The London-based Privy Council has ordered Opposition Leader, Lennox Linton to pay chartered accountant Kieron Pinard-Byrne £20, 000 in court costs stemming from a defamation case.

The judgment was delivered on January 29 and Linton has 21 days from the date of the order to pay the sum.

According to the order, Linton must pay Pinard-Byrne the “costs before the Judicial Committee, the amount of those costs to be assessed on the standard basis if not agreed between the parties.”

Additionally, the “Respondent pay the Appellant’s costs in Court of Appeal of the Eastern Caribbean Supreme Court (Commonwealth of Dominica), the amount of those costs to be assessed on the standard basis if not agreed between the parties.”

Recently Linton was ordered to pay Pinard-Byrne $79,324.86 in the same matter by the High Court in Dominica.

The matter centers around the Layou River Economic Citizenship Program and the Layou River Hotel project and goes back to 2002 when Pinard-Byrne sued Linton because of an article published on the program on a website and statements made about the same program on a radio show, on which Linton was a guest.

According to Pinard-Byrne, he was libeled by Linton.

In March 2011 the High Court in Dominica ruled in favor of Pinard-Byrne.

The matter was taken to the Eastern Caribbean Supreme Court (ECSC) in March 2013 and the High Court’s decision was reversed with a ruling in Linton’s favor.

The ECSC, in its ruling, said its decision was based on ‘qualified privilege.’

Qualified privilege gives the press some level of immunity from defamation charges for statements made in good faith, unless it can be proven it was done with malice.

Immediately after the ruling, Pinard-Bryne’s attorney, Tony Astaphan, took the matter to the Privy Council since, according to him, the ECSC’s ruling had narrowed the issue of qualified privilege ‘much too much.’

When the Eastern Caribbean Supreme Court of Appeal met in Dominica in March 2014, the judges granted leave to Pinard-Byrne to take the matter to the Privy Council after Astaphan said his client had fully complied with all the rules as laid down by the court of appeal.

The Privy Council ruled in favor of Pinard-Byrne late last year.

It was the final case to be heard by the Privy Council since Dominica has made the Caribbean Court of Justice its final appellate court.

    This situation is sadly deteriorating into a racial and ethnic problem with no end to the divisiveness it could cause. Both gentlemen are Dominicans, one an immigrant and the other, a descendant of immigrants. Yet, this court battle is being allowed to disintegrate into hate and rancour.

    Mr. Linton was on the right track when he tackled the Layou River Hotel debacle and tried to get to answers on the matter. But there IS a difference between investigating matters fairly and causing damage to people’s reputations. Mr. Linton crossed the line when he made the offending remarks about Mr. Byrne. No one wants to be wrongly accused. It would have been best if Mr Linton had led a class action suit against Mr. Byrne or the government if he thought either was responsible for the massive losses of this project. But the route he took of casting aspersions about Mr. Bryne and then accusing him of benefiting from the spoils, without a shred of evidence, was wrong and harmful to Mr. Byrne.

I am confident you will agree that someone did benefit from the project, and in its condition, it clearly was not Dominica or Dominicans. You are correct it is not about Linton, it is about being frustrated by the number of individuals reaping off the country and when we cry foul, they can take us to their courts and we have to pay in the white man’s court, and Dominicans are supporting that foolishness because of politics and no nationalistic fervency.     I do not understand if Dominica is no longer in the jurisdiction of the British Privy council how can they ordered someone to honor a verdict; or ruling of the Privy Council render long after Skerrit remove Dominica from the British Privy Council jurisdiction, and become a member of the CCJ.

    Can a citizen of a Sovereign nation be subject to a foreign court such PC, although we are subject to the CCJ? Something is legally wrong. Right now if a verdict is rendered by the Supreme Court (high court) in Dominica and one wish to appeal a higher court; no longer can any lawyer in Dominica appeal to the Privy Council in England, the matter can only be taken to the CCJ.

For the life of me I can not see how somebody’s skin colour has anything to do with it, unless you can prove otherwise of course.     Mr. lennox Linton, in spite of the evil ruling against you, most of us in Dominica see you as our hero. You took our burdens and carried it on your back. In God’s eyes you are the winner!

    At our High Court here, Linton as expected lost, He appeals to the Eastern Caribbean Supreme Court, and won. Byrnes appeals to the Privy Council and wins. The privy council is now replaced by the ECSC as our final court and if the case was heard today, Linton would win.

    This episode reminds me of an incident in the book of Acts 26:30-32 where Paul was arrested, jailed, and got death penalty. However, when Agrippa heard his sider of the story, he said this: “the king rose up, and the governor, and Bernice, and they that sat with them: And when they were gone aside, they talked between themselves, saying, This man doeth nothing worthy of death or of bonds. Then said Agrippa unto Festus, This man might have been set at liberty, if he had not appealed unto Caesar.”

    Is this part of the fulfillment of the prophecy of the Baroness, when she told us in no uncertain terms that those that don’t support Skerrit would SUCK SALT?

    Let’s not forget she is British, served in many ministerial positions within the UK Government, most notably as the Attorney General for England and Wales and Advocate General for Northern Ireland, and is a very close friend of Skerrit.

    Her position as AG would put her in a position where she would most probably know those inside of the privy council, and therefore I would not be at all surprised that their decision was under some influence.

    For me with no legal training this is confusing. It appears to me that this is all about cost, so why does Linton have to pay 20000 pounds to Pinard for his cost at the Privy council, and also be liable for cost before the judicial committee again to be paid to Pinard….just asking.

      After reading another article on the same subject, I am no longer confused as the 20000 pounds is a payment on account of Pinard cost before the Privy Council, so there is a very high possibility that this 20000 will increase, unless the Privy Council have already included the cost using the standard basis.

        You are right. This is just an amount to be paid on account a stand by amount. It costs a lot of money to go to the Privy Council, no wonder so many of us in the Caribbean could not take our matter before the Privy Council. It is too costly, particuallry if you loose. Like in this case. I am not sure if he will be asked to pay less than the amount on cost. Lennox Lawyers and KPB’s lawyers have to agree on a cost (lawyers time, court time etc etc) less than the amount that normally obtains or the court will impose the regular cost.

        Who cares about “knowing” Skerrit? What is this lunch time in secondary school? We have a country to run, mouths to feed. All around us the other islands that were ALREADY ahead are continuing to grow, while we contract. Skerrit is one man who is failing miserably at his job. Criticizing his policies for their failure to produce economic and social progress is the right of our citizens. When we do so, please don’t take it personal — we PAY this man to do a job and he is on his own agenda.

        You guys need to grow up about all these personalities and recognize the country is in serious need of real leadership. Until then you all will keep making excuses for him while our children remain prey to the pitfalls of an impoverished society!

    Poor LINTON! I think history will be very kind to you even if the spoils goes to Byrne. I can’t advise you to leave politics since that is what they want. They want to see Mr Francis ( the one who offends none) as leader. Sad.
    The story reminds me of Joan of arc who was burnt at the stake by a diabolical institution only to be canonised as a saint ( their idea) centuries later by the same institution.
    All in all I think that a certain senior council pushing people to civil unrest while he safely resides overseas since that might be the only escape plan for PM

Do you know that PM Roosevelt Skerrit went to the BVI court to fight on behalf of Dominica to get 51% of the shares. Do you know that The PM spent a day on the stand being questioned and after being told by the judge he is a creditably witness, should he be jailed.

      @Michael Davis – Aren’t Courts of Law THESE DAYS seemingly more interested in who can pull the most clever technicality or exploit the best loophole in the law for the benefit of their client instead of making decisions based on what is wrong or right? Then again, it is called a “Court of the Law” and not a “Court of What is necessarily Wrong or Right”.

      For example, a court can claim that homosexuality is legal but that still does not make it right.

      Unfortunately law these days is no longer about wrong or right.

      Someone once told me that a lawyer is worse than a hurricane and more and more, I’m realizing that person may very well be correct. When a hurricane passes, it will leave something behind even if is the shell of one’s house. But when a lawyer passes by, they will try to take everything………every single thing including the shell of the house.
