughter of my late sister, Barbara who passed away last year, I am the uncle of her mother, residing on the island of Guadeloupe. I think the hospital was negligence, in effect caused her death, there is malpractice involved, and I will do everything in my power to seek justice, no matter how long it takes, I am going to seek some legal representation for her and file a law suite against the Government, and the hospital, because I believe they are responsible for her death.

    So, once again the system has failed my family, my nephew was murdered a few years ago, the police released the man who confessed to his murder, now this; that is too darn much now!

    While I understand the law, I believe that there is room for change. If the prosecution presents a weak case and the accused gets off, he will be found not guilty based on the evidence presented but does that mean he is “innocent”? Hence because he was not convicted his identity will never be revealed, according to the law. A predator will therefore be in the midst of an unsuspecting public and our children at risk. That can’t be right. Seems like the accused is being protected.

    I have never seen an any sex crime article ,which does not concern the police;or any other crime ,where the police comes forward so quickly to educate the public about the law…Why are the police not coming together to ask that this law which protects police officers concerning sex crimes to be banned?A police
    officer is a man like any other man but they have taken an oath to respect,work with the law ,to see that the public respect the law, and obey the law.
    As a matter of fact when a police officer does any crime ,he should be punished more severely than any other man in the society…

    Mr. Carbon, let me say this to you….the moment a sex offender is tried, found guilty and convicted both his name AND photo should be published so the public is aware of the damage these offenders pose to society – especially after they leave prison. Publishing their name alone is not enough. How often do you remember a stranger’s name? Trust me, it’s more likely to identify a person’s face. As a matter of fact, we need a sex-offenders registery that is made available to the general public. These pervets do not deserve protection. The only people needing protection are the victims. It is time to amend this law and I won’t stop until this is done. Whatever it takes I will rally, protest and shake up the government until there’s enough fire under their feet to get them moving. Ridiculous!

    The policeman that theft was a alleged crime as stated in DNO reports!!!..The report did not say he was convicted..BUT his photo was broad for all to see…This case with the policeman sexual assault,he was charged…Meaning they had reasons to believe that he did it..He was caught fleeing the land and you all coming with nonsense laws!!!..If he not guilty,it can be PUBLICIZED!!!.Just as well!!
    But there must be many more victims to afraid to come out..cause of the laws and protections you all give these men!!..You all punish the victims even more when you set these men free…Think of the fear they live in!!..All I can say is how wicked the system is…DA is a small place..News travels…All you better have him under protections for real….

    Many times people are arrested for sexual abuse to minors and its false. The people involve are coach to make these allegations just to destroy peolple lives thats why they are not publishing the names involve.     In Canada, their names will not be published. It is stated, “Name withheld to protect the identity of the victim and the victim’s family. If the abuser is charged and/or imprisoned the name is still not published. In rare cases this is done. There are always conditions.
    Since this does not concern the majority of us, we could not care less if the name is released or not :) We have better things to do with our time than expect and demand that their names be publicized.
    Who cares anyway?. This is a matter for the police, the victim, the victim’s family and the perpetrator. Everything else is merely news which we soon forget about.
    Consider that this is a big country. The cities are highly populated. The towns are obviously smaller. As Dominica, I could understand every one knows every one and that it is even more important to withhold the names. Who knows, knows.

    The Act of 1998, is not a very good act; in that it seems to give immunity to sexual predators, and pedophile to continue there vicious act on the unsuspecting; the fact that they are not convicted of a crime should not be a reason that their names should not be made known to the media, and the public as long as they are taken into custody.

    The police must have a reason to be able to arrest someone!

    One can say Francisco Telemaque was arrested on suspicion of committing an sexual act on a minor; and is assisting the police in their investigation: that is legal; we read that so often; we read of alleged perpetrators of crimes who are on the run trying to evade justice, and the police. We learn their names long before they are even arrested; in any event, in Dominica it is a different ball game altogether.

    I believe the minor’s name should not be published, even after the perpetrator of the crime is convicted; hence saving the victim some embarrassment, and the stigma which tends to follow people in a small country as ours.

    Dominica is a place where criminals usually get away with crimes, a rapist can get away with raping someone and simply walk out of one of our kangaroo courts free to go and rape again! The idea of disclosing the alleged rapist name, serves the purpose of awareness for every woman crossing path with that alleged rapist to be careful.

    We need to remember a fire can’t start without an arch, and where there is smoke there is also a burning fire! I agree that many times women scream rape for whatever purpose, they lie, some women does that for gain, by settling out of court for money, but in the case of a minor, minor’s seldom lie.

    Publishing the name of a suspect, is by no means a conviction; I would hope the theory in Dominica is innocent until proven guilty!

    And what’s the difference if police revile the culprits name to the public, or whether his neighbors or someone who knows him witness the arrest, and broadcast his name to the public? Something horrible happened in Wesley one day, before the offender was taken into custody; I had the whole case outlined to me: the morning lasts year when my sister died before the news came to me from my relatives in Wesley, someone called me from Canada, and told me, about an hour later another person called me from Houston Texas, and gave me the news, by then I called home, the person who answered the phone in my dead sisters house, informed me “uncle”, I just looking for your number to call you; so nothing remains hidden in Dominica.

    That law is flawed, people have a right to know!

    we all are aware how the court system works in dominica,cases taking 5 and even 10 years before they are ever called.
    we need our parliament to amend those laws. are you telling me that sex offenders are allowed to destroy children because the public does not know who they are? those of us who have children now how costly it is to raise them and so some people will begin to take matters into their own hands cause the law and the courts are failing our children and failing us as parents

    People! The Sexual Offences Act section 38.1 of 1998 states:-

    “After a person is charged with an offence under this Act, any matter that is likely to lead members of the public to identify a person as a complainant or as the accused in relation to that charge shall not be published in any written publication or be broadcast in Dominica…”

    Legal interpretation is simple. The law states ‘AFTER A PERSON IS CHARGED’ with an offence under the Act. This simply means that during the investigations there is no gag on media to publish that a certain sexual incident took place allegedly and a police officer or a politician or a priest or whoever is assisting the police in the investigation. However, it is a thin line and Media has to be careful because they may not know whether the person referred to has been already charged. Maybe a lawyer can add his bit to say whether this is the law.

    Admin: The name can only be released after the person is convicted. Read the entire excerpt again. The law is very clear on this.

    Thanks Mr. PRO for your explanation. Prior to your explanation I was wondering why the bus drivers name was released but the officers name was not. Very good job in explaining this to us.

    Based on the anonymity of sexual crime, my question now is what falls under the category of sexual crime? Is sexual crime just limited to sex against minors or sex that violates the laws of Dominica? I ask this question in light of the gay couple that were recently charged in Dominica for sexual activities and there names were revealed before they were convicted by the court. Here is what DNO published on March 21, 2012

    “Information reaching DNO indicates that homosexual cruise ship passengers alleged to have been involved in public sexual acts are in police custody at the CID Department.” “Police Chief Cyrille Carrette has confirmed that two males from California, John Robert Hart and Dennis Jay Mayer, have been charged for indecent exposure and are expected to appear in court on Thursday morning.” I am simply trying to understand the difference here. Is it because they were not charged for having sex but rather for “indecent exposure” which they pleaded guilty for on March 22? So I guess this one does not fall under the category of sexual crime

    Our education system is failing us. They need to replace computers/smart phones with books. I cannot believe that something so simple is so difficult for so many of us to understand. Yet we have the most high-tech assets at our disposal. tsk, tsk, tsk.

    Those of us asking for the names to be published, I wonder how we would feel if somehow we or someone close to us ends up in such a position and it is a complete lie, yet as soon as the accusation is made, our names are published?

    Think about that?

    Remember not every allegation is true.

I say Jail the mother along with the man because the child would have shown some sign of the abuse. Mother’s are sometimes so consumed by trying to keep their relationships with men that are not their daughter’s father that they are blinded to only their needs.

      You are nuts! You still have to keep quiet otherwise you will be charged and by the perpetrator. The best thing you can do for yourself is to obey the Law and be respectful of Mr. Carbon. He has a job and obligation to fullfill.
      How many men have been accused of abuse? How many parents reported them if they are aware their children were abused?
      You know there has been a failure in D/ca dating back to bygone years to report sexual abuse cases. Those who were abused also kept quiet and there were many of them. There was no Law then to protect women or so they thought. Today, times have changed. Good for young girls and women.
      This should include homosexuals and lesbians if they abuse underage young boys and girls. Whatever is proved to be non-consensual is a crime.

      The bus driver’s name CAN be published, because he has been tried and found guilty, BUT the policeman’s name CANNOT be mentioned/published, because he has only been charged and is still awaiting trial. If he is found guilty, then his name will be mentioned/published.

      Please reread the article slowly and you will understand.

      Mr. PRO,

      With all due respect to this article and what the Law of this Country states, I am of the opinion that this law must be amended or scrapped because in any case Dominica is a small ISLAND anyways and families are affected in this process, while I am on that issue, I can tell you up front, many persons are going to take the law in their hands because of that anonymity thing, and you can already begin to quote me.
      Can you recall the incident regarding that guy who was serving time from Calibishie, and he was either bailed or something, the following week, he was slain in a shed in the heights of that same village.
      We must be objective in everything we do and say, and the legislative body or the powers that be, must and should make amends to that piece of legislation. Blood line is blood line, and if a man rapes my 13 year old daughter and why he remain anonymous because of public identity, whatever he does, cannot erase the bad memories of parents, cousins an relatives alike.
      A sex offender should be know publicly, it is a horrendous crime and should be punishable by death, and again the death penalty may be in our law books but not enacted , but too late will be our cry.
      I am calling in citizens of this beloved Country of our, to rally with the families and friends of the latest incidents, and let us allow our voices to be heart in what seeminglyof the better part of a peace Caribbean.
      It becomes ordinary to wake up tomorrow and hear about another incident, and what makes it even worst, law enforcement officers themselves are caught in that demonic web. So what really is public interest, after the very fabric of society is already in shambles?
      There is an outrageous cry against those perpetrators, and wrong is wrong, and right is right.
      If Dr. Lennox Honeychurch receives a meritorious award, his name is published in the papers, a public testimony of a hard working individual who took our history to another phase, similarly Police officer John Brown molested a minor of 13 years, his damn name should be gazetted all the same.
      This hiding of people’s names and anonymity vibes are going to prompt violence among our peaceful nation.
      My PRO, I am sorry because you are doing your job with uttermost prudence, but what you said it was God asking you to do it because its gonna be the beginning of a revolution for justice in this Country. Please appeal to the Mister responsible for defense in this country, I am sure is the beloved Prime Minister. Sir, wake up and please bring a solution to this menace in our Country, I may not be like John the Baptiste crying in the wilderness but I am a voice nonetheless.
      I sense something coming and it is not going to be nice, so I am calling on the powers that are to wake up and smell the coffee. I may be grammatically incorrect here and typographical errors may be many, but the words I am penning here will resound in the annuls of our history if we are not careful.
      That is the cry of a concern citizen who has seen and heard a lot since my 53 years in this Country.
      Mr. Tiyani, was ousted from the position of the magistracy, and people said he was mad but his words were really beginning to bare fruit just before they axed him.

        The law is a protective law, however word gets around and even if names are not published information gets out. I say the law is protective as it stands guard over the age old concept..inocent untill proven guilty. There have been instances where men have been accused of sexual crimes and the accusations have turned out to be false. Imagine the stigma that would be attached to these individuals after they have been publicly identified based on a lie.

        I take the view that , Law or no Law, in Dominica the close-knit family relationships, which makes up our society, render it impossible for such acts to be hidden. The law, however well intended, is, therefore, ineffective.

    According to the Sexual Offences Act of 1998 the identity of an accused of a sex crime cannot be published even after that person is charged in court.

    “After a person is charged with an offence under this Act, any matter that is likely to lead members of the public to identify a person as a complainant or as the accused in relation to that charge shall not be published in any written publication or be broadcast in Dominica…” section 38.1 of the Act reads.

    It stated, however, that the name can be published “after that person has been tried and convicted of the offense.”

    The Act made it clear that any newspaper, periodical and editor who publish any matter in contravention of section 38.1 of the Act “is guilty of an offence and is liable to a fine of $50,000.00 and to imprisonment for three years.”

    This act need to be amended in order to protect our children. We cannot continue to keep laws on the books which protect the criminals. Publish the names, whether they are priest, pastor, lawyer, Doctor, Nurse, Policeman, Senator or Woman.

      I support that 100% and we need to rally our elected officials to change and amend that Act and do so without delay. I will also go further and lobby for the implementation of an “Island Sex Offender Registrar” because it is imperative that we protect the victim and the Act as it does not protect the victim or other potential victims in our communities but rather the allege offender and that is wrong. We need to step it up and catch up with the times.

        @John Carson, registering “sex offenders” DO NOT PROTECT THE VICTIMS. However, knowledge of “sex offenders” in a community WILL, sometimes, keep them from the rest of society.

      In my country people sometimes complain that the law gives more protection to the villain than the victim.

      The laws pertaining to sexual offences especially of children should be reviewed, revised, and updated with the maximum protection of the innocent in view.

      Watch out for laws that are ”fuzzy” and difficult to interpret.

      Watch out for laws that contradict.

      Do not give the justice an excuse for talking out of both sides of his or her mouth.

      As St. Paul said ”Let your yea be yea, and your nay be nay.”
